09/20/2016 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 20 , 2016 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, September 20, 2016 at 7 : 06 p.m. in Room 315, Council Chambers, City County Building, 451 South State. The following Council Members were present: Charlie Luke Derek Kitchen Lisa Adams Andrew Johnston Erin Mendenhall Stan Penfold The following Councilmember was absent: James Rogers Cindy Gust-Jenson, Council Executive Director; Jennifer Bruno, Executive Council Deputy Director; Patrick Leary, Mayor' s Chief of Staff; David Litvack, Mayor' s Deputy Chief of Staff; Margaret Plane, City Attorney; and Kory Solorio, Assistant City Recorder; were present. Councilmember Penfold presided at and Councilmember Mendenhall conducted the meeting. OPENING CEREMONY #1. 7:06:31 PM Pledge of Allegiance . #2 . 7:07:01 PM Welcome and Review of Standards of Conduct. #3 . 7:08:48 PM The Council and Salt Lake City Fire Department will recognize the Fire Department' s new cadets , who will be officially sworn- in on September 21 , 2016 and community members whose selfless actions made a difference in the lives of others . Fire Chief Brian Dale recognized community members whose selfless actions made a difference in the lives of others; Robert Carson was awarded the Citizens Heroism Metal and Dillion Garcia was presented with a Citizens Accommodation Award. Chief Dale stated the Mayor and Council provided the Fire Department with funding and the challenge to increase diversity and outreach among the City' s youth. He introduced the Fire Department Cadet Leader Program Members/Cadet Planning Committee . Susi Alley, Fire Department Explorer Program and Community Outreach Specialist reviewed the establishment, goals, and accomplishments of the Program/Committee . Hannah Lingle, Cadet Planning Committee Chair, spoke of the Program' s benefits to the youth of the City and of the Committee' s creation of an oath of office, code of conduct, values, motto, and charter. 16 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 20 , 2016 #4 . 7:24:41 PM Councilmember Penfold moved and Councilmember Kitchen seconded to approve the minutes of the following Council meetings, which motion carried, all members present voted aye . • September 6, 2016 Formal Meeting • September 13, 2016 Limited Formal Meeting (M 16-3) (M 16-4) PUBLIC HEARINGS Note: Items 1 and 2 are related to the Lincoln Elementary School Rezone. #1 . 7 :25:33 PM Accept public comment and consider an ordinance amending the zoning of properties located at 1069 South 200 East, 1063, 1064 , 1070 and 1071 South Roberta Street and 1070 and 1110 South 300 East Street from Single-Family Residential (R-1/5,000) District to Public Lands (PL) District and amending the Central Community Master Plan Future Land Use Map pursuant to Petition Nos . PLNPCM2016-00094 and PLNPCM2016-00095 . This proposal is related to the expansion of Lincoln Elementary School . The Salt Lake City School District is constructing a new school on the east side of the property. Once the new building is constructed, the original will be demolished and the land developed as open space (Petitioner: Salt Lake City School District) . (P 16-28) #3 . 7 :26:51 PM Accept public comment and consider an ordinance amending the zoning of property located at 1117 East South Temple Street from Moderate Density Multi-Family Residential (RMF-35) District to 16 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 20 , 2016 Residential/Mixed Use (R-MU-35) District and amend the Avenues Community Master Plan Future Land Use Map pursuant to Petition Nos . PLNPCM2015- 00808 and PLNPCM2015-00887 . The proposal would allow the property owner to build a 14-unit apartment building with underground parking. Current zoning would limit construction to two dwellings (Petitioner: Tariq Mughal) . View Attachments Luke Mughal, representing the applicant, stated a meeting was held with the Community Council and all the needs presented had been met and addressed by the applicant. He said the proposal would add value to the community. He pointed out a setback precedent set by a neighbor on the west side was being met and there was a development agreement with the City for no commercial use of the property. Cindy Cromer and Vincent Chang spoke in opposition of the proposal . Comments included concern with development agreements, proposed setbacks, not consulting with the Historical Landmarks Commission regarding the proposal, current/potential parking issues, and concern with potential changes to the nature of the area. Mike Marron, Scott Cruze, Susan Sundstrom, and Larry Foote all spoke in favor of the proposal . Comments included security with underground parking, the potential benefit to the University of Utah and its community, concern with potential parking issues, impeding height of the building, how a new building would fit in next to existing historical buildings, many years of neglect to the property, and sharing a driveway with the proposed developer. Councilmember Penfold moved and Councilmember Luke seconded to close the public hearing and defer action to a future Council meeting, which motion carried, all members present voted aye . (P 16-29) POTENTIAL ACTION ITEMS #1 . 7:37:44 PM Adopting an ordinance amending various sections of Title 21A Zoning pertaining to attached garage regulations in residential zoning districts pursuant to Petition No. PLNPCM2014-00133 . This proposal has been revised based on Council feedback. The proposal would change the garage-building standards and eliminate the proposed special exception for attached garages that project forward from the front facade in residential district (Petitioner-Salt Lake City Council) . (P 16-24) #2 . 7 :38 :30 PM Adopting an ordinance amending the zoning map pertaining to properties located at 842 , 834 , 824 , 825, 845, and 843 West Hoyt Place, 826 West 200 North, and 247 North 800 West to rezone those parcels from R-1/5,000 and R-1/7,000 to SR-3 pursuant to Petition No: PLNPCM2015-00301 . The rezone would allow for medium density development potential and a broader range of housing options. There is no specific development project proposed at this time. Although the applicant has requested that the property be rezoned to SR-3, consideration may be given to rezoning the properties to another zoning district with similar characteristics (Petitioner: David Robinson) . (P 16-27) Items 3 and 4 are related to 800 West and 800 North Rezone. #3 . 7 :39:19 PM Adopting an ordinance amending section 21A.33 . 020 Table of Permitted and Conditional Uses for Residential Districts, to allow for "Community Recreation Center" as a conditional use in the Residential Multi-Family, Low Density (RMF-35) pursuant to Petition No . PLNPCM2015-00775 . The changes would apply citywide. (P 16-26) #4 . 7 :40 :02 PM Adopting an ordinance closing a portion of 800 West, north of a terminating cul-de-sac, at approximately 800 North pursuant to Petition No . PLNPCM2015-00462 . This portion of 800 West was cut off as a result of freeway construction association with Interstate 15. The purpose of the closure is to make the site available for the construction of a Rose Park Immigrant and Refugee Community Center (Petitioner: Tom Lloyd) . (P 16-26) #5 . 7 :40:32 PM Adopting an ordinance amending the final budget of Salt Lake City, including the employment staffing document, for Fiscal Year 2016-2017 . Under the proposal, the remaining funds from the Public Safety Bond would be used to construct a logistics facility for the Fire Department at 1560 South Industrial Road-the site of the Fire Department Training Tower. Included is a proposal to use Police Impact fees for the payment of the long term lease for the police crime lab, which would free up funding for other projects. This amendment may also include funding relating to purchase or lease of real property, or related expenses. Budget amendments happen several times each year to reflect adjustments to the City's budgets, including proposed project additions and modifications (Budget Amendment No. 1) . View Attachments Councilmember Luke moved and Councilmember Penfold seconded to adopt Ordinance 63 of 2016 amending the Final Budget of Salt Lake City, including the employment staffing document for Fiscal Year 2016-2017 , as outlined in the transmittal for Budget Amendment No. 1 (providing for a Fire Department Logistics building and Lease Payments for the Crime Lab) and, consider the following Council added item: The Council wishes to express its concerns about the placement and size of new homeless resource centers in the City. Since site selection is a mayoral decision, the Council has requested the Mayor announce sites for the facilities by Oct. 10 in order to allow time for public engagement before any State legislative deadline . In addition, the Council has asked the Mayor' s office and Salt Lake County to submit a plan by Nov. 1 for how they will identify and rectify potential negative neighborhood impacts, including determining the resources that will be needed. The Council also has identified needed changes in City land use ordinances intended to help minimize potential impact. The Council is striving to reach a balance of needs as we protect our neighborhoods and care for those in need. It should be clear we are driven by compassion as we seek short and long term solutions . So, additionally, Council Members have called for a plan from the Mayor in preparation for how the City will address emergency services this winter, 16 - 5 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 20 , 2016 and respond to the crisis conditions along 500 West and the Rio Grande/Pioneer Park area. Councilmember Luke further moved the Council allocate $1,031,000 from the Surplus Land Account, for the Administration to use for property acquisitions and related expenses, with these understandings in mind: • That the City, with support and endorsement of Salt Lake County, will request reimbursement from the State; • That the location or facility comply with all City zoning standards and regulations; • That the location or facility be compatible with adjoining land uses, including: o A 250 cap on the number of beds; o A prohibition of overflow accommodations . o Addressing criteria established through the Homeless Site Selection Commission process and the Administration including geographic criteria, other buffers, and environmental justice buffers as referenced in a September 9, 2016, Salt Lake City Council staff report. Councilmember Mendenhall called for the question, which motion carried, all members present voted aye . (B 16-9) 7 :4 3:5 2 PM COMMENTS Steven Hunt, Marilyn Oblad, Jeff Bair, Rebekah Huber, and Dewitt Smith all spoke regarding the current congestion of traffic at Whittier Elementary School during student pick-up/drop-off times . Comments included the needed design and construction of student pick-up/drop-off lanes, hazardous traffic situations/potential dangers, submittal of a Capital Improvement Projects (CIP) application from the Liberty Wells Community Council, feasibility of the proposal, Development Review Team' s (DRT) support of the proposed project, and recommendation the Council find funding to support the proposed project . Bernard Hart expressed concern regarding homelessness . He questioned how the homeless could transition out of homelessness without affordable housing and health care and the lack of available funding. UNFINISHED BUSINESS #1 . 7 :52 :18 PM Adopting a 2016 Economic Development Policy Statement 16 - 6 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 20 , 2016 represents the Council' s vision for economic development policy. View Attachments Councilmember Luke moved and Councilmember Kitchen seconded to adopt the 2016 Economic Development Policy Statement: The Salt Lake City Council' s 2016 Economic Development Policy Statement The Council wishes to foster a robust, sustainable and diverse economy in Salt Lake City through: a. Maintaining Salt Lake City' s position as Utah' s preeminent economic center and one of the most important in the Intermountain West. b. Cultivating qualities that contribute to Salt Lake City' s vibrancy and economic health, including: i. A diverse population; ii. Identifiable neighborhoods; iii. Neighborhood business districts; iv. Thriving arts and culture; v. Affordable housing; vi. Transportation options, particularly transit and alternative modes; and vii.Access to natural outdoor environments that is unmatched by other urban areas . c. Promoting economic and educational opportunities that target populations in need. d. Increasing the skills of the City' s workforce. e. Encouraging business projects that meet the City' s vision, create high-quality jobs, and are located to maximize the City' s existing infrastructure, transit options, and housing. f. Working collaboratively with other levels of governments and with non-governmental organizations to increase the effectiveness and efficiency of our efforts . g. Fostering population growth by increasing density, where appropriate. h. Expanding the City' s tax base so that funding for public infrastructure and services can keep pace with demand. i . Tracking City progress in economic development, identifying successes and areas needing improvement. (R 16-12) 7 :5 4 :2 7 PM CONSENT 16 - 7 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 20, 2016 Councilmember Penfold moved and Councilmember Luke seconded to adopt the Consent Agenda, which motion carried, all members present voted aye . #1 . Adopting Resolution 29 of 2016 authorizing Salt Lake City to apply for a grant award from the United States Bureau of Reclamation for drought contingency planning. View Attachments (R 16-11) #2 . Setting the date of Tuesday, October 4 , 2016, at 7 : 00 p.m. to hold a public hearing and accept public comment regarding an ordinance amending various sections of Salt Lake City Code pertaining to the local historic designation process (amending various sections of Title 21A Zoning) pursuant to Petition No . PLNPCM2015-00149 . Under the proposal, changes would be made to align the process with State code. Specifically, signatures would be needed from at least 33 percent of residents in a proposed district before an application could be initiated (currently only 15 percent are required) , and additional informative outreach efforts would be required, among other changes (Petitioner: Former Mayor Ralph Becker) .
