TUESDAY, FEBRUARY 16, 2016
The City Council met in Work Session on Tuesday, February 16, 2016, at
2 : 12 p.m. in Room 326, Committee Room, City County Building, 451 South
State Street .
In Attendance: Council Members Andrew Johnston, Erin Mendenhall, Charlie
Luke, Derek Kitchen, Stan Penfold, and Lisa Adams .
Absent: Councilmember James Rogers .

Councilmember Penfold presided at and conducted the meeting.
The meeting was called to order at 2 : 12 p.m.
AGENDA ITEMS
#1 . 2:12:17PM BRIEFING ON THE ANNUAL HOUSING REPORT FOR 2014 AND 2015.

Nick Tarbet and Mike Akerlow briefed the Council with attachments .
Discussion was held regarding use of existing developments to
subsidize low income/affordable housing, funding sources for affordable
housing, progress of the Wendell Apartments and First Step House,
NeigborhoodLlFT program data, and concern with financing time frames of
subsidy programs .

Vandongen, briefed the Council with attachments and a Power Point

Presentation.
Discussion was held regarding cadet Use of Force and Continual
Education training, perception/scenario training for cadets, examples of
soft physical control, progress of new simulator training, handling of
Use of Force complaints, collection of Use of Force data, turning over
Police Use of Force investigations to other entities, incorporation of
de-escalation into training, importance of Critical Incident Technique
(CIT) training, impact of female trainers in de-escalation training, and
current staffing.
Mayor Biskupski addressed the Council . She said she was meeting with
Chief Brown to discuss how the City could serve the Community in a better
fashion and was confident the Chief' s recommendations were headed in the
right direction to create a more effective and transparent Department.
Mayor Biskupski said she hoped to find support amongst the Council with
the recommendations that had been made .
Councilmember Penfold said in starting the budget process, he wanted
to see what was required to fill the positions if additional staffing was
needed. He said the Council wanted to include use of lethal-force
statistics in the reporting process that was being addressed for all
Departments . He commented that the Council might explore alternative
models for ensuring police transparency and accountability in lethal-
force incidents, including functions currently assigned to the Police
Civilian Review Board.
#3 . 4:14:58 PM BRIEFING ON AN ORDINANCE ENACTING CHAPTER 2 . 05, SALT
LAKE CITY CODE, TO CREATE APPOINTMENT REGULATIONS. The Council will
discuss the legislative role in the advice and consent process as
outlined by State and City Code, and discuss potential ordinance changes
to further clarify that role. View Attachments
Jennifer Bruno and Neil Lindberg briefed the Council with
attachments .
Discussion was held regarding personal information in relation to
public records/Government Records Access and Management Act (GRAMA) and
consideration to follow a process similar to the Advice and Consent
Process for Board/Commission appointments .
Mayor Biskupski addressed the Council . She referenced Section
2 . 02 . 020 (D) of the proposed ordinance: Following receipt of the foregoing
information, the City Council shall promptly schedule consideration of
its Advice and Consent to the Mayor' s appointment. She asked the Council

to consider including language in the ordinance regarding specific timing
for the Council to consider Advice and Consent once submission of an
appointment had been received from the Mayor. Mayor Biskupski also
referenced Section 2 . 05 . 030 (B) : The City Council may decline to give its
consent to a proposed appointment, even if an appointee meets applicable
minimum requirements . She asked the Council to consider including the
language "and must provide written justification for said decision" . She
indicated these additions would be helpful to all involved.
Discussion followed regarding the Mayor' s requests and included
exploring options for language in the proposed ordinance regarding a
Council written response upon decline of consent to a proposed
appointment .
A unanimous Straw Poll was taken in support of including specific
language in the proposed ordinance regarding timing for the Council to
consider Advice and Consent once submission of an appointment had been
received by the Mayor.
A unanimous Straw Poll was taken in support of delaying the proposed
ordinance for briefing and action until March 1, 2016 .
#4 . 4:39:47 PM BRIEFING ON AN ORDINANCE AMENDING VARIOUS SECTIONS OF
THE SALT LAKE CITY CODE PERTAINING TO ATTACHED GARAGE REGULATIONS IN
RESIDENTIAL ZONING DISTRICTS. This ordinance amends various sections of
Chapter 21A. 24 and Section 21A. 52. 030 of the Salt Lake City Code.

with attachments and a Power Point Presentation.
Discussion was held regarding the Special Exception process, concern
regarding Special Exception requirements/approval, and binding Special
Exceptions to new construction rather than demolition/re-construction.
Councilmember Penfold requested Staff explore options for additional
criteria under certain property constraints and clearly articulate those
constraints, and a proposal that tightened Special Exceptions . The
Council agreed with the requests .
#5. 4:53:35 PM BRIEFING ON A REQUEST TO AMEND THE TABLE OF PERMITTED
USES FOR MANUFACTURING DISTRICTS TO ALLOW BUS LINE YARD AND REPAIR AS A
PERMITTED USE IN THE M-1 ZONING DISTRICT (LIGHT MANUFACTURING DISTRICT) .
The proposed ordinance changes would apply citywide within Manufacturing

zoning districts and amend Section 21A. 33. 040 of the Salt Lake City Code.

attachments .
Discussion was held regarding the proposed 1, 000 foot buffer between
single and two-family zoning districts; and Lighting Manufacturing
District (M-l) zoning, uses, and changes .
The Council agreed to move forward with the public hearing for this
item.
#6. 5:04:07 PM BRIEFING ON AN ORDINANCE AMENDING CERTAIN SECTIONS OF
TITLE 21A (ZONING) OF THE SALT LAKE CITY CODE PURSUANT TO PETITION NO.
PLNPCM2015-00146 TO PROVIDE ADDITIONAL CLARITY AND EFFICIENCY IN LAND USE
REGULATION. This ordinance fine tunes City Code related to public
hearings and the operations of various Boards & Commissions. Petitioner -
Former Mayor Ralph Becker, Petition No. PLNPCM2015-00146. View

Maryann Pickering, Nick Norris, and Nick Tarbet briefed the Council
with attachments .
Discussion was held regarding concern with potential changes to the
Historic Landmarks Commission, concern with not requiring notice by mail
for text amendments, and concern with noticing for Special Exceptions .
Councilmember Penfold stated this item was scheduled for public
hearing on March 15, 2016 .
#7 . 5:56:14PM BRIEFING REGARDING ISSUES FOR THE 2016 STATE LEGISLATIVE
SESSION.
David Litvack and Lynn Pace updated the Council regarding 2016 State
Legislative Session issues .
Discussion was held regarding legislation for economic development
of property at the Point of the Mountain and potential affects to the
City, a meeting with Legislators regarding development in the Northwest
Quadrant, and current legislation regarding homelessness .

REPORT OF THE EXECUTIVE DIRECTOR, INCLUDING A REVIEW OF COUNCIL
INFORMATION ITEMS AND ANNOUNCEMENTS. The Council may give feedback or

staff direction on any item related to City Council business, including
but not limited to: Communication Budget Policy, Early Advertising for

Mid-Year Convention, American Planning Association National Conference
and scheduling Items.

No discussion was held.
#10 . 5:17:49 PM CONSIDER A MOTION TO ENTER INTO CLOSED SESSION, IN
KEEPING WITH UTAH CODE FOR ANY ALLOWED PURPOSE.
Councilmember Luke moved and Councilmember Adams seconded to enter
into Closed Session to discuss deployment of security personnel, devices,
or systems pursuant to Utah Code §52-4-205 (1) (f) ; and §78B-1-137
Attorney-Client matters that are privileged. A roll call vote was taken.
Council Members Johnston, Mendenhall, Penfold, Luke, Kitchen, and Adams
voted aye . Councilmember Rogers was absent .
