12/05/2017 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 5, 2017 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, December 5, 2017 at 7 : 02 p .m. in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present : Charlie Luke Andrew Johnston Derek Kitchen Lisa Adams Erin Mendenhall Stan Penfold James Rogers Jennifer Bruno, Council Executive Deputy Director; Margaret Plane, City Attorney; Patrick Leary, Mayor' s Chief of Staff; David Litvack, Mayor' s Deputy Chief of Staff; and Kory Solorio, Assistant City Recorder; were present . Councilmember Penfold presided at and conducted the meeting. View Attachment Councilmember Kitchen read the resolution . Councilmember Kitchen moved and Councilmember Luke seconded to adopt Resolution 35 of 2017, which motion carried, all members voted aye . (R 17-1) PUBLIC HEARINGS #1 . 7 :12:14 PM Accept public comment and consider adopting an ordinance amending the final budget of Salt Lake City, including the employment staffing document, for Fiscal Year 2017-18 . The proposed amendment includes a proposal to use RDA for affordable housing projects (Budget Amendment No. 2) . View Attachments Councilmember Adams moved and Councilmember Rogers seconded to close the public hearing, suspend the rules, and adopt Ordinance 65 of 2017 amending the Fiscal Year 2017-2018 budget to allow for: a. $2 million toward the general purposes of the Housing Trust Fund to be administered by HAND. 17 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 5, 2017 b. $1 million towards a new Renovation Pilot Program, aimed at providing renovation funds to improve existing affordable housing units in the City, in exchange for a guaranteed period of continued affordability, which motion carried, all members voted aye except Councilmember Kitchen, who was absent for the vote . (B 17-12) #2 . 7 :15:00 PM Accept public comment and consider a grant application requesting funds to support Salt Lake City' s Consumer Protection Program for two years, including the salary and benefits of a new Consumer Protection Processor position, to assist with the efforts to deter unfair and fraudulent business practices, maintain a fair marketplace, and encourage consumers and businesses to support and participate in ethical business practices . Councilmember Rogers moved and Councilmember Adams seconded to close the public hearing and refer action to a future meeting, which motion carried, all members voted aye . (B 17-4) POTENTIAL ACTION ITEMS #1 . 7 :15:58 PM Adopting an ordinance amending the final budget of Salt Lake City, including the employment staffing document, for Fiscal Year 2017-18 . Budget amendments happen several times each year to reflect adjustments to the City's budgets, including proposed project additions and modifications. This proposed amendment includes funding for Operation Rio Grande; possibly adding additional police officers; improvements at Pioneer Park that would remove the shuttered restrooms and open up the center of the park; and many other changes (Budget Amendment No. 1) . View Attachments Councilmember Mendenhall moved and Councilmember Luke seconded to adopt Ordinance 66 of 2017 amending the Final Budget of Salt Lake City, including the employment staffing document, for Fiscal Year 2017-18 as proposed by the Administration, with the following changes : • A-7 : Pioneer Park improvements implementation rescope using $544 ,000 of CIP funds along with up to $300,000 in financial contributions from the Pioneer Park Coalition. • A-2 : Operation Rio Grande using $2 ,169,200 from Fund Balance in addition to the Administration' s proposal for: 1 . Adding 50 new police officer FTEs, purchasing 50 vehicles and other equipment. 2 . Quarter-year funding for five civilian positions as follows : 17 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 5, 2017 a. One Quality Assurance Manager. b. Three Crime Lab Technicians . c. One Victim Advocate. 3 . Adding four civilian positions to the staffing document without funding this fiscal year as follows : a. Two Crime Intelligence Analysts . b. Two Records Clerks . • I-4 : Study of potential safety improvements along 600 North from 800 West to Redwood Road using $50 ,000 from FY 2018 Transportation Division vacancy savings . Councilmember Luke said he strongly supported the motion and thanked his colleagues for helping move it forward. Councilmember Rogers said this was something the Rose Park Community needed. He said traffic calming measurers had been invested in the community and this was another opportunity to create a walkable/livable environment for the neighborhood. Councilmember Penfold called for the question, which motion carried, all members voted aye . (B 17-11) #2 . 7 :18 :43 PM Adopting an ordinance that would rezone property located at 416 East 500 South from Residential Office (RO) to Residential/ Mixed Use (R-MU) pursuant to Petition Nos . PLNPCM2017-00184 and PLNPCM2017-00185 . The proposal would also amend the associated future land use map from Residential/Office Mixed Use to High Mixed Use. The intent of the changes is to provide flexibility for the owners to make changes to the property, including the ability to add or create a retail component and additional residential density. The Planning Commission forwarded a negative recommendation to the Council regarding both proposals. View Attachments Councilmember Rogers moved and Councilmember Luke seconded to adopt Ordinance 67 of 2017 amending the Central Community Master Plan to "High Mixed Use" and rezone the parcel to R-MU for the parcel located at 416 East 500 South, which motion carried, all members voted aye . (P 17-37) #3 . 7 :19:22 PM Adopting an ordinance that would rezone properties within the Northwest Quadrant area to be consistent with the Northwest Quadrant Master Plan pursuant to Petition No. PLNPCM2017-00655 . The proposed rezone includes: View Attachments • Rezoning properties currently zoned Agricultural (AG) and Open Space (OS) to Light Manufacturing (M-1) . 17 - 3 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 5, 2017 • Removing the mapped Lowland Conservancy Overlay (LCO) from the Northwest Quadrant. • Rezoning a parcel that is currently split-zoned AG and OS to AG. Councilmember Rogers moved and Councilmember Luke seconded to adopt Ordinance 68 of 2017 : • Amending the zoning map pertaining to several parcels located within the Northwest Quadrant area bound by the Northwest Quadrant Development Area and Eco-Industrial Buffer Area from AG and OS to M-1 . • Removing the LCO Lowland Conservancy Overlay District from the subject area. • Amending the zoning map pertaining to several parcels located within the Northwest Quadrant bound by 1800 South Street to the north, 7200 West Street to the east and the western and southern boundaries of the city boundary to rezone those parcels from AG to M-1 . • Amending the zoning map pertaining to one parcel located at approximately 1500 North 7200 West Street to rezone the parcel from AG and OS to AG, which motion carried, all members voted aye . (P 17-38) #4 . 7 :19:45 PM Adopting an ordinance amending Chapter 21A.27 , Salt Lake City Code, pertaining to land use regulations in the Form Based Urban Neighborhood (FB-UN2) zoning district pursuant to Petition No . PLNPCM2016-00463 . The proposal would require increased setbacks (distance between the property line and the structure) for buildings located next to certain residential areas, and step backs (Floors rising above a certain height must be 'stepped back" 15 horizontal feed from the building foundation at ground level . ) The proposal also includes design standards that are intended to clarify how the ground floors of buildings can be designed and used, address parking garage issues, and address issues that have arisen regarding overall building scale. View Attachments Councilmember Rogers moved and Councilmember Kitchen seconded to adopt Ordinance 69 of 2017 amending Chapter 21A.27 of the Salt Lake City Code pertaining to the FB-UN2 zoning district. Councilmember Adams said it would be helpful to outline what changes were made to the ordinance for the public . Mr . Tarbet said regarding ground floor use, the ordinance was amended to reduce the required depth for an active use from twenty-five feet to ten feet . He said regarding townhome restrictions, the Council eliminated the maximum number of units (minimum of three/maximum of five) in favor of the maximum length standards (two-hundred linear feet) . He said there was a request for additional height if setbacks and step backs were included, which the 17 - 4 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 5 , 2017 Council did not support . He said finally; the Council did not support allowing commercial parking lots as a use in the FB-UN2 zoning district . Councilmember Mendenhall said she recalled (after some discussion) keeping the townhome restrictions to a minimum of three/maximum of five . Mr. Tarbet stated straw polls showed the Council supported eliminating the minimum/maximum in-favor of the two-hundred linear feet guideline because of the requirement to break up a facade in that length. Councilmember Kitchen stated he was in favor of Form Based zoning and the City would have to continue to iron out issues in the code as it was rolled out City-wide. He thanked Cindy Cromer (for initially bringing up concerns regarding the Sugar House iteration of Form Based zoning) and the community for keeping their eyes on zoning codes and helping the City see issues where they arise . He said although not perfect, he supported the updated design standards . Councilmember Penfold called for the question, which motion carried, all members voted aye . (P 17-23) #5. 7:23:31 PM Approving a resolution which would adjust the boundary of the Mosquito Abatement District to include more of Salt Lake City. (R 17-12) #6. 7:24:12 PM Adopting an ordinance that would amend a section of the Salt Lake City Zoning Ordinance to include the Utah Jazz practice facility located at 1432 South 500 West into the localized alternative sign overlay district on the block that currently houses the Vivint Arena pursuant to Petition: PLNPCM2017-00407 . If approved, the overlay would allow the applicant to install signage that would otherwise not meet the basic standards of the existing zoning. View Attachments Item pulled from agenda. Councilmember Penfold stated this item was tabled and would be on the agenda next week for consideration. (P 17-25) #7 . 7:24:22 PM Adopting an ordinance that would amend the City' s accessory dwelling unit (ADU) regulations pursuant to Petition No. PLNPCM2014-00447 . ADUs are small apartments that share a lot with a single-family home. They can be basement apartments, above and inside garages, or entirely separate buildings. View Attachments 17 - 5 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 5 , 2017 The Council has expressed support to: • Include the boundaries recommended by the Planning Commission instead of allowing ADUs citywide. • Remove limits to the amount of new ADUs to be permitted each year. • Have the ordinance reviewed in three-year's time. Other changes may be considered by the Council based on the December 5, 2017 work session discussion. Item pulled from agenda. Councilmember Penfold stated (after several discussions) the Council had asked the Planning Department to review the discussion and concerns which were raised. He said Staff committed to return a revised ordinance to the Council in a March/April timeline . (P 17-20) COMMENTS TO THE CITY COUNCIL 7 :26:06 PM Douglas Cotant expressed frustration regarding safety and the lack of handrails in the building where he lived. Michael Fife commented about the Council' s approval to fund 50 additional police officers and 14 additional staff, instead of the original request for 27 additional officers . He expressed concern and frustration with an additional tax increase to fund the officers . He suggested the Council not get ahead of the budget and spend the money the City actually had. Sim Gill, Salt Lake County District Attorney, said as a private citizen and a resident of Salt Lake City, he came to thank the Council for adopting the resolution supporting legislation to enhance penalties for targeted offenses . He spoke regarding the strong message being sent to the State Legislature on the importance of hate crimes and targeting issues from the grass roots level . Jerry Schmidt spoke in opposition of Accessory Dwelling Units (ADUs) and expressed frustration with the ordinance approval process . NEW BUSINESS #1 . 7:36:39 PM Adopting a Legislative Action initiating a review of the City' s zoning ordinance pertaining to additional height allowed for retaining walls in the Foothill zoning districts, through the City' s special exception process . Specifically, a review of the requirement to obtain "no less than 80% of the neighbors owning property" which abut the alley. She said in some situations it became a mathematical impossibility and property owners could be held hostage . She said she hoped to have something easier in place which could be applied more readily. Councilmember Penfold acknowledged Council Staff was currently screening applications for alley closures through criteria the Council had previously set and was waiting for further discussion of alley closures throughout the City. Councilmember Penfold called for the question, which motion carried, all members voted aye . UNFINISHED BUSINESS #1 . 7:39:17 PM Adopting an ordinance adopting the Transit Master Plan. The Plan evaluates the City's travel patterns and transit needs and makes recommendations about transit service, infrastructure, supportive investments and policies for the next 20 years. The plan also includes recommendations, implementation strategies, and potential funding sources. View Attachments Councilmember Mendenhall moved and Councilmember Johnston seconded to adopt Ordinance 70 of 2017 to adopt the Salt Lake City Transit Master Plan with the revisions shown in the revised draft dated December 4 , 2017 , with the following amendment: • That on Page 3-10 in the revised plan section titled Transit Master Plan Priority Corridors for Capital Investments , the sentence that reads , "While the Transit Master Plan is generally mode-neutral, an interest in what a streetcar network would look like was one 17 - 7 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, DECEMBER 5, 2017 motivating factor for the City Council in funding this plan. " be omitted from the plan' s final version. Councilmember Mendenhall said the Council had been working on this for quite a while along with the Transportation Department . She expressed excitement with the adoption of the Transit Master Plan and called on the Council to figure out funding to make it happen . Councilmember Kitchen echoed Councilmember Mendenhall' s request to find funding for the Transit Master Plan . He said it was great on paper but resources were needed. Councilmember Penfold said he remembered working on the plan years ago, trying then to put funding together, and getting Utah Transit Authority (UTA) to partner with the City. He said he was thrilled to see this completed. Councilmember Luke said the Transit Master Plan project was a long time coming. He said the genesis started moving quickly during the Sugar House debate regarding the street cars . He said a lot of hard work had gone into this and thanked the Transportation Department and UTA. Councilmember Penfold called for the question, which motion carried, all members voted aye . State of Utah CCJJ (Commission on Criminal and Juvenile Justice - Jurisdictions with Halfway Houses and Parole Violator Centers Grant funding for targeted enforcement and additional patrol shifts, adding an office technician at the Community Connection Center, and a mobile surveillance trailer. 4 .
