04/01/2014 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, APRIL 1 , 2014 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, April 1, 2014 at 7 : 00 p.m. in Room 315, City Council Chambers, City County Building, 451 South State. The following Council Members were present: James Rogers Kyle LaMalfa Stan Penfold Luke Garrott Erin Mendenhall Charlie Luke Lisa Adams Cindy Gust-Jenson, Executive Council Director; Margaret Plane, City Attorney; David Everitt, Mayor' s Chief of Staff; Mayor Ralph Becker; and Beverly Jones, Deputy City Recorder; were present. Councilmember Rogers presided at and conducted the meeting. OPENING CEREMONY #1 . 7 : 08 : 08 PM Pledge of Allegiance. #2 . 7 : 08 :41 PM Councilmember Garrott moved and Councilmember Mendenhall seconded to approve the Salt Lake City Work Session meeting minutes for Tuesday, March 18, 2014, which motion carried, all members voted aye . View Minutes (M 14-3) PUBLIC HEARING #1 . RE: 7 : 10: 06 PM Accept public comment and consider adopting a proposal that would amend the City' s zoning regulations to establish water-efficient landscaping and tree protection regulations in an effort to promote sustainable urban living pursuant to Petition No. PLNPCM2010-00322; amending Sections 21A. 48, Zoning: Landscaping and Buffers, and 21A. 62, Zoning: Definitions, Salt Lake City Code. The proposed changes are designed to: View Attachments • reduce water consumption through grouping plants with similar watering needs together and ensure efficiencies in the irrigation system design upon installation; and • require the protection of existing trees in the landscaping when designing large projects. Councilmember Garrott moved and Councilmember Luke seconded to close the public hearing and defer action to a future meeting, which motion carried, all members voted aye . RE: 7 : 13: 04 PM Adopting an ordinance amending Salt Lake City Code related to Subdivisions, Site Development and Zoning regulations, amending Title 20, Subdivisions, Chapter 18 . 28, Site Development Regulations, and various sections of Title 21A, Zoning, pursuant to Petition Nos . PLNPCM2009-00484 and PLNPCM2009-01339 . The proposed amendments are designed to: View Attachments • reflect current design standards and best practices in lot, block, and street layout and connectivity; • make the review process more efficient and user-friendly; • facilitate incorporation of solar energy systems in new developments; and • consolidate subdivision regulations in one place. A roll call vote was taken, which motion failed, Council Members Adams, Luke, 14 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, APRIL 1, 2014 Mendenhall, Garrott, Penfold, and Rogers voted nay and Councilmember LaMalfa voted aye . 7 :25: 08 PM Motion 2 : Councilmember Garrott moved and Councilmember Mendenhall seconded to adopt Ordinance 8 of 2014 to approve the petition with the expressed intent that the Planning Division not accept any further applications or petitions for the closure of alleys in Salt Lake City until the City Council holds a policy discussion on the issue which will happen this calendar year. 7 :28 : 01 PM Substitute Motion: Councilmember Penfold moved and Councilmember Adams seconded to adopt the ordinance with no conditions. 7 :29: 00 PM Council Members spoke to the motions on whether or not a moratorium should be placed on alley closures/vacations until a discussion was held. Councilmember Rogers called for the question with a roll call vote on the substitute motion, which motion failed, Council Members Adams, Penfold, and Rogers voted aye and Council Members Luke, Mendenhall, LaMalfa, and Garrott voted nay. 7 : 34 : 06 PM Councilmember Rogers called for a roll call vote on Motion 2 . 7 :34 : 34 PM Discussion was held on whether the Council could bring back a motion to adopt the ordinance with no conditions attached. 7 :39:39 PM Motion 3 : Councilmember Rogers moved and Councilmember Garrott seconded a vote to stop the discussion, which motion carried, Council Members Adams, Luke, Mendenhall, Penfold, Garrott, LaMalfa, and Rogers voted aye . 7 : 41 : 04 PM Councilmember Rogers called for the question on Motion 2, which motion carried, Council Members Luke, Mendenhall, Garrott, and LaMalfa, voted aye and Council Members Adams, Penfold, and Rogers voted nay. (P 14-4) QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 7 : 42 : 02 PM Councilmember LaMalfa asked the Mayor about his recent trip to Geneva. Mayor Becker said it was fascinating to be part of a delegation reviewing a treaty that the USA was part of. 14 - 3 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, APRIL 1 , 2014 COMMENTS TO THE CITY COUNCIL 7 : 43 : 55 PM Barbara Gallegos spoke about the owner of an apartment complex where she lived. She said her carpet had been flooded twice and the linoleum was growing mold. She said if she did not renew her lease the landlord was going to charge her $20 more a month on a month to month lease plus $10 more a month for parking. She asked what her rights were . Councilmember Garrott asked staff to help Ms . Gallegos get the information she needed about her rights and the responsibilities of the landlord. CONSENT AGENDA 7 : 46 : 57 PM Councilmember Luke moved and Councilmember LaMalfa seconded to adopt the Consent Agenda, which motion carried, all members voted aye. #1 . RE: Setting the date of April 22, 2014 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance regarding proposed changes to the City' s size regulations for A-frame signs pursuant to Petition No . PLNPCM2013-00740 . The proposed changes would clarify the allowed size to be more compatible with typical A-frame sign manufacturing dimensions. The proposed changes will affect Section 21A. 46. 055, Temporary Portable Signs. Related provisions of Title 21A, Zoning, may also be amended as part of this petition. RE: Setting the date of April 22, 2014 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance regarding proposed changes to the City' s sign regulations for the Sugar House Business Districts (CSHBD1 and CSHBD2) pursuant to Petition No. PLNPCM2013- 00739 . The proposed change would allow one projecting building sign (blade sign) per business located at street level . Currently, only one projecting sign is allowed per street frontage. RE: Setting the date of April 22, 2014 at 7 :00 p.m. to accept public comment and consider adopting an ordinance amending the City' s regulations for drive-through facilities pursuant to Petition No . PLNPCM2009-00169 . The proposed changes would address service accessibility at drive-through windows for all patrons regardless of their mode of transportation and improve pedestrian access and safety. The proposed changes will affect Section 21A. 40. 060, Drive-Through Facility Regulations.
