The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday,
September 22, 2009 at 7:00 p.m. in Room 315, City Council Chambers, City County
Building, 451 South State.
The following Council Members were present:
Carlton Christensen Van Turner Eric Jergensen
Jill Remington Love JT Martin Luke Garrott
Soren Simonsen
Cindy Gust-Jenson, Executive Council Director; Edwin Rutan, City Attorney;
Mayor Ralph Becker; and Christine Meeker, City Recorder; were present.
Councilmember Christensen presided at and Councilmember Love conducted the
meeting.
OPENING CEREMONY
#1.7 :05:46 PM The Council led the Pledge of Allegiance.
#2.7 : 07: 03 PM Councilmember Turner moved and Councilmember Garrott seconded
to approve the minutes of the Salt Lake City Council meeting held September 8, 2009,

PUBLIC HEARINGS
#1. 7 : 07: 16 PM RE: Accept public comment and consider action to amend the
Central Community Master Plan Future Land Use Map to change the land use designation
for property located at approximately 248 South and 254 South 800 East from Medium
Density Residential use (15-30 dwelling units per acre) to Medium/High Density
Residential use (30-50 dwelling units per acre) pursuant to Petition No. PLNPCM2008-
00149 (Reese Enterprises) . View Attachments
The following citizens spoke in opposition to the petition: Cindy Cromer,
Ester Hunter, Melinda Main and Nancy Saxton.
Councilmember Jergensen moved and Councilmember Turner seconded to close the
public hearing, which motion carried, all members voted aye.
Councilmember Christensen moved and Councilmember Turner seconded to refer the
decision to a future Council meeting, which motion carried, all members voted aye.

amending the zoning map to change the zoning designation of property located at 230
West North Temple Street from Public Lands (PL) to Residential Mixed Use (R-MU) ,

Councilmember Garrott moved and Councilmember Christensen seconded to close the
public hearing and refer the decision to a future Council meeting, which motion
carried, all members voted aye.

#4. 7: 17: 00 PM RE: Accept public comment regarding a resolution providing
for the holding of a special bond election in Salt Lake City, Utah, at the same time
as the municipal general election, for the purpose of submitting to the qualified
electors thereof the question of whether general obligation bonds of the City, in an
amount not to exceed $125,000,000, shall be issued and sold for the of paying the
costs of providing public safety facilities; providing for the holding of a public
hearing and the publication of a Notice of Public Hearing; declaring official intent
with respect to certain expenditures; and providing for related matters. View

Ray Kingston asked the Council to connect the bond issue with the site the
building would be built on and not use the Barnes Bank building.
Councilmember Christensen moved and Councilmember Garrott seconded to close the
public hearing relating to the issuance of the City's general obligation bonds to
fund public safety facilities and the impact such facilities will have on the private
sector, which motion carried, all members voted aye.

#5. 7:21:33 PM RE: Receive a briefing regarding impact fees and Waxie's
Enterprises, Inc. appeal seeking a refund of impact fees paid and accept public
comment regarding the request from Waxie' s Enterprises, Inc. to refund a portion of
the impact fees paid. View Attachments
Councilmember Love said under Salt Lake City Code the City Council was
designated as the appeal authority for impact fee disputes.
7:22:06 PM Jodi Hoffman, Legal Counsel for the City Council, spoke regarding
the Council' s role.
7:24: 16 PM David Baird, representing Waxie' s Enterprises, Inc. spoke regarding
the appeal.
7:47: 17 PM LuAnn Clark, Community and Economic Development, spoke regarding
the appeal.
7:48:55 PM Lynn Pace, Deputy City Attorney spoke regarding the appeal.
Councilmember Simonsen moved and Councilmember Garrott seconded to close the
public hearing refer the decision to a future Council meeting, which motion carried,
all members voted aye.

8:07: 18 PM COMMENTS TO THE CITY COUNCIL
Donald Throgmorton spoke about traffic speed and running stop signs on Center
Street and 500 North. Ray Wheeler and Jeff Salt spoke in opposition to the purchase
of land for a soccer field. Mallie Jowell spoke in opposition to raising property
taxes for a Public Safety building. Ray Kingston spoke in support of the Parks,
Trails and Urban Forestry Advisory Board.

Councilmember Simonsen moved and Councilmember Garrott seconded to recess as
the City Council and convene with the Mayor as the Board of Canvassers, which motion
carried, all members voted aye.
Councilmember Christensen moved and Councilmember Jergensen seconded to adopt
the returns as prepared by the Recorder's Office for the election, which motion
carried, all members voted aye.
Councilmember Simonsen moved and Councilmember Turner seconded to adjourn as
the Board of Canvassers and reconvene as the City Council, which motion carried, all
members voted aye.
