The meeting was called to order at 7:00 pm MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, July 20, 2021 1 A.OPENING CEREMONY: 1. Council Member Amy Fowler will conduct the formal meeting. Minutes: Council Member Fowler welcomed attendees to the meeting and reviewed the new hybrid meeting format. 2. Pledge of Allegiance. Minutes: A moment of silence was held while the American Flag and Pledge text was displayed on the screen, those present recited the pledge. 3. Welcome and Public Meeting Rules. Minutes: Council Member Fowler presented the rules of decorum. 4. The Council will consider adopting a joint ceremonial resolution with Mayor Mendenhall declaring racism as a public health crisis. Minutes: Council Member Fowler read the resolution and the names of those that were instrumental in drafting the resolution. Council Member Wharton asked that a copy of the resolution be sent to the League of City and Towns to encourage other entities to adopt similar practices. Kevin Nguyen (University of Utah Student) commented on the resolution and its importance; thanked all of those involved in its creation. Council Member Fowler presented Andrew Johnston with gifts commemorating his service on the Council and commented on the difficulties Council Member Wharton faced as the former Council Chair presenting him a gift for his service and thanked the Council Members and their families for the support through the last 15 months. Budget amendments happen several times each year to reflect adjustments to the City’s budgets, including proposed project additions and modifications. The proposed amendment includes use of federal American Rescue Plan Act (ARPA) dollars for police officer compensation and salary adjustments for non-represented employees, among other items. During its July 13, 2021 Work Session meeting, the Council received information about the tax increase as well as information about the District’s abatement activity in the City. Brian Moench, Tena Rohr, Alice McHugh George Chapman, Anne Charles, Nigel Swaby, and Emily Alworth spoke in opposition to: •Lack of scientific evidence concerning the pesticides •Pesticides were neurotoxins and caused damage •Citizens did not want the toxins sprayed throughout the City •Mosquitos were becoming toxin-resistant •Citizens did not want the tax increase •Communities of color would be impacted more so than other communities •Tax increase unfairly placed the burden on the citizens and should be the Inland Port’s obligation •Provided information concerning the effects from the Inland Port according to Utah’s Board of Physicians Council Member Fowler explained that the City Council was unable to prevent the tax from occurring and the agenda item was used as a place for public comments on the topic. Council Members expressed concern over the use of pesticides and the practice or aerial spraying. The proposal would rezone the parcels from CN (Neighborhood Commercial District) and SR-1A (Special Development Pattern Residential District) to R-MU-35 (Residential/Mixed Use District). The applicant would like to build a multi-family development on the lots, however the request is not tied to a development proposal. The properties are located within the Avenues Local Historic District and any demolition or construction must be approved by the Historic Landmark Commission. Consideration may be given to rezoning the property to another zoning district with similar characteristics. Other sections of Title 21A – Zoning may also be amended as part of this petition. The proposal would rezone the properties from CC (Corridor Commercial District) to CSHBD2 (Sugar House Business District) and would amend the Sugar House Master Plan Future Land Use Map. The applicant is requesting to amend the Future Land Use Map in the Sugar House Master Plan from "Mixed Use - Low Intensity" to "Business District Mixed-Use - Neighborhood Scale." The intent of the request is to allow more flexibility to develop a future multi-family residential, office, or mixed-use development. David Scheer, Roger Harrie, Jackson Bradshaw, and Brian Hutchinson spoke to traffic issues in the Capitol Hill neighborhoods and asked for support of the Capital Improvement Program project to help with traffic calming. Alice McHugh expressed concern over the water needs of the Inland Port concerning the drought. Thanh (Tang) Huynh asked the Council to support funding for tennis courts MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, July 20, 2021 8 and thanked Council Members and the Mayor for their work throughout the pandemic. Robyn Adamson commented on the structural racism and urged Council to support processes that prevent structural racism to continue. Daniel Schelling, Hillary Jacobs, and Eric Edelman spoke to the Foothills trail stating: •A committee with no conflicts of interest was necessary •Thanked Council for addressing short-falls concerning the Foothills trails project •Asked Council to keep lobbyists out of the project •Asked that planning for the next phases be opened up for public input and the inclusion of third parties •Important to protect the natural areas in the Foothills Council Member Fowler asked those commenting to keep decorum and be respectful. Michael Valentine, Nicole Curtis, Robert Stefanik, Oscar Arvizu, Kevin Hartley, Mike Hatch, Donna Lyman, Angie Starr, Benjamin Anderson and Ronni Frazier spoke to Pantages Theater: •Questioned if the building was truly hazardous •Answers were needed to address what happened with the sale of the property •Why were historical specialists not contacted concerning the restoration costs •Why couldn’t the public tour the theater •Opposed to the demolition of the building •Architecture of the historic building was enjoyable and what it could offer for the future •Bringing justice to the theater and not allowing such a process to happen again Cindy Cromer refered to her comments submitted via email regarding the loss of housing in the City. George Chapman stated dogs should be allowed in Allen Park, spoke to the City’s affordable housing acts, expressed opposition to high density housing in single family zoning districts, and suggested creating more housing zones and adding traffic calming on east Capital Boulevard. Emily Alworth commented on the drought and using smart watering systems in MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, July 20, 2021 9 the City to cut down water usage.   E.NEW BUSINESS: 1. Resolution: Intention to Designate Central Business Improvement Area 2022 The Council will consider adopting a resolution of intention to designate Central Business Improvement Area 2022 (CBIA-22). The area is made up of about 50 city blocks and is currently managed by The Downtown Alliance under a contract with the City that expires April 2022. The resolution is the first step in establishing a funding tool for downtown marketing, promotion, business advocacy, and initiatives such as The Blocks, The Farmer’s Market, holiday lighting, and other programs. Administrative decisions are those made by the Planning Commission, Historic Landmark Commission, or the Zoning Administrator in the administration of the zoning ordinance. The amendments primarily clarify what matters can be decided by the City's Appeals Hearing Officer, who can appeal decisions, and when an appeal can stay a decision, modify City Code to align with State law, related case law, and make other clarifications to the appeals chapter of the zoning ordinance, including: •Clarify that the City Appeals Hearing Officer can only make decisions regarding the interpretation and application of provisions of Salt Lake City Code, not provisions regarding the interpretation and application of provisions of the Utah State Code, the Utah Constitution, Utah common law or federal law. •Modify the list of allowed appellants to the land use applicant, City board or officer, or “an adversely affected party” to comply with new State Code. •Eliminate automatic stays of decisions. An appellant would have to specifically request and justify a “stay” (a hold on further proceedings on a matter) when appealing an administrative decision. A special exception is a minor alteration of a dimensional requirement of the zoning ordinance or addresses accessory uses and structures. The purpose of this proposal is to amend the zoning ordinance related to special exceptions to accomplish the following: •Simplify the zoning ordinance by updating regulations and eliminating special exceptions; •Reallocate staff resources away from processing land use applications that favor individual properties and towards updating zoning codes to align with adopted master plans; and, •Increase predictability and reduce neighbor conflicts that are created by requests for exceptions to the zoning regulations; There are more than forty special exceptions authorized in the zoning ordinance. The proposal addresses each special exception and results in each special exception being deleted, permitted, or authorized through a different process in the zoning ordinance. Some special exceptions that will become permitted include changes to standards to add flexibility and reduce impacts. Special exceptions are approved by staff of the Planning Division, the Planning Commission, or Historic Landmark Commission. The proposed rezone to R-MU would allow for a café eatery within the existing building, which is not currently permitted under the existing RMF-35 zoning designation. The area is made up of about 50 city blocks and is currently managed by The Downtown Alliance under a contract with the City that expires April 2022.
