08/15/2013 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL THURSDAY, AUGUST 15, 2013 The City Council of Salt Lake City, Utah, met in Special Session on Thursday, August 15, 2013 at 6 : 01 p.m. in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present: Soren Simonsen Luke Garrott Jill Remington Love Kyle LaMalfa Charlie Luke Carlton Christensen Councilmember Stan Penfold was not present. Cindy Gust-Jenson, Executive Council Director; Margaret Plane, City Attorney; David Everitt, Mayor' s Chief of Staff; and Cindi Mansell, City Recorder; were present. Councilmember LaMalfa presided at and conducted the meeting. OPENING CEREMONY #1 . 6:01:46 PM Pledge of Allegiance . #2 . 6:03:09 PM Councilmember Christensen moved and Councilmember Luke seconded to approve the Work Session minutes of Tuesday, June 4, Friday, June 21, Tuesday, July 9, and Tuesday, July 16, 2013 and the Formal Meeting minutes of Friday, June 21, and Tuesday, July 16, 2013, which motion carried, all members present voted aye . View Attachments (M 13-3) (M 13-4) PUBLIC HEARINGS #1 . 6:03:29 PM Accept public comment and consider adopting one or more ordinances adopting the final rate of tax levy, for all City funds including the Library Fund, in an amount greater than the Certified Tax Rate, upon all real and personal property within Salt Lake City made taxable by law for Fiscal Year 2013-14 and adopting the final budget, including the library budget, for Fiscal Year 2013-2014 . View Attachments Steve Blach, Bob Clark, Andrew Eatchel, Bliss Parsons, Scott Hawkins, Saundra Duffy-Hawkins, George Clyman, Mark Dee Whitaker, Nancy Freeman, and Jerry Bergosh spoke against the proposed tax levy and resulting property tax increase . Concerns included the flat economy, percentage of tax increase, citizens on fixed incomes, intended use for tax increase funds not being legitimately disclosed, elected officials forgetting their promises to keep the budget in line, citizens losing trust in government, potential of other areas for income other than a property tax increase such as taxing the 13 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL THURSDAY, AUGUST 15, 2013 daytime population, the need for more consistent Police patrol and presence, what the City was doing to improve efficiency and lean operations, and the need for government to live within its means similar to residents and private business owners . The request was also made to change the parking meter charge to free after 6pm to stalls surrounding City Hall in effort to encourage (rather than discourage) citizens to attend Council meetings and provide input. Hyrum Matthews said he was not a Salt Lake City resident but did have concerns about the Good Landlord Program being implemented by West Jordan City. He said many cities look to Salt Lake City for a model and he would encourage research as to how effective this program had been for Salt Lake City as well as impacts to residents and property owners . Jason Mathis said although he had concerns about the property tax increase and process, he wanted to offer suggestions for expenditure for these additional funds . He suggested new way-finding signage and addressing the crisis in Pioneer Park and the Rio Grande Neighborhood by funding homeless mitigation efforts . Councilmember Luke moved and Councilmember Christensen seconded to close the public hearing, which motion carried, all members present voted aye . 6:30:15 PM Councilmember Simonsen moved and Councilmember Garrott seconded to adopt an ordinance adopting the final City budget excluding the budget for the Library Fund which was separately adopted, and the employment staffing document of Salt Lake City, Utah for fiscal year 2013-2014 . 6:30:45 PM Councilmember Christensen said at one time the Council adopted a judgment levy in case they did not go forward with the tax increase . He inquired as to the intent of the Council . 6:31:18 PM Councilmember Simonsen withdrew his original motion. He then moved and Councilmember Love seconded to adopt Ordinance 47 of 2013 adopting the final City Budget, excluding the budget for the Library Fund which was separately adopted, and the employment staffing document of Salt Lake City, Utah for fiscal year 2013-2014, with the following changes : removal of the judgment levy revenue in the amount of $631, 938 and the related appropriation in the non-departmental budget. 6:32:14 PM Individual Council Members present spoke to the proposed tax increase . 13 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL THURSDAY, AUGUST 15, 2013 Chair LaMalfa called for the question and the motion carried 5-1, with Councilmember Christensen voting nay. Councilmember Penfold was not present. 6:49:10 PM Councilmember Simonsen moved and Councilmember Luke seconded to adopt Ordinance 48 of 2013 adopting the final City Budget for the Library Fund of Salt Lake City, Utah for fiscal year 2013- 2014, which motion carried, all members present voted aye. 6:49:33 PM Councilmember Simonsen moved and Councilmember Garrott seconded to adopt Ordinance 49 of 2013 adopting the final rate of tax levy to be credited to the Library Fund for fiscal year 2013-2014 : . 000820 for general Library Fund operations; and . 000007 for the Library' s Judgment Levy; which motion carried, all members present voted aye . 6:50:09 PM Councilmember Simonsen moved and Councilmember Garrott seconded to adopt Ordinance 50 of 2013 adopting the final rate of tax levy, including the final levy for the Library Fund, upon all real and personal property within Salt Lake City, made taxable by law for fiscal year 2013-2014 : . 0003965 for General Fund operations; . 000820 for general Library Fund operations; . 001064 for repayment of General Obligation bonds previously approved by voters; and . 000007 for the Library' s Judgment Levy; which motion carried 5-1, with Councilmember Christensen voting nay. Councilmember Penfold was not present.
