TUESDAY, AUGUST 12 , 2014
The City Council of Salt Lake City, Utah, met in Regular Session on
Tuesday, August 12, 2014 at 7 : 00 p.m. in Room 315, Council Chambers,
City County Building, 451 South State .
The following Council Members were present:
Stan Penfold Luke Garrott Erin Mendenhall
Kyle LaMalfa Charlie Luke Lisa Adams
The following Councilmember was absent:
James Rogers
Cindy Gust-Jenson, Executive Council Director; Jennifer Bruno,
Executive Council Deputy Director; Ralph Becker, Mayor; David Everitt,
Mayor' s Chief of Staff; Boyd Ferguson, Senior City Attorney; and Scott
Crandall, Deputy City Recorder; were present.
Councilmember Luke presided at and Councilmember Mendenhall
conducted the meeting.

Garrott seconded to approve the minutes of the following Salt Lake
City Council meetings , which motion carried, all members present voted
aye .

PUBLIC HEARINGS
#1 . 7:06:51 PM Accept public comment and consider adopting one or
more ordinances adopting the final rate of tax levy, for all City
funds including the Library Fund, greater than the Certified Tax Rate,
upon all real and personal property within Salt Lake City made taxable
by law for Fiscal Year 2014-15 and adopt the final budget for Fiscal
Year 2014-15. View Attachments This hearing is required by state law,
because the Council is proposing to recover property tax revenue that
was not collected last year due to property value adjustments. This
results in a minor, one-time, one-year increase in the Salt Lake City
general property tax revenue collected. This is a routine process the

City uses to recover money that was otherwise due to the City.
George Chapman, Saundra Duffy-Hawkins, Jon Metcalf, and Salvador
Gomez spoke about the proposal . Comments included inadequate public
notice, additional tax increase, use money to increase police
officer' s salaries, economic hardship, cut spending instead of raising
taxes, wasting taxes on frivolous things, and undervalued business
properties .
Councilmember Penfold asked staff to direct Mr . Metcalf to the
County Assessor to address concerns about his property assessment .
Councilmember Penfold moved and Councilmember Garrott seconded to
close the public hearing, which motion carried, all members present
voted aye .
Councilmember Penfold moved and Councilmember LaMalfa seconded to
adopt the following ordinances :
• Ordinance 46 of 2014 , establishing the final rate of tax levy
upon all real and personal property within Salt Lake City for
Fiscal Year 2014-15 (Library Fund) : 0 . 000782 for general Library
Fund operations and 0 . 000005 for the Library' s Judgment Levy; and
• Ordinance 47 of 2014 , establishing the final rate of tax levy
upon all real and personal property within Salt Lake City for
Fiscal Year 2014-15 for the City' s General Fund and Library Fund:
0 . 003787 for General Fund operations; 0 . 000782 for general
Library Fund operations; 0 . 001066 for repayment of General
Obligation Bonds previously approved by voters; 0 . 000035 for the
City' s General Fund Judgment Levy; and 0 . 000005 for the Library' s
Judgment Levy; and
• Ordinance 48 of 2014 (City budget) and Ordinance 49 of 2014
(Library Fund) ratifying the budgets for all City funds including
the Library Fund, and adopting the attached schedule, which
includes a minor correction to reflect the correct amount needed
to construct the McClelland Trail .
Councilmember Mendenhall called for the question, which motion
carried, all members present voted aye .

#2 . 7 :16:03 PM Accept public comment and consider adopting
ordinances to increase Green Fees and related changes . This fee
increase would not apply to Junior Golf Fees. The ordinances will
also address issues relating to discounting authority. (Amend

neighborhoods and needed to be preserved.
Councilmember LaMalfa moved and Councilmember Penfold seconded to
close the public hearing, which motion carried, all members present
voted aye .
Councilmember Penfold moved and Councilmember Garrott seconded to
adopt Ordinance 50 of 2014 , amending Sections 15 . 16. 031 and 15. 16. 035
relating to golf courses, green fees, and group reservations, and
Ordinance 51 of 2014, amending the Consolidated Fee Schedule, which
motion carried, all members present voted aye .

#3. 7:19:06 PM Accept public comment and consider adopting an
ordinance amending the zoning map for property located at 878-880 West
200 North Street from R-1-7000 (Single Family Residential) to SNB
(Small Neighborhood Business) pursuant to Petition No. PLNPCM2013-
000942 . View Attachments The property currently has both a residential
and retail use. The proposal would bring an existing legal
nonconforming retail use into compliance with zoning regulations.
Although the applicant has requested that the property be rezoned to
SNB (Small Neighborhood Business) , consideration may be given to
rezoning the properties to another zoning district with similar
characteristics. (Petitioner - Li Chen)
Li Chen submitted written comments in favor of the proposal .
Councilmember LaMalfa moved and Councilmember Garrott seconded to
close the public hearing and adopt Ordinance 52 of 2014 , which motion
carried, all members present voted aye .

#4 . 7:19:56 PM Accept public comment regarding the issuance of the
City' s Sales and Excise Tax Bonds to finance the cost of acquisition,
construction and improvement of various City buildings, parks,
property and roads and the potential economic impact that such
improvements and projects will have on the private sector. (Projects
also include the McClelland Trail)
Councilmember Penfold moved and Councilmember LaMalfa seconded to
close the public hearing and refer to August 19, 2014, which motion
carried, all members present voted aye .

7:21:59 PM Councilmember Mendenhall made an introductory statement
prior to public comments .
The following spoke or submitted written comments about a police
incident involving the shooting of a resident' s dog (Geist) : Eric
Jensen, Coleen Salinas, Catrina Melton, Patsy Rose, Susan Barretta,
Ernie Larum, Susan Bowlden, Merle French, Ray Matthews, Sarah West,
Ryan Peltekian, Dan Wheatley, Sean Kendall, Gene Baierschmidt, Richard
Jex, Debbie Williamson, Arthur Benjamin, Brittany Bremer, Ember Davis,
and Jeremy Moore . The following submitted written comments only: Cory
Isaac, Dee Harper, Collette Holmes, Brian Farrell, and Lisa Hansen.
Comments included action needed to prevent similar incidents, fear of
police officers, unjustified/illegal entry, implement additional
training, listen to residents needs, lethal force should be last
resort, utilize animal control, animal cruelty/unnecessary killing,
establish new laws/policy changes, demand accountability of police,
residents labeled violent/ridiculous, independent review, public
apology needed, learn how to identify dog behaviors, abuse of power,
feeling of betrayal, mandatory cameras on police officers, pets are
considered family members, utilize other deterrents, precedence that
police are exempt from laws/discipline, bias police review, erosion of
constitutional rights, and overreaching/controlling government.
George Chapman said the City needed to stop ticketing Uber/Lyft
drivers pending further review. He asked the Council to contact
Wasatch Front Regional Council regarding future streetcar development.
Jihad Al-Ali spoke about local elections, democracy, corruption,
and drug dealers .
Jim Webster spoke about the removal of approximately 400 trees in
Miller Park. He said there was a lot of misinformation about this
issue and a fraudulent news article was written by the Yalecrest
Community Council chair suggesting residents endorsed this action.

Councilmember Penfold moved and Councilmember LaMalfa seconded to
adopt the Consent Agenda, which motion carried, all members present
voted aye .
#1 . Setting the date of Tuesday, September 2 , 2014 at 7 : 00 p.m.
to accept public comment and consider adopting an ordinance amending
Section 21A. 40 . 065, Salt Lake City Code, relating to outdoor dining
regulations pursuant to Petition No. PLNPCM2014-00106 . The amendments
would allow outdoor dining for nonconforming restaurants and other

similar uses through the City's special exception process (Chapter
21A. 52-Special Exceptions) . Currently, nonconforming restaurants are
not allowed to have outdoor dining. Related provisions of Title 21A,
Zoning, may also be amended as part of this petition. (Petitioner -
