The City Council met in Work Session on Tuesday June 11, 2020, in
an Electronic Meeting, pursuant to Salt Lake City Emergency
Proclamation No. 2 of 2020(2)(b).
In Attendance: Council Members Andrew Johnston, Amy Fowler, Chris
Wharton, Daniel Dugan, Darin Mano, James Rogers, and Analia
Valdemoros.

Councilmember Wharton presided at and conducted the meeting.
The meeting was called to order at 3:33 p.m.
AGENDA ITEMS
#1. 3:33:14 PM CONSIDER A MOTION TO ENTER INTO CLOSED SESSION, IN KEEPING WITH UTAH CODE §52-4-205 FOR ANY ALLOWED PURPOSE. Councilmember Fowler moved and Councilmember Valdemoros
seconded to enter into Closed Session to discuss collective
bargaining strategies pursuant to Utah Code §52-4-205(1)(b); and
Attorney-Client matters that are privileged pursuant to Utah Code
§78B-1-137, Utah Open and Public Meetings Law. A roll call vote
was taken. Council Members Johnston, Wharton, Mano, Valdemoros,
Dugan, Fowler, and Rogers voted aye. See File M 20-1 for Sworn Statement.

#2.4:41:00 PM FOLLOW-UP DISCUSSION REGARDING THE POLICE DEPARTMENT BUDGET FOR FISCAL YEAR (FY) 2020-2021, INCLUDING POSSIBLE CHANGES RELATED TO THE COMMUNITY DIALOGUE ABOUT RACE AND JUSTICE IN RELATION TO LAW ENFORCEMENT POLICIES AND BUDGET. View Attachments
Jennifer Bruno briefed the Council regarding the following:
• Expected new growth revenue being less than anticipated
(Council tasked with finding $43,782 in savings)
• Less money to fund new initiatives through the judgement
levy ($456,367)
• Concept of moving funding from the Police Department for
increased transparency/prioritization, with the following
aspects: $512,578 transferred to non-departmental budget
ensuring a body-camera for every officer, reallocating
$55,000 for de-escalation training to non-departmental
budget, adding $267,800 to non-departmental budget for
additional de-escalation training, and potential of
restoring/hiring three Social Worker positions ($80,798)
• Concept of allocating funding ($2.8 Million – from Police
Dept budget) in a holding account pending further review
of the overall department budget and additional community
conversation (achieving this would mean a full year hiring
freeze for sworn officers and no recruiting class), with
the option to add to the account or make changes during
budget amendments.
Possible Legislative Intents regarding:
• moving programs from Police Department budget (Park
Rangers, Social Workers, and potentially Internal
Affairs), and determining consequences/operational side-
effects
• outlining steps (and timeline) for a Police Department
budget audit, to inform a zero-based budget exercise and
the FY 2021 budget
• prioritizing reimbursement of the Housing Stability
Program and addressing community needs identified in the
Community Development Block Grant (CDBG) process with

Coronavirus Aid, Relief, and Economic Security Act (CARES)
funds
• coordination with City Attorney’s Office to author an
ordinance implementing a Police section of the reporting
ordinance (in coordination with Mayor’s Office, Police
Department, and Finance)
• Capturing the following funds into a holding account for
Council identified community-building priorities
(underserved communities & communities of color): $422,979
from funds not expended from CIP projects older than three
years (including $250,000 of funding from CIP daycare
project), and $996,159 from the North Temple Viaduct CDA
account for debt service.
Councilmember Fowler indicated she wanted to add a
legislative intent with the power to deny acceptance of grant
applications for military grade equipment. Ms. Bruno said this
could be framed as a Council initiative, and the Police Department
could apply for such grants, but the Council would have the final
say (retaining more flexibility than prohibiting the Police
Department from applying from such grants). Katherine Lewis said
they could work through a way to have that language tied to Council
appropriation & budgetary power (draft ordinance to solidify the
concept). Councilmember Wharton said he agreed with Councilmember
Fowler’s request (the Council ultimately having to agree to receive
such appropriations - within the Council’s purview to approve or
deny). Councilmember Johnston added it was important for the
Council to be made aware of what surplus items the City would be
receiving and how they were to be used (training munitions vs.
full SWAT combat vehicles), and for the Council to be able to
review on case-by-case basis.
Councilmember Johnston said an audit was needed (with high
prioritization) for the Police Department budget and inquired if
funding would need to be allocated. He added that the findings of
the audit could help inform any future Mayor/Council initiated
commission, along with the clear intent to ensure any community
investment funding went to communities of color/underserved
communities. Ms. Bruno said there were five firms on contract
(specializing in municipal finance/operations), no Request for
Proposal (RFP) process was required, and sufficient funding was
available (encumbered).

Tim Doubt provided clarification of Internal Affairs’(IA)
role and reasoning for it being within the Police Department
(investigations were conducted regarding officer action/misconduct
and referred to a Commander/Supervisor who determined disciplinary
action). He said IA received all complaints about officers,
complaints against an officer were retained in a personnel file
only if disciplinary action was issued, and a database was used
for complaints against officers (detailing every complaint an
officer has had, disciplinary actions, etc.).
Straw Poll: Support for Staff’s recommendations on the
following:
• Move funding from Police Department to non-departmental
(directing it to officer body-cameras/training, and social
worker positions);
• $2.8 Million placed into a holding account (pending ongoing
discussions with the community & department on how to best
use funds);
• Re-evaluating with Legislative Intents;
• Community investment (funding from day care/North Temple
Viaduct directed to catalytic projects for either North
Temple and/or communities of color - contingent on the
findings of the future joint Mayor/Council commission);
and
• Changes to reporting requirements for the Police Department
All Council Members were in favor.

#4.6:40:08 PM FOLLOW-UP BRIEFING ABOUT UNRESOLVED ISSUES RELATING TO THE PROPOSED BUDGET FOR FISCAL YEAR (FY) 2020-2021. View Attachments
Jennifer Bruno, Benjamin Luedtke, and Lisa Shaffer briefed
the Council regarding the following information:
• $588,000 to be appropriated from Fund Balance for police
body-cameras, including revenue reimbursed from Airport
for body-cameras
• Potential funding source from funds not
expended/encumbered from FY 2019 & 2020 Community Land
Trust
• Attorney’s Office budget overage ($29,000)
• Increasing funding for homeless services (future needs)

• Transportation funding for projects added to a holding
account (excluding staffing)
• Restoring vacancy savings for Fire Department ($272,562
for seven fire fighters and one civilian position)
• Restoring vacancy savings for Public Services (maintenance
of parks and facilities, and additional homeless camp
clean-up)
• Adding funding to non-departmental for the Inn Between
Lani Eggertsen-Goff discussed the Inn Between’s Funding Our
Future application and said it was currently in the review process
and would come back to the Council for review within the next
month.
Further discussion was held regarding the Mayor’s recommended
budget regarding camp clean-ups, vacancy savings in relation to
Fund Balance, concerns regarding next year’s budget (specifically
looking at Fund Balance – including projections for the next few
years), current running balance of Fund Balance, and the Council’s
funding of the Financial Risk Assessment, (within Budget Amendment
No. 4) taking into consideration the risks to maintaining Fund
Balance (anticipated to be completed in FY 2021).
Straw Poll: Support for the Council to give direction to
Staff/Administration to look at unfreezing all/some Fire
Department positions (exploring all possible options – taking into
consideration the needs of the department), and report back at the
Council’s next meeting (before budget adoption). All Council
Members were in favor.
