12/12/2017 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 12 , 2017 The City Council of Salt Lake City, Utah, met in Formal Session on Tuesday, December 12, 2017 at 7 : 09 p.m. in Room 315, Council Chambers, City County Building, 451 South State. The following Council Members were present: Charlie Luke Andrew Johnston James Rogers Stan Penfold Erin Mendenhall Derek Kitchen Lisa Adams Cindy Gust-Jenson, Council Executive Director; Jacqueline Biskupski, Mayor; Patrick Leary, Mayor' s Chief of Staff; Margaret Plane, City Attorney; and Scott Crandall, Deputy City Recorder; were present. Councilmember Penfold presided at and conducted the meeting. The Mayor and Council expressed their appreciation to Councilmember Adams for her contributions on the Council over the past four years and leadership as the RDA Chair and presented her with a gift . #6 . 7:39:36 PM Recognition of outgoing City Councilmember Stan Penfold, for his service to Salt Lake City District 3 and as 2017 Council Chair. The Mayor and Council expressed their appreciation to Councilmember Penfold for his contributions on the Council over the past eight years and leadership as the Council Chair and presented him with a gift. 17 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 12 , 2017 PUBLIC HEARINGS #1 . 8:16:03 PM Accept public comment for Grant Application: 2017 State of Utah Alcohol and Drug-Free Committee - DUI Enforcement Equipment requesting funds for the purchase of wireless communication systems for motor squad officers to assist with DUI enforcement. View Attachment William Callaway spoke about pursuing efforts to provide free rides to people who were too impaired to drive. He said security for their vehicles/property also needed to be considered. Councilmember Mendenhall moved and Councilmember Adams seconded to close the public hearing and defer action to a future meeting, which motion carried, all members voted aye . (B 17-4) POTENTIAL ACTION ITEMS #1 . 8:18:29 PM Adopting an ordinance for "Growing SLC: A 5 Year Housing Plan" to replace the existing "Salt Lake City Community Housing Plan" pursuant to Petition No . PLNPCM2017-00168 . The plan envisions Salt Lake City as a place where all its residents can find housing that is safe, secure and affordable. The plan outlines goals for creating long- term solutions for increasing the housing supply, expanding housing opportunities throughout the city, addressing systemic failures in the rental market, and preserving existing units. View Attachment Councilmember Mendenhall moved and Councilmember Kitchen seconded to adopt Ordinance 71 of 2017, adopting "Growing SLC: A 5 Year Housing Plan with the following changes: 1 . The City Council' s Guiding Principles for Evaluating and Appropriating City Funds on Housing Developments be inserted into the Housing Plan as Chapter 2, to inform and provide guidance to City officials, the community, developers and all other interested parties of the Council' s criteria that will be considered as they weigh requests for City funding; AND 2 . The changes approved by the Council as outlined in Attachment B, be included in the final draft of the Housing Plan; AND 3 . The following update replace the Accessory Dwelling Unit language for section 1 . 1 . 3 of the Housing Plan on Page 18 : 1 . 1 . 3 Revise the Accessory Dwelling Unit ordinance to expand its application and develop measures to promote its use . Accessory Dwelling Units (ADUs) will contribute to creating a range of housing options . These units , typically 500-600 square feet in size, fit on existing properties, usually behind single-family homes . 17 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 12 , 2017 The production cost on these small, relatively inexpensive units is reduced, because the price of land is removed from the equation. This model also allows for households to accommodate their changing family needs, perhaps housing a student or aging parent. The City will explore and make recommendations on clear internal processes and potential building plans . The revised ordinance should expand the use of ADUs and create design and approval standards that ensures an ADU integrates within the neighborhood; AND 4 . The following clause be included as a "Whereas Clause" in the adopting ordinance: "Whereas the City Council has established "Guiding Principles for Evaluating and Appropriating City Funds on Housing Developments" and included those in the Growing Salt Lake Plan, the City Council intends to both measure the success of the City' s housing efforts and to appropriate funds consistent with those Guiding Principles" . Council Members Mendenhall, Kitchen, and Adams commented on the proposal . They said a lot of effort went into developing the plan and thanked everyone involved. Councilmember Penfold called for the question, which motion carried, all members voted aye . (P 17-30) COMMENTS TO THE CITY COUNCIL 8 :23:12 PM Douglas Cotant thanked Councilmember Adams for her service on the Council . He said he would miss her and wanted their friendship to continue . Councilmember Adams thanked Mr . Cotant for his comments and friendship. The following spoke and/or submitted hearing cards regarding issues relating to police incidents/releasing body-cam footage : William Callaway, Bernie Hart, Cristobal Villegas, Adam Guyman, Jacob Jensen, David Newlin, and Will Griffith. Elinda McKenna, Francesca Ball, Stephen Christian, Adair Kovac, and Mark Barrett submitted hearing cards only. Comments included adding 50 new police officers, additional officers would create more problems, consider needs of those living around Rio Grande, use State assistance for additional doctors to help people overcome their current situations, help people find housing and jobs, implement 24-hour body-cam release policy, unjustified police behavior/shootings, teen suicides, drug overdoses, treat people with compassion/dignity, people freezing on streets, public comment period too short, dire circumstances, more police did not equal less crime, political anger, minority populations, rehabilitation beds, government action, wheelchair accessibility, officer training needed, listening to 17 - 3 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 12 , 2017 constituent concerns, Road Home closure, delay tactics, give community ability to police law enforcement, failure to adopt a reasonable housing policy for 20-years, increase accountability/transparency, define "community oriented policing", prioritize criminal activity, and police officers being the leading source of homicides . Victoria Sethunya spoke about questions/concerns she had regarding Operation Rio Grande, Salt Lake being a sanctuary city, immigrants being turned over to Immigration Enforcement, treatment of victims of medical malpractice, arresting corrupt medical providers, lawsuits, etc. Councilmember Penfold asked Ms . Sethunya to meet with Staff to address her questions . Cindy Cromer spoke and submitted written comments expressing appreciation to Council Members Adams and Penfold for their service on the City Council . She said she would e-mail the balance of her comments to the Council . James Berensen spoke about promises to help the homeless, illegal asset seizures, taxpayer funded bodyguards/chauffer, two-minute rule violating Constitution (still waiting for court case) , wasting taxpayer money, putting tax increases on ballot, and ending corruption. Dave Iltis thanked Council Members Adams and Penfold for their service . He said he was having a difficult time getting answers from Public Utilities regarding lighting issues in the City. He said they were using outdated standards and were unwilling to consider better technology. He asked for assistance from the Council and Administration. Soren Simonsen thanked the Council for adopting the new Housing Plan and Transit Master Plan. He said they were important public policy documents which would help guide future activity in the City. He said he hoped implementation would not be delayed too long. He also thanked Council Members Penfold and Adams for their service on the Council . Billy Palmer, Neighbor Works, thanked the Council for adopting a comprehensive housing policy. He said he looked forward to partnering with the City to address a variety of housing needs, including mixed- income and neighborhoods of choice . He thanked Council Members Penfold and Adams for their service . Lex Scott and Ameer Cornell were not available when called to speak (no comments on hearing cards) . NEW BUSINESS 17 - 4 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 12 , 2017 #1 . 9:04 :46 PM Adopting a resolution extending the time period for satisfying the conditions set forth in Ordinance 56 of 2016 pursuant to Petition No . PLNPCM2015-00438 . The proposal would extend the deadline by two years for the property owner to meet certain conditions listed in the 2016 ordinance. The original ordinance was a result of the property owner 's request to close and vacate a portion of West Capitol Street adjacent to properties located at approximately 686 and 690 North West Capitol Street . View Attachment Councilmember Adams moved and Councilmember Luke seconded to adopt Resolution 36 of 2017 extending the time period for satisfying conditions set forth in Ordinance 56 of 2016 by two years, to December 16, 2019, which motion carried, all members voted aye . (P 16-15) UNFINISHED BUSINESS #1 . 9:05:28 PM Adopting an ordinance amending a section of the Salt Lake City Zoning Ordinance to include the Utah Jazz practice facility located at 1432 South 500 West into a localized alternative sign overlay district pursuant to Petition No . PLNPCM2017-00407 . If approved, the overlay would allow the applicant to install signage that would otherwise not meet the basic standards of the existing zoning. The Planning Commission forwarded a negative recommendation, however the applicant has requested the Council consider the request. In September, the Council adopted changes requested by the same applicant to the sign overlay district for the Vivint arena block. Petitioner: Larry H. Miller Arena Corporation . (P 17-25) #2 . 9:05:32 PM Adopting a resolution authorizing the waiver of fees associated with the construction of the Salt Lake County Health Department' s new Salt Lake City Public Health Center located at 610 South 200 East (Public Benefits Analysis) . View Attachment Councilmember Adams moved and Councilmember Kitchen seconded to decline the request to waive permit fees for the new Public Health Center, on the basis that the City and County have a long established process for cost allocation to cover each entity' s costs, and to avoid confusion for taxpayers and other permit applicants , which motion carried, all members voted aye . (R 17-11) CONSENT 9:0 6:2 7 PM 17 - 5 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 12 , 2017 Councilmember Luke moved and Councilmember Rogers seconded to adopt the Consent Agenda, which motion carried, all members voted aye . #1 . Setting the date of Tuesday, January 9, 2018 at 7 : 00 p.m. to accept public comment on the proposed project area plan for the Northwest Quadrant Project Area Creation Plan (Community Redevelopment Area) (CRA) . Setting the date of Tuesday, January 9, 2018 at 7 : 00 p.m. to accept public comment regarding development agreements with property owners in the Northwest Quadrant. The purpose of the development agreements would be to vest the property owners in current land use and create a process for future tax increment reimbursement requests.
