TUESDAY, APRIL 11 , 2006
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, April 11, 2006, at 7 : 00 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State .
The following Council Members were present:
Van Turner Nancy Saxton Dave Buhler
Soren Simonsen Eric Jergensen Jill Remington Love
Carlton Christensen
Mayor Ross C. "Rocky" Anderson; Cindy Gust-Jenson, Executive
Council Director; Edwin Rutan, City Attorney; and Scott Crandall,
Deputy City Recorder; were present.
Councilmember Buhler presided at and Councilmember Love conducted
the meeting.
#1 . 7:07:15 PM The Council led the Pledge of Allegiance.
#2 . 7:08:34 PM Councilmember Turner moved and Councilmember Saxton
seconded to approve the minutes of the Salt Lake City Council meetings
held March 30, 2006 and April 4, 2006, which motion carried, all

PUBLIC HEARINGS :
#1 . 7:08:48 PM RE: Accept public comment and hear protests
concerning the proposed creation of the Salt Lake City Strongs Court
(#102109) and Fenway Avenue (#102129) reconstruction Special
Improvement District (the "District") ; to construct improvements within
the City consisting of the reconstruction of roadways, including
installation of concrete pavement, gutters, sidewalk, water facilities,
driveway approaches, street lighting, and all other miscellaneous work
necessary to complete the improvements in a proper and workmanlike
manner; to pay the improvement costs and expenses by special
assessments to be levied against the property benefited by such
improvements; to provide notice of intention to authorize such
improvements and to fix a time and place for protests against such
improvements, assessments or the creation of the district; to declare
its official intent to reimburse itself for expenditures paid by it
prior to the sale of bonds; and to authorize advertisement of
construction bids and related matters . View Attachment
Councilmember Saxton moved and Councilmember Turner seconded to
close the public hearing, which motion carried, all members voted aye .

refer the issue to Engineering, which motion carried, all members voted

#2 . 7:10:07 PM RE: Accept public comment and hear protests
concerning the proposed creation of Salt Lake City Yale Avenue 1300
East to 1500 East Street Lighting Special Improvement District (SID)
Job No. 106029 to construct improvements within the City consisting of
the installation of decorative street lighting poles, and all other
miscellaneous work necessary to complete the improvements in a proper
workmanlike manner; to levy an assessment to operate and maintain said
street lighting facilities; to create the Salt Lake City, Yale Avenue
1300 East to 1500 East Street Lighting Special Improvement District LC-
106029 (the "District") ; to pay the acquisition and installation costs
and expenses and the operation and maintenance costs of said
improvements by special assessments to be levied against the property
benefited by such improvements; to provide notice of intention to
authorize such improvements and to fix a time and place for protests
against such improvements, assessments or the creation of the District;
to declare its official intent to reimburse itself for expenditures
paid by it prior to the sale of bonds; and to authorize advertisement
of construction bids and related matters . View Attachment
Councilmember Jergensen moved and Councilmember Buhler seconded to
continue the public hearing.
Councilmember Love said some residents requested that the hearing
be continued so they could meet with City staff to review
issues/options before deciding which direction to go. She said if the
hearing was closed, residents would not be able to provide further
comment.
Councilmember Christensen asked procedurally if the SID was
invalid since the percentage of residents opposing the project was 55% .
Ms . Gust-Jenson said it would be if the Council voted to close the
hearing. She said due to confusion some residents might be interested
in withdrawing their protest. She said continuing the hearing would
allow residents time to review additional information before
determining whether to leave their protest in place or withdraw it.
Councilmember Christensen said so as long as the hearing was not
closed residents could actually withdraw their protest . Ms . Gust-
Jenson said that was correct.
Councilmember Love called for the question, which motion carried,
all members voted aye .

COMMENTS TO THE CITY COUNCIL
7:12:02 PM Travis Soto and Marlene Gonzalez spoke concerning
Community Development Block Grant (CDBG) funding for the Multi-Cultural
Legal Center.
Bob Schofield spoke concerning the street lighting SID on Yale
Avenue . He said he was concerned the issue was being continued when
more than 51% of the residents opposed the project. Councilmember Love
said staff would meet with Mr. Schofield after the meeting.
UNFINISHED BUSINESS :
#1 . 7:07:40 PM RE : Adopting an ordinance rezoning property
generally located at 1443 East Sunnyside Avenue from Open Space (OS) to
Institutional (I) , and amending the East Bench Master Plan pursuant to
Petition Nos . 400-05-08 and 400-05-09 . View Attachment
Councilmember Love said the item was being postponed until April
18, 2006 to allow the Council and the public time to review additional
information.

CONSENT AGENDA
7:18:09 PM Councilmember Turner moved and Councilmember Christensen
seconded to approve the Consent Agenda, which motion carried, all
members voted aye .
#1 . RE: Requesting the Administration not hold a hearing at 5 : 00
p.m. on April 18, 2006 regarding a proposal to sell property at 615
North Catherine Circle and property located at 1420 West 600 North to
respective abutting neighbors to the north for continued landscape
maintenance and development. Sale of the properties to private parties
was contemplated as part of the realignment of 600 North for connection
to 700 North years ago. Properties will be sold for fair market value .

accept comment regarding an ordinance amending Chapter 8 . 04, Salt Lake
City Code, relating to animal control.

accept public comment regarding an ordinance approving, and authorizing
the execution and delivery of an interlocal agreement regarding the

design and construction of the Salt Lake City Intermodal Terminal
Connection to TRAX LRT project by and between Salt Lake City
Corporation and Utah Transit Authority; relating to the design
construction, ownership and funding of an extension of the TRAX Light
Rail Line from the Delta Center Station to the Salt Lake City
Intermodal Hub, providing for two stations on such extended TRAX Line,
providing for the conveyance by Salt Lake City of the Intermodal Hub
site and the improvements thereon to Utah Transit Authority and
providing for other related matters; authorizing the assignment to Utah
Transit Authority of certain contracts relating to the Salt Lake City
Intermodal Hub and the TRAX extension project; authorizing the
execution and delivery of a public way use agreement granting to Utah
Transit Authority certain City street surface use rights for operation
of the light rail extension; authorizing and approving the execution
and delivery of all documents necessary to consummate the foregoing
transactions; and related matters .

#4 . RE: Setting the date of May 2, 2006 at 7 : 00 p.m. to accept
public comment regarding an ordinance extending the corporate limits of
Salt Lake City to include approximately 405.59 acres of unincorporated
territory included within the Parley' s Pointe annexation petition,
located in the vicinity of 2982 East Benchmark Drive (3000 East and
2100 South to 2600 South) , and amending the East Bench Community Master
Plan, and the Arcadia Heights, Benchmark and H-Rock Small Area Master
Plan, and amending the Salt Lake City Zoning Map to zone and designate
this area as Foothill Residential (FR-2) , Open Space (OS) and Natural
Open Space (NOS) upon its annexation into the City pursuant to Petition
No. 400-05-41 .
