SPECIAL WORK SESSION MEETING
TUESDAY, FEBRUARY 28 , 2018
The City Council met in a Special Work Session on Tuesday, February
28, 2018, in Room 326, Committee Room, City County Building, 451
South State Street.
In Attendance: Council Members James Rogers, Andrew Johnston,
Derek Kitchen, Erin Mendenhall, Charlie Luke, and Amy Fowler.
Absent: Councilmember Chris Wharton

Councilmember Mendenhall presided at and conducted the
meeting.
The meeting was called to order at 12 : 46 p.m.
AGENDA ITEMS

Councilmember Mendenhall said the purpose of the meeting was
to review proposed State Legislation which would take away a core
City function (land use authority) in the Northwest Quadrant (NWQ) .

She said the proposed Bill would create a governance board with
board authority and limited City participation. She talked about
accountability of City officials . She said officials elected by
City residents would not have a final say on critical land use
decisions for more than 24, 000 acres of City property (more than
1/3 of the City) . She elaborated that for two years the City had
been working in good faith with the State and private property
owners to develop an infrastructure back bone to serve both the
new prison and allow for expansion into a business area, enacted
a master plan, determined zoning, and established a Redevelopment
Project Area. She declared the City would continue to work with
the State to create appropriate legislation which respected local
control and kept development moving forward.
Laura Fritts and Nick Norris briefed the Council . Comments
included reflection on the past two years of work the City had
completed preparing for development opportunities in the NWQ,
Senate Bill 234 regarding proposed changes to Utah Inland Port
Authority State Code, potential affects to land use in the NWQ
(particularly appeal authority) , proposed provisions for economic
development tax increment, and foreign trade zone proposals .
Discussion was held regarding tax increment regulated by the
State and current land-use appeals process and comparison to the
proposed appeals process .
Council Members requested the following item from Staff:
• Provide a count of current businesses and private land owners
in the affected area.

KEEPING WITH UTAH CODE §52-4-205 FOR ANY ALLOWED PURPOSE.
Councilmember Luke moved and Councilmember Rogers seconded to
enter into Closed Session to discuss Attorney-Client matters that
are privileged pursuant to Utah Code §78B-1-137, and for other
lawful purposes that satisfy the pertinent requirements of the
Utah Open and Public Meetings Act. A roll call vote was taken.
Council Members Rogers, Luke, Fowler, Johnston, Kitchen, and
Mendenhall voted aye. See File M 18-1 for Sworn Statements .
In Attendance: Council Members Mendenhall, Luke, Johnston, Fowler,
Rogers, and Kitchen.
Absent: Councilmember Chris Wharton.
