06/09/2020 - Work Session - MinutesMINUTES OF THE SALT LAKE CITY COUNCIL WORK SESSION MEETING TUESDAY, JUNE 9, 2020 20 - 1 The City Council met in Work Session on Tuesday June 9, 2020, in an Electronic Meeting, pursuant to Salt Lake City Emergency Proclamation No. 2 of 2020(2)(b). In Attendance: Council Members Andrew Johnston, Amy Fowler, Chris Wharton, Daniel Dugan, Darin Mano, James Rogers, and Analia Valdemoros. Councilmember Wharton presided at and conducted the meeting. The meeting was called to order at 3:12 p.m. Full Meeting Recording Found here: 3:12:33 PM AGENDA ITEMS #1. 3:15:12 PM (8:40) UPDATE FROM THE ADMINISTRATION ABOUT THE MAYOR’S EMERGENCY DECLARATIONS RELATING TO COVID-19 (CORONAVIRUS), THE MARCH 18TH EARTHQUAKE IN THE SALT LAKE VALLEY, AND RECENT PROTESTS IN THE CITY. As part of the update, the Council may discuss public health and other public safety, policy and budget issues stemming from the emergency declarations. The Council may also receive information or updates from organizations or experts related to the emergency responses and coordination, including but not limited to earthquake damage to the City, the functioning of the Emergency Operations Center (EOC), City response and aid, and the status of City buildings. View Attachments Rachel Otto and Lisa Shaffer briefed the Council regarding the current state of the Mayor’s Emergency Declaration. Ms. Otto presented an update which included the following information: MINUTES OF THE SALT LAKE CITY COUNCIL WORK SESSION MEETING TUESDAY, JUNE 9, 2020 20 - 2 • Localized data from the Salt Lake County Health Department regarding COVID-19 cases was received and reviewed. • The County’s epidemiologist stated the data showed a steady decline in positive cases/outbreak. • Governor Herbert extended the Orange Phase to June 12th at 12:00 AM. • The Council extended the Emergency Status through July 10th. Ms. Shaffer explained there was no current update regarding the status of repairing City-owned buildings that were damaged from the March 18th Earthquake. #2.3:19:33 PM (13:30) BRIEFING REGARDING THE ADMINISTRATION’S PROGRESS ON THE COUNCIL’S LEGISLATIVE INTENT STATEMENTS FOR FISCAL YEAR (FY) 2020-2021, AS WELL AS LEGISLATIVE INTENTS FROM PREVIOUS YEARS THAT HAVE NOT YET BEEN COMPLETED. Legislative intents are formal requests the Council makes of the Administration. This briefing will include updates on a variety of subjects, including the crossing guard program, funding for affordable housing, and more. All Council Members were in favor. #3. 3:44:34 PM (40:00) FOLLOW-UP DISCUSSION WITH THE ADMINISTRATION ABOUT CRITERIA THEY WILL USE IN CONTRACTS WITH PROVIDERS FOR HOUSING STABILITY PROGRAMS APPROVED BY THE COUNCIL ON JUNE 2, 2020. MINUTES OF THE SALT LAKE CITY COUNCIL WORK SESSION MEETING TUESDAY, JUNE 9, 2020 20 - 5 Ms. Eggertsen-Goff provided an update on the Housing Stability Recommendations which included the following information, in summary: • The Administration was exploring options for immediate deployment of housing stability assistance. (Funding sources included Housing Trust Fund (HTF), Coronavirus Aid, Relief, and Economic Security (CARES) Act, and Funding Our Future (FOF). • Competitive application process for FOF FY 2020-2021, program parameters requested by community partners during expedited application process. • Partner recommendations for rental/mortgage assistance, and rapid rehousing based on proven track record of running successful programs. Criteria was determined based on researched/collected data, guardrails (how programs were administered), and available community partners. • Rental Assistance Partners included: Utah Community Action, Asian Association, and Catholic Community Services. Mortgage Assistance Partners included: NeighborWorks Salt Lake and Community Development Corporation of Utah. Rapid Re-Housing partners included: The Road Home, Utah Community Action, and South Valley Services. • Critical dates and timeline were reviewed with the proposition of State assistance becoming available August 1st, 2020. #4. The conversation may include issues of community concern about race, equity, and justice in relation to law enforcement policies, procedures, budget, and ordinances. Ms. Otto provided an update which included the following information: • The Equity Plan was the point of orientation while communicating as a City (ensuring overall inclusiveness). • Plans to launch a Racial Equity in Policing Commission, to include community listening sessions to look at policies/best practices within the Police Department. Mayor Mendenhall spoke on the following: MINUTES OF THE SALT LAKE CITY COUNCIL WORK SESSION MEETING TUESDAY, JUNE 9, 2020 20 - 6 • Short/medium/long-term actions (administrative, budget, policy) were continuing to be reviewed to orient community conversation. • A draft proposal was currently underway regarding the Citizen Review Board. Mr. Brown and Mr. Doubt spoke on the following: • CompStat (a unit within the Police Department – used to track crime and police use of force related incidents) was led by a director with five civilian full-time employees (FTE). • The Records Management (RMS) System was updated and provided to the public to ensure transparency. • Arrest data was broken down by Council district and was also available to the public to ensure transparency. • Policies that speak on restraints were provided to Council for review and were released to the public. • The Police Department not using tear gas or rubber bullets (considered to be an indiscriminate use of force). • Verbal commands were given before any sort of use of force took place. • Officer involved critical incidents were not investigated by SLC Police Department themselves, but by teams determined by the District Attorney’s office to determine if the incident was justified by law. • The Citizen Review Board (made up of 10 members) by statute reviewed all use of force situations. • Officers receive training under State codes to investigate and follow-up with crime which includes a minimum of 40 hours of training per year. • The Community Policing goal was to establish and maintain a co- responder team model to include social workers and officers. • Uniforms, protective vests, and computers were included in the needs within the equipment funds. • $628,000 was currently funded within the budget for body cameras. Councilmember Johnston said the My Brother’s Keeper Alliance (M.B.K.A.)(Review, Engage, Report, Reform), and Campaign Zero (community oversight, limiting use of force, community representation, body cameras, training, etc.) concepts would help inform a commission on Racial Equity in Policing and asked that these options get reviewed for future discussions. Councilmember Fowler said she wanted more data on how often MINUTES OF THE SALT LAKE CITY COUNCIL WORK SESSION MEETING TUESDAY, JUNE 9, 2020 20 - 7 the co-responder team model was deployed and (in the long-term) wanted to see what the outcome was. Mike Brown said he would provide those numbers to the Council. #6.6:08:46 PM (3:02:05) FOLLOW-UP BRIEFING REGARDING UNRESOLVED ISSUES RELATING TO THE PROPOSED BUDGET FOR FISCAL YEAR 2020-2021. View Attachments Jennifer Bruno provided an update which included the following information: • Request for a straw poll in regard to the Judgement Levy (one- year, one-time property tax increase – triggering a Truth in Taxation hearing in August). • Funds within the Police Department budget were discussed to be moved into a holding account (with emphasis on ensuring body cameras be provided for all Police officers). Straw Poll: Support for acceptance of the Judgement Levy.
