The Council will receive a briefing about potentially amending City Code Chapter 2.08.120 identifying the functions and responsibilities of the Sustainability Department. The amendment responds to a Legislative Intent from the last annual budget. There are four primary functions proposed and some have supporting focus areas and prioritization rankings. The changes are necessary to bring the City's building regulations into compliance with state law. Troy Anderson and Antonio Padilla presented the following: •Ordinance Amendments ◦Chapter 18.48 Boarded Building Fees ◾Boarding Process 1.Building identified 2.Boarding request 3.Cost recovery for boarding 4.Continues monitoring 5.Annual boarding fees 6.Collection of annual fees ◦Chapter 18.24 Building Construction Enforcement ◾Creates fines for Title 18 construction violations ◾Creates a civil penalty enforcement option ◾Civil notice and order, daily fines, small claims court, hearing officer to reduce fines after compliance ◦Chapter 18.50 Existing Residential Housing ◾Updates required for existing dwellings Council Members requested: •Boarded Building annual fees increase after each year boarded, and residential or commercial buildings should have different fees based on different values of the buildings to mitigate boarded buildings •Clarification on the definition of “coming into compliance” versus “fixing the problem” when violations occur and are remedied •Construction permits are required to be submitted before photos of surrounding properties in case future claims are made against the development •Passage of building fees from one developer to another ◦Fees are transferred with the title of the property to each owner Council Member Mano requested a review of how to transfer fees and their schedule as required information to be disclosed when a real estate transaction was happening.   5.Ordinance: Zoning Incentives for Adaptive Reuse and Preservation of Buildings Text Amendment ~ 3:00 p.m.  20 min. The Council will receive a briefing about a proposal that would amend various sections of Title 21A of the Salt Lake City Code pertaining to zoning incentives for adaptive reuse and preservation of buildings. The proposal would remove zoning barriers that prevent the reuse of buildings and offer zoning incentives to encourage a building to be reused rather than demolished. The proposed amendments involve multiple chapters of the Zoning Ordinance and would apply Citywide. Michelle Hoon discussed the following: •Increase of funding requested for ambassador program and services provided •Available metrics from the program on the number of engagements with citizens in homes and on the streets ◦Council Member Petro requested those metrics to fund the project with its growing scope of work Andrew Johnston discussed the families being displaced due to foreign government funding running out and stated that Salt Lake County had taken the lead to ensure the 25 families were placed in a motel until further solutions could be discussed and implemented.   8.Fiscal Year 2024-25 Budget: Department of Public Services ~ 4:25 p.m.  45 min. No discussion was held.   14.Ordinance: Planning and Historic Landmark Commission Membership and Appeals Hearing Officer Term Limit Text Amendment Written Briefing  - The Council will receive a written briefing about a proposal that would amend various sections of Title 21A of the Salt Lake City Code pertaining to the membership and term length of zoning decision-making bodies. The proposal is intended to reduce the minimum required number of commissioners for both the Planning Commission and Historic Landmark Commission so that if there is a sudden exit of commissioners, both land use authorities would be able to conduct City business. The proposal would also remove the language stating that the appeals hearing officer can serve no more than two consecutive five-year terms. This amendment will affect Chapter 21A.06 Decision Making Bodies and Officials.
