02/21/2012 - Formal Meeting - Minutes PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, FEBRUARY 21, 2012 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, February 21, 2012 at 7 : 00 p.m. in Room 315, City Council Chambers, City County Building, 451 South State. The following Council Members were present: Carlton Christensen Charlie Luke Stan Penfold Jill Remington Love Luke Garrott Soren Simonsen Kyle LaMalfa Cindy Gust-Jenson, Executive Council Director; Edwin Rutan, City Attorney; David Everitt, Mayor' s Chief of Staff; and Beverly Jones, Deputy City Recorder; were present. Councilmember Simonsen presided at and conducted the meeting. OPENING CEREMONY #1 . 7 : 11 :27 PM The Council led the Pledge of Allegiance. Councilmember Simonsen acknowledged the death of Richard Wirick, an activist for Downtown Salt Lake City, to a pedestrian/bus accident. He asked the audience to offer a moment of silence . #2 . 7 : 17 : 41 PM Adopting a joint resolution with Mayor Becker celebrating the 100 Year anniversary of the Salt Lake Council of Women. View Attachments Councilmember Christensen moved and Councilmember Love seconded to adopt Resolution 4 of 2012, which motion carried, all members voted aye . Councilmember Christensen read the resolution. Council Members Christensen and Love presented the resolution to Cathreen M. Stevens, President of the Salt Lake Council of Women. 7 :22 : 13 PM Ms . Stevens thanked the Mayor and the City Council for the acknowledgement. (R 12-1) #3. 7 :24 : 12 PM Councilmember Garrott moved and Councilmember Luke seconded to approve the Salt Lake City Council minutes for Tuesday, February 7, 2012 and Tuesday, February 14, 2012, which motion carried, all members voted aye . RE: 7 :24 : 41 PM Accept public comment regarding proposed Salt Lake City Council District boundary maps . Redistricting, completed every ten years after the census, is required to substantially balance the population so each person is equally represented. View Attachments Councilmember Garrott moved to close the public hearing and defer action to a future date. Councilmember LaMalfa made a substitute motion which was seconded by Councilmember Luke to continue the public hearing to a future meeting, which motion carried, all members voted aye . (U 12-1) #2 . RE: 7 :28 : 00 PM Accept public comment regarding proposed Salt Lake City School Board District boundary maps . Redistricting, completed every ten years after the census, is required to substantially balance the population so each person is equally represented. View Attachments Eliot Sykes thanked the Council for making the process as open and transparent as possible . Haytham Ibrahim spoke about growth in the Glendale area. Esmeralda Valle, Joel Arvizo, Elizabeth Montoya, Ryan Robinson and Nancy Flanders spoke in support of more opportunities for children in the Glendale area . Alisia DeLeon spoke in favor of school map number two. Councilmember LaMalfa moved and Councilmember Christensen seconded to close the public hearing, which motion carried, all members voted aye . Councilmember LaMalfa moved and Councilmember Christensen seconded to adopt Resolution 5 of 2012 designating the new Salt Lake City School Board District boundaries attached as in Exhibit A, the consensus map. The adopted map is a result of the redistricting process based on the 2010 census results, which motion carried, all members voted aye . (U 12-2) #3 . RE: 7 : 44 :25 PM Accept public comment and consider adopting Budget Amendment No. 5 for Fiscal Year 2011-2012 . The Administration is proposing adjusting the FY 2012 budget in a number of areas . *Notable items include an HVAC system replacement for Fire Station No . 2, an upgrade to the City' s website, funding to treat the City' s urban forest for insects and disease, funding to allow for solar panels on 12 - 2 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, FEBRUARY 21 , 2012 the roof of the new Public Safety Building and funding for the remodel of Plaza 349 . View Attachments Michael Cohn, member of the Healthy Tree Committee, wanted the Council to immediately pass the budget amendment funding spraying or injecting trees to save them from disease . DeWitt Smith spoke in support of the short term effort to fund the care of the estimated 6, 000 trees currently at risk. Anne Cannon did not wish to speak but submitted a hearing card in support of the effort to save the trees . Councilmember Penfold moved and Councilmember Love seconded to close the public hearing, which motion carried, all members voted aye. Councilmember Love moved and Councilmember Luke seconded to adopt Ordinance 10 of 2012 pulling Item A-6, Citywide Tree Treatment for Insects and Disease, from the budget amendment and approve the funding, which motion carried, all members voted aye . (B 12-5) #4 . RE: 7 :57 : 13 PM Accept public comment and consider adopting a resolution regarding the Council' s Philosophy Statement on the Economic Health of the City. View Attachments Councilmember LaMalfa moved and Councilmember Penfold seconded to close the public hearing, which motion carried, all members voted aye . Councilmember Garrott moved and Councilmember LaMalfa seconded to adopt Resolution 6 of 2012, which motion carried, all members voted aye . (R 12-2) COMMENTS TO THE CITY COUNCIL 8 : 00 :25 PM Amir Cornell spoke in support of accessory dwelling units . Cindy Cromar said she had worked on the City' s open space plan . She said part of the plan was a proposal for trails to link the City' s neighborhoods with the City' s recreational opportunities . She said the Trans Valley Corridor had not received the attention it should have . Loree Hagen thanked the Council and the Mayor for tabling the Sunnyside test area until further public input could be received. UNFINISHED BUSINESS #1 . RE: 8 : 09 : 19 PM Adopting a resolution authorizing the approval of an interlocal cooperation agreement between Salt Lake City and Salt Lake County to help pay for two studies pertaining to transportation and parking in Big and Little Cottonwood Canyons . One study would make 12 - 3 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, FEBRUARY 21, 2012 recommendations for improving parking in the canyons . The other would consider transportation systems that create a more environmentally and economically sustainable transportation system in the two canyons and in the communities that are gateways to the canyon. RE: 8 : 09 : 55 PM Adopting a resolution authorizing the Mayor to execute an interlocal cooperation agreement to join the Jordan River Commission. View Attachments Councilmember LaMalfa moved and Councilmember Luke seconded to adopt Resolution 8 of 2012 authorizing the Mayor to execute an interlocal cooperation agreement to join the Jordan River Commission and identify that Council Chair Soren Simonsen will serve as the City' s representative on the commission and that Kyle LaMalfa will serve as the alternate, which motion carried, all members voted aye . (R 12-3) #3. RE: 8 : 10 : 39 PM Adopting an ordinance (the "2012 Assessment Ordinance") approving the assessment list and levying assessments upon property in Salt Lake City, Utah Special Assessment Area (North Temple Viaduct) No. 109014 (the "Assessment Area") ; establishing the effective date of the 2012 Assessment Ordinance; providing for a procedure to contest an assessment; and related matters . (This action is the next step for the City Council for the purpose of paying a portion of the costs associated with the improvements . ) View Attachments Councilmember Christensen moved and Councilmember Luke seconded to adopt Ordinance 9 of 2012 , which motion carried, all members voted aye except Councilmember Garrott who voted nay. (Q 09-9) CONSENT AGENDA 8 : 13 : 06 PM Councilmember Garrott moved and Councilmember Penfold seconded to approve the Consent Agenda with the exception of Items 3 and 4, which motion carried, all members voted aye . #1 . RE: Setting the date of Tuesday, March 6, 2012 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance amending the City' s zoning regulations to modify requirements for approving conditional use permits pursuant to Petition No. PLNPCM2009-00174 . 12 - 4 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, FEBRUARY 21, 2012 These requirements were modified by the City Council in July, 2008 . The proposed amendments are intended to clarify and resolve problems encountered by the Community Development Department in applying these requirements . Related provisions of Title 21A, Zoning, may also be amended as part of this petition. (Petitioner Mayor Ralph Becker) (P 12-1) #2 . RE: Setting the date of Tuesday, March 6, 2012 at 7 : 00 p.m. to accept public comment and consider adopting a resolution updating policy statements for the City' s Community Housing Plan. The intent is to address development of new housing opportunities, preservation of the City' s existing housing stock and reflect current housing and economic conditions . (T 11-5) #3 . RE: Setting the date of Tuesday, March 6, 2011 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance to combine the Open Space Lands Advisory Board with the Parks, Trails and Urban Forestry Advisory Board to create the Parks, Natural Lands, Trails and Urban Forestry Advisory Board.
