TUESDAY, JANUARY 2 , 2018
The City Council met in Work Session on Tuesday, January 2, 2018,
in Room 326, Committee Room, City County Building, 451 South State
Street.
In Attendance: Council Members James Rogers, Andrew Johnston,
Chris Wharton, Derek Kitchen, Erin Mendenhall, Charlie Luke, and
Amy Fowler.
Staff in Attendance: Cindy Gust-Jenson, Council Executive
Director; Jennifer Bruno, Council Executive Deputy Director;
Jacqueline Biskupski, Mayor; Patrick Leary, Mayor' s Chief of
Staff; David Litvack, Mayor' s Deputy Chief of Staff; Lynn Pace,
Mayor' s Senior Advisor; Nick Tarbet, Council Senior Policy
Analyst; Orin Goff, Building Services Building Official; Michaela
Oktay, Planning Manager; Kelsey Lindquist, Principal Planner;
Melissa Jensen, Housing and Neighborhood Development Director;
Sean Murphy, Housing and Neighborhood Development Project and
Policy Manager; Mary Beth Thompson, Finance Director; Margaret
Plane, City Attorney; Lara Fritts, Economic Development Director;
Lisa Shaffer, Public Services Director; Samantha Slark, Senior
City Attorney; Laura Briefer, Public Utilities Director; and Kory
Solorio, Assistant City Recorder.
Council Members Luke and Mendenhall presided at and conducted
the meeting.
The meeting was called to order at 4 : 06 p.m.
AGENDA ITEMS
#1 . 4:06:17PM NOMINATION OF COUNCIL CHAIR AND VICE CHAIR FOR
CALENDAR YEAR 2018 . The Council will take a straw poll to nominate
the Council Chair and Vice Chair for calendar year 2017.
Councilmember Mendenhall was nominated for Council Chair and
Councilmember Wharton was nominated for Council Vice-Chair.
Councilmember Luke said the nominations would be ratified during
the formal meeting.
#2 . 4:22:10PM BRIEFING REGARDING AN ORDINANCE AMENDING THE
CITY' S REGULATIONS FOR PROPERTY CLEARING AND WEED CONTROL,
INCLUDING ENFORCEMENT OF VIOLATIONS. The changes include clearer
language on the noticing of the City's intent to abate zoning
violations, collection of the costs of abatement, the appeals
process and the duties and roles of the Fines Hearing Officer.

Discussion was held regarding what prompted the amendments, Civil
Enforcement ability/process to issue tax liens, and how a tax lien
notice differed from a delinquent fine notice .
#3 . 4:29:41 PM BRIEFING BY THE ADMINISTRATION REGARDING
INCLUSIONARY ZONING. Inclusionary zoning refers to local land use
ordinances that require or encourage developers to include
affordable units in new residential developments. View Attachments
Nick Tarbet, Melissa Jensen, and Sean Murphy briefed the
Council with attachments . Discussion was held regarding how
Inclusionary Zoning programs with the highest success were
defined, cities loosing growth due to Inclusionary Zoning,
analysis of Inclusionary Zoning, shortage of housing stock, how to
address concerns in the development community, stunting growth of
affordable housing, similar size cities with Inclusionary Zoning,
Utah specific funding sources, potential of fast-tracking permits
as a viable incentive, and impacts to Staff time.
Councilmembers requested the following items from Staff:
• Consult with a housing economics expert to prevent stunting
housing growth.
• Feedback on how other cities worked with major employers to
create affordable housing.
• Consider the impacts of fast-tracking permits .
• Consider the impact to Staff time.
• Consider under-zoned areas in the City ready for more intense
development.
#4 . 5:26:43 PM BRIEFING REGARDING BUDGET AMENDMENT NO. 3 FOR
THE FISCAL YEAR 2017-18 BUDGET. Budget amendments happen several
times each year to reflect adjustments to the City's budgets,
including proposed project additions and modifications. The
proposed amendment includes $300, 000 to address the need for a
lighting system replacement at the City-owned Smith 's Ballpark.

maintenance and capital costs, funding maintenance of all City
facilities/buildings going forward, and potential of a facilities
fee.
Council Members requested the following items from Staff:
• Consider establishing a sufficient revenue source to cover
maintenance and capital expenses .
• Consider policy direction for ongoing maintenance and capital
costs for City buildings (especially those with commercial
uses) .
• Consider policy to include a facilities fee in ticket prices .
#5 . 5:44:43 PM BRIEFING REGARDING THE TIMELINE, GOALS, AND
PROGRESS OF ECONOMIC DEVELOPMENT EFFORTS IN THE CITY' S NORTHWEST
QUADRANT. View Attachments
David Litvack, Lynn Pace, Lara Fritts, and Laura Briefer
briefed the Council with attachments . Discussion was held
regarding infrastructure redundancy concerns, Trax extension costs
to the International center and Northwest Quadrant, and City
estimated costs for infrastructure.

#6 . 6:04:44PM REPORT OF THE EXECUTIVE DIRECTOR, INCLUDING A
REVIEW OF COUNCIL INFORMATION ITEMS AND ANNOUNCEMENTS. The Council
may give feedback or staff direction on any item related to City
Council business, including but not limited to scheduling items.

#7 . REPORT OF THE CHAIR AND VICE CHAIR.
No discussion was held.
#8 . CONSIDER A MOTION TO ENTER INTO CLOSED SESSION, IN KEEPING
WITH UTAH CODE §52-4-205 FOR ANY ALLOWED PURPOSE .
