TUESDAY, APRIL 5, 2011
The City Council of Salt Lake City, Utah, met in Regular Session on
Tuesday, April 5, 2011 at 7 : 00 p.m. in Room 315, City Council Chambers,
City County Building, 451 South State .
The following Council Members were present :
Carlton Christensen Van Turner Jill Remington Love
Stan Penfold Luke Garrott J T Martin
Soren Simonsen
Cindy Gust-Jenson, Executive Council Director; Mayor Ralph Becker;
Edwin Rutan, City Attorney; David Everitt, Mayor' s Chief of Staff; and
Chris Meeker, City Recorder were present .
Councilmember Love presided at and Councilmember Martin conducted
the meeting.
7 : 0 5: 0 7 PM OPENING CEREMONY
#1 . 7 : 05: 11 PM The Council led the Pledge of Allegiance .
#2 . 7 : 05:36 PM Approval of the minutes of March 22 , 2011 .
Councilmember Simonsen moved and Councilmember Turner seconded to
approve the minutes, which motion carried, all members voted aye .

PUBLIC HEARINGS
#1 . 7 : 05:58 PM RE: Accept public comment and consider adopting an
ordinance rezoning properties located at approximately 1374 and 1380
South West Temple Street from Residential Business RB to Residential
Mixed Use R-MU. This would allow the property to be redeveloped with a
mix of uses including, but not limited to, a restaurant, offices and
residential units . Petitioner Sattar Tabriz, SNT Enterprises, Petition
No. PLNPCM2010-00549 .
Councilmember Love moved and Councilmember Turner seconded to
close the public hearing, which motion carried, all members voted aye .
Councilmember Christensen moved and Councilmember Garrott seconded
to adopt Ordinance 13 of 2011, which motion carried, all members voted
aye .

to adopt Ordinance 14 of 2011, which motion carried, all members voted
aye .

ordinance regarding proposed changes to the City' s zoning regulation
relating to greenhouses, cold frames and hoop houses for gardening and
small solar and wind energy systems (e.g. solar panels and wind
turbines) . Related provisions of Title 21A - Zoning - may also be

close the public hearing and refer the issue to the next Council
Meeting, specifically looking for options for consideration such as :
• Hours of Operation
• Community events
• Provision for gardening on property owned by another entity
• Sale of products beyond food sales
• Fence height regulations .
• Including but not limiting discussion of any other issues
that Council Members would want to raise on an interim basis,
which motion carried, all members voted aye .

ordinance regarding proposed changes to the City' s zoning regulation to
prohibit new electronic billboards and regulate changing existing
billboards to an electronic format. Related provision of Title 21A -

• Allowing an accessory structure in the side yard behind the
primary structure.
• Removing the proper names "Delta Center" and "Franklin Quest
Baseball Stadium" from the sign regulations and adding the
terms "sports stadium, " "ballpark" and the address of the
facilities .
• Clarifying the definition of a Fraternity and Sorority to
read "a building which is occupied only by a group of
university or college students who received lodging and /or
meals on the premises in exchange for compensation, and are
associated together in a fraternity/sorority that is
officially recognized by the university or college, and that
has a national affiliation. "
• Providing a definition for a pitched roof.
• Removing the outdated summary of yard area and size

Maintenance) .
Kristina Heintz submitted a card requesting the Council allow
zoning changes for higher density urban housing.
Councilmember Love moved and Councilmember Simonsen seconded to

#1 . 8:46:46 PM Re: Adopting an ordinance relating to the proposed
Public Safety Building, amending the text of Section 21A. 32 . 140 , the
Salt Lake City Code, pertaining to communication towers in the Public
Lands zoning districts , and amending the zoning map to rezone a portion
of the land bounded by 400 South and 500 South Street and 300 and 400
East Streets from Transit Corridor TC-75 to rezoning Residential Mixed-
Use R-MU, and Residential/Office RO to Transit Corridor TC-75 and
Public Lands PL-2 pursuant to Petition No PLNPCM2009-01424 . Related
provisions of Title 21A - Zoning may also be amended as part of this

Councilmember Penfold moved and Councilmember Turner seconded to
adopt Ordinance 16 of 2011, rezoning a portion of the land bounded by
400 South and 500 South Street and 300 and 400 East Streets from
Transit Corridor TC-75 to Residential Mixed-Use R-MU, and
Residential/Office RO to Transit Corridor TC-75 and Public Lands PL-2
pursuant to Petition No PLNPCM2009-01424, which motion carried, all
members voted aye except Councilmember Simonsen who voted nay.

Councilmember Simonsen said he would be voting against the
ordinance . He said he supported the Public Safety Building but
continued to be disturbed by the inadequate response to urban design.
He said the project missed the mark in terms of creating a grand
boulevard on 500 South.
Councilmember Penfold moved and Councilmember Simonsen seconded to
defer action on the text amendment pertaining to the emergency
communication towers to a future meeting, which motion carried, all
members voted aye .

David Carter spoke regarding the emergency communication tower.
He asked that the City share the tower with A T & T.
UNFINISHED BUSINESS
#1. 8 :53:21 PM RE: Adopting an ordinance amending Section
12 . 56 . 205 and 12 . 56 . 550, Salt Lake City Code, defining electric vehicle
charging stations, limiting their use to electric vehicles being
actively charged, imposing a limit for use, and establishing a civil

adopt Ordinance 15 of 2011, which motion carried, all members voted
aye .

Councilmember Penfold moved and Councilmember Garrott seconded to
adopt the Consent Agenda, which motion carried, all members voted aye.
#1 . RE : Approving the appointment of Alfonsa Price to the
Housing Authority of Salt Lake City for a term extending through
October 1, 2015 .
