The City Council met in Work Session on Tuesday, March 22, 2016, at 2 : 15
p.m. in Room 326, Committee Room, City County Building, 451 South State
Street .

#1 . 2:15:17PM RECEIVE A BRIEFING REGARDING AN ORDINANCE AMENDING THE
ZONING MAP FOR PARCELS LOCATED AT APPROXIMATELY 1196 SOUTH 700 WEST
STREET, 1197 SOUTH 800 WEST STREET, AND 1203 SOUTH 800 WEST STREET TO
REZONE THOSE PARCELS FROM SINGLE FAMILY RESIDENTIAL (R-1/7,000) TO
SPECIAL DEVELOPMENT PATTERN RESIDENTIAL (SR-3) PURSUANT TO PETITION NO.
PLNPCM2015-00436. The proposal would allow a developer to build 18 twin
home units on individual lots with a private street running through the
center of the property. The intended development would not be allowed
under current zoning. Although the applicant has requested that the
properties be rezoned from R-1/7, 000 to SR-3, consideration may be given
to rezoning the properties to another zoning district with similar

street lighting and additional parking, no on-street parking permitted,
on-site garbage collection, Home Owners Association (HOA) standards,
overflow parking on 700 West, and emergency vehicle ingress/egress .
Discussion was held regarding parking issues . A public hearing was
scheduled for April 19, 2016 .
#2 . 2:29:49 PM RECEIVE A BRIEFING REGARDING A REQUEST TO AMEND PARK
STRIP LANDSCAPING ZONING PURSUANT TO PETITION NO. PLNPCM2014-00194 . This
is an amendment request and ordinance change intended to address the
health of street trees, and to address height concerns of both plant
materials and structures (Petitioner - Salt Lake City Council) . View

Doug Dansie, Nick Tarbet, and Nick Norris briefed the Council with
attachments/Powerpoint. Comments included vegetation/height issues, water
conservation, community education/outreach, pedestrian safety issues
(sight distance triangle) , tree health/maintenance, modify ordinance to
identify allowed uses (eliminate prohibited uses) , park-strip width,
submit landscape/irrigation plan, structural encroachments allowed in
park-strip, bond requirements removed, utilize best management practices,
and tree survey/protection/tracking.
Councilmember Adams suggested modifying language in Section D,
Paragraph 2 (Tree Grates) identifying whom would provide "tree wells with
grates" and "an operable irrigation system" (City or property
owner/developer) .
A public hearing was scheduled for April 19, 2016 .
#3. 2:50:05 PM RECEIVE A BRIEFING REGARDING PROPOSED AMENDMENTS TO THE
BALLPARK/CENTRAL COMMUNITY FUTURE LAND USE MAP PURSUANT TO PETITION NO.
PLNPCM2013-00899 AND PETITION NO. PLNPCM2013-00900 . This proposal would
amend portions of the Central Community Future Land Use Map from Medium
Density Residential to the lower density zone, Single-Family Residential,
(amending the zoning map pertaining to multiple parcels situated in an
area bounded by 1300 South and 2100 South Streets and Main and 200 West
Streets to rezone certain parcels from Moderate Density Multi-Family
Residential District (RMF-35) to Single-Family Residential District (R-
1/5, 000) and amending the Central Community Master Plan Future Land Use
Map) . Although the applicant has requested that the properties have
specific zoning, consideration may be given to rezoning the properties to
another zoning district with similar characteristics (Petitioner - Salt

Michael Maloy, Nick Tarbet, and Michaela Oktay briefed the Council
with attachments/PowerPoint. Comments included unique downzone project,
broad community support, preserve residential housing stock, consistent
development patterns, walkability/transit access, Transit Oriented
Development (TOD) areas, master plan compatibility, extensive public
process, and historic neighborhood preservation.
A public hearing was scheduled for April 19, 2016 .
#4 . 2:58:41 PM RECEIVE A BRIEFING REGARDING AN ORDINANCE THAT WOULD
AMEND SECTIONS OF THE SALT LAKE CITY CODE (SECTION 21A.52) RELATING TO
RESIDENTIAL DWELLING UNIT LEGALIZATION PURSUANT TO PETITION NO.
PLNPCM2015-00142 . Under the proposal, a new process would be instituted
to legalize excess dwelling units that have existed prior 1995 but have
never been officially recognized by the City. The City implemented a
temporary legalization process from September 2012 to September 2013.
When it concluded, the Council asked the Administration to research a
permanent legalization solution. Related provisions of Title 21A, Zoning,
may also be amended as part of this petition (Petitioner — Former Mayor

Christopher Lee, Nick Tarbet, and Nick Norris briefed the Council
with attachments . Comments included business license requirements and
Good Landlord Program participation.
Councilmember Rogers asked if Planning contacted the Apartment
Association about the proposal . Mr. Norris said he needed to double check
but thought they were included in open house mailing lists . Mr. Lee said
he would also verify if they were contacted in 2012 with the original
proposal .
A public hearing was scheduled for April 19, 2016 .
#5. 3:07:32 PM RECEIVE A BRIEFING REGARDING PROPOSED AMENDMENTS TO THE
1700 SOUTH WEST TEMPLE MAJESTIC MEATS ZONING MAP PURSUANT TO PETITION NO.
PLNPCM2015-00809. The proposed ordinance would amend the zoning map
pertaining to properties located at 115 West 1700 South and 1710 South
West Temple to rezone those parcels from Community Business District (CB)
to Mixed use District/R-MU-45. The proposed change is intended to make
the property more marketable so the current owners can relocate their
business. Although the applicant has requested that the properties have
specific zoning, consideration may be given to rezoning the properties to
another zoning district with similar characteristics (Petitioner -

Doug Dansie, Nick Tarbet, Nick Norris, and Raymond Zaelit briefed
the Council with attachments/PowerPoint. Comments included non-conforming
use, petitioner chosing to relocate for business expansion, downzone area
to single-family homes, height limitations, step-back requirements,
parking issues, family-owned business/meat distributor, and future
redevelopment project area.
A public hearing was scheduled for April 19, 2016 .
#6. 3:18:09PM RECEIVE A BRIEFING REGARDING NINE SUBDIVISION VACATIONS
AT THE SALT LAKE CITY INTERNATIONAL AIRPORT PURSUANT TO PETITION NO.
PLNSUB2014-00242 . The proposed ordinance would vacate nine subdivisions
located on Salt Lake International Airport property. The properties are
being vacated, or dissolved, in preparation of the Airport 's Terminal
Redevelopment Program. The subdivisions all reside on Airport property
and were originally drawn in the late 1800s and early 1900s, long before
the airport was built (Petitioner - Salt Lake City Department of

Allen McCandless, Nick Norris, and Russell Weeks briefed the Council
with attachments . Comments included cloud on property titles, potential
affect on bonding capacity/financing, private ownership issues, platted
streets/alleys, five subdivisions contained Airport interests, and
proposal would help facilitate future airport expansion/development .
Mr. McCandless said he would work with the Attorney' s Office prior
to the public hearing to ensure appropriate changes were made to the
ordinance .
A public hearing was scheduled for April 26, 2016 .
#7 . 3:25:56 PM RECEIVE A BRIEFING REGARDING PROPOSED AMENDMENTS TO THE
FINAL BUDGET OF SALT LAKE CITY, INCLUDING THE EMPLOYMENT STAFFING
DOCUMENT FOR FISCAL YEAR 2015-2016. (BUDGET AMENDMENT NO. 3) View

Jennifer Bruno and Ben Luedtke briefed the Council with attachments .
Discussion was held on potential to capture savings by not funding vacant
Administrative positions . Straw Poll: Support to not withhold $90, 000
intended for employees the Administration might choose to hire . All
Council Members present were in favor.
Discussion was held on potential savings by not funding some
outstanding Capital Improvement Program (CIP) projects . Ms . Bruno said
some Council Members expressed concerns that withholding funding could

jeopardize specific projects from moving forward. She said the
Administration did not have a current projection on the budget shortfall,
so Council could choose to delay discussion until April 19, 2016 allowing
time to receive a revenue update regarding sales tax.
Councilmember Rogers said he did not want to delay completion of the
Jordan River Parkway Trail since the Legislature approved funding for the
project. Councilmember Adams said the Pratt Coalition was trying to raise
$1 million for the Sego Lily project with the understanding the City
would contribute $500, 000 . She said it was important for the City to keep
that commitment.
Councilmember Rogers asked what the savings would be if Council
moved forward with those two projects and delayed all other CIP projects .
Ms . Bruno said approximately $7 . 7 million. She said Staff could try to
identify/prioritize approximately $3 . 5 million of CIP projects for the
next meeting until a clearer revenue picture was available . Straw Poll:
Support for Ms . Bruno' s suggestion with the understanding that the Jordan
River Parkway Trail and Sego Lily projects would move forward with
funding. All Council Members present were in favor.
Ms . Gust-Jenson said she spoke with the Mayor' s Office regarding
potential funding for enhancing the Employees Bike Share program
($5, 000) . She said funding (potentially from Sustainability) would have
to be appropriated by Council and the Administration would come back with
a proposal .

Lynn Pace and David Litvack briefed the Council with attachments .
Mr. Pace said a summary was provided to the Council concerning which
Legislative Bills passed or failed. Discussion was held on the following
issues :
• Prison relocation/ Northwest Quadrant development. Mr. Pace said no
significant legislation was passed. He said issues the City needed
to follow-up on included completion/adoption of Northwest Quadrant
Master Plan, adopt/implement appropriate zoning, explore potential
to create Redevelopment Area identifying City priorities/resources,
draft/execute appropriate agreements with the State for roadways,
utilities, etc. , and continue discussions about the North Temple
Landfill .

• Homeless issues/facilities and services. Mr. Pace said five Bills
were passed which would require a lot of follow-up. He said the City
needed to re-constitute its site-selection committee/process . He
said the State' s financial assistance was based on the
identification/construction of multiple sites where services could
be provided. He said some pieces were addressed in the legislation
but others would have to be explored through the site-selection
process .
Councilmember Adams asked how much funding was allocated by the
State. Mr. Litvack said $9 . 2 million ($4 . 5 million ongoing and $4 . 75
million one-time) . Discussion was held on specifics issues the
funding was intended to address such as new facilities, services,
programming, operations, pedestrian safety, and maximizing existing
facilities such as Midvale Shelter. Mr. Litvack said the main focus
would be on families, single men, and single women. Councilmember
Mendenhall expressed concern that was only three of the nine target
populations which needed to be addressed. Ms . Gust-Jenson said there
were policy/zoning implications associated with this issue and
consideration was needed about how the Council would participate in
the process/ongoing discussions .
Mr. Litvack said the Mayor' s Office previously spoke to
Councilmember Rogers about ensuring Council representation on the
Site Selection Commission and Council engagement/participation
throughout the entire process . He said policy considerations would
be presented to the Council at the April 12, 2016 meeting. He said
Gale Miller and Palmer DePaulis were invited to attend the meeting
and talk about previous work conducted by the Selection Site
Evaluation Commission. Councilmember Johnston said Council needed to
be careful about stepping in and micromanaging existing programs . He
said he supported making policy decisions for Salt Lake but the
City' s role in the process needed to be well defined.
• Historic Districts. Mr. Pace said he felt Legislators were looking
for a process which would produce a greater degree of consensus in
neighborhoods prior to going forward with historic districts . He
said the bill essentially intended either a greater degree of
consensus from residents or a greater degree of consensus among
Council Members . He said the City currently had two petitions in
process which were interrupted by the Legislative Session but would
now be allowed to move forward and would eventually come to the
Council for consideration.

• Jordan River Parkway Bridge. Mr. Pace said funding approved for the
project would go to the Jordan River Commission which would then be
combined with City and County funds to complete the project.
• Wildland Fire Suppression. Mr. Pace said the proposal would shift
suppression costs from local governments to the State and in
exchange the State requested a contribution (in-kind in terms of
education, best practices, fire mitigation) from local governments .
He said the City needed to work with fire personnel to ensure the
appropriate amount was allocated toward those resources both on
wildland areas within the City and on City-owned watershed or canyon
property even if located outside City limits .
• Police Body Cameras. Mr. Pace said a series of standards were passed
relating to the use of police cameras . He said he was not aware of
the City' s current level of compliance but some changes might be
needed. He said the bill also addressed data retention, disclosure,
and specific guidelines regarding how much footage was public or
private at different stages of the process .
• Rocky Mountain Power legislation. Mr. Pace said this legislation
needed to be part of the City' s process when the Rocky Mountain
Power franchise agreement was renewed. He said he hoped the City
would continue pursuing air quality and renewable energy objectives
with Rocky Mountain Power.
• Air Quality. Mr. Pace said there were several bills relating to air
quality issues . He said HB316 dealt with building codes and was
adopted with generous modifications (2015 building codes, electrical
codes, energy codes, etc. ) and with a six-year code adoption cycle
going forward. He said within the bill were a number of other
provisions which he hoped would be helpful in terms of
addressing/improving air quality (energy efficiency in new homes,
etc. ) .
• Retirement Benefits. Mr. Pace said there was a lot of discussion but
only one bill passed which required that any future retirement bills
had to contain a complete funding source (retirement account surplus
could not be used) .
• Non-Competition. Mr. Pace said the Senate passed a "watered down"
version which essentially adopted by reference whatever common law
already provided.

• Liquor Legislation. Mr. Pace said he was not aware of any
significant policy changes . Councilmember Kitchen said he understood
some liquor licenses were freed-up and requested feedback on those
including what that could mean for local restaurants/bars . Mr. Pace
said some vendors had multiple licenses which were consolidated into
one which freed-up licenses . He said he was unsure if those were
earmarked for specific counties or specific uses but would research
the issue and get back to the Council .
Mr. Pace thanked Council Members, the Legislative Subcommittee,
and Mr. Litvack for their assistance and hard work during the session.
