TUESDAY, AUGUST 27 , 2013
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, August 27, 2013 at 7 : 00 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State.
The following Council Members were present:
Carlton Christensen Charlie Luke
Stan Penfold Soren Simonsen
Luke Garrott Jill Remington Love
The following Councilmember was absent:
Kyle LaMalfa
Cindy Gust-Jenson, Executive Council Director; Margaret Plane,
City Attorney; David Everitt, Mayor' s Chief of Staff; and Beverly
Jones, Deputy City Recorder; were present.
Councilmember Love presided at and conducted the meeting.
OPENING CEREMONY
#1 . 7 : 04 : 05 PM Pledge of Allegiance.
#2 . 7 : 04 :36 PM Councilmember Garrott moved and Councilmember
Simonsen seconded to approve the Salt Lake City formal and work
session meeting minutes for Thursday, August 15, 2013 and the formal
meeting minutes of Tuesday, August 20 , 2013 , which motion carried, all
members present voted aye . View Minutes

7 : 04 : 58 PM QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL
Councilmember Garrott asked what the City' s options were legally
on horse drawn carriages . David Everitt, Mayor' s Chief of Staff, said
from a regulatory standpoint the City licensed businesses and also
allowed Certificates of Convenience and Necessity. He said there were
specific regulations as to what the City needed to have in place in
order for a business to be allowed to operate . He said the City could
not simply revoke a business license. He said there was a process
through which a business has to be placed on notice and then given an
opportunity to respond. He said that process was in place for a reason
and the City needed to follow it.
Councilmember Garrott asked about regulation of businesses
regulated by Certificates of Convenience and Necessity. He asked if

all the regulations were found in ordinances . Mr. Everitt said that
was correct . He said it was about standards with regard to what kind
of reporting the businesses did on an annual basis and what kind of
regulations had to be complied to . Councilmember Garrott asked how
often the Certificates were renewed. Mr . Everitt said he did not know.
He said staff was looking into the regulatory side of the
certificates . He said there were expectations in terms of reports of
certified veterinarians as to the health and safety of animals in
these kinds of businesses .

Councilmember Simonsen moved and Councilmember Luke seconded to
recess as City Council and convene with the Mayor as the Board of
Canvassers, which motion carried, all members present voted aye .

Councilmember Garrott moved and Councilmember Simonsen seconded
to adopt Resolution 41 of 2013, which motion carried, all members
present voted aye except Mayor Becker who was absent for the vote .
Councilmember Simonsen moved and Councilmember Luke seconded to
adjourn as Board of Canvassers and reconvene as City Council, which
motion carried, all members present voted aye.

#2 . RE: 7 : 10 : 10 PM Adopting a resolution confirming the sale and
authorizing the issuance of up to $3, 020, 000 aggregate principal
amount of general obligation bonds of the City to finance all or a
portion of the cost of acquiring and preserving open space, park and
recreational lands and amenities; authorizing the execution and
delivery of certain related documents; and providing for related

Councilmember Penfold moved and Councilmember Simonsen seconded
to adopt Resolution 42 of 2013 confirming the sale and authorizing the
issuance of up to $3,020,000 in General Obligation Bonds of Salt Lake
City, which motion carried, all members present voted aye .

CONSENT AGENDA 8 : 08 : 42 PM
Councilmember Penfold moved and Councilmember Luke seconded to
approve the Consent Agenda with the exception of Item H-1, the
appointment of Chet Cannon, which motion carried, all members present
voted aye .
Councilmember Penfold recused himself.
Councilmember Garrott moved and Councilmember Simonsen seconded
to approve Item H-1, the appointment of Chet Cannon, which motion
carried, all members present voted aye except Councilmember Penfold
who was recused for the vote .
#1 . RE: Approving the appointment of Chet Cannon to the
Transportation Advisory Board for a term extending through September
26, 2016 .

p.m. to accept public comment and consider adopting an ordinance
amending Title 21A, Zoning, Salt Lake City Code, relating to the
City' s zoning regulations allowing community gardens in the Open Space
OS zoning district pursuant to Petition No. PLNPCM2012-00032 . The
change would allow community gardens in appropriate City-owned
locations. Community gardens would not be allowed along the Jordan
River, City Creek, Red Butte Creek, Emigration Creek and Parley's
Creek. Related provisions of Title 21A, Zoning, may also be amended as
