08/14/2018 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, AUGUST 14 , 2018 The City Council of Salt Lake City, Utah, met in Formal Session on Tuesday, August 14, 2018 in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present: James Rogers Andrew Johnston Amy Fowler Chris Wharton Erin Mendenhall Charlie Luke Derek Kitchen Cindy Gust-Jenson, Council Executive Director; Jennifer Bruno, Council Executive Deputy Director; Patrick Leary, Mayor' s Chief of Staff; David Litvack, Mayor' s Deputy Chief of Staff; Margaret Plane, City Attorney; and Scott Crandall, Deputy City Recorder; were present. Councilmember Mendenhall presided at and Councilmember Wharton conducted the meeting. The meeting was called to order at 7 : 29 p.m. OPENING CEREMONY #1 . 7 :29:47 PM Pledge of Allegiance . #2 . 7:30: 15 PM Welcome and Review of Standards of Conduct . #3. 7:31:58 PM Councilmember Rogers moved and Councilmember Kitchen seconded to approve the minutes of the following City Council meetings . • July 31, 2018 Formal Meeting • May 29, 2018 Work Session (M 18-3) (M 18-4) PUBLIC HEARINGS #1 . 7 :32 : 18 PM Accept public comment about an ordinance amending Chapter 14 .32 and enacting Chapter 14 . 56, Salt Lake City Code, to regulate the placement of wireless telecommunication facilities in the public right-of-way. Small cell wireless facilities could pave the way for 5G technology in Salt Lake City and improved service for 4G. As part of changes to State law, the City will soon be required to allow small cell installations within its right-of-way. The City is preparing design guidelines and a new ordinance to address forthcoming small cell infrastructure installations throughout the City. View Attachment Councilmember Mendenhall moved and Councilmember Johnston seconded to close the public hearing and defer action to a future date. 18 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, AUGUST 14 , 2018 Substitute Motion: Councilmember Luke moved and Councilmember Fowler seconded to continue the public hearing to a future date. Councilmember Luke said he wanted to continue the hearing to allow further review/input on design guidelines currently being worked on by the Planning Department. He said leaving the hearing open would eliminate the need to publish another notice and help expedite the process . Councilmember Wharton called for the question on the Substitute Motion, which motion carried, all members voted aye. (0 18-12) #2 . 7:34 : 10 PM Accept public comment and consider adopting an ordinance amending the identification requirements for business license applicants (amending Sections 5 . 02 . 060, 5 . 12 . 030, 5 . 14 . 030 , 5 . 16 . 050 , 5 . 40 . 050 , 5 . 54 . 030 , 5 . 61 . 110, 5 . 64 . 530, 5 . 64 . 600, 5 . 65 . 041 , 5 . 70 . 030, 5 . 74 . 030, 5 . 84 . 130 , 5 . 86 . 055 , and 5 . 86 . 470 , Salt Lake City Code) . The proposal will impose additional requirements regarding the identification of business license applicants. The proposed ordinance will require the presentation of photo identification as part of the business license application process and will also require business license applicants to provide evidence that they possess professional certifications necessary to operate specific categories of businesses. (0 18-11) #3 . 7 :34 :57 PM Accept public comment and consider adopting one or more ordinances adopting the final rate of tax levy, for all City funds including the Library Fund, in an amount greater than the Certified Tax Rate, upon all real and personal property within Salt Lake City made taxable by law for Fiscal Year 2018-2019 and adopting the final budget, including the Library Budget, for Fiscal Year 2018-2019 . View Attachment Kira Kilmer said the property valuation she received on her East Liberty Park residence showed a 33% increase (up $500 - more than any other year) . She asked if this would be an ongoing tread and whether other homes in the area experienced the same increase (was it only hers) . Councilmember Wharton asked Staff to meet with Ms . Kilmer to address her questions/concerns . Margaret Holloway said she understood the necessity for taxes but felt it was important for the City to utilize taxes for their intended 18 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, AUGUST 14 , 2018 purpose . She said when money was shifted around, the City lost credibility and generally came back to the public for more . She said if money had to be moved, the Council needed to find a way to replace it . Michael Nielsen said clarification was needed regarding items listed on property owner' s tax assessments . He said a reason or rationale needed to be provided showing why money was needed and how it would be spent . Councilmember Wharton asked Staff to meet with Mr. Nielsen to address his questions/concerns . Spencer Nir expressed concerns about tax increases . He said although he wanted to buy a home in Salt Lake, he was less inclined to do so given the City' s history of tax increases . He said the City complained about the lack of affordable housing but continued to raise taxes on a regular basis . He asked the Council to be cautious and consider reallocating current revenue and also think about the impact taxes had on less well- to-do residents . Hal Noyce Jr. submitted a written comment card expressing concerns about escalating taxes and the difficulties they imposed on residents with limited income (may force people to leave the City) . Councilmember Mendenhall moved and Councilmember Kitchen seconded to close the public hearing and adopt Ordinance 38 of 2018 , establishing the final rate of tax levy, including the final levy for the Library Fund, upon all real and personal property within Salt Lake City, made taxable by law for fiscal year 2018-2019, and ratify the budget as adopted by the Council in June, which motion carried, all members voted aye . (B 18-1) (B 18-2) POTENTIAL ACTION ITEMS #1 . 7 :43: 06 PM Adopting an ordinance rezoning a portion of one parcel located at 744 West Jackson Avenue from SR-1 Special Development Pattern Residential District to TSA-UN-T Transit Station Area District (Urban Neighborhood Transition) pursuant to Petition No . PLNPCM2017-00709 . The parcel is currently split-zoned and the proposal would make the full parcel TSA-UN-T Transit Station Area District (Urban Neighborhood Transition) for future development purposes. (P 18-16) 18 - 3 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, AUGUST 14 , 2018 COMMENTS TO THE CITY COUNCIL 7:44: 42 PM Margaret Holloway spoke about the proposed road reconstruction General Obligation (GO) Bond. She said she sent a comment to the City about a pot hole that needed to be filled and received a response back telling her "first pass the bond and then we will put it on the list" . She said pot holes were a safety issue, dangerous to cyclists/others, and she was very upset to receive that type of response . She said especially when she was only asking for a hole to be filled, not for total street reconstruction. She said that kind of dialog made residents angry and was totally unacceptable and the City needed to re-evaluate how it responded to resident' s concerns and requests . UNFINISHED BUSINESS #1 . 7 :47 :45 PM Adopting a resolution providing for the holding of a bond election regarding the issuance and sale of $87 ,000 , 000 General Obligation Bonds to improve streets and roads and providing for related matters . As part of the "Funding Our Future" initiative, the City is considering issuing a General Obligation (GO) bond of up to $87 million dollars to pay for street reconstruction. (This would be in addition to the recently adopted sales tax increase, a portion of which will pay for increased street maintenance. ) View Attachment Councilmember Mendenhall moved and Councilmember Kitchen seconded to adopt Resolution 33 of 2018, providing for the holding of a local special bond election in Salt Lake City, Utah for the purpose of submitting to the qualified electors of the City the question of the issuance and sale of $87 ,000,000 General Obligation Bonds; providing for the holding of a public hearing and the publication of a Notice of Public Hearing; and providing for related matters. Councilmember Mendenhall said this was an opportunity to have a conversation with residents about the need for streets reconstruction. She said a lot of work had taken place and she was glad this could be done through a public vote . She said this was one piece of several funding sources the City needed to address infrastructure needs . She said she hoped the Council would unanimously support putting this on the ballot so residents/voters could decide if they wanted to make a commitment to rebuild City streets . (B 18-6) 18 - 4 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, AUGUST 14 , 2018 #2 . 7 :50: 02 PM Adopting a resolution of intention to designate an Assessment Area for the purpose of levying assessments against properties within the Assessment Area to continue to promote business activity and economic development in the central business area of downtown Salt Lake City by assessing benefited properties within the Assessment Area for the costs of such economic promotion activities for a period of three years and to fix a time and place for protests against the Assessment Area and its assessments, and related matters . Setting the date of Tuesday, September 4 , 2018 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance amending the zoning map pertaining to a parcel of property approximately located at 569 East 2nd Avenue to rezone the parcel from SR-lA (Special Development Pattern Residential District) to SNB (Small Neighborhood Business District) pursuant to Petition No . PLNPCM2015-00273 . The applicant is requesting the rezone in order to make the parcel zoning uniform for future development purposes. (Applicant: Boldspace, LLC) View Attachment (P 18-22) #2 . Setting the date of Tuesday, September 4 , 2018 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance amending Chapter 21A. 46, Section 21A.52 . 030 (A) , and Section 21A. 60 . 020 , Salt Lake City Code, pertaining to vintage signs pursuant to Petition No . PLNPCM2017- 00819 . The amendments would clarify regulations concerning nonconforming signs. The proposed changes would support the retention, restoration, and reuse of non-conforming signs that help create the distinct character of Salt Lake City's neighborhoods, business districts, and corridors, through the following changes to the ordinance: 1 . Create additional clarity about the maintenance options available for nonconforming signs. 2. Establish a process for property owners to nominate potential vintage signs for designation and modification. 3. Produce criteria to ensure that designated signs have characteristics that make them worthy of additional flexibility 4 . Setting the date of Tuesday, September 4 , 2018 at 7 : 00 p.m. to accept public comment about an ordinance amending the zoning of properties located at 629 East 800 South Street and 633 East 800 South Street from RMF-30 (Low Density Multi-Family Residential District) to R- MU-35 (Residential/Mixed Use District) and amending the Central Community Master Plan Future Land Use Map pursuant to Petition No. PLNPCM2018-00024 and Petition No. PLNPCM2018-00025 . The proposed ordinance would make the following amendments for the properties located at 629 East 800 South and 633 East 800 South: 1 . Rezone the property from RMF-30 (Low Density Multi-Family Residential) to the R-MU-35 (Residential Mixed-Use) ; and, 2. Amend the future land use designation in the Central Community Master Plan from Low Density Residential (1-15 dwelling units/acre) to Medium Residential/Mixed Use (10-50 dwellings units/acre) . These amendments would allow the property owner, Wasatch Community Gardens to use the two single-family homes (both of which are contributing structures in the Central City Local Historic District) on the property as administrative offices. Setting the date of Tuesday, September 4, 2018 at 7 : 00 p.m. to continue to accept public comment and consider adopting an ordinance amending Chapter 9. 16, Article I, renumbering Section 9. 16. 110 and Section 9.16.120, and repealing Chapter 9. 16, Article II, and Chapter 21A.20 (Enforcement) , Salt Lake City Code, relating to weeds and the clearing of real property pursuant to Petition No. PLNPCM2017-00058 . The changes include clarifying language about the noticing of the City's intent to abate zoning violations, collection of the costs of abatement, the appeals process, and the duties and roles of the Fines Hearing Officer.
