07/19/2016 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JULY 19, 2016 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, July 19, 2016 at 7 : 06 p.m. in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present: Charlie Luke Stan Penfold Derek Kitchen James Rogers Andrew Johnston Erin Mendenhall The following Councilmember was absent: Lisa Adams Cindy Gust-Jenson, Executive Council Director; Patrick Leary, Mayor' s Chief of Staff; Margaret Plane, City Attorney; Laura Briefer, Public Utilities Director; and Kory Solorio, Assistant City Recorder; were present. Councilmember Rogers presided at and Councilmember Penfold conducted the meeting. (M 16-4) POTENTIAL ACTION ITEMS #1. 7:08:23 PM Adopting an ordinance amending the Zoning Map to establish the Yalecrest-Harvard Heights Local Historic District for properties located on Harvard Ave between 1300 East & 1500 East pursuant to Petition No. PLNHLC2015-00032 (Petitioners : Amy and Cory Reid) . View Attachments Councilmember Luke moved and Councilmember Mendenhall seconded to adopt Ordinance 47 of 2016 amending the Zoning Map to establish the Yalecrest - Harvard Heights Local Historic District, which motion carried, all members present voted aye . (P 16-19) 16 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JULY 19, 2016 #2 . 7 :08 :58 PM Adopting an ordinance amending the Zoning Map pertaining to several parcels located at approximately 1932 North 2200 West Street to rezone those parcels from Agricultural (AG-2) to Business Park (BP) pursuant to Petition No. PLNPCM2016-00007 . The parcels total 18. 39 acres, and neighboring properties currently have BP zoning. Although the applicant has requested that the properties be zoned to BP Business Park, consideration may be given to rezoning the properties to another zoning district with similar characteristics (Petitioner - Jeff Beck) . View Attachments Councilmember Rogers moved and Councilmember Kitchen seconded to adopt Ordinance 48 of 2016 amending the Zoning Map for parcels located at approximately 1932 North 2200 West Street from Agricultural (AG-2) to Business Park (BP) . Councilmember Rogers further moved the Council adopt a legislative intent initiating a review of the zoning map for properties located on 2200 West, between North Temple and 2100 North, to consider rezoning those parcels to Light Manufacturing (M-1) . The intent is for the Administration to review the current zoning to determine if rezoning these properties to Light Manufacturing (M-1) would be more appropriate and help maximize economic development along this corridor. Councilmember Rogers spoke to the motion. He stated the reason for the legislative intent was to maximize opportunities for economic growth of City property which abuts the Airport . He said this would keep applications for rezoning from occurring as entities came into the area. Councilmember Kitchen said he believed this area of town needed economic investment . Councilmember Penfold called for the question, which motion carried, all members present voted aye . (P 16-18) QUESTIONS TO THE MAYOR FROM THE COUNCIL 7 :10:48 PM Councilmember Rogers asked when the housing policy transmittal would be presented to the Council . Mr . Leary stated the transmittal was received in his office and would be forwarded to the Council in time for discussion at the August 9, 2016 Council meeting. Councilmember Johnston asked if there was an update from the Administration on the current algae bloom and contamination . Mr . Leary asked Laura Briefer, Public Utilities Director, to update the Council regarding the current algae bloom. 16 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JULY 19, 2016 Ms . Briefer stated elevated levels of the Harmful Algae Bloom (HAB) were discovered last week in Utah Lake which was closed to public recreation/use by the Utah County Health Department. She indicated HAB was harmful because exposure to the bacteria and potential toxins released by these bacteria was a public health concern. She reported samples had been detected with elevated levels in the Jordan River and precautions had been taken throughout Salt Lake County restricting public access . Ms . Briefer stated the City' s drinking water sources were not impacted by the situation. Councilmember Luke asked if other tributaries in the City that feed into the Jordan River were being tested. Ms . Briefer indicated other tributaries in the City included City Creek, Parley' s Canyon, and Red Butte Stream. She said the Jordan and Salt Lake Canal was a discharge point for Utah Lake water into the systems where pipes being, with the exception of Liberty Park Pond. She said Liberty Park Pond may have received some mixture of Utah Lake water. Ms . Briefer stated the Liberty Park Pond area was closed and samples were being tested. Councilmember Luke indicated the Rose Park and Glendale Golf Courses used canal or Jordan River water as secondary water sources . He asked if they had been switched over to a culinary water source . Ms . Briefer indicated that they had been switched to culinary water. Councilmember Kitchen asked what had caused the HAB. Ms . Briefer said there were a number of conditions that needed to be in place in order for this type of algae to grow: warmer water temperatures, still water, a lack of mixing of the water with wind or storms, Utah Lake currently at historically low levels, the potential for nutrients to come into water ways, nitrogen and phosphorus typically found in agricultural, urban run offs, and sometimes waste water. She stated there was information on the potential cause of HAB on the State Department of Environmental Quality website . Councilmember Kitchen asked if this attributed to local global warming. Ms . Briefer said a water quality incident such as this and looking at the impacts of climate change with increased air temperatures and increased minimum water temperatures could be something that potentially attributes to the effects of climate change . Councilmember Kitchen asked if systemic changes needed to be made . Ms . Briefer said she believed there was a concept of integrated water management which was tying together this water supply/water quality scenario planning for climate change or climate variations . 16 - 3 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JULY 19, 2016 She said there were a number of strategies to prepare for something like this . She explained the biggest strategy the City had in place was the Watershed Protection which could be translated across the system. She indicated the community needed to come together and look at cause and effect, the policies in place, and the technology behind the situation to assess what could be done in the future. Councilmember Johnston asked if fishing and farming off the Jordan River were affected by the HAB. Ms . Briefer said the State Department of Agriculture had issued warnings to the agricultural community regarding application of this water on crops/produce and warnings/cautions related to fishing. She indicated precautionary measures were being taken to protect public health. Mr. Leary added that people along the river were being notified including homeless people and refugees who may be fishing. He said City networks were being used aggressively to get the word out to communities that might not get the word through regular channels . Councilmember Rogers asked if that included individuals who have property rights to the Jordan River. Ms . Briefer said she did not know but would find out if those individuals had been notified. Councilmember Johnston asked if there was a time frame for reopening the Liberty Park Pond and about the overall system. Ms . Briefer indicated the Liberty Park Pond was no longer pulling any Utah Lake water. She said part of the Jordan and Salt Lake Canal were currently being flushed and samples were being collected with a two day turnaround time for results . Ms . Briefer stated the overall HAB situation was being questioned throughout the Salt Lake Valley. She said at this time it does not appear the HAB has dissipated but it could be affect by weather conditions . She reported the weather forecast for the next week did not have any weather systems moving in. Ms . Briefer reported the City was gearing up to manage the situation for the next couple of weeks or possibly longer. Councilmember Mendenhall addressed the Administration. She expressed concern with the refugees who find food by fishing in the Jordan River. She said because there was not a direct path to get communications to that population she wondered if the City would be able to offer a food subsidy in the mean time . Mr. Leary stated he would follow through with Councilmember Mendenhall' s request . Councilmember Penfold acknowledged/welcomed Robert Lochead, Leavitt Institute for International Development Deputy Director, and a group of law students visiting from the Republic of Moldova who were here on an internship observing the judicial system. 16 - 4 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JULY 19, 2016 COMMENTS TO THE CITY COUNCIL 7 :27 :06 PM Douglas Cotant commented about problems he had experienced at the New Grand Hotel and hoped the City could investigate the matter. Cindy Cromer commented on a revised version of remarks she made in 2013 regarding development rights and development agreements . View Comments Senator Karen Mayne thanked the Council for their help regarding her previous request for more bus routes in Salt Lake City and Salt Lake County. She explained the history of a resolution she produced which was passed by the Utah State Legislature to encourage procurement of Utah workers and firms for building the prison . She said she would present this same legislation to her colleagues after the first of the year regarding Airport redevelopment . She encouraged the Council to look at the resolution and hoped they would recognize Salt Lake City' s authority over the Airport redevelopment . View Comments Councilmember Penfold asked Staff for follow-up regarding previous language which was drafted around procurement and preference to local firms and workers . NEW BUSINESS #1 . 7 :34 :18 PM Adopting an ordinance amending the Salt Lake City Code to reflect numerous organizational changes within the City' s Administration, including the renaming of the former "Community and Economic Development Department" . The department will be renamed "Community and Neighborhoods". View Attachments Councilmember Luke moved and Councilmember Kitchen seconded to adopt Ordinance 49 of 2016 amending various sections of the City Code to reflect the correct department names in conjunction with the changes made during the adopted annual budget, which motion carried, all members present voted aye . (0 16-11) #2 . 7 :34 :48 PM Adopting an resolution authorizing the approval of an Interlocal Cooperative Agreement between the City, Salt Lake County, and the Valley Emergency Communications Center regarding joint acquisition of a Computer Aided Dispatch and related software systems . Under the proposal, all entities would utilize the same 911 dispatch software in order to improve functionality and efficiency among the different entities. (C 16-524) UNFINISHED BUSINESS #1 . 7 :35:58 PM Adopting a resolution authorizing the approval of an Interlocal Cooperation Agreement between Salt Lake City and Salt Lake County with respect to the County' s transfer of $3,750,000 to the City for the purpose of financing highway construction, reconstruction and maintenance projects, or for financing enforcement of traffic laws . (C 15-523) #2 . 7 :36:39 PM Adopting a resolution authorizing a loan from Salt Lake City' s Housing Trust Fund to North Temple Flats, LLC. The $1 million loan would be used to construct a 168-unit apartment complex at 1999 West North Temple, 58 percent of which would have affordable rent . (R 16-9) #3 . 7 :37 :11 PM Adopting a resolution authorizing a grant from the City' s Housing Trust Fund to The Community Foundation. The funds would be used to establish the "Low Wage Worker" pilot project, which would provide one-time subsidies to developers as an incentive for them to build affordable housing. Setting the date of Tuesday, August 9, 2016 at 7 : 00 p.m. to hold a public hearing and accept public comment regarding closing a portion of 1300 South Street between 900 West and the Jordan River. The street closure would allow the City to create an access point to the Jordan River, which is consistent with the Westside Master Plan. Petition No. PLNPCM2015-00765. Setting the date of Tuesday, August 9, 2016 at 7 : 00 p.m. to hold a public hearing and accept public comment regarding closing a portion of 1700 East between Emerson Avenue (1500 South) and Logan Avenue (1600 South) . Located within the Wasatch Hollow Open Space area, the designated street was never developed. It will be designated a City-owned parcel under the proposal . Traffic will not be impacted. Setting the date of Tuesday, August 9, 2016 at 7 : 00 p.m. to hold a public hearing and accept public comment regarding amending the zoning map pertaining to seven parcels located at approximately 211 to 251 North Cornell Street along with adjacent platted alleys and an unimproved portion of Seward Avenue to rezone those parcels from BP- Business Park to TSA-MUEC-T-Transit Station Area Mixed Use Employment Center Transitions .
