TUESDAY, FEBRUARY 3 , 2015
The City Council of Salt Lake City, Utah, met in Regular Session on
Tuesday, February 3, 2015 at 7 : 00 p.m. in Room 315, Council Chambers,
City County Building, 451 South State .
The following Council Members were present:
Charlie Luke Stan Penfold Luke Garrott Lisa Adams
James Rogers Kyle LaMalfa Erin Mendenhall
Cindy Gust-Jenson, Executive Council Director; David Everitt,
Mayor' s Chief of Staff; Margaret Plane, City Attorney; and Scott
Crandall, Deputy City Recorder; were present.
Councilmember Garrott presided at and Councilmember Mendenhall
conducted the meeting.
OPENING CEREMONY

#2 . 7:10:13 PM Councilmember Adams moved and Councilmember Luke
seconded to approve the minutes of the following Salt Lake City
Council meetings , which motion carried, all members voted aye .

PUBLIC HEARINGS
#1. 7:12:14 PM Accept public comment and consider adopting an
ordinance amending the City' s building height standards in the FB-UN2
Form Based Urban Neighborhood District pursuant to Petition No.
PLNPCM2014-00085 . The proposal would enable a developer to build a
multi-family residential building up to five stories with a maximum
height of 65 feet on property located on the northwest corner of 200
West Fayette Avenue. Currently, regulations limit building height to
four stories with a maximum height of 50 feet. (Petitioner - Michael

submitted written comments in favor of the proposal .
Councilmember Garrott moved and Councilmember Rogers seconded to
close the public hearing and defer action to a future meeting, which
motion carried, all members voted aye .

#2 . 7 :15:46 PM Accept public comment and consider adopting an
ordinance amending the Salt Lake City Code relating to newsracks in
the public right-of-way (amending Chapter 14 . 36, Newsracks, and the
Consolidated Fee Schedule) pursuant to Petition No . PLNPCM2012-00793 .
The proposed ordinance would increase licensing fees for newsracks and
would make the City's Property Manager responsible for reviewing
permits and enforcing the newsrack ordinance. Currently, the City's
Zoning Administrator is responsible. (Petitioner - Mayor Ralph Becker)

Larry Carter said there were conflicting documents regarding
proposed fees and asked for clarification . Councilmember Garrott asked
Council staff to work with Mr . Carter .

policies, preserve all courses, self-funding standards, golf task
force recommendations, keep courses accessible to everyone, golf
provides life lessons, include/promote disc golf, quality of life
issues, expand golf tournaments, courses are community assets,
cultivates friendships, health issues/exercise, wildlife habitats,
benefit to charities, affordability/accessibility, citizen gathering
place, provide multiple recreational activities, open space
preservation, infrastructure investment, Golf Alliance for Utah, golf

contributes to vibrant neighborhoods, potential land development,
social/financial benefits, golf course branding, confusion about
revenue losses, rate increases, efficient water systems/secondary
water, investigate why other courses are successful, indoor golf
simulators, build/lease restaurants, explore revenue enhancements,
build youth programs/golf tourism, large capital investment needed,
open space bonding, self-sustaining courses, return golf to
professionals, other recreational opportunities subsidized by the
City, return golf to the General Fund, privatize some courses, provide
other open space activities, First Tee programs, fill unused tee
times, marketing ideas, sell more annual passes, add more value to
annual passes, reduce cart fees, deferred maintenance, event center
concept, future population growth/demand, provide green corridor along
Jordan River, incentives/discounts, sell/develop Bonneville, revisit
consultant' s findings, support golf professionals/superintendents,
discount fees for disabled, family sport, promote golf leagues, and
transfer Wingpointe to the Airport.
Councilmember Penfold moved and Councilmember Luke seconded to
close the public hearing, which motion carried, all members voted aye.
8:51:45 PM Councilmember Garrott explained the timetable for future
action and invited public participation through e-mail, phone, Open
City Hall, etc.

COMMENTS TO THE CITY COUNCIL 8:56:13 PM
George Chapman said the Mayor attend the Clean Air Utah Rally but
continued to support Stericycle through customers like the Airport,
Police Department, and University of Utah and asked the Mayor to do
something about that.
Douglas Cotant spoke about the memorial service for Sergeant Cory
Wride and the need to enhance law enforcement vehicles with bullet
proof materials .
Hank Williams spoke about the Harvard Avenue local historic
district application which was withdrawn. He said problems with the
process needed to be addressed for future applications such as better
public meeting notification, clear intent statement about the
proposal, and potential impacts to neighborhoods .
Soren Simonsen said there was a group of interested residents who
wanted to meet with Planning to work through some issues (including
housing) relating to the Sugar House Streetcar Corridor Master Plan
proposal . Councilmember Garrott said the Council discussed a third
type of housing during the Work Session and suggested Mr. Simonsen
inquire with Planning about how they understood the Council' s
direction. Mr. Simonsen said his group had been unsuccessful in
numerous attempts to arrange a meeting with Planning over the past
eight months and asked for the Council' s help.
Joe Zeidner spoke about the Mayor' s 5000 DOORS proposal . He said
his daughter was disabled and asked the Council to support housing
opportunities and mixed-use neighborhoods .
Kathryn Casull submitted a hearing card with no comments .
UNFINISHED BUSINESS
#1. 9:08:15 PM Adopting a resolution authorizing a loan totaling
$750, 000 from the City' s Housing Trust Fund to NeighborWorks . The loan
would be used to develop affordable housing and rehabilitate qualified
homes. NeighborWorks is a non-profit organization that creates
affordable housing and rebuilds neighborhoods. View Attachments
Councilmember Rogers moved and Councilmember Garrott seconded to
adopt Resolution 3 of 2015.
9:08:39 PM Councilmember LaMalfa expressed concern that the City
had been lending/concentrating low-income people in the same

neighborhoods for the past forty years and asked Council Members, in
conjunction with the resolution, to support housing opportunities for
residents and support helping the community advance to a place where
opportunities would abound.
9:14:52 PM Councilmember Garrott said there were outlets to address
Councilmember LaMalfa' s concerns including Council discussions about
how to reshape the City' s housing policies .
Councilmember Mendenhall called for the question, which motion
carried, all members voted aye .

#2 . 9:16:00 PM Adopting a resolution authorizing a loan totaling
$265, 000 from the City' s Housing Trust Fund to Shelter the Homeless.
The loan would be used to renovate a 32-unit permanent supportive
housing apartment building at 204 West 200 North. Shelter the Homeless
is a non-profit organization created by the Road Home that provides
affordable housing options for individuals and families experiencing
long term homelessness. View Attachments

adopt Resolution 4 of 2015, which motion carried, all members voted
aye .

Councilmember Penfold moved and Councilmember Garrott seconded to
adopt the Consent Agenda, with the exception of Item H1 which would be
rescheduled to a future meeting, which motion carried, all members
voted aye .
#1. Confirming the public hearing date of Tuesday, February 24,
2015 at 7 : 00 p.m. to accept public comment and consider adopting an
ordinance amending the Sugar House Master Plan, amending the zoning
ordinance to create Streetcar Corridor form-based zoning districts,
and amending the zoning map to show locations of FB-SC (form-based
streetcar core) and FB-SE (form-based streetcar edge) zoning districts
pursuant to Planning Petitions Nos . PLNPCM2012-00576 and PLNPCM2012-

the City' s special events permitting process . The proposal would make
the City's regulations more succinct; provide clarity about what
constitutes small and large events; and creates a category for
grandfathered events. Grandfathered events are those that have been
held at the same location on the same date for three years or more and
