04/02/2019 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, APRIL 2, 2019 The City Council of Salt Lake City, Utah, met in Formal Session on Tuesday, April 2, 2019 in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present: James Rogers Amy Fowler Chris Wharton Erin Mendenhall Charlie Luke Andrew Johnston Analia Valdemoros Cindy Gust-Jenson, Council Executive Director; Jennifer Bruno, Council Executive Deputy Director; David Litvack, Mayor' s Deputy Chief of Staff; Katherine Lewis, Senior City Attorney; and Scott Crandall, Deputy City Recorder; were present. Councilmember Luke presided at and Councilmember Johnston conducted the meeting. The meeting was called to order at 7 : 02 p .m. OPENING CEREMONY #1. 7:02:42 PM The Pledge of Allegiance . #2 . 7:03: 14 PM Welcome and Review of Standards of Conduct. #3. 7:04 :50 PM Councilmember Mendenhall moved and Councilmember Rogers seconded to approve the minutes of the Work Session meeting held February 5, 2019, which motion carried, all members voted aye . View Minutes (M 19-4) #4 . 7 :05: 11 PM Adopting a joint ceremonial resolution with the Mayor supporting the United Nations treaty on the prohibition of nuclear weapons . The resolution was read by Councilmember Luke and presented to representatives from Utah Campaign to Abolish Nuclear Weapons (UCAN) . Councilmember Luke moved and Councilmember Fowler seconded to adopt Resolution 7 of 2019, which motion carried, all members voted aye . (R 19-1) 19 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, APRIL 2 , 2019 PUBLIC HEARINGS #1 . 7 :12:43 PM Accept public comment and consider adopting an ordinance amending the final budget of Salt Lake City, including the employment staffing document, for Fiscal Year 2018-19. Budget amendments happen several times each year to reflect adjustments to the City's budgets, including proposed project additions and modifications. The proposed amendment includes funding for reconstructing 1500 South and other street improvements, expanding the Parks maintenance yard to accommodate the new streets maintenance crew, and an engineering study of structural and water conditions at the Warm Springs Plunge historic building, among other changes (Budget Amendment No. 5) . View Attachment Cristobal Villegas spoke in support of Census Coordinator funding. He expressed concern that the job description did not specifically state applicants needed to understand marginalized identities/economic classes which were historically present in census counting. He asked the Council to ensure the person hired understood the role ethnicity (race, gender identify, etc. ) played in census taking. Councilmember Rogers moved and Councilmember Wharton seconded to close the public hearing and refer action to a future date, which motion carried, all members voted aye . 7: 16:58 PM Ms . Gust-Jenson said based on the Council' s earlier decision to add tuition reimbursement expansion to the budget amendment, Staff suggested continuing the hearing (rather than closing) . She said, if desired, the Council could make a motion to reconsider the prior vote and then make a new motion to continue the hearing. Councilmember Fowler moved and Councilmember Wharton seconded to reconsider the prior motion closing the hearing and referring action to a future date, which motion carried, all members voted aye . Councilmember Rogers moved and Councilmember Fowler seconded to continue the public hearing to a future date, which motion carried, all members voted aye . (B 19-6) POTENTIAL ACTION ITEMS #1 . 7 : 15:38 PM Consider a proposal that would amend the zoning and future land use map for property located at 515 South 400 East pursuant to Petition No. PLNPCM-2018-00642 and Petition No. PLNPCM2018-00643 . The petitioner is requesting to change the future land use map for the 19 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, APRIL 2 , 2019 property from "Residential/Office Mixed Use" to "High Mixed Use" and to change the zoning map from Residential Office (RO) to Residential/Mixed Use (R-MU) . The intent is allow more flexibility to develop future multi- family residential, office or mixed-use development. A specific site development proposal has not been submitted with this request. The Planning Commission forwarded a negative recommendation, therefore an ordinance has not been drafted. If the Council decides to approve the zone change and master plan amendments, an ordinance would be drafted and considered for approval . Although the applicant has requested that the property be rezoned to R-MU, consideration may be given to rezoning the property to another zoning district with similar characteristics. (P 19-2) #2 . 7 : 16: 10 PM Adopting an ordinance amending various sections of Title 21A, Salt Lake City Code, pertaining to regulation changes for Open Space and similar uses pursuant to Petition No . PLNPCM2010-00406 . The proposed amendments address issues related to development standards, definitions and sign regulations relating to parks, open space and public facility uses, among other changes. The overall purpose of the project is to ensure City regulations help various departments meet their service and program goals, and support best practices relating to open space, recreation and land management. (P 19-3) #3 . 7 :19: 01 PM Adopting an ordinance that would amend various sections of Title 21A, Salt Lake City Code, pertaining to Conditional Building and Site Design Review (CBSDR) pursuant to Petition No . PLNPCM2016-00615 . The CBSDR process enables development of buildings that are taller or larger than zoning regulations would typically allow. It also enables flexible implementation of some design standards. The proposed amendments would clarify and improve the application process for developers. Under the proposal, minor requests related to zoning and design standards would be handled by the Administration, while major requests would be handled by the Planning Commission. Other sections of Title 21A, Zoning, may also be amended as part of this petition. COMMENTS TO THE CITY COUNCIL 7 :23:52 PM The following spoke about the need to increase the salary of Salt Lake City police officers : Steven Winters, Sarah Crane, Alen Gibic, Jonathan Fitisemanu, Pete Sauers, and Erin Shupe. Comments included Police Association, ongoing pay inequity, hazardous calls/situations, higher exposure to critical incidents, assault on officers/injuries, salary survey recommending adjustment, higher salaries needed to recruit best/brightest talent, officers exploring/moving to other agencies, Capital City needing to be pinnacle of State (top salaries) , need to keep up with rising costs, fewer applicants joining police force, elected officials giving themselves a pay raise, lack of concern from City officials, officers being underpaid/understaffed, and overworked, other agencies having better career paths/incentives/wages, City having highest service demand/more complex problems, new officers requiring lengthy training (retain experienced officers) , needing to plan for and protect City' s future (unprecedented growth) , police department being one of the best (diverse background/representation) , and consider negative message being sent to current and future officers . Cristobal Villegas spoke about inequity in adhering to two-minute comment time, escalating living costs requiring pay increases, need for campaign finance reform, and democratic engagement. NEW BUSINESS #1 . 7 :42 :28 PM Adopting a resolution authorizing Salt Lake City to apply for a $50, 000 grant award from the United States Department of Agriculture for a Northern Utah Food Hub Feasibility Study. The study 19 - 4 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, APRIL 2 , 2019 would assess the viability of specific infrastructure improvements that would strengthen community-based food trade connections and assist in the economic development of the rural agricultural business sector in Northern Utah. There is no cost sharing required to receive this grant. The U. S. Department of Agriculture requires a resolution adopted to the governing board of the applicant agency to apply for the grant. S . Department of Agriculture' s Rural Business Development Grant Program) , which motion carried, all members voted aye . Councilmember Rogers proposed a friendly amendment, seconded by Councilmember Fowler, to suspend the rules and adopt Resolution 8 of 2019, which motion carried, all members voted aye. (R 19-7) CONSENT 7 :4 3:4 8 PM Councilmember Luke moved and Councilmember Fowler seconded to approve the Consent Agenda, which motion carried, all members voted aye. #1. Setting the date of Tuesday, April 23, 2019 at 7 :00 p.m. to accept public comment and consider adopting an ordinance for a partial street vacation of Hillside Avenue adjacent to property located at 239 North East Capitol Street pursuant to Petition No. PLNPCM2108-00121 . Under the proposal, the property owner would purchase the front yard area between the house and the sidewalk at market-rate (the area is currently City-owned) . The approximately 2, 000 square-foot area includes an existing wall and structures. The partial vacation will not impact vehicular traffic or pedestrian access to the street or sidewalk.
