TUESDAY, NOVEMBER 21 , 2017
The City Council met in Work Session on Tuesday, November 21, 2017,
in Room 326, Committee Room, City County Building, 451 South State
Street.
In Attendance: Council Members Lisa Adams, Stan Penfold, Erin
Mendenhall, Derek Kitchen, Charlie Luke, James Rogers, and Andrew
Johnston.

Councilmember Penfold presided at and conducted the meeting.
The meeting was called to order at 2 : 18 p .m.
AGENDA ITEMS
#1 . 2:18:31PM FOLLOW-UP BRIEFING ABOUT "GROWING SLC: A 5-YEAR
HOUSING PLAN. " The plan envisions Salt Lake City as a place where
all its residents can find housing that is safe, secure and
affordable. The plan outlines goals for creating long-term
solutions for increasing the housing supply, expanding housing
opportunities throughout the city, addressing systemic failures in
the rental market, and preserving existing units. View Attachments
Councilmember Penfold acknowledged a lot of people were
working to find successful solutions to the housing needs in the
City. He thanked everyone who was a part of that and said there
was significant commitment in the community and progress was being
made.

Nick Tarbet and Benjamin Luedtke briefed the Council with
attachments . Discussion was held and feedback was given from the
Council regarding direction and guidelines to support/fund the
following projects and/or statements :
1 . 2:24:41PM Adhere to federal-level efforts discouraging the
concentration of poverty.
Council Members were in support of this statement and wished
to include language stating two different approaches could be
applied to affordable housing (geographically and project based) .
2 . 2:30:23PM Include a mix of affordable and market-rate units.
Council Members were in support of this statement and wished
to include language stating: the Council wanted a mix of market
and affordable rates and supported paying more when needed (higher
costs depending on location/services) because the priority to have
these types of units throughout the City was important. Council
Members requested Staff bring back recommended language
acknowledging the Council recognized the expense involved to
support the statement and to clarify/avoid problems in situations
primarily in the twenty-percent and below supportive long-term
housing where it would be challenging to do a market-rate mix.
3. 2:33:07PM Uphold an equitable ratio of affordable to market
rate units throughout the city. Ideally, projects outside areas of
high opportunity should have lower ratios of affordable units .
Council Members discussed confusion with Redevelopment Agency
(RDA) funding as well as City and RDA-owned properties, needed
policy discussion concerning higher ratios of affordability in
more expensive areas, thoughts/position on inclusionary zoning,
and belief/position of allocated funding.
4 . 2:47:03PM Place affordable housing within areas of high
opportunity.
Council Members expressed concern with the language
suggesting the City would only invest in affordable housing.
Suggestions were made to not preclude the statement but create a
healthy balance, replace the word "place" with the word "include"
or "incentivize", and to ensure the statement matched the statement
"Adhere to federal-level efforts discouraging the concentration of
poverty" indicating the Council would be more inclined to fund
areas of high opportunity if certain requirements were met.
5 . 2:48:52PM Award funding through a competitive, accountable,
fair and transparent process to give all interested developers ,

agencies and organizations equal opportunity to submit proposals
for consideration.
Council Members indicated this was an important policy
statement and it was critical to state the Council was interested
in and would demand a fully accountable and transparent process .
6 . 2:49:53PM Help build mixed-income projects throughout the
City so that no one neighborhood was overly impacted by a large
increase of housing units .
Council Members expressed hesitation with the policy
statement. Comments included the potential of keeping affordable
housing out of neighborhoods the Council wished to start having
affordable housing be more accessible in, creating a policy in
contrast to several others, striking the statement, concern with
too much building in Sugar House, avoiding conflicting messages
between zoning ordinances and the Housing Plan, a different tool
for measuring density rather than the Zoning Plan, incorporating
the statement in other policy priorities, and high concentrations
of affordability versus high concentration of housing. Council
Members requested Staff remove the statement and add/modify it
into Statement No. 3 (Uphold an equitable ratio of affordable to
market rate units throughout the City. Ideally, projects outside
areas of high opportunity should have lower ratios of affordable
units) .
7 . 2:56:21PM Preserve existing affordable housing; new projects
would create a net increase in affordable housing units available .
Council Members discussed the definition of workforce housing
in relation to Annual Median Income (AMI) , replacing one category
of affordability with another, preserving buildings in relation to
net increase, preserving/improving the reprehensible condition of
current affordable housing units, enhancing the civil penalties
ordinance to include apartments with additional signifiers for
poorly-kept properties to help Business Licensing/Compliance with
more efficient enforcement, and addressing the need for supportive
services . Councilmember Penfold asked Staff to re-group and
eliminate the statements as discussed/instructed by the Council
and to include and consider them for straw-polling next week.
8 . 3:11:08PM Keep publicly-funded housing projects affordable
as long as possible.
There were no objections from Council Members .
9 . 3:11:29PM Add to the diversity of all housing types available
in Salt Lake City and create a welcoming environment for people of

all backgrounds and incomes.
There were no objections from Council Members .
10 . 3:12:07 PM Collaborate with the private sector to include
affordable units in developments that are planned or in progress,
which otherwise might not have affordable units .
Cindy Gust-Jenson stated this concept was previously raised
by Housing and Neighborhood Development (HAND) in a preliminary
briefing. She said while in the process some developers ran into
a gap situation which might be an opportunity for the City to work
with developers to help fill the gap and at the same time negotiate
opportunity for affordable units . There were no objections from
Council Members .
11 . 3:13:14PM Include collaboration with community and private
sector partners to enable opportunities for in-kind contributions ,
creative financing and service delivery models .
There were no objections from Council Members .
12 . 3:13:29PM Utilize City-owned land whenever possible.
There were no objections from Council Members .
Councilmember Penfold said there were other statements
needing to be addressed. He asked Council Members to review the
statements and to point out any they felt strongly about including,
otherwise they would probably not be used.
Councilmember Kitchen said he wished to include a statement
indicating that when utilizing RDA money, it would first be
considered how housing would be developed to maximize tax increment
and neighborhood economic development goals .
Councilmember Penfold said (reverting back to RDA and HAND
Staff) he believed it was an important conversation going forward
around how there was an overall goal to improve livability and
quality of life and all of those sort of foundational tax-base
considerations anywhere in the City. He said with different ranges
of affordable housing percentages (depending on which
neighborhoods) were being looked at and how they were viewed, it
was difficult to decide where to invest City resources .
#2 . 3:18:29 PM DISCUSSION REGARDING BUDGET AMENDMENT NO. 2
(REDEVELOPMENT AGENCY (RDA) BUDGET AMENDMENT NO. 3) . Budget
amendments happen several times each year to reflect adjustments
to the City's budgets, including proposed project additions and

modifications. The proposed amendment includes a proposal to use
RDA for affordable housing projects. View Attachments
Jennifer Bruno, Benjamin Luedtke, Mike Reberg, and Melissa
Jensen briefed the Council with attachments . Discussion was held
regarding money provided from the General Fund to the Housing Trust
Fund (HTF) , finding a dedicated revenue stream for the HTF, looking
at a way to leverage short-term rentals as an on-going revenue
stream for the HTF, how AMI was evaluated for programing
considerations, how other cities operated around low-wage worker
difficulties, further definition and clarification regarding rehab
and acquisition, and potential enforcement procedures with sub-
standard housing units and how it would affect rents .
Councilmember Penfold said (for clarification) this was
Budget Amendment No. 2 for the General Fund and Budget Amendment
No. 3 in the RDA budget, including a proposal for a transfer of
money from the RDA to the General Fund. He said a public hearing
would be held December 5, 2017 with tentative action on December
12, 2017 .
Council Members requested the following items from Staff:
• A process to track the HTF (for loan forgiveness, lower return
on investment, etc. ) to provide to the Council .
• Discussion to find a dedicated revenue stream for the HTF.
#3. 3:50:57PM BRIEFING ON A PROPOSAL THAT WOULD AMEND A SECTION
OF THE SALT LAKE CITY ZONING ORDINANCE TO INCLUDE THE UTAH JAZZ
PRACTICE FACILITY LOCATED AT 1432 SOUTH 500 WEST INTO THE
LOCALIZED ALTERNATIVE SIGN OVERLAY DISTRICT ON THE BLOCK THAT
CURRENTLY HOUSES THE VIVINT ARENA. If approved, the overlay would
allow the applicant to install signage that would otherwise not
meet the basic standards of the existing zoning. View Attachments
Nick Tarbet, John Anderson, Wade Budge, and Spencer Stokes
briefed the Council with attachments . Discussion was held
regarding sign dimensions, electronic signs distracting drivers,
sign shapes, original signage, billboard policy issues, current
on-site sign permitted uses, concern with setting a precedence if
approved, sign content, and digital/electronic sign guidelines .
Councilmember Penfold asked the Council to let Staff know if
they had any additional questions or needed any further
information. He said a public hearing would be held November 28,

2017 with tentative action on December 5, 2017 .
Council Members requested the following item from Staff:
• Discussion on how to allow a sign to be in alignment with the
existing ordinance and to allow the sign to be updated.
#4 . 4:12:26 PM BRIEFING REAGARDING A RESOLUTION AUTHORIZING A
$1 MILLION LOAN FROM SALT LAKE CITY' S HOUSING TRUST FUND TO GARDEN
LOFTS HOLDING, LP, TO FACILITATE THE DEVELOPMENT OF AN 272-UNIT
AFFORDABLE HOUSING PROJECT AT 154 WEST 600 SOUTH. The project will
feature a mix of one to three bedroom apartments and studio
apartments. View Attachments
Nick Tarbet, Melissa Jensen, and Lily Grey briefed the Council
with attachments . Discussion was held regarding a previous
discussion concerning a 75, 000 affordable-unit shortage and the
current existing motel on the parcel .
Mr. Tarbet said if the Council supported the project, it would
be scheduled for tentative adoption on November 28, 2017 . He said
a public hearing was needed for this item.
#5 . 4:41:30 PM FOLLOW-UP BRIEFING REGARDING BUDGET AMENDMENT NO.
1 FOR THE FISCAL YEAR 2017-18 BUDGET. Budget amendments happen
several times each year to reflect adjustments to the City's
budgets, including proposed project additions and modifications.
This proposed amendment includes funding for Operation Rio Grande;
improvements at Pioneer Park that would remove the shuttered
restrooms and open up the center of the park; and many other
changes. View Attachments
Jennifer Bruno, Benjamin Luedtke, Mary Beth Thompson, Kristin
Riker, and Mike Brown briefed the Council with attachments . The
following items were discussed as follows :
A-15 : 4:42:23 PM ZAP Funding for Oak Hills Tennis Pro Shop Phase
I ($400,000 - CIP Fund)
Cost overrun concerns and policy allowing a percentage of
cost overrun to be determined internally.
A-16 : 4:50:06PM Justice Court Judge 0 . 50 FTE Increase ($0 this
fiscal year - General Fund) Potential of using State funds to
offset the increased workload coming out of Operation Rio Grande
and Full-Time Employee (FTE) hiring.

I-1 : 4:54:36PM Homeless Resource Center Construction Mitigation
($TBD - General Fund fund balance) Mr . Luedtke stated the current
Economic Development budget for consultants this fiscal year was
approximately $39, 000 . He said Economic Development was planning
to absorb the cost for this construction mitigation next fiscal
year. He said Staff could flag the item in future budget amendments
(from the annual budget) to verify if there were sufficient
remaining funds this fiscal year or what the plan was when the
annual budget was received from next year. There were no objections
from Council Members .
I-2 : Wildlife Mitigation Studies of Northwest Quadrant Area
($TBD - General Fund fund balance)
Item withdrawn .
I-3 : 4:55:29PM Additional Training and/or Retention Funding for
Police Officers ($TBD - General Fund fund balance) Number of
officers lost through attrition who were reaching retirement,
incentives to retain officers, and considering other
targets/accomplishments (i .e . decreasing crime) rather than
keeping up funding to fund officer positions .
Council Members requested the following items from Staff:
• Tag January/February budget amendment for review after the
first of the year.
• Include fleet component in the proposed budget amendment.
• Discussion surrounding funding to capture/bridge the funding
gap of officers transitioning to other employment.
• Collaborate with Utah League of Cities and Towns concerning
the current State Public Safety retirement benefit.
• Count of officers approaching the 20-year mark.
• Proposed budget/plan to obtain a 33-percent decrease in crime
across the city
Discussion continued regarding the current fund balance,
intent of $20, 000 for Local Business Marketing Programs funded in
Fiscal Year 2018 non-departmental budget, and Twilight Concert
funding/preservation.
Council Members requested the following items from Staff:
• Clarify (before the budget amendment was finalized) if Local
First Utah was allocated funding for this year, when funding
would be available (rules) , and if not funded find the funding
in this budget amendment if possible.

• Find funding (for Twilight Concerts specifically) for
Economic Development to present to the Arts Council to
administer Twilight as a grant program.
• Follow-up from the Arts Council regarding brand continuity,
and their concept of grant programs/concerts with money used
from allocated funding.
Councilmember Penfold said a public hearing was scheduled for
November 28, 2017 with tentative action on December 5, 2017 .

THE CITY' S REGULATIONS IN THE FORM BASED URBAN NEIGHBORHOOD (FB-

#7 . 5:29:55PM FOLLOW-UP BRIEFING ABOUT AN ORDINANCE THAT WOULD
AMEND THE CITY'S ACCESSORY DWELLING UNITS (ADUs) REGULATIONS. ADUs
are small apartments that share a lot with a single-family home.
They can be basement apartments, above and inside garages, or
entirely separate buildings. The amendments would generally allow
ADUs throughout the entire city and limit the number of ADU permits
issued per year to 25. Petition No. PLNPCM2014-00447. View

Nick Tarbet, Nick Norris, and Michael Maloy briefed the
Council with attachments . Discussion was held regarding comparison
of conditional use versus special exception process, Staff
time/resources to respond to Council requests for additional
information, application evaluation process including conditional
use/special exceptions, tracking/measuring/evaluating the
criteria addressed, potential concerns to address ordinance
modifications in the future, considering ADUs City-wide, ADU
design standards, stand-alone ADUs, ADU cap, and owner occupancy.
Councilmember Penfold said this discussion would be continued
next week. He asked Council Members to share ideas for straw polls
with Staff.

• Follow-up regarding the legal aspect of owner occupancy
(requiring an affidavit) .

PROGRESS ON THE COUNCIL' S LEGISLATIVE INTENT STATEMENTS FOR
FISCAL YEAR 2017-18, INCLUDING PENDING ITEMS FROM PREVIOUS
YEARS. Legislative intents are formal requests the Council makes
of the Administration. This briefing will include updates on a
variety of matters, including procuring Customer Relationship
Management software, infrastructure funding, elected official
compensation, and more. View Attachments
Allison Rowland and Randy Hillier briefed the Council with
attachments . Discussion was held regarding the Road Conditions
Survey timeline, public safety compensation study, and elected
officials compensation study.
Council Members requested the following items from Staff:
• Response from Human Resources regarding the
willingness/interest to conduct a Public Safety compensation
study and the review process timeline.
• What a policy discussion surrounding Police compensation
would look like and what information would be needed.
• Incorporate capital cities into the elected official' s
compensation study.
• Information/circumstances surrounding elected officials
compensation situation/position with the City.
• Tie legislative intent updates to budget amendments, to
prevent them being overlooked in the annual process .
Councilmember Penfold said if Council Members had additional
questions or thoughts regarding legislative intents to share them
with Staff. He asked Staff to return with written
comments/responses on December 5, 2017 .
