The City Council of Salt Lake City, Utah, met in Formal Session on
Tuesday, September 4 , 2018 in Room 315, Council Chambers, City County
Building, 451 South State .
The following Council Members were present :
James Rogers Andrew Johnston Amy Fowler

Jennifer Bruno, Council Executive Deputy Director; Jacqueline

present .
Councilmember Mendenhall presided at and Councilmember Kitchen
conducted the meeting.
The meeting was called to order at 7 : 04 p .m.

PUBLIC HEARINGS
#1 . 7 : 05:35 PM Accept public comment and consider adopting an
ordinance amending Chapter 9 . 16, Article I, renumbering Section 9. 16 . 110
and Section 9. 16. 120, and repealing Chapter 9. 16, Article II , and Chapter
21A.20, Enforcement, Salt Lake City Code, relating to weeds and the
clearing of real property pursuant to Petition No . PLNPCM2017-00058 . The
changes include clearer language on the noticing of the City's intent to
abate zoning violations, collection of the costs of abatement, the
appeals process, and the duties and roles of the Fines Hearing Officer.

close the public hearing and defer action to a future meeting, which
motion carried, all members voted aye .

#2 . 7:06:23 PM Accept public comment and consider adopting an
ordinance amending Chapter 21A. 46, Section 21A. 52 . 030 (A) , and Section
21A. 60 . 020, Salt Lake City Code, pertaining to vintage signs . pursuant
to Petition No. PLNPCM2017-00819 . The amendments would clarify
regulations concerning non-conforming signs. The proposed changes would
support the retention, restoration, and reuse of non-conforming signs
that help create the distinct character of Salt Lake City's
neighborhoods, business districts, and corridors, through the following
changes to the ordinance:
1 . Create additional clarity about the maintenance options
available for non-conforming signs.
2. Establish a process for property owners to nominate potential
vintage signs for designation and modification.
3. Produce criteria to ensure that designated signs have
characteristics that make them worthy of additional
flexibility.
4. Provide a framework of options that will support property
owners in retaining these signs.
This petition was initiated by the City Council in June 2016. View

Judi Short and Kirk Huffaker spoke in support of the proposal .
Comments included: Sugarhouse had lost important iconic signage,
preservation of remaining signs, signs in every neighborhood were
important, signs were part of the character that defined Salt Lake City,
and signage was about places and cultural legacy.
Councilmember Mendenhall thanked the community members for their
persistence in pursuing the vintage sign ordinance, and said it was an
important ordinance to give old signs new life .
Councilmember Luke thanked the community and recognized the
proposed ordinance as preserving heritage through signage . He said he
wanted to see the City re-evaluate its position regarding signage so
that it was not just historic/vintage signs being protected, but allowed
for improvements that fostered creativity and unique identity.
Councilmember Wharton thanked the community and expressed his
excitement for the opportunity to vote on the proposed ordinance, citing
the rich history of Salt Lake City signage and the possibility of
historic signage becoming public art features . He said this would help
place-make various communities .

Councilmember Rogers moved and Councilmember Wharton seconded to
close the public hearing, suspend the rules, and adopt the revised
Ordinance 45 of 2018, amending Chapter 21A. 52 . 030 (A) , and Section
21A. 60 . 020 of the Salt Lake City Code pertaining to vintage signs , which
motion carried, all members voted aye .

#3 . 7 : 12 :20 PM Accept public comment and consider adopting an
ordinance amending the zoning map pertaining to a parcel of property
approximately located at 569 East 2nd Avenue to rezone the parcel from
SR-lA (Special Development Pattern Residential District) to SNB (Small
Neighborhood Business District) pursuant to Petition No. PLNPCM2015-
00273 . The applicant is requesting the rezone in order to make the parcel
zoning uniform for future development purposes. View Attachments
Joseph Hatch spoke in support of the proposed rezone . He said he
represented the owner of the property involved and hoped the Council
could support the rezone .

motion carried, all members voted aye .

Task Force Grant requesting funding for the costs associated with the
Salt Lake City Police Department taking over fiduciary responsibilities

POTENTIAL ACTION ITEMS
#1 . 7 : 14 : 11 PM Consider adopting an ordinance amending Section
21A. 37 . 020, Salt Lake City Code, relating to design standards pursuant
to Petition No. PLNPCM2017-00921 . Design standards are intended to use
principles of planning and architecture to shape and promote a walkable
environment, foster place making, protect property values, help maintain
the established character of the City and implement the City's master
plans. The proposed amendment would add language clarifying that design
standards apply to new construction and additions as well as to existing
structures when physical modifications to design elements are proposed.
Other sections of Title 21A, Zoning, may also be amended as part of this

adopt Ordinance 46 of 2018, amending Section 21A.37 . 020, Salt Lake City
Code, pertaining to design standards, which motion carried, all members

#2 . 7 :14 :46 PM Consider adopting an ordinance amending Section
21A. 33 . 070, Salt Lake City Code, pertaining to retail service
establishments pursuant to Petition No. PLNPCM2017-00752 . The proposed
ordinance would amend the land use table to allow Retail Services in the
Mixed Use (MU) zone as a permitted use. The MU zone currently allows
"Retail Sales ", which is a similar land use type. During the previous

amendment to the land use tables, retail services was inadvertently
removed from the section of the ordinance that allows that use in the MU

Ordinance 47 of 2018 , amending Section 21A. 33 . 070 , Salt Lake City Code,
pertaining to retail service establishments, which motion carried, all
members voted aye .

#3 . 7 : 15:20 PM Consider adopting an ordinance amending Chapter
21A. 06, Chapter 21A. 16, and Section 21A. 35 . 020 , Salt Lake City Code,
pertaining to the appeals process for decisions made by the Historic
Landmark Commission pursuant to Petition No . PLNPCM2017-00154 . The
amendments intended to align City ordinance with State Code. The changes
would allow applicants to appeal a decision of the Historic Landmark
Commission to the Mayor, among other changes. Other sections of Title
21A-Zoning may also be amended as part of this petition. (Petitioner:

Councilmember Mendenhall moved and Councilmember Wharton seconded
to adopt Ordinance 48 of 2018, amending various chapters of the Salt
Lake City Code pertaining to the appeals process for decisions made by
the Historic Landmark Commission, which motion carried, all members voted
aye, except Councilmember Rogers, who voted nay.

COMMENTS TO THE CITY COUNCIL 7 : 16:23 PM
Cindy Cromer referenced a handout she provided and spoke regarding
the administrative process for awarding contracts . She suggested, during
the budgeting process, to provide a two-stage process : a request for
qualifications and a request for proposals, and advised against awarding
contracts to the lowest bidder.
CONSENT 7 : 19: 0 8 PM
Councilmember Mendenhall moved and Councilmember Rogers seconded to
approve the Consent Agenda, which motion carried, all members voted aye .
#1 . Setting the date of Tuesday, September 18 , 2018 at 7 : 00 p.m.
to accept public comment pertaining to the general development of the
State Inland Port. The Council is interested in hearing residents'
feedback and concerns pertaining to the development in the northwest
quadrant of the City, including the Inland Port. The Council 's intent is

to use this feedback to inform the City on potential changes and
improvements that could be made; additionally, this information will be
shared with the Inland Port Board so they may consider it as they
establish policies and processes for future development of the Inland
Port.

#2 . Setting the dates of Tuesday, October 2, 2018 and Tuesday,
October 16, 2018 at 7 : 00 p.m. to accept public comment and consider
adopting an ordinance amending the City' s Accessory Dwelling Unit (ADU)
regulations. ADUs are small apartments that share a lot with a single-
family home. They can be basement apartments, above and inside garages,
or entirely separate buildings. Currently, new ADU permits are only
available for properties located a half mile or less from a fixed rail
transit stop. The proposal would:
• Allow ADUs citywide
as conditional uses in the FR (Foothill Residential District)
and R-1 (Single Family Residential) zoning districts.
as permitted uses in all other residential zoning districts
that already allow duplexes, triplexes, and multi-family as
permitted uses.
• Prohibit ADUs from being used as short term rentals.
• Require properties with ADUs to have a deed restriction stating
that the owner must occupy the property.
• Create different standards for Attached and Detached ADUs.
• Change the wording of some standards for clarity.
• Add design standards to address compatibility with principle

to accept public comment related to the resolution of intention to
designate an Assessment Area for the purpose of levying assessments
against properties within the Assessment Area to continue to promote
business activity and economic development in the central business area
of downtown Salt Lake City by assessing benefited properties within the
Assessment Area for the costs of such economic promotion activities for
a period of three years and to fix a time and place for protests against
the Assessment Area and its assessments , and related matters . View
