TUESDAY, SEPTEMBER 24 , 2013
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, September 24, 2013 at 7 : 00 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State.
The following Council Members were present:
Carlton Christensen Charlie Luke Stan Penfold
Soren Simonsen Luke Garrott Kyle LaMalfa
Jill Remington Love
Cindy Gust-Jenson, Executive Council Director; Margaret Plane,
City Attorney; David Everitt, Mayor' s Chief of Staff; and Beverly
Jones, Deputy City Recorder; were present.
Councilmember LaMalfa presided at and Councilmember Penfold
conducted the meeting.
OPENING CEREMONY

Christensen seconded to approve the Work Session Minutes of Tuesday,
August 20 , 2013 and the Formal Meeting Minutes of Tuesday, August 27 ,
2013 and Tuesday September 3, 2013, which motion carried, all members

PUBLIC HEARINGS
#1. RE: 7 :30 :20 PM Accept public comment and consider adopting,
renumbering, and amending existing ordinances of Salt Lake City Code
to give the City discretion to grant leave with pay to employees who
are certified disaster service employees to participate in disaster
relief services for up to 12 work days in any 12 month period. The
proposal would also create Title 22, Local Emergencies, a separate
title in Salt Lake City Code, to give local emergency provisions
greater prominence . The proposal is part of the City's efforts to
actively prepare for disasters and catastrophic events. (Creating new
Title 22, Local Emergencies; renumbering and amending existing
provisions on emergency management in Sections 2. 08. 010, 2. 08. 020,
2. 09. 025, 2. 09. 030, 2. 09. 040, 2. 09. 050, 2. 09. 060, 2. 09. 070, 2. 09. 080,

Councilmember Christensen moved and Councilmember Garrott
seconded to close the public hearing, which motion carried, all
members voted aye .
Councilmember Christensen moved and Councilmember Simonsen
seconded to adopt Ordinance 54 of 2013, which motion carried, all
members voted aye .

#2 . RE: 7 :32 :27 PM Accept public comment and consider adopting an
ordinance amending Salt Lake City Code, (Section 2 . 54 . 030) relating to
the personal use of City-owned vehicles by employees and the payment
required by employees who take such vehicles home. The proposed
changes would: View Attachments
• Limit the employee' s personal use of City-owned vehicles . The
change is designed to lessen the overall carbon footprint and
allow for quicker emergency response time for all duty
emergency responders .
• Alter the fee structure that determines how much employees pay
to use the vehicles . The change would base fees off an
individualized calculation from the employee' s residence to the
City' s boundaries rather than the current approach that is
based on how close they live to a demarcation line.
Councilmember Luke moved and Councilmember LaMalfa seconded to
close the public hearing, which motion carried, all members voted aye .
Councilmember Luke moved and Councilmember LaMalfa seconded to
suspend the rules and adopt Ordinance 55 of 2013, which motion
carried, all members voted aye .

#3 . RE : 7 : 33 :29 PM Accept public comment and consider adopting an
ordinance closing a 370-foot portion of City-owned alley adjacent to
the Glendale Library Branch property at 1365 South Concord Street
pursuant to Petition No. PLNPCM2013-00172 . The alley is situated
midblock between Concord Street and 1200 West and between California
Avenue and 1400 South. Closing the alley to vehicle traffic will allow
the alley to be landscaped. (Petitioner Mayor Ralph Becker) View

Jay Ingleby said he represented Glendale Park. He said they had
been waiting four years for a library. He said he was in favor of the
petition. Randy Sorensen said he was the Glendale Community Council

Chair. He said it had been four years since the library was proposed.
He said the community had been waiting a long time for a library.
Councilmember LaMalfa moved and Councilmember Simonsen seconded
to close the public hearing, which motion carried, all members voted
aye .
Councilmember LaMalfa moved and Councilmember Love seconded to
adopt Ordinance 56 of 2013, which motion carried, all members voted
aye .

#4 . RE: 7 : 37 : 49 PM Accept public comment and consider adopting an
ordinance amending Title 21A, Zoning, Salt Lake City Code, relating to
the City' s zoning regulations allowing community gardens in the Open
Space (OS) zoning district pursuant to Petition No. PLNPCM2012-0032 .
The change would allow community gardens in appropriate City-owned
locations. Community gardens would not be allowed along the Jordan
River, City Creek, Red Butte Creek, Emigration Creek, and Parley's
Creek. Related provisions of Title 21A, Zoning, may also be amended as

Christensen seconded to recess as the City Council and convene as the
Board of Directors of the Local Building Authority, which motion
carried, all members voted aye .
Director Garrott moved and Director Simonsen seconded to adjourn
as the Board of Directors of the Local Building Authority and
reconvene as the City Council, which motion carried, all members voted
aye .

QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 7 : 56 :26 PM
Councilmember LaMalfa asked David Everitt, Acting Mayor, about
the Glendale Library. Mr. Everitt said at the Library Board meeting
yesterday the Board was told that a bidder had been selected and the
Engineering Division was negotiating a contract .

Saundra Puffy-Hawkins and Scott Hawkins spoke in opposition of
the local opinion ballot and also in opposition of the $70, 000 to
$130, 000 cost .

UNFINISHED BUSINESS
#1 . RE: 8 : 50 : 31 PM Adopting a parameters resolution authorizing
the issuance and sale of up to $10 million aggregate principal amount
of the City' s sale and excise tax revenue bonds to finance all or a
portion of the cost of acquiring, constructing, improving, or
remodeling certain improvements within the City, including a streetcar
line in the Sugar House neighborhood, and providing for related
matters; and setting the date of Tuesday, October 15, 2013 at 7 : 00
p.m. (included as part of the parameters resolution) to receive input
from the public with respect to the issuance of the City' s sales and
excise tax bonds to finance all or a portion of the cost of (a)
acquiring, constructing, and improving (i) a streetcar line in the
Sugar House Neighborhood, (ii) various improvements to create a
"greenway" surrounding such a streetcar line, and (iii) related
improvements, and (b) acquiring, constructing, improving, and
remodeling various other capital improvement program projects and the
potential economic impact that such improvements and projects will

to adopt Resolution 44 of 2013 authorizing the issuance and the sale
of sales and excise tax revenue bonds and setting the date of Tuesday,
October 15, 2103 at 7 : 00 p.m. to hold the public hearing, which motion
carried, all members voted aye .

CONSENT AGENDA
Councilmember LaMalfa moved and Councilmember Simonsen seconded
to adopt the Consent Agenda, which motion carried, all members voted
aye .
#1. RE: Setting the date of Tuesday, October 15, 2013 at 7 : 00
p.m. to accept public comment and consider adopting an ordinance
amending Salt Lake City Code relating to abandonment or loss of a
nonconforming use (Section 21A. 38 . 070) pursuant to Petition No.
PLNPCM2013-00265 . The proposed changes would restructure the section
text for clarity and make City code more consistent with State Code
and Best Practices. Related provisions of Title 21A, Zoning, may also
be amended as part of this petition. (Petitioner Mayor Ralph Becker) .

#2 . RE: Setting the date of Tuesday, October 15, 2013 at 7 : 00
p.m. to accept public comment and consider adopting an ordinance
amending the zoning map pertaining to property located at 401 East 900
South from RMF-30 (Low Density Multi-Family Residential) to CN
(Neighborhood Commercial) and amending the Central Community Master
Plan Future Land Use Map pursuant to Petition Nos . PLNPCM2013-00156
and PLNPCM2013-00398 . The changes are designed to bring an existing
non-conforming commercial business into compliance with City zoning
regulations. Although the applicant has requested that the property be
rezoned to CN (Neighborhood Commercial) consideration may be given to
rezoning the properties to another zoning district with similar
characteristics. Related provisions of Title 21A, Zoning, may also be

#3 . RE: Setting the date of Tuesday, October 15, 2013 at 7 :00
p.m. to accept public comment and consider adopting an ordinance
amending certain sections of Title 21A, Zoning, Salt Lake City Code,
relating to parking and transportation demand management pursuant to
Petition No. PLNPCM2010-00468 . The changes are designed to encourage
sustainable transportation and mobility development by integrating

Transportation Demand Management strategies. Among others, the

• Reducing the number of curb cuts allowed in residential and

• Expanding regulations for bicycle parking, location, and
design.
