12/07/2007 - Minutes (2) SALT LAKE VALLEY SOLID MANAGEMENT FACILITY FEE EXEMPT POLICY AND GUIDELINES UPDATED NOVEMBER 2007 1. All governmental agencies, i.e. federal, state, county, municipal, special districts and school districts shall be charged. These governmental bodies have their own revenue sources and will be charged the appropriate disposal fee to dispose of their waste at the landfill. 2. Exemptions for disposal fees may be granted for one time community service projects on publicly owned land if a written request for exemption is made seven days in advance to the Landfill Manager/Executive Director of the Salt Lake Valley Solid Waste Management Facility. Only refuse collected from public property located within the boundaries of Salt Lake City or Sal Lake County is eligible for a fee exemption. Approval by the Salt Lake Valley Solid Waste Management Council is not necessary in such instances. The Landfill Manager/Executive Director has the responsibility to make the determination. Upon written request the Landfill Manager/Executive Director may waive the fee or authorize a reduced fee for one-time cleanup projects in the general public interest organized by non-profit groups such as scout troops, churches or other volunteer organization. The Landfill Manager/Executive Director may authorize the donation of compost, mulch, or wood chips for community service projects not to exceed 10 tons per project upon written request. The Executive Director will provide a quarterly report to the Solid Waste Management Council on all compost, mulch and wood chip donations. A file will be maintained of all written requests together with the response. 3. Requests for an annual standing exemption for a governmental agency, church or charity, non-profit organization, or any other user of the Landfill may be made to the Solid Waste Management Council at the regularly scheduled meeting in October, except for 2008 requests; 2008 requests must be submitted before January 15, 2008. Solid Waste/Landfill staff shall make a recommendation to the Council in its regularly scheduled meeting in November. Recommendations for fee exemptions for 2008, however, will be recommended by staff at the first Solid Waste Management Council meeting in February of 2008. Upon receipt of the staff recommendation, the Council will make a decision in the November meeting with the exception of 2008 when the decision will be made in February of 2008 on the request. An annual standing exemption will only be issued to organizations that accept donations from the public, and then refurbish the articles making them available to the public for free or at a deeply discounted price. Their efforts assist in the collection and restoration of items that would normally be in the waste stream coming to the landfill. A maximum of 10,000 tons will be accepted under an annual fee exemption in 2008, 9,000 tons in 2009, and 8,000 tons thereafter. All tons exceeding the maximum fee exemption in any year will be charge at actual cost. A list of exempt organizations will be maintained in the Solid Waste management Facility Division office as an attachment to this policy. 4. An exemption for disposal may be granted to an on-site contractor for work at the landfill as approved by the Landfill Manager/Executive Director. 5. An exemption may be granted to the lessor of landfill property should such a provision be included in the lease. 6. In the event of a natural disaster, a state of emergency, or other circumstance requiring immediate disposal and disregard of weighing procedures, the Council Chairman may suspend or totally exempt particular entities from disposal fees at the Landfill.
