TUESDAY, OCTOBER 15 , 2019
The City Council of Salt Lake City, Utah, met in Formal Session on
Tuesday, October 15, 2019 in Room 315, Council Chambers, City County
Building, 451 South State .
The following Council Members were present:
Charlie Luke Analia Valdemoros Chris Wharton
Andrew Johnston Erin Mendenhall Amy Fowler
The following Councilmember was absent:
James Rogers
Jennifer Bruno, Council Executive Deputy Director; David Litvack,
Mayor' s Deputy Chief of Staff; Lynn Pace, Acting City Attorney; and Scott
Crandall, Deputy City Recorder; were present.
Councilmember Luke presided at and conducted the meeting.
The meeting was called to order at 7 : 04 p.m.
OPENING CEREMONY
#1 . 7:04:45 PM Pledge of Allegiance .
#2 . 7:05:11 PM Welcome and Review of Standards of Conduct.
PUBLIC HEARINGS
#1 . 7:06:00 PM Accept public comment and consider a request to close
a City-owned alley located at approximately 1000 South between 800 West
and Jeremy Street (850 W) pursuant to Petition No. PLNPCM2018-00666 . The
alley is referenced as Mead Avenue but the City recognizes it as an alley
rather than a street. The applicant's reason for the request includes a
concern about crime in the area, and the request received the necessary
support of abutting property owners. However, the Planning Commission
forwarded a negative recommendation. The Planning Commission forwarded
a negative recommendation, therefore an ordinance has not been drafted.
If the Council decides to approve the request, an ordinance would be
drafted and considered for approval . View Attachments
Melinda Hale, James Keifert, Alan Midgley, Meagan Keifert, and
Richard Hale spoke in support of the proposal . Jorge Orea and Greg Bailey
submitted hearing cards also in support . Comments included: ongoing
problems (criminal activity/drugs/vandalism) , lighting issues, lack of
City maintenance (weeds/snow removal, etc. ) , overgrown trees/vegetation,

property access/fencing issues, safety concerns, homeless activity, and
potential to close the entire alley.
Councilmember Fowler moved and Councilmember Johnston seconded to
close the public hearing and defer action to a future meeting, which
motion carried, all members present voted aye .

#2 . 7:14:48 PM Accept public comment and consider adopting an
ordinance amending the final budget of Salt Lake City, including the
employment staffing document, for Fiscal Year 2019-20 . Budget amendments
happen several times each year to reflect adjustments to the City 's
budgets, including proposed project additions and modifications. The
proposed amendment includes funding for the Airport Redevelopment
Program that reflects necessary scope changes to the project to
accommodate passenger growth, among other changes. (Budget Amendment No.

Councilmember Wharton moved and Councilmember Johnston seconded to
close the public hearing and defer action to a future meeting, which
motion carried, all members present voted aye.

#3 . 7:15:30 PM Accept public comment regarding Grant Application:
2020 Jurisdictions with Halfway House and Parole Violator Centers Grant,
requesting to provide training, supplies, overtime for enforcement,
investigations, a mental health team response and patrol . In addition,
grant funding would partially fund the replacement of the Police
Department' s mobile command center motor home which is no longer

Councilmember Fowler moved and Councilmember Johnston seconded to
close the public hearing and refer the item to a future Consent Agenda
for action, which motion carried, all members present voted aye.

POTENTIAL ACTION ITEMS
#1 . 7:16:07 PM Adopting an ordinance amending the zoning of property
located at 504 South 900 East Street and amending the Central Community
Master Plan Future Land Use Map pursuant to Petition No. PLNPCM2018-
00839 and Petition No. PLNPCM2018-00898 . The proposal would rezone the
property from Moderate Density Multi-Family Residential District (RMF-

35) to Residential/Mixed Use (RMU-35) and a Master Plan Amendment from
Medium Density Residential to Medium Residential/Mixed Use. The intent
of the proposal is to build a mixed-use development. No site plan has
been submitted at this time. Although the applicant has requested that
the property be rezoned to Residential/Mixed Use (RMU-35) , consideration
may be given to rezoning the property to another zoning district with
similar characteristics. (Ian Kaplan, ADDVirtue, Ivy Partners) View

Margaret Holloway expressed concerns about ongoing shootings in her
neighborhood (five in the past six months) . She said this was a serious
problem and something needed to be done to address it.
NEW BUSINESS
#1 . 7:19:35 PM Adopting a resolution requesting the recertification
of the Justice Court of Salt Lake City. Justice Courts must be
recertified every four years by the Utah Judicial Council . View

suspend the rules and adopt Resolution 30 of 2019, which motion carried,
all members present voted aye .

#1 . 7:20:08 PM Adopting two related resolutions regarding City
bonds :
1 . a resolution authorizing up to $62 ,500,000 of sales and excise tax
revenue refunding bonds, Series 2019; delegating authority to certain
officials and officers to approve the final terms of such bonds; and
providing for related matters (Refund Federally Taxable Sales and
Excise Tax Revenue Bonds, Series 2013A and Sales Tax Revenue Bonds,
Series 2007A) ; and

2 . a resolution authorizing (i) the execution of an Annual Contribution
Agreement and (ii) the issuance and sale by the Redevelopment Agency

Councilmember Fowler moved and Councilmember Mendenhall seconded to
adopt Resolution 31 of 2019, adopting a delegating bond resolution
authorizing up to $62 ,500,000 of sales and excise tax revenue refunding
bonds and providing for related matters, which motion carried, all
members present voted aye .

adopt Resolution 32 of 2019, adopting a resolution authorizing (i) the

#2 . 7 :21 :20 PM Adopting an ordinance memorializing key Council
information requests, including updates or reports the Council has
requested from the Administration, items the Council is entitled to
receive based on State or City Code, or information items that are
routinely shared relating to the Finance Department and City budget
policy. The goal of gathering all the reporting information into one
easy-to-reference location is to enhance transparency and add clarity to
the process of sharing information needed by the Council to fulfill its

to approve the Consent Agenda except Item G-3 Street vacation near 538
East 14th Avenue and removing the State of Utah, Commission of Criminal
and Juvenile Justice, Jurisdictions with Halfway Houses and Parole
Violator Centers Grant from Item G-4 Grant Holding Account items, which

#1. Setting the date of Tuesday, November 12, 2019 at 7 :00 p.m. to
accept public comment and consider adopting an ordinance that would amend
the City' s Consolidated Fee Schedule (CFS) . The proposal would reduce
current rates for "Class 7" customers of the Sewer Utility. Higher rates
are assessed for this category because of the treatment cost on what
Class 7 customers discharge into the City's sanitary sewer. View

accept public comment and consider adopting an ordinance for the second
amendment to the final budget of Salt Lake City, including the employment
staffing document, for Fiscal Year 2019-20. Budget amendments happen
several times each year to reflect adjustments to the City's budgets,
including proposed project additions and modifications. The proposed
amendment includes funding for maintenance of existing art in the City
and a study to learn more about maintaining that art collection, funding
police overtime for patrols in City parks, and a roundabout at 2000 East
Parleys Canyon Boulevard to improve traffic flow and safety, among other

at 7 : 00 p.m. to accept public comment and consider adopting an ordinance
that would partially vacate a portion of 14th Avenue adjacent to a
property located at 538 East 14th Avenue pursuant to Petition No.
PLNPCM2018-00561 . The purpose of the partial vacation is to reconcile
the location of fencing and landscaping within the park strip. The
partial vacation will not impact vehicular traffic or pedestrian access
