TUESDAY, DECEMBER 2 , 2014
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, December 2, 2014 at 7 : 30 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State.
The following Council Members were present:
James Rogers Luke Garrott Kyle LaMalfa
Erin Mendenhall Lisa Adams Charlie Luke
Stan Penfold
Cindy Gust-Jenson, Executive Council Director; David Everitt,
Mayor' s Chief of Staff; Margaret Plane, City Attorney; and Beverly
Jones, Deputy City Recorder; were present.
Councilmember Luke presided at and conducted the meeting.
OPENING CEREMONY
#1 . 7 : 31 :52 PM Pledge of Allegiance.
#2 . 7 :32 : 16 PM Councilmember Mendenhall moved and Councilmember
Garrott seconded to approve the minutes of the Work Session meeting
held November 18, 2014, which motion carried, all members voted aye.

#3 . 7 : 32 : 35 PM Approving a resolution supporting "We the People
Amendment" to the United States Constitution.
This item was pulled from the agenda. Councilmember Luke said the
resolution would be read next week.
PUBLIC HEARINGS
#1 . RE : 7 : 32 : 50 PM Accept public comment and consider adopting an
ordinance amending Ordinance 48 of 2014 which adopted the final budget
of Salt Lake City, Utah, for the Fiscal Year beginning June 1, 2014
and ending June 30, 2015. Budget amendments happen several times each
year to reflect adjustments to the City's budgets, including proposed
project additions and modifications. This amendment contains a number
of proposed adjustments to the Fiscal Year 2014-15 Budget, including
funding for:
• staff to handle increased installation of fiber networks in the
City,
• conversion of additional City fleet to electric vehicles,
• a program to harvest fruit from local fruit trees,

• maintenance of protected bike lands; and
• purchase of unused golf course property to be maintained as open

The following spoke or submitted hearing cards on the budget
amendment: Steve Sayer, Karen Major, David Jones, and Terri Holbrooke
opposed opening the Library 24/7 . Nicole Warren, Principal at Rose
Park Elementary, Angela Wright, YMCA, and Michael Williams,
Development Office at the Salt Lake City School District, thanked the
Council for funding the track project at Rose Park Elementary. Blake
Perez thanked the Council for the opportunity to develop the Rose Park
Fitness Plaza. George Chapman opposed the fire station on Forest Dale
Golf Course, the walking patrols on Gateway private property, and
favored opening the library 24/7 . Brent Dalton said he favored
increased police force in the Gateway area. Lynnae Larsen-Jones said
she opposed the fire station at Forest Dale Golf Course .
Councilmember Penfold moved and Councilmember LaMalfa seconded to
close the public hearing and defer to a future date.
7 : 49 : 39 PM Councilmember Garrott made a substitute motion to keep
the public hearing open until next week. There was no second.
Councilmember Luke called for the question on the original
motion, which motion carried, all members voted aye except
Councilmember LaMalfa who voted nay.

POTENTIAL ACTION ITEMS
#1. RE: 7 :50 :23 PM Adopting an ordinance approving the West Salt
Lake Master Plan pursuant to Petition No. PLNPCM2010-00656 . The plan
has been updated to reflect the evolution of transportation, land use,
and sustainability in the area south of Interstate 80 from Interstate
215 on the west to Interstate 15 on the east . The updated plan lays
out the vision, goals, and policies for the area, including:
• encouraging reinvestment and redevelopment,
• protecting ongoing investment in low-density residential
neighborhoods while incorporating high-density development; and
• making West Salt Lake a destination for outdoor recreation.

Councilmember LaMalfa moved and Councilmember Rogers seconded to
adopt Ordinance 69 of 2014 regarding the West Salt Lake Master Plan
pursuant to Petition No. PLNPCM2010-00656 including the proposed
changes outlined in the Council staff report attached as the

transmittal and move that the Council amend the name of the West Salt
Lake Master Plan to the Westside Master Plan.
7 :51: 08 PM Councilmember Garrott spoke to the motion.
7 :52 :51 PM Councilmember LaMalfa said this petition had been in
the works for four years . He said this was a positive plan driven by
citizen input that would provide direction for future development of
the Westside . He said the master plan would be compatible with the
City' s future needs .
Councilmember Luke called for the question, which motion carried,
all members voted aye .

#2 . RE : 7 : 55 : 46 PM Adopting a resolution approving Capital
Improvement Program allocations for Fiscal Year 2014-15, which were
included within the 2014-15 Fiscal Year Budget. View Attachments
Councilmember Garrott moved and Councilmember Adams seconded to
adopt Resolution 27 of 2014 approving Capital Improvement Allocations
for Fiscal Year 2014-15 in the attached schedule and confirming the
conditions of approval as set forth in the motions adopted on October
21, 2014, which motion carried, all members voted aye.

COMMENTS TO THE CITY COUNCIL 7 : 56 : 48 PM (Comments are taken on any
item not scheduled for a public hearing, as well as on any other City
business. Comments are limited to two minutes)
Lourdes Cooke thanked the Council for the creation of Yalecrest-
Harvard Park Local Historic District. George Chapman said there should
be a separate letter from Salt Lake City to the League of Cities and
Towns . Polly Hart said the last few months animal services had started
issuing leash infractions as criminal tickets . She said according to
the ordinance, animal officers still had the option of giving a
warning, a simple infraction ticket, or a misdemeanor ticket. She said
if enforcement officers gave a ticket it had to be criminal and was
automatically a Class B misdemeanor which involved a $1, 000 fine and
six months in prison. Hilary Jacobs said she was in Memory Grove on
Saturday and a man playing with his dog received a ticket and had to
pay a $400 fine. Simon Arop Gowad submitted a hearing card (no
subject) but did not wish to speak.

#1 . RE: 8 : 03 : 51 PM Adopting a resolution authorizing not more
than $19,500,000 General Obligation Refunding Bonds; delegating
authority to certain officials and officers of the City; and providing
for related matters . View Attachments
Councilmember Garrott moved and Councilmember Penfold seconded to
adopt Resolution 28 of 2014, which motion carried, all members voted
aye .

#2 . RE: 8 : 04 : 36 PM Adopting an ordinance amending the Salt Lake
City Code relating to DNA testing of sexual assault evidence
collection kits (amending article IV of Chapter 2 . 10) . If adopted the
proposed ordinance would:
• Require all sexual assault evidence collection kits obtained
before November 1 , 2014 be submitted to a qualified lab for DNA
testing within three years from the date of adoption.
• Require all sexual assault evidence collection kits obtained
after November 1, 2014 be submitted to a qualified lab for DNA
testing, with the lab determining how many and which samples to
test based on their professional judgment and protocols.
• Require the police department to report on performance measures
as part of the annual budget process. View Attachments
Councilmember LaMalfa moved and Councilmember Garrott seconded to
adopt Ordinance 70 of 2014 enacting Article 5 of Chapter 2 . 10, Salt
Lake City Code, pertaining to DNA testing with the following changes;
that Section 2 . 10 . 160A, include the date of June 2 , 2015 for the
establishment of procedures regarding collection and testing of DNA
evidence and sexual offenses occurring in the City and that Section
2 . 10 . 170 require implementation of testing procedures set forth in
Section 2 . 10 . 160 by the date of August 2 , 2015 .
8 : 05 : 17 PM Councilmember LaMalfa said this would increase justice
for victims of sexual assault . He said the Council set out to fund a
comprehensive approach to DNA testing and to train officers and others
on how to better approach victims of sexual assault . He said they set
out to audit the system to try and help victims at each stage of the
process .
8 : 08 : 19 PM Councilmember Garrott said this was not within the
Council' s traditional bailiwick. He said they tended to think they had
to deal with pot holes, parks, etc . but justice should be number one
on the Council' s list of items pursued for the citizenry.

Councilmember Garrott called for the question with a roll call
vote . Council Members Adams, Mendenhall, Garrott, Penfold, LaMalfa,
Rogers, and Luke voted aye .

CONSENT AGENDA 8 : 09 : 33 PM
Councilmember Garrott moved and Councilmember Penfold seconded to
adopt the Consent Agenda with a correction on Item H-4 where the date
changes from January 6, 2014 to January 6, 2015 , which motion carried,
all members voted aye .
#1. RE: Approving the appointment of Jana Ostler to the Library
Board for a term extending through June 30, 2017 .

#2 . RE: Approving the appointment of Lucy E. Hansen and Landon A.
Allred to the Sugar House Park Authority Board for a term extending
through October 10, 2018 .

#3 . RE: Confirming the date of Tuesday, December 9, 2014 at 7 : 00
p.m. to accept public comment and consider approving a resolution
adopting the 2014 Water Conservation Master Plan as required by
Section 73-10-32 of the Utah Code to be filed with the Utah Division
of Water Resources . This plan is the fourth update under this Utah

#4 . RE: Confirming the date of Tuesday, January 6, 2015 at 7 : 00
p.m. to accept public comment and consider adopting an ordinance
amending various fees set forth in the Salt Lake City Consolidated Fee
Schedule. Proposed changes to the Consolidated Fee Schedule include
