TUESDAY, APRIL 9, 2013
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, April 9, 2013 at 8 : 58 p.m. in Room 326, Committee Room,
City County Building, 451 South State .
The following Council Members were present:
Soren Simonsen Luke Garrott Stan Penfold
Kyle LaMalfa Charlie Luke Carlton Christensen
The following Councilmember was absent:
Jill Remington Love
Cindy Gust-Jenson, Executive Council Director; Edwin Rutan, City
Attorney; Ralph Becker, Mayor; Cindi Mansell, City Recorder; and Sonya
Kintaro, Chief Deputy City Recorder; were present.
Councilmember LaMalfa presided at and conducted the meeting.
OPENING CEREMONY

UNFINISHED BUSINESS
#1 . 8:59:53 PM Adopting a resolution approving the proposed goal,
outcome, and timeline of the Downtown Master Plan. View Attachments
Councilmember Penfold moved and Councilmember Luke seconded to
defer action to a future meeting, which motion carried, all members
present voted aye.

#2 . 9:00:37 PM Adopting an ordinance amending Section 15 . 16 . 010,
Salt Lake City Code, to allow community youth teams and organizations
to receive credit of up to 50% of the cost of their annual field usage
fees by voluntarily completing park facilities maintenance work for
the City. This item is a follow-up to action taken by the Council at
its April 2, 2013 meeting regarding athletic field fees. View

Councilmember Garrott moved and Councilmember Penfold seconded to
adopt Ordinance 19 of 2013 with the condition that Sweat Equity be put
in quotes ("Sweat Equity") .
Councilmember Christensen asked if that created any dilemmas from
a legal standpoint. Mr. Rutan said no.

carried, all members present voted aye .

#3. Utah Performing Arts Center Project (UPAC) View Attachments
a. 9:02:11 PM Adopting a public hearing resolution authorizing the
holding of a public hearing and setting the date of Tuesday, May 7,
2013 at 7 : 00 p.m. to receive input from the public with respect to the
issuance of the City' s sales and excise tax revenue bonds to finance a
portion of the cost of acquiring, constructing and equipping a
performing arts center and related improvements and the potential
economic impact that such performing arts center and related
improvements will have on the private sector and providing for related
matters .

Councilmember Christensen moved and Councilmember Simonsen
seconded to adopt Resolution 15 of 2013 and set the date of May 7,
2013 for a public hearing, which motion carried, all members present
voted aye .
b. 9:02:47 PM Setting the date of Tuesday, May 7 , 2013 at 7 : 00
p.m. to accept public comment and consider adopting an ordinance
amending the Fiscal Year 2013 adopted budget that creates a budget of
$116,000 ,000 in Capital Improvement Project (CIP) Fund. (Budget
Amendment No. 5)
Councilmember Penfold moved and Councilmember Luke seconded to
set the date of May 7, 2013 for a public hearing, which motion
carried, all members present voted aye .

#4 . 9:03:07 PM Local Building Authority of Salt Lake City, Utah

Councilmember Simonsen recused himself.
1 . Councilmember Christensen moved and Councilmember Garrott
seconded to recess as the City Council and convene as the Board of
Directors of the Local Building Authority, which motion carried, all
members present voted aye.
