TUESDAY, AUGUST 27 , 2019
The City Council of Salt Lake City, Utah, met in Formal Session on
Tuesday, August 27, 2019 in Room 315, Council Chambers, City County
Building, 451 South State .
The following Council Members were present:
James Rogers Amy Fowler Charlie Luke
Chris Wharton Erin Mendenhall Andrew Johnston
Analia Valdemoros
Cindy Gust-Jenson, Council Executive Director; David Litvack,
Mayor' s Deputy Chief of Staff; Lynn Pace, Acting City Attorney; and
DeeDee Robinson, Deputy City Recorder were present.
Councilmember Luke presided at and conducted the meeting.
The meeting was called to order at 7 : 05 p.m.
PUBLIC HEARINGS
#1 . 7:08:20 PM Accept public comment and consider adopting an
ordinance that would amend the zoning of property located at 504 South
900 East Street and amending the Central Community Master Plan Future
Land Use Map pursuant to Petition Nos . PLNPCM2018-00839 and PLNPCM2018-
00898 . The proposal would rezone the property from Moderate Density
Multi-Family Residential District (RMF-35) to Residential/Mixed Use
(RMU-35) and a Master Plan Amendment from Medium Density Residential to
Medium Residential/Mixed Use. The intent of the proposal is to build a
mixed-use development. No site plan has been submitted at this time.
Although the applicant has requested that the property be rezoned to
Residential/Mixed Use (RMU-35) , consideration may be given to rezoning
the property to another zoning district with similar characteristics.

Ian Kaplan, owner' s representative for the project, spoke about
legal access to additional parcels, a current land dispute, addition of
shared street parking, a proposed community patio, removal of an eastside
curb-cut for additional parking, and adequate parking to be provided as
per City code .
Jami Bogenschutz, property owner, spoke about proposed uses of the
property if rezoned, how the current property did not benefit the
neighborhood, and proposal for housing diversity with owner-occupied on-
site management being a win-win for the neighborhood.

Jarod Hall spoke in support of the rezone and said the proposal
created opportunities for development of in-fill lots to increase
density/diversity of housing types .
Bob Parker, Mark Duncan, and Steven Rasmussen (written comments
only) expressed concerns regarding parking in the area. Comments included
University of Utah students utilizing parking with no time limits, no
adequate parking for current residents, utilizing easement did not make
sense, driveway access being blocked, many commuting from elsewhere in
the City, fighting for places to park, request for resident parking
deemed ineligible as per the City, and request for new development to
provide a new paved alley and parking for residents .
Dean Anesi expressed concern regarding future control of the zoning
if the rezone were to occur, such as the use changing to commercial and
adequate parking not being provided within the area.
Councilmember Mendenhall moved and Councilmember Rogers seconded to
close the public hearing and defer action to a future meeting.
Councilmember Johnston proposed a substitute motion and
Councilmember Valdemoros seconded to continue the public hearing to a
future meeting, which motion carried, all members voted aye .

#2 . 7:20:12 PM Accept public comment and consider adopting an
ordinance that would amend the zoning of a portion of property located
at 650 East South Temple Street from Institutional District (I) to
Residential/Office District (RO) and amending the Central Community
Master Plan Future Land Use Map from Institutional to Residential/Office
Mixed-use pursuant to Petition Nos . Petitions PLNPCM2019-00230 and
PLNPCM2019-00231 . The intent of the proposal is to allow more flexibility
to develop a future multi-family residential, office or mixed-use
development. No site plan has been submitted at this time. Although the
applicant has requested that the property be rezoned to
Residential/Office District (RO) , consideration may be given to rezoning
the property to another zoning district with similar characteristics.

Dustin Holt spoke on behalf of the Masonic Temple Association. He
provided a brief history of the Masonic Temple located on South Temple
Street, described ongoing maintenance/operations funding, and requested
to include the paved parking (on five parcels) within the RO zone
designation.

Councilmember Fowler moved and Councilmember Mendenhall seconded to
close the public hearing and defer action to a future meeting, which
motion carried, all members voted aye .

#3. 7:23:17 PM Accept public comment and consider adopting an
ordinance that would amend the zoning map pertaining to two parcels
located at 402 and 416 East 900 South to rezone those parcels from RB
(Residential/Business District) and CN (Neighborhood Commercial
District) to CB (Community Business District) pursuant to Petition No.
PLNPCM2018-01025 . Currently, these parcels fall within two different
zoning districts. The applicants would like to rezone to one district
for consistency. No development plans have been submitted at this time.
Although the applicant has requested that the property be rezoned to CB,
consideration may be given to rezoning the property to another zoning
district with similar characteristics. View Attachments
Kelly Margetts provided a handout and spoke in opposition of the
proposal . He expressed concerns regarding fire hazards (lack of fire
sprinklers) and parking access being blocked by semi-trucks . He urged
the Council to delay approval until the owner could provide agreeable
terms .
Barton Moody provided a handout and said the proposal would impact
his quality of life. He said having a restaurant patio installed near
his property would render it unlivable . He said there was already
traffic, noise, and parking issues in the area surrounding the Pulp
Lifestyle Kitchen restaurant since last October. He said this was a
rezoning for development, at his expense.
Mark Riekhof (hearing card only) submitted written comments stating
a change in zoning would not be necessary for a remodel and suggested
the zone be changed to CN, not CB (allowing too much latitude in building
a new structure) . He said a proposed patio facing Denver Street would be
intrusive on the neighborhood.
Councilmember Johnston moved and Councilmember Mendenhall seconded
to continue the public hearing to a future meeting, which motion carried,
all members voted aye .

#4 . 7:27:58 PM Accept public comment and consider adopting an
ordinance that would amend various sections of Title 21A of Salt Lake
City Code pertaining to the D-2 Downtown Support District design
standards pursuant to Petition No. PLNPCM2018-00118 . The proposal would
add design standards for new construction and allow projecting signs in
the D-2 Downtown Support District, among other changes. If adopted, the

proposed design standards would implement some recommendations of the
Downtown Master Plan, which the City Council adopted in May 2016. Other
related provisions of Title 21A may- be amended as part of this petition.

#5 . 7:28:38 PM Accept public comment and consider adopting an
ordinance that would amend the table of permitted and conditional uses
for Transit Station Area Districts in Section 21A. 33 . 035 to add
"Restaurant with drive-through facility" as a conditional use pursuant
to Petition No . PLNPCM2018-00575 . The proposal would amend the text of
the Transit Station Area Mixed-Use Economic Center Transitional (TSA-
MUEC-T) district to allow drive-through windows for restaurants as a
conditional use with additional criteria. Currently, drive-throughs are
only allowed for financial institutions in the TSA- MUEC-T district.
Other related provisions of Title 21A may be amended as part of this

Lynn Schwarz , Judi Short, and Soren Simonsen spoke in opposition of
the proposal . Comments included increased driving being proposed in a
zone where there should be less driving, adverse effects from drive-
throughs (increased pollution) , and drive-throughs working against
walkable communities presenting difficulties for pedestrians .
Lorrie Hendricks and Terese Walton spoke in support of the proposal .
Comments included close proximity to the freeway (Redwood Road/North
Temple Street) , neighborhood not as walkable (as Sugar House) due to
location, interested tenants desiring a drive-through, and proposal seen
as a contribution to the community.
Councilmember Johnston said he was in support of the proposed
amendment due to it (transitional between TSA/other zones) being unique
to the City and would not be universally applicable across all TSA zones
within the City.
Councilmember Valdemoros said when the zone was created, drive-
throughs were adamantly prohibited. She said the property had been vacant
for some time, there was difficulty finding tenants, and issues with
vagrancy. She said there was a need to balance that with the need of the
neighborhood, and she trusted the Planning Commissions' positive
recommendation for the proposal .

#6 . 7:39:13 PM Accept public comment and consider adopting an
ordinance that would amend the zoning map pertaining to two (2) parcels
located at approximately 868 East 2700 South Street and 2716 South 900
East Street to rezone those parcels from R-1/7 , 000 (Single Family
Residential District) to R-1/5,000 (Single Family Residential District)
pursuant to Petition No. PLNPCM2016-00577 . The changes would allow the
developer to create five, single-family residential units from the two
properties. Although the applicant has requested that the property be
rezoned to R-1/5, 000 (Single Family Residential District) , consideration
may be given to rezoning the property to another zoning district with
similar characteristics. View Attachments
Judi Short spoke in support of the proposal . She said new single
family affordable housing was needed in Sugar House . She said the
existing home on 900 South would be remodeled (not demolished) , therefore
remaining affordable .
John Blankevoort (hearing card only) submitted written questions :
What was the minimum square footage allowed for this development to build
homes (per lot) , and why were they being allowed to build without
providing parking space .

#1 . 7:42:54 PM Adopting a resolution for project funding allocations
in the Capital Improvement Program (CIP) , which involves the
construction, purchase or renovation of buildings , parks, streets or
other physical structures . Generally, projects have a useful life of

Manufacturing (M-1) pursuant to Petition No . PLNPCM2018-00657 . The

Travis Bird suggested the City organize a Jerry Sloan Day and was
seeking legal information from City Attorneys to build a Jazz Museum.
Soren Simonsen spoke about the historic Jordan River delta (being
a major tributary to the Great Salt Lake) . He said preserving/restoring
habitat along the river and Jordan River watershed (south shore of Great
Salt Lake) from development would be less expensive and more impactful
than to recapture open space with limited ecological integrity after
development. He suggested a new preserve (wet-land/bird refuge) be
considered for the Jordan River for conservation.
UNFINISHED BUSINESS

General Obligation and Refunding Bonds; delegating authority to certain
