TUESDAY, SEPTEMBER 12 , 2006
The City Council of Salt Lake City, Utah, met in Regular Session on
Tuesday, September 12, 2006, at 7 : 00 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State .
The following Council Members were present:
Van Turner Nancy Saxton Dave Buhler
Soren Simonsen Eric Jergensen Carlton Christensen
Jill Remington Love
Mayor Ross C. "Rocky" Anderson; Cindy Gust-Jenson, Executive
Council Director; Edwin Rutan, City Attorney; and Scott Crandall,
Deputy City Recorder; were present.
Councilmember Buhler presided at and Councilmember Jergensen
conducted the meeting.
#1 . 7:09:59 PM The Council led the Pledge of Allegiance.
#2 . 7:10:25PM Councilmember Simonsen moved and Councilmember Love
seconded to approve the minutes of the Salt Lake City Council meeting
held September 5 , 2006, which motion carried, all members voted aye .

PUBLIC HEARINGS :
#1. 7:10:41 PM RE: Accept public comment and consider adopting an
ordinance amending Section 21A. 62 . 040, Salt Lake City Code, relating to
definitions , and Section 21A. 40 . 120, Salt Lake City Code, relating to
regulations of fences, walls and hedges pursuant to Petitions 400-04-20
and 400-04-26 . View Attachments
Laura Howart said Version B of the proposed ordinances was
consisted with the master plan, promoted safe livable neighborhoods and
preserved unique streetscapes .
Councilmember Turner moved and Councilmember Saxton seconded to
close the public hearing, which motion carried, all members voted aye.
Councilmember Buhler moved and Councilmember Turner seconded to
adopt Ordinance 68 of 2006 (Version B) .
Councilmember Buhler said Ms . Howart brought this issue forward
approximately two years ago and had been patient as the proposal worked
its way through the process . He said Version B was more in line with
the legislative intent he originally presented to the Council . He said
he thought the proposal would stop front yards from unintentionally

becoming fortresses to neighboring properties and urged the Council to
support the motion.
Councilmember Jergensen called for the question, which motion
carried, all members voted aye .

QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 7:14:44 PM
Councilmember Christensen asked the Mayor to thank the Fire
Department for the great job they did containing a fire which occurred
at his aunt' s condominium.
Councilmember Turner said a series of events were planned for his
district relating to an effort to educate residents about potential
hazards and other emergencies . He thanked City departments and the
Administration for their preparation and support.
COMMENTS TO THE CITY COUNCIL 7:17:04 PM
The following spoke or submitted written comments regarding
Pioneer Park: Peter Cole, Arthur Holman, Jaynie Brown, Steven Szykula
and Barbara Durst. Comments included funding all phases, benefits from
improvements, family activities, blighted area, impact on local
businesses/visitors, availability of drugs/alcohol, 2005 SHARP study,
risk factors, prevention, early addiction, change image/perception of
Pioneer Park, install jogging trails and dog park, increased
utilization and City-wide development.
The following spoke or submitted written comments regarding
approval of Conditional Uses by an Administrative Hearing Officer:
Randy Sorensen, Jay Ingleby and Ross Andra. Comments included poor air
quality in Glendale, limiting hazardous businesses, include local
residents in decision making body, chemical spills, group decisions and
quality of life issues .
Douglas Cotant spoke concerning vandalism and lack of security at
the New Grand Hotel .
UNFINISHED BUSINESS
#1. 7:31:33PM RE: Adopting a resolution extending the time
period for satisfying conditions set forth in Ordinance No . 11 of 2003
pursuant to Petition 400-01-37 . (24 months from September 20, 2006 to
September 20, 2008) View Attachment
Councilmember Simonsen said he was involved with the project and
needed to be recused.

Councilmember Christensen moved and Councilmember Saxton seconded
to adopt Resolution 56 of 2006 .
Councilmember Saxton said if the petitioner came back and
requested an extension beyond September 20, 2008, she wanted to
encourage a landscaping requirement along 300 South. She said the area
was currently being used for staging but was a pivotal pedestrian
corridor which needed to be landscaped. She said consideration needed
to be given to residents along 300 South who had been impacted by this
unimproved area.
Councilmember Jergensen called for the question, which motion
carried, all members voted aye, except Councilmember Simonsen, who was
recused.

#2 . 7:32:04PM RE: Adopting a resolution expressing official
intent regarding certain capital expenditures to be reimbursed from
proceeds of an obligation to be issued by the City, and related

Councilmember Buhler moved and Councilmember Saxton seconded to
adopt Resolution 55 of 2006.
Councilmember Buhler said the property had been purchased by the
City but a decision had not been made regarding its use. He said a
proposal had been made to use the site for a police station or a
combination police/fire station. He said he and Councilmember Love
were holding a district meeting at the end of the month to obtain input
from the neighborhood. He said the action being taken would preserve
the option that if, in the future, the City bonded to build a police
station on that site, bond proceeds could be used to reimburse the City
for the money which had already been expended to purchase the property.
Councilmember Jergensen called for the question, which motion
carried, all members voted aye .

#3. 7:33:32 PM RE: Adopting a resolution authorizing the sale of
the Salt Lake City, Special Assessment Bonds , Series 2006 (900 South,
Main Street to 900 West, Street Improvements Special Improvement
District No. 102004) (The "Series 2006 Bonds") providing for pricing
and terms of the Series 2006 Bonds, prescribing the form of bonds, the
maturity and denomination of said bonds; providing for the continuance
of a guaranty fund; authorizing and approving a bond purchase

Salt Lake City, appointing a Board of Equalization and review for the
Salt Lake City 2004 sidewalk replacement and Quayle Avenue
reconstruction Special Improvement District (The "District") ; setting
the dates for the Board of Equalization to hear and consider objections
and corrections to any proposed assessments; authorizing the City
Recorder to publish and mail a notice of meetings of the Board of
Equalization and review; and related matters . View Attachments
Councilmember Saxton moved and Councilmember Turner seconded to
adopt Resolution 58 of 2006, which motion carried, all members voted
aye .

#5 . 7:34:32PM RE : Adopting a legislative action initiated by
Council Members Love and Saxton requesting the Administration to
research possible amendments to the Salt Lake City Code relating to
handling and procedures for methamphetamine or other chemically-
contaminated houses . View Attachments
Councilmember Love moved and Councilmember Saxton seconded to
adopt the Legislative Action.
Councilmember Love said this was a first step. She said she
received a number of calls following the Council discussion about this
issue . She said she looked forward to the process and was interested
to see what recommendations the Administration' s would come back with
on ways the City could protect home owners and renters .
Councilmember Saxton said she appreciated Councilmember Love' s
leadership along with Liberty Wells and City department representatives
who were involved and understood this issue . She said this was a good
example of how communities could make a difference by bringing issues
to the Council .
Councilmember Buhler thanked Council Members Love and Saxton for
bringing this forward and wanted to encourage the Administration to act
quickly. He said this was a serious problem in City neighborhoods and
hoped the Administration would give the issue some urgency and provide
a response to the Council before the end of the year.
Councilmember Jergensen called for the question, which motion

CONSENT AGENDA
7:36:28 PM Councilmember Buhler moved and Councilmember Simonsen
seconded to approve the Consent Agenda, which motion carried, all
members voted aye.
#1. RE: Setting the date of October 3, 2006 at 7 : 00 p.m. to
accept public comment and consider adopting an ordinance amending
Chapter 21A.54, Salt Lake City Code, pertaining to Conditional Uses
pursuant to Petition 400-05-17 .
