THURSDAY, SEPTEMBER 21 , 2006
The City Council of Salt Lake City, Utah, met in Regular Session
on Thursday, September 21, 2006 at 7 : 20 p.m. in Room 326, City Council
Office, City County Building, 451 South State .
The following Council Members were present:
Carlton Christensen Van Turner Jill Remington Love
Nancy Saxton Eric Jergensen Dave Buhler
The following Councilmember was absent :
Soren Simonsen
Cindy Gust-Jenson, Executive Council Director; Acting Mayor Rocky
Fluhart; Edwin Rutan, City Attorney; Larry Spendlove, Senior City
Attorney and Chris Meeker, Chief Deputy City Recorder, were present.
Councilmember Buhler presided at and conducted the meeting.
PUBLIC HEARINGS
#1 . 7 : 20 : 26 PM Accept public comment and consider adopting
resolutions initiating eminent domain proceedings ; regarding the
Westside Railroad Re-alignment and Public way Improvements - (500 North
to 200 South and 500 West to 1000 West) - Project No . 109009 . View

7 : 21 : 28 PM Jason Broschinsky, Alan King, Stacy Knox, Mike Harman
and Roger Jacobsen.
Councilmember Jergensen moved and Councilmember Turner seconded to
close the public hearing, which motion carried, all members present
voted aye .
Councilmember Jergensen asked what the City' s legal obligation
towards the properties was . Mr. Spendlove said there were two
obligations . He said the first was the obligation to pay a fair market
value and the second was the obligation to assist financially to
relocate . He said second appraisals were also an obligation.
Councilmember Turner asked the administration to find out what or if
the City was obligated to financially assist employees of companies
that were relocating.
7 : 44 : 30 PM Councilmember Christensen moved and Councilmember Love
seconded to enter into Executive Session for the purpose of strategy
sessions to discuss the purchase, exchange, or lease of real property

when public discussion of the transaction would disclose the appraisal
or estimated value of the property under consideration or prevent the
public body from completing the transaction on the best possible
terms, and to discuss pending or reasonably imminent litigation;
pursuant to Utah Code Ann. § § 52-4-204, 52-4-205 (1) (c) and (d) , and
attorney-client matters that are privileged, pursuant to Utah Code
Ann. § 78-24-8, which motion carried, all members present voted aye.
Councilmember Christensen moved and Councilmember Love seconded to
adopt Resolution 60 of 2006, initiating eminent domain proceedings on a
parcel of real estate located in Salt Lake County and identified as
parcel number 08-35-458-023 owned by R&R Center LLC at approximately 3
North and 800 West Street in Salt Lake City and consider the next item
on the agenda, which motion carried, all members present voted aye .
Councilmember Christensen moved and Councilmember Jergensen move
to reconsider Resolution 60 of 2006, removing the wording "consider the
next item on the agenda", which motion carried, all members present
voted aye .
Councilmember Christensen moved and Councilmember Love seconded to
adopt Resolution 60 of 2006, (I) initiating eminent domain proceedings
on a parcel of real estate located in Salt Lake County and identified
as parcel number 08-35-458-023 owned by R&R Center LLC at approximately
3 North and 800 West Street in Salt Lake City, which motion carried,
all members present voted aye .
Councilmember Christensen moved and Councilmember Love seconded to
adopt Resolution 61 of 2006, (II) initiating eminent domain proceedings
on a parcel of real estate located in Salt Lake County and identified
as parcel number 15-02-228-001 owned by Terry Nish at approximately 761
West South Temple Street in Salt Lake City, which motion carried, all
members present voted aye .
Councilmember Christensen moved and Councilmember Love seconded to
adopt Resolution 62 of 2006, (III) initiating eminent domain
proceedings on a parcel of real estate located in Salt Lake County and
identified as parcel number 15-02-227-003 owned by Grand Staircase Inc.
at approximately 767 West South Temple Street in Salt Lake City, which
motion carried, all members present voted aye .
Councilmember Christensen moved and Councilmember Love seconded to
adopt Resolution 63 of 2006, (IV) initiating eminent domain proceedings
on a parcels of real estate located in Salt Lake County and identified
as parcel numbers 15-02-227-001 and 15-02-227-002 owned by Jason
Broschinsky at approximately 777, 779 and 799 West South Temple Street
in Salt Lake City, which motion carried, all members present voted aye .

Councilmember Christensen moved and Councilmember Jergensen
seconded to adopt Resolution 64 of 2006, (V) initiating eminent domain
proceedings on a parcels of real estate located in Salt Lake County and
identified as parcel numbers 15-02-228-003, 15-02-228-004 and 15-02-
228-005 owned by Knox Investment LTD at approximately 741 West South
Temple, 741 West South Temple and 721 West South Temple Street in Salt
Lake City, which motion carried, all members present voted aye.
