HomeMy WebLinkAbout055B of 2025 - Zoning Text Amendment - K-12 Public School Development Standards in PL DistrictSALT LAKE CITY ORDINANCE No. 55B of 2025 (Amending Title 21A of the Salt Lake City Code pertaining to K-12 Public School Development Standards in the PL District) An ordinance amending the text of Title 21A of the Salt Lake City Code pertaining to the K-12 Public School Development Standards in the PL District, pursuant to Petition No. PLNPCM2025-00320. WHEREAS, on July 9, 2025, the Salt Lake City Planning Commission (“Planning Commission”) held a public hearing on a petition initiated by Mayor Erin Mendenhall to amend Salt Lake City’s land use regulations pertaining to the K-12 Public School Development Standards in the PL District (Petition No. PLNPCM2025-00320); and WHEREAS, at its July 9, 2025 meeting, the Planning Commission voted in favor of forwarding a negative recommendation to the Salt Lake City Council (“City Council”) on said petition; and WHEREAS, after a public hearing on this matter the City Council has determined that adopting this ordinance is in the city’s best interests. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Amending the text of Section 21A.32.070. That Section 21A.32.070 of the Salt Lake City Code (Zoning: Special Purpose Districts: PL Public Lands District) is hereby amended as follows: 21A.32.070: PL PUBLIC LANDS DISTRICT A. Purpose Statement: The purpose of the PL Public Lands District is to specifically delineate areas of public use and to control the potential redevelopment of public uses, lands and facilities. This district is appropriate in areas of the City where the applicable master plans support this type of land use. 2 B. Uses: Uses in the PL Public Lands District, as specified in Section 21A.33.070, "Table Of Permitted And Conditional Uses For Special Purpose Districts", of this title, are permitted subject to the general provisions set forth in Section 21A.32.010 of this chapter and this section. C. Minimum Lot Area and Lot Width: D. Maximum Building Height: 1. Local government facilities, prison or jail, government offices, arenas, stadiums, fairgrounds and exhibition halls: 75 feet; provided, that where abutting a zoning district allowing greater height, the height standard of the abutting district shall apply. 2. Schools, K-12 Public: 125 feet 3. Other uses: 35 feet E. Minimum Yard Requirements: 1. Schools, K-12 Public: when a site for a public school includes multiple parcels or lots, setbacks shall apply to the perimeter of the site and to property lines shared between the school district and a different property owner. a. Front Yard: 30 feet b. Corner Side Yard: 30 feet c. Interior Side Yard: i. Buildings next to a residential or manufacturing zoning district: 50 feet. ii. Buildings next to any other zoning district: 30 feet d. Rear Yard: i. Buildings next to a residential or manufacturing zoning district: 50 feet. ii. Buildings next to any other zoning district: 30 feet 2. Other Uses: a. Front Yard: 30 feet b. Corner Side Yard: 30 feet c. Interior Side Yard: 20 feet d. Rear Yard: 30 feet 3 3. Accessory Buildings and Structures in Yards: Accessory buildings and structures may be located in required yard areas subject to Section 21A.36.020, Table 21A.36.020B. F. Required Landscape Yards: All front and corner side yards shall be maintained as landscaped yards in conformance with the requirements of Chapter 21A.48. G. Landscape Buffers: When a lot in the PL Public Lands District abuts a lot in a single- family or two-family residential district, landscape buffers, in accordance with the requirements of Chapter 21A.48, shall be required. H. Modifications for Schools, K-12 Public: In accordance with Utah Code 10-9a-305 the planning director may modify a regulation set forth in this zoning district or that applies to the zoning district when located elsewhere in this title, if the modification does not negatively impact the health or safety of the general public or occupants of a K-12 Public School. The planning director may consult other city departments when determining if a modification negatively impacts the health or safety of the general public or building occupants. SECTION 2. Amending the text of Subsection 21A.34.020.B. That Subsection 21A.34.020.B of the Salt Lake City Code (Zoning: Overlay Districts: H Historic Preservation Overlay District: Applicability) is hereby amended as follows: B. Applicability: All properties located within the boundaries of a local historic, part of a thematic designation, or designated as a landmark site are subject to the requirements of this chapter. 1. Applicable Standards: The applicable standards of this chapter are determined by the historic status rating of the property, either contributing or noncontributing, as identified in the most recent historic resource survey on file with the Salt Lake City Planning Division or a historic status determination issued in accordance with Subsection 21A.34.020.D. 2. Exceptions: School, K-12 Public uses and their accessory uses are exempt from any provisions in Section 21A.34.020 Historic Preservation Overlay District. SECTION 3. Amending the text of Subsection 21A.36.020.B. That Subsection 21A.36.020.B of the Salt Lake City Code (Zoning: General Provisions: Conformance with Lot and Bulk Controls: Obstructions in Required Yards) is hereby amended as follows: 4 B. Obstructions In Required Yards: Accessory uses and structures, and projections of the principal structure, may be located in a required yard only as indicated ("X") in table 21A.36.020B of this section. No portion of an obstruction authorized in table 21A.36.020B of this section shall extend beyond the authorized projection. Dimensions shall be measured from the finished surface of the building or structure. [note to codifier: Table 21A.36.020B Obstructions in Required Yards, along with the Notes thereto, remains in this portion of the subsection and is unaffected by this amendment – a new subsection 21A.36.020.B.1 follows the table and notes] 1. Allowed obstructions in required yards for Schools, K-12 Public: a. All yards: (1) Parking stalls, vehicle drive aisles, and circulation elements necessary for the safe and efficient movement of people, bicycles, and vehicles. Curb cut locations, width, spacing and total number of curb cuts shall be determined by the Transportation Director on streets with city jurisdiction and the Utah Department of Transportation on streets under state jurisdiction. (2) Playground equipment and structures are allowed in any required yard. (3) Athletic fields and courts, including necessary accessory buildings to support the athletic facility. Bleachers over 20 feet in height shall be setback a minimum of 50 feet from a property line that is shared with a residential land use. b. Any other obstruction allowed in 21A.36.020 Conformance with Lot and Bulk Controls. SECTION 4. Effective Date. This ordinance shall become effective on the date of its first publication.
