TUESDAY, AUGUST 11, 2009
The City Council of Salt Lake City, Utah, met in Regular Session on
Tuesday, August 11, 2009 at 7 : 00 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State .
The following Council Members were present:
Carlton Christensen JT Martin Van Turner
Jill Remington Love Eric Jergensen Soren Simonsen
Luke Garrott
Cindy Gust-Jenson, Executive Council Director; Lynn Pace, Deputy
City Attorney; Mayor Ralph Becker; and Scott Crandall, Deputy City
Recorder; were present.
Councilmember Christensen presided at and Councilmember Garrott
conducted the meeting.
OPENING CEREMONY
#1 . 7:01:34 PM The Council led the Pledge of Allegiance .
#2 . 7:01:59 PM Councilmember Jergensen moved and Councilmember
Simonsen seconded to approve the minutes of Salt Lake City Council
meetings held July 14 , 2009 and August 3, 2009, which motion carried,
all members voted aye .

PUBLIC HEARINGS
#1 . RE: 7:02:38 PM Accept public comment and consider one or more
ordinances adopting and ratifying the rate of tax levy, greater than
the Certified Tax Rate, upon all real and personal property within Salt
Lake City made taxable by law for Fiscal Year 2009-10 . View
Attachments
Mallie Jowell, Ann Newbold, Farrell Wankier and Mike Tanner spoke
or submitted written comments concerning declining property values, tax
increases and continued spending.
Councilmember Simonsen moved and Councilmember Christensen
seconded to close the public hearing, which motion carried, all members
voted aye .
Councilmember Christensen moved and Councilmember Jergensen
seconded to adopt Ordinance 47 of 2009 establishing Salt Lake City' s
certified property tax rate, based on the latest official numbers
provided by Salt Lake County Auditor' s Office (dated June 30 , 2009) .
These tax rates are applicable upon all real and personal property

within Salt Lake City made taxable by law for the fiscal year
commencing July 1, 2009 and ending June 30, 2010, as follows : 1)
General Fund: 0 . 003349, which will generate $54 ,003,556 in property tax
revenues; 2) General Fund - Judgment Levy: 0 . 000015, which will
generate $240,854 ; and 3) General Obligation Bonds : . 000530 , which will
generate $8,546,397 .
7:12:18 PM Council Members comments on the issue included complex
taxation process, ability to maintain steady revenue stream,
fluctuating sales/franchise tax revenue, reduction in City
staff/services, salary cuts, provide/maintain essential services,
impact of school district taxes, correlation between taxes and
services, shared frustration with residents, lean budget, modest tax
increase and capitalizing on lower construction costs .
Councilmember Garrott called for the question, which motion
carried, all members voted aye .
Councilmember Simonsen was recused for the following item.
Councilmember Turner moved and Councilmember Jergensen seconded to
adopt Ordinance 47 of 2009 - Library Fund Base Budget: 0 . 000690 , which
will generate $11,126,442 in revenue, funding the base budget
originally proposed to the Council by the Library Board, which motion
carried, all members voted aye, except Councilmember Simonsen, who was
recused.
Councilmember Jergensen moved and Councilmember Simonsen seconded
to adopt Ordinance 47 of 2009 - Library Fund Property Tax Stabilization
and New Growth Rate Setting: 0 . 000021, which will generate $338 , 630 in
revenue, which relates to authorized new growth and stabilizing
property tax revenues from the previous year, which motion carried, all
members voted aye .
Councilmember Simonsen moved and Councilmember Jergensen seconded
to adopt Ordinance 47 of 2009 - Library Fund - additional budget for
operating/capital: . 000049, which will generate $790,139 in property
tax revenues .
7:25:26 PM Council Members comments on the issue included support
for additional libraries, sufficient funds for current year,
planning/design for new branches, stimulus project, utilize lower
building costs, how libraries impact communities, investing in
neighborhoods, indentifying potential sites/programs, nominal tax
increase, creating jobs and long-term planning/commitment . A
clarification was made that two branches would be designed/planned but
only one would be constructed.

Councilmember Garrott called for a role call vote, which motion
carried, all members vote aye, except Council Members Christensen and
Martin, who voted nay.
Councilmember Simonsen moved and Councilmember Turner seconded to
adopt Ordinance 47 of 2009 - Library Fund - Judgment Levy: 0 . 000002,
which will generate $39,572 in revenue, which motion carried, all
members voted aye .

#2 . RE: 7:35:43 PM Accept public comment and consider adopting an
ordinance amending Section 21A. 32 . 140, Table of Permitted and
Conditional Uses for Special Purpose Districts to allow public parks in
the Public Lands (PL-1 and PL-2) zoning districts pursuant to Petition

Councilmember Love moved and Councilmember Simonsen seconded to
close the public hearing, which motion carried, all members voted aye.
Councilmember Christensen moved and Councilmember Simonsen
seconded to adopt Ordinance 48 of 2009, which motion carried, all
members voted aye .

appropriation resolution for homelessness prevention and rapid re-
housing program funds and approving an interlocal cooperation agreement
between Salt Lake City and the U.S. Department of Housing and Urban

to close the public hearing, which motion carried, all members voted
aye .
Councilmember Jergensen moved and Councilmember Simonsen seconded
to adopt Resolution 43 of 2009, which motion carried, all members voted
aye .

#4 . RE: 7:37:21 PM Accept public comment and consider adopting a
resolution authorizing the issuance of up to $7,000,000 principal
amount of water and sewer revenue bonds of the City to finance certain
improvements, facilities and property that will be part of the City' s
water, sewer and stormwater system, including, but not limited to the
replacement of existing digester covers, and the potential economic
impact that such project would have on the private sector.

Councilmember Love moved and Councilmember Simonsen seconded to
close the public hearing, which motion carried, all members voted aye.

seconded to approve the resolution, which motion carried, all members
voted aye .

QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 7:38:40PM
Council Members Turner, Martin and Christensen thanked the Mayor
for the City' s assistance/support relating to "Night-Out-Against Crime"
activities .
Councilmember Jergensen said he and Mayor Becker attended a
celebration regarding the restoration and rebuilding of Memory Grove .
He said it had been 10 years since a tornado passed through the City
and invited people to visit the site and look at before and after
pictures of the area.
Councilmember Simonsen thanked the Mayor for his vision/dedication
regarding the proposed Sugar House/South Salt Lake street car project
and for working on appropriate ways to fund the project including
federal grants .
COMMENTS TO THE CITY COUNCIL 7:45:20 PM
Douglas Cotent spoke concerning Main Street Plaza security and
having the City take back ownership of the street.
Vera Miles, Don Barron and Jeanne Larsen spoke or submitted
comments in opposition to proposed changes to the taxicab ordinance .
Juan Arce-Larreta spoke in support of proposed changes to the
Parley' s Trail project and finalizing the interlocal agreement.
CONSENT AGENDA 7:55:51 PM
Councilmember Love moved and Councilmember Simonsen seconded to
approve the Consent Agenda, which motion carried, all members voted
aye .
#1 . RE: Setting the date of September 22, 2009 at 7 : 00 p.m. to
accept public comment and consider adopting a resolution providing for
the holding of a special bond election in Salt Lake City, Utah, at the
same time as the municipal general election, for the purpose of
submitting to the qualified electors thereof the question of whether
general obligation bonds of the City, in an amount not-to-exceed

$125,000,000, shall be issued and sold for the purpose of paying the
costs of providing public safety facilities; providing for the holding

declaring official intent with respect to certain expenditures; and
providing for related matters .
