TUESDAY, APRIL 3, 2012
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, April 3, 2012 at 7 : 00 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State.
The following Council Members were present:
Carlton Christensen Kyle LaMalfa Stan Penfold
Jill Remington Love Luke Garrott Charles Luke
Soren Simonsen
Cindy Gust-Jenson, Executive Council Director; Ed Rutan, City
Attorney; Mayor Ralph Becker; and Chris Meeker, City Recorder; were
present.
Councilmember Simonsen presided at and Councilmember LaMalfa
conducted the meeting.
OPENING CEREMONY

Tuesday, March 27, 2012, which motion carried, all members present

PUBLIC HEARINGS
#1. 7 :20:21 PM RE : Accept public comment and consider adopting an
ordinance amending Section 21A. 52 . 030 - Special Exceptions to the
City' s zoning regulations . The ordinance will modify procedures and
standards to legalize existing residential dwelling units unrecognized
by city records, a process referred to as "unit legalization" . The
proposed changes will address existing unit legalization issues,
support the existing Salt Lake City Housing Plan, set life safety
requirements and help implement the Landlord Tenant Initiative. Related
provisions of Title 21A - Zoning may also be amended as part of this

Blankevoort; Cindy Cromer; Rosemary Emery; Tom Brooks ; Sean Igo and
Bruce Lindsay. Esther Hunter asked the Council to keep the sunset
clause . Larry Livingston said parking needed to be addressed.

seconded to close the public hearing and refer to a future meeting,
which motion carried, all members voted aye.

#2 . 7:35:47 PM RE: Accept public comment and consider adopting
proposed changes to the City' s zoning regulations relating to allowing
accessory dwelling units (ADUs) in single-family and multi-family
zoning districts . This is proposed to provide a broad mix of housing
opportunities in existing neighborhoods that address changing family
needs , economic conditions, smaller household sizes, and increase use
of existing housing, public infrastructure and transit. This could
increase the number of dwelling units in an existing neighborhood under
this proposal. Related provisions of Title 21A - Zoning - may also be

#1 . 8:06: 14 PM RE : Adopting an ordinance rezoning the frontage of
properties located at 545 and 555 West 500 North from SR-lA and Sr-3
(Special Development Pattern Residential) to TSA (Transit Station Area)
and rezoning the rear of the property located at 555 West 500 North

Councilmember Christensen said he was encouraged by the petitioner
wanting to improve the area. He said it was important that an
expectation be created that was sustainable for property owners of the
future .

Councilmember Christensen moved and Councilmember Garrott seconded
to adopt Ordinance 18 of 2012 , subject to the provisions of a public
street, by amending the Planned Development to provide a right-of-way
easement for sidewalk and adjustment to buildable lot areas , which
motion carried, all members voted aye .

Philosophy Statement on Arts and Culture. View Attachment
Councilmember Simonsen moved and Councilmember Garrott seconded to
adopt Resolution 14 of 2012, which motion carried, all members voted
aye .
#3 . 8: 11:20 PM RE : Adopting a resolution updating policy
statements for the City' s Community Housing Plan. The intent is to
address development of new housing opportunities, preserve the City's
existing housing stock and reflect current housing and economic
conditions. View Attachments
This item was referred to a future meeting.
#4 . 8: 12: 06 PM RE: Adopting the proposed Salt Lake City Council
District boundary maps. Redistricting, completed every ten years after
the census, is required to substantially balance the population so each
person is equally represented. View Attachments
Councilmember Love said Map E took the boundary between districts
4 and 5 down 800 South, from 1300 East to 800 East.
Councilmember Luke thanked the independent Redistricting Working
Group for their service and recommendations . He said the process used
worked well .
Councilmember Christensen asked that citizens who' s representation
changed be notified of the changes .
Councilmember Love moved and Councilmember Penfold seconded to
adopt Resolution 15 of 2012, designating the new City Council District
Boundaries attached as Exhibit "A" specifically City Council Map 5
Version "E" , which motion carried, all members voted aye .
8:22:53 PM COMMENTS TO THE CITY COUNCIL
Tom Brooks said he opposed the Good Landlord ordinance . He said
the State Legislature had changed the law and information found on Salt
Lake City' s web site was contradictory and incorrect. Ann Cannon
submitted a card asking the Council to clarify the intent and actuality

of the housing related items . Douglas Cotant spoke about being
solicited for money while on TRAX.
NEW BUSINESS
#1 . 8:29: 12 PM Re : Adopting a motion authorizing the City Council
Chair to sign a letter engaging Management Partners to conduct a
performance audit of the Salt Lake City Public Library System. (A
review team of representatives of the City Council Office, the Salt
Lake City Library System, and Mayor Ralph Becker's Administration met
March 28 to consider proposals by two companies under contract to the
City Council to conduct audits. After reviewing the proposals, the
review team recommended Management Partners, headquartered in San Jose,
California to conduct a performance audit of the Salt Lake City Library
System. A formal motion by the City Council authorizing the Council
Chair to sign an engagement letter would in effect confirm the
recommendation. However, the City Council has the authority to select
another company under contract to the Council or to reject any and all

Councilmember Simonsen moved and Councilmember Penfold seconded to
suspend the rules and approve the motion, which motion carried all
members voted aye .

wish Jeff Bedard, Salt Lake City Police Officer, a Happy Birthday,
which motion carried, all members voted aye .
UNFINISHED BUSINESS
#1 . 8:32:30 PM RE: Adopting an ordinance establishing policy and
guidelines for City acceptance of donations. This ordinance would
authorize donations for the purpose of making improvements on City
property and provide guidelines for acceptance of such donations. The
ordinance also expresses policy on volunteer efforts. View Attachments

an historic district is currently-being addressed by the Administration
through a separate petition. Proposed changes for designation of
historic districts will be considered in the future. This proposal

• Improve clarity without changing thc intent of specific zoning
rcgulations .
• Streamline thc approval process for applicants .
• Allow thc Historic Landmark Commission to modify bulk and lot

• Address ongoing problems with administration of existing

to accept public comment and consider three options regarding the
City' s 10-Year Capital Facilities Plan (CFP) and Impact Fees . The
Council suggested changes to the original proposed 10-Year CFP
resulting in a recalculation of impact fees. Once the Council formally
adopts the plan, the amount of impact fees charged by the City will be
amended. Note: Capital improvements involve the construction,
purchase or renovation of buildings, parks, streets or other physical
structures. Generally, projects have a useful life of five or more
