The City Council of Salt Lake City, Utah, met in Formal Session on
Tuesday, March 6, 2018 in Room 315, Council Chambers, City County
Building, 451 South State .
The following Council Members were present:
James Rogers Andrew Johnston Amy Fowler
Chris Wharton Erin Mendenhall Charlie Luke
The following Councilmember was absent:
Derek Kitchen
Jennifer Bruno, Council Deputy Executive Director; David Litvack,
Mayor' s Deputy Chief of Staff; Margaret Plane, City Attorney; and Scott
Crandall, Deputy City Recorder; were present.
Councilmember Mendenhall presided at and conducted the meeting.
The meeting was called to order at 7 : 13 p.m.
OPENING CEREMONY
#1. 7:13:21 PM Pledge of Allegiance.

#4 . 7:15:47 PM Councilmember Johnston moved and Councilmember Rogers
seconded to approve the minutes of the following Council meetings, which
motion carried, all members present voted aye, except Councilmember Luke,
who was absent for the vote .
• January 2, 2018 Work Session.
• January 16, 2018 Work Session.
• February 6, 2018 Formal Meeting.

PUBLIC HEARINGS
#1. 7 : 16: 10 PM Accept public comment and consider adopting an
ordinance that would rezone properties at 419, 422 , 423, and 430 South
1100 West Street from R-1/5, 000 Single-Family Residential District to I-
Institutional District pursuant to Petition No . PLNPCM2017-00447 . The
parcels are owned by Neighborhood House, a local nonprofit organization.
The proposed changes would rezone the parcels to the same zoning as
adjacent parcels, and would allow Neighborhood House to expand its
daycare services on the site by demolishing two current buildings and

constructing one larger facility. Although the applicant has requested
that the property be rezoned to I-Institutional District, consideration
may be given to rezoning the property to another zoning district with

Brandon Felsted spoke/submitted written comments about the
proposal . He said problems with Neighborhood House included parking
issues, littering/garbage, child/pedestrian safety, increased traffic,
and general disrespect for the neighborhood. He asked the Council to
reconsider their request.
Jennifer Nuttall, Neighborhood House Executive Director, said she
was glad she could address the concerns raised by Mr. Felsted. She said
all the issues raised had been taken into consideration. She said updated
plans would nearly triple their off-street parking which would help with
safety issues, traffic congestion, garbage reduction, and provide a
positive impact on the neighborhood.
Jason Rogers spoke in favor of the proposal . He said his children
attended Neighborhood House which allowed him to obtain/continue his
employment with Salt Lake City. He said he felt increased parking would
help address concerns related to current problems .
Councilmember Johnston moved and Councilmember Fowler seconded to
close the public hearing and defer action to a future meeting, which
motion carried, all members present voted aye .

#2 . 7:23:33 PM Accept public comment and consider adopting an
ordinance closing and vacating a portion of 1100 West Street located
between Goshen Street and the Jordan River and between 400 and 500 South
streets pursuant to Petition No . PLNSUB2017-00320 . The portion of street
exists on paper only, and is not utilized for transportation purposes or
to access other properties. Under the proposal, the City would donate
the .25 acre property to the abutting property owner, Neighborhood House,

resolution authorizing the donation of City-owned property to

#4 . 7:25: 06 PM Accept public comment and consider adopting an
ordinance amending various sections of Title 21A, Zoning Code, pertaining
to planned development regulations pursuant to Petition No. PLNPCM2016-
00600 . A planned development is an approval process that allows the
Planning Commission to modify zoning standards to create a better
development project than what would be allowed under strict zoning
regulations. The amendment is intended to:
• Ensure that planned developments are meeting a Citywide planning
objective;
• Ensure that project designs are compatible with adjacent
development; and
• Clarify zoning regulations.
Related provisions of Title 21A, Zoning, may also be amended as
part of this petition. (Petitioner: Salt Lake City Planning Commission)

Cindy Cromer spoke about land exploitation, incompatibility with
surrounding properties, outrageous developer requests, and clarification
about what constituted an enhanced project. She said the ordinance needed
to be modified to require applicants to wait at least one year following
any denial .
Councilmember Johnston moved and Councilmember Fowler seconded to
close the public hearing and defer action to a future meeting, which
motion carried, all members present voted aye .

#5. 7:28: 03 PM Accept public comment and consider adopting an
ordinance amending Section 21A. 34 . 020 , Salt Lake City Code, pertaining
to demolition and new construction in the H-Historic Preservation Overlay
District pursuant to Petition No . PLNPCM2009-00014 . The ordinance would:
• Clarify language to make the demolition and economic hardship
process more transparent;
• Clarify the documentation required for an application for new
construction to be considered complete;
• Revise the standards for new construction in a local historic
district so that they are more user friendly; and

• Align the standards for new construction to the city's adopted
design guidelines.
• Clarify the importance of the design guidelines in designing and

ordinance amending Section 21A.34 .020, Salt Lake City Code, pertaining

#7 . 7:29: 14 PM Accept public comment and consider adopting an
ordinance amending Section 9 . 08 . 010 , Salt Lake City Code, to adjust the
definition of recyclable items . The proposal would:
• Remove plastic bags from the list of acceptable recyclable items
for the City's curbside recycling program;
• Allow the Sustainability Department to change the list of
acceptable recyclable items as needed based on technology and
secondary markets, rather than going through an ordinance change;
and
• Change the definition of "Bulky Waste" to only include trees,
branches and stumps that are larger than 8-inches in diameter.

diameter will be managed through the "Green Waste Collection

Councilmember Rogers moved and Councilmember Fowler seconded to
close the public hearing.
Councilmember Rogers modified his motion to close the public hearing
and adopt the ordinance. Councilmember Fowler seconded the motion.
Councilmember Johnston said this was a big issue in some
neighborhoods and because he was unaware of any public feedback, he was
concerned about closing the hearing.
Councilmember Luke asked about the reason for taking action tonight.
Councilmember Rogers said he was amenable with delaying action.
Councilmember Mendenhall asked if Councilmember Rogers wanted to change
his motion.
Councilmember Rogers moved to close the hearing and defer action to
a future meeting.
Councilmember Fowler asked for clarification about the intent of
the ordinance . Councilmember Rogers said it provided "brown container"
clarification. Councilmember Mendenhall said it sounded like
Councilmember Johnston was looking for some feedback, perhaps from the
Administration, on public outreach/awareness regarding the proposal .
Councilmember Johnston said he just wanted to be sure about public
awareness before the hearing was closed. Councilmember Mendenhall said
that was a separate request and Councilmember Johnston could make a
friendly amendment to the motion.
Councilmember Johnston made a friendly amendment to continue the
public hearing. Council Member Rogers and Fowler accepted the friendly
amendment .
Councilmember Johnston said he wanted to ensure the Council was
clear that the public had knowledge of what was being proposed. He said
a big issue last year was when brown container pick-up was cutoff.
Councilmember Rogers said he did not mind continuing the hearing because
he knew there would be confusion regarding street pick-up as well with
the changes . He said he was in support as long as action was not delayed
beyond March 20, 2018 .
Councilmember Mendenhall asked if Staff had clarification on the
proposal and Councilmember Johnston' s concerns about public
outreach/feedback. Lehua Weaver, Council Associate Deputy Director,
explained the intent of the ordinance. She said the Sustainability

Division received quite a bit of feedback from public outreach efforts .
She said the feedback was mainly about how the program would be
administered (how services would be delivered, etc. ) , not about
definition changes .
Councilmember Johnston said he was under the impression the bulky
waste clean-up was part of this revision as well . Ms . Weaver said the
Administration did not need to make any changes to the ordinance in order
to change the neighborhood clean-up program, it was just this one
definition of size of branches and stumps (which bins they went in) . She
said the proposal was consistent with changes the Administration tried
to implement over the past few years . Councilmember Johnston said with
that in mind he did not want to hold this up.
Councilmember Rogers said he wanted to go back to his original
motion to close the public hearing and approve the ordinance .
Councilmember Fowler seconded the motion.
Councilmember Luke made a substitute motion to close the public
hearing and defer action to a future meeting. The motion was seconded by
Councilmember Wharton.
Councilmember Mendenhall called for a roll call vote on the
substitute motion, which motion carried 4 to 2 . Council Members Johnston,
Wharton, Mendenhall, and Luke, voted aye . Council Members Rogers and
Fowler voted nay. Councilmember Kitchen was absent.

#8 . 7:36:37 PM Accept public comment and consider adopting an
ordinance amending the Salt Lake City Consolidated Fee Schedule for Waste
and Recycling Fees . The City conducted a review of the fees charged to
special event organizers for waste and recycling cans. The review found
that the fees needed to be increased and the fee structure changed in
order to recoup City costs. The proposal would increase some fees for
cans delivery and collection at special events, and clarifying fees for
other related services. View Attachment
Brandon Felsted said he did not understand why his combined bill
continued to increase (approximately 10% per year) . He said he thought
there needed to be some checks/questions about why that was happening.
Councilmember Mendenhall said this particular proposal was just for
special event organizers, not for residents . She said Staff was available
to help address Mr. Felsted' s concerns .
Councilmember Wharton moved and Councilmember Fowler seconded to
continue the public hearing with a follow-up briefing to discuss policy

issues raised by the increase to special event fees, which motion
carried, all members present voted aye .

#9 . 7 :39: 18 PM Accept public comment for Grant Application: 9-
Line/900 South Trail - Active Transportation Network Implementation
Program 2017 requesting funding for the design and construction of a
portion of the 9-Line/900 South Trail between 900 East and 1300 East.

Robert Goodman spoke in favor of the proposal . He said he owned a
home in the 9th and 9th area and thought this would be a great addition
to the neighborhood.
Councilmember Johnston moved and Councilmember Rogers seconded to
close the public hearing and defer action to a future meeting, which
motion carried, all members present voted aye .

POTENTIAL ACTION ITEMS
#1 . 7 :41: 02 PM Adopting an ordinance amending Chapter 21A. 42 , Salt
Lake City Code, pertaining to regulations for temporary uses pursuant to
Petition No . PLNPCM2017-00272 . Temporary Use permits are issued for a
wide variety of events including festivals, fundraisers, temporary food
service, Christmas tree sales, etc. The proposed changes are designed to
clear up confusion and clarify the code by specifying the types of uses
and structures that are allowed and the standards that regulate them.

Councilmember Johnston moved and Councilmember Rogers seconded to
adopt Ordinance 4 of 2018 amending Chapter 21A. 42 , Salt Lake City Code,
pertaining to regulations governing temporary uses and further moved the
recommended clarifications which were discussed during the January 6,
2018 Work Session and outlined in the Staff memo be included in the final
ordinance, which motion carried, all members present voted aye .

#2 . 7 :42 :20 PM Adopting a resolution authorizing approval of an
Interlocal Cooperation Agreement between Salt Lake City Corporation and
Salt Lake County regarding the operation of the Sorenson Multicultural
Center, Sorenson Unity Center, and Steiner West Pool located at 855 West
California Avenue. The proposed contract details the terms for management
and maintenance of the Sorenson Campus. View Attachment

I, renumbering Section 9. 16. 110 and Section 9. 16. 120, and repealing
Chapter 9. 16, Article II, and Chapter 21A.20 - Enforcement, Salt Lake
City Code, relating to weeds and the clearing of real property pursuant
to Petition No. PLNPCM2017-00058 . The changes include clearer language
on the noticing of the City's intent to abate zoning violations,
collection of the costs of abatement, the appeals process, and the duties

Councilmember Johnston moved and Councilmember Luke seconded to
adopt the Consent Agenda with a correction to Item 3 changing the public
hearing date from April 3, 2018 to March 20, 2018, which motion carried,
all members present voted aye .
#1 . Setting the date of Tuesday, March 20 , 2018 at 7 : 00 p.m. to
accept public comment on new revenue options under consideration,
including a potential sales tax increase, and funding and project needs .

Road Home and Shelter the Homeless, Inc. Under the proposal, lease fees
would be waived for portion of City-owned right-of-way located at
approximately 224 South 500 West that the Road Home intends to fence in

accept public comment and consider adopting a resolution authorizing the
approval of an interlocal cooperation agreement between Salt Lake City
and Salt Lake County with respect to the County' s transfer of up to
$500,000 to the City for highway construction, reconstruction and
maintenance projects . Specifically, the funds would be used to design
and construct a segment of the 9-Line Trail on 900 South between 900
East and 1300 East . This would encompass a high-comfort, above-the-curb
trail along 900 South in conjunction with a road reconstruction from
Lincoln Street (950 East) to 1300 East and wayfinding signage on 900

approval of an amended and restated Interlocal Agreement between Salt

Lake City Prosecutor' s Office. The agreement includes budget
information, leasing terms and other details relating to the proposed
relocation of both the City Prosecutor 's Office and the County District
Attorney 's Office to a new space located between 400 and 500 South Main

accept public comment and consider adopting an ordinance amending the
final budget of Salt Lake City, including the employment staffing
document, for Fiscal Year 2017-2018 . Budget amendments happen several
times each year to reflect adjustments to the City's budgets, including
proposed project additions and modifications. The proposed amendment
includes adjustments for a revenue shortfall due to understaffing in
parking enforcement, funding to move the City Prosecutor 's Office to the
