TUESDAY, DECEMBER 5 , 2017
The City Council met in Work Session on Tuesday, December 5, 2017,
in Room 326, Committee Room, City County Building, 451 South State
Street.
In Attendance: Council Members Lisa Adams, Stan Penfold, Erin
Mendenhall, Derek Kitchen, Charlie Luke, James Rogers, and Andrew
Johnston.

Councilmember Penfold presided at and conducted the meeting.
The meeting was called to order at 4 : 27 p.m.

#1 . 4:28:11PM BRIEFING REGARDING A GRANT APPLICATION REQUESTING
FUNDS TO SUPPORT SALT LAKE CITY' S CONSUMER PROTECTION PROGRAM FOR
TWO YEARS, INCLUDING THE SALARY AND BENEFITS OF A NEW CONSUMER
PROTECTION PROCESSOR POSITION, TO ASSIST WITH THE EFFORTS TO DETER
UNFAIR AND FRAUDULENT BUSINESS PRACTICES, MAINTAIN A FAIR
MARKETPLACE, AND ENCOURAGE CONSUMERS AND BUSINESSES TO SUPPORT AND
PARTICIPATE IN ETHICAL BUSINESS PRACTICES . View Attachments
Sylvia Richards, Jennifer Bruno, and Mary Beth Thompson
briefed the Council with attachments . Discussion was held
regarding specific target areas of business practices, extracting
General Fund revenue for a specific program, limiting the number
of payday lenders, effect to nuisance hotels/motels, vision after
two year activity completion, enforcement of photo identification
(ID) and Department of Professional Licensing (DOPL) background
checks for business owners, and potential of consumer empowerment
by accessing data the City produced.

Council Members requested the following items from Staff:
• Provide potential effects to nuisance hotels/motels .
• Provide national research which correlates density of payday
lenders in areas with incidents of reported fraud/bankruptcy
or any other unhealthy financial scenarios for residents .
• Provide tracking information (when available) regarding
issues/gaps identified, what the City could legally provide
in the way of response/service, challenges/problems in the
community, and ordinance and legislation gaps which the City
could not regulate.
#2 . 4:46:36PM BRIEFING REGARDING AN ORDINANCE THAT WOULD
AMEND THE CITY' S ACCESSORY DWELLING UNIT (ADU) REGULATIONS . ADUs
are small apartments that share a lot with a single-family home.
They can be basement apartments, above and inside garages, or
entirely separate buildings . View Attachments
The Council has expressed support to:
• Include the boundaries recommended by the Planning Commission
instead of allowing ADUs citywide,
• Remove limits to the amount of new ADUs to be permitted each
year, and
• Have the ordinance reviewed in three-year's time. Other
changes may be considered by the Council .
Nick Tarbet, Nick Norris, Michael Malloy, and Paul Nielson
briefed the Council with attachments .
Councilmember Penfold stated there had been many lengthy
discussions about ADUs over the past six months . He said one
concern which evolved in the process was that many in the Community
and on the Council were in different places about the proposed
ordinance. He said he wanted to propose for discussion a concept
of sending the ADU ordinance back to the Planning Department for
modification, to re-examine and re-define some of the concerns and
issues identified through the public process, and to bring it back
to the Council at the beginning of next year (before the budget
process) .
Discussion was held regarding the timeframe to modify the
ordinance, pros and cons of a conditional use permit application
process, lack of enforcement ability to deal with housing issues,
and conditional use enforcement by complaint .
A unanimous Straw Poll was taken in support of sending the

ADU ordinance back to the Planning Department for modification and
changes (particularly related to recommendations to consider a
conditional use permit opportunity) and return to the Council with
a March/April timeline for presentation.
#3. 5:07:34PM BRIEFING REGARDING AN ORDINANCE ADOPTING THE
TRANSIT MASTER PLAN (TMP) . The plan evaluates the City 's travel
patterns and transit needs and makes recommendations about transit
service, infrastructure, supportive investments and policies for
the next 20 years. The plan also includes recommendations,
implementation strategies, and potential funding sources. View

Russell Weeks, Jonathan Larsen, and Julianne Sabula briefed
the Council with attachments . Discussion was held regarding a mode-
neutral plan, streetcar corridors, more specific recommendations
regarding the Wasatch Front Regional Council (WFRC) Regional
Transportation Plan, whether or not the TMP currently/sufficiently
refers to other regional planning documents which provide a more
frequent planning level, adequate access to the International
Center, and concern with transit to the industrial center south of
Interstate 80 (I-80) (west part of the City) .
A unanimous Straw Poll was taken in support of striking the
sentence on Page 3-10 in the revised plan section titled Transit
Master Plan Priority Corridors for Capital Investments which
reads, "While the plan is mode-neutral, an interest in what a
streetcar network would look like was one motivating factor for
the City Council in funding this plan" .
#4 . 5:23:20PM BRIEFING REGARDING BUDGET AMENDMENT NO. 1 FOR
THE FISCAL YEAR 2017-18 BUDGET. Budget amendments happen several
times each year to reflect adjustments to the City's budgets,
including proposed project additions and modifications. This
proposed amendment includes funding for Operation Rio Grande;
possibly adding additional police officers; improvements at
Pioneer Park that would remove the shuttered restrooms and open up
the center of the park; and many other changes. View Attachments
Jennifer Bruno, Benjamin Luedtke, Mike Brown, Tim Doubt, and
Mary Beth Thompson briefed the Council with attachments .
Discussion was held regarding concern with public comment on the
Pioneer Park proposal, cleaning of Pioneer Park restrooms,
Administration response concerning the Pioneer Park Coalition,
concern with the number of trees being removed in the Pioneer Park

proposal, funding timeline for the proposed additional Police
Department officers/staffing, Crime Lab turn-around timeline,
distinguishing between the current and additional need for
officers, timeline to hire a Crime Lab Technician, current state
accredited crime labs, potential to staff and use City Crime Lab
services as a resource for other entities to outsource, current
need for a Victim Advocate position, expected use/needs for
approved additional officers, concern regarding the current fund
balance in relation to the proposed costs for additional Police
Department officers and staff, concern with the additional work
load and the potential effect for additional/new prosecutors,
leasing versus purchasing new police vehicles, potential of
offering affordable housing for police and firefighters, and
addressing retention of police officers at the State level .
Councilmember Penfold proposed modifying the Staffing
Document to incorporate the proposed Police Department positions
and potentially look at funding in the next fiscal year. He said
modifying the Staffing Document now would allow flexibility to
prepare/organize for the new positions .
Unanimous Straw Polls were taken in support of:
• Reconfirming the Council' s decision to add 50 new officers
and to consider the proposal of new/additional Police
Department support staff separately (not as part of the 50
new/additional officers) .
• Funding in the current budget the Quality Assurance Manager,
three Crime Lab Technicians, and the Victim Advocate
position.
• Including all of the proposed (9) new/additional Police
Department positions in the current Staffing Document
(regardless of funding) .
A 4-3 Straw Poll was taken in support of not leasing but
rather purchasing new Police vehicles, with Council Members Luke,
Mendenhall, Kitchen and Johnston opposed; Council Members Rogers,
Adams, and Luke in favor.
Council Members requested the following item from Staff:
• Provide information on how much the City Crime Lab could
potentially make (to cover new hire costs) by outsourcing
City Crime Lab services as a resource to other jurisdictions,
a fee structure for services, and the ability to prioritize
City priorities before contracted work.

#5 . 6:02:49PM DISCUSSION REGARDING THE PROPOSAL FOR GENERAL
FUND BUDGET AMENDMENT NO. 2 OF FISCAL YEAR 2017-18 (RDA BUDGET
AMENDMENT NO. 3) , WHICH WOULD TRANSFER $15 . 6 MILLION IN RDA HOUSING
FUNDS TO THE CITY' S DEPARTMENT OF HOUSING AND NEIGHBORHOOD
DEVELOPMENT (HAND) TO ADMINISTER. As a part of the discussion, the
Council will also consider discussing the previous proposal for
spending the Housing Funds, titled the draft "RDA Housing Funding
Strategy. " Budget amendments happen several times each year to
reflect adjustments to the City's budgets, including proposed
project additions and modifications. View Attachments
Councilmember Penfold stated this item did not need to be
discussed. He said he assumed the proposal agreed upon earlier (in
the RDA meeting) was being moved forward. He said a public hearing
would be held on this component at the formal meeting this evening
with the possibility of suspending the rules and adopting the
proposal .
