SPECIAL WORK SESSION MEETING
FRIDAY, MARCH 9, 2018
The City Council met in a Special Work Session on Tuesday, March
9, 2018, in Room 326, Committee Room, City County Building, 451
South State Street.
In Attendance: Council Members Andrew Johnston, Erin Mendenhall,
Charlie Luke, Chris Wharton, Derek Kitchen (via speakerphone) , and
James Rogers (via speakerphone) .
Absent: Councilmember Amy Fowler.

meeting.

Councilmember Mendenhall said the purpose of the meeting was
to discuss a list of concerns based upon the foundational
violations of land use authority being taken away from the City
(potentially 20, 000 acres of tax increment) . She talked about the
potential loss of over $500 million in tax increment opportunity
in Salt Lake City and said almost a quarter of the City was being
taken away. She said the bill passed was far worse than any bill
the City had contemplated and left the City with a lot of work to
do to examine the reality of the impacts of what had happened.
Councilmember Luke said it was also important to realize the
actions which took place this Legislative Session not only harmed
Salt Lake City' s ability to effectively manage and govern the City
when there was already forty-three percent of the City which was
tax exempt, there was little flexibility to move budgeting money
around when looking at the areas of potential growth. He said for
Salt Lake City those areas of growth were going to be on the west
side in the Northwest Quadrant. He stated it hurt the City, put
more pressure on residents, and was unfair to City
taxpayers/residents .

feedback or staff direction on any item related to City Council

#3. REPORT OF THE CHAIR AND VICE CHAIR.
No discussion was held.
#4 . 3:43:17 PM CONSIDER A MOTION TO ENTER INTO CLOSED SESSION,
IN KEEPING WITH UTAH CODE §52-4-205 FOR ANY ALLOWED PURPOSE .
Councilmember Johnston moved and Councilmember Luke seconded
to enter into Closed Session to discuss Attorney-Client matters
that are privileged pursuant to Utah Code §78B-1-137, and for other
lawful purposes that satisfy the pertinent requirements of the
Utah Open and Public Meetings Act.

Councilmember Wharton asked for clarification that the closed
session was for imminent litigation. Ms . Plane indicated the closed
session was to discuss both Attorney-Client matters that are
privileged and imminent litigation.
A friendly amendment was made to the motion and was accepted
by Council Member' s Johnston and Luke to enter into Closed Session
to discuss Attorney-Client matters that are privileged pursuant to
Utah Code and §78B-1-137 , and for other lawful purposes that
satisfy the pertinent requirements of the Utah Open and Public
Meetings Act; and §52-4-205 (1) (c) , strategy sessions to discuss
pending or reasonably imminent litigation.
Ms . Gust-Jenson stated Councilmember Rogers would be calling
in to participate via speakerphone during the Closed Session
meeting.
Councilmember Mendenhall called for a roll call vote. Council
Members Kitchen (via speakerphone) , Wharton, Luke, Johnston, and
Mendenhall voted aye. See File M 18-1 for Sworn Statements .
