TUESDAY, FEBRUARY 7, 2012
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, February 7, 2012 at 7 : 00 p .m. in Room 315, City Council
Chambers, City County Building, 451 South State .
The following Council Members were present :
Carlton Christensen Kyle LaMalfa Stan Penfold
Jill Remington Love Luke Garrott Charles Luke
Soren Simonsen
Cindy Gust-Jenson, Executive Council Director; Ed Rutan, City
Attorney; , David Everitt; Chief of Staff; and Chris Meeker, City
Recorder; were present .
Councilmember Simonsen presided at and conducted the meeting.
OPENING CEREMONY
#1 . 7 : 13 : 18 PM RE: The Council led the Pledge of Allegiance .
#2 . 7 : 13 : 41 PM RE: Adopting a joint resolution with Mayor
Becker designating February 18 , 2012 Congressional Gold Medal Day for
the Veterans of the 100th Infantry Battalion, 442nd Regimental Combat
Team and the Military Intelligence Service .
Salt Lake County Councilmember Jani Iwamoto and Judge Raymond Uno
spoke to the resolution . View Attachments
Councilmember Christensen moved and Councilmember Penfold
seconded to adopt Resolution 2 of 2012 , which motion carried, all
members voted aye .

PUBLIC HEARINGS
#1 . 7 :28 : 17 PM RE: Accept public comment regarding proposed
Salt Lake City Council District boundary maps . Redistricting,
completed every ten years after the census, is required to
substantially balance the population so each person is equally

Dee Rowland spoke in favor of the process and congratulated the
City Council .
Councilmember Christensen moved and Councilmember Luke seconded
to close the public hearing.
Councilmember LaMalfa moved and Councilmember Love seconded a
substitute motion to keep the public hearing open for two weeks, which
motion carried, all members voted aye .

#2 . 7 : 34 : 13 PM RE: Accept public comment regarding proposed Salt
Lake City School Board District boundary maps . Redistricting,
completed every ten years after the census, is required to
substantially balance the population so each person is equally

The following citizens spoke in favor of School Board Map 1 :
Aimee Horman, Amanda Thorderson and Heather Bennett.
The following citizens spoke in favor of School Board Map 2 : Edie
Trimmer and Alama Ulnare.
James Guilkey, the Chair of the Citizens Re-Districting Group,
commented on both maps and requested a post mortem analysis .
Councilmember Simonsen said the primary goal was the filing
period for School Board elections which was in early March and the
Council had hoped to give the School Board 30 days . He said his hope
was to take action on February 21, 2012 .
Councilmember Garrott moved and Councilmember Love seconded to
keep the public hearing open and defer action to a future date, which
motion carried, all members voted aye .

#3 . 7 : 50 : 34 PM RE: Accept public comment and consider adopting:
a) An ordinance enacting Chapter 8 . 06 of Title 8, Animals, Salt
Lake City Code, requiring dog breeders to obtain an annual
license. The ordinance will (i) include an exception for
responsible breeder licensees belonging to recognized
organizations which require and enforce adherence to a code
of ethics and standards specific to their breed, (ii)
authorize a five-year responsible breeder license at no
charge; and (iii) amend Section 8 . 04 . 521, Salt Lake City
Code, Appendix A, to include penalties . This ordinance will

mirror Salt Lake County' s Code Chapter 8 . 14 . (Since the date
of setting the February 7, 2012 public hearing, the
ordinance has been revised to: (i) include a revision to
Section 8 . 04 . 090 stating "nothing in this section or Chapter
8 . 06 of this title shall be construed so as to exempt any
dog or cat from having a required rabies vaccination; " and
(ii) strike language from 8 . 06 . 010 that would allow a dog
breeder to apply for a refund of the breeder license fee . )

b) An ordinance revising and amending the Salt Lake City
Consolidated Fee Schedule to enact fees for a dog breeder' s
license.
The following were in support of the ordinance but did not wish
to speak: Lynn Anderson, Jeremy Beckham, Amy Meyer, Sara Groberg,
Jordan Kasteler, Autumn Wagner and Jason Rose.
Councilmember LaMalfa moved and Councilmember Luke seconded to
close the public hearing, which motion carried, all members voted aye.
Councilmember LaMalfa moved and Councilmember Luke seconded to
adopt Ordinance 5 of 2012 requiring dog breeders to obtain an annual
license, which motion carried, all members voted aye.
Councilmember LaMalfa moved and Councilmember Christensen
seconded to adopt Ordinance 6 of 2012 revising and amending the Salt
Lake City Consolidated Fee Schedule, which motion carried, all members
voted aye .

#4 . 7 : 57 : 55 PM RE : Accept public comment and consider adopting an
ordinance amending the Major Street Plan of the Salt Lake City
Transportation Master Plan pursuant to Petition No. PLNPCM2010-00354 .
The Major Street Plan identifies and classifies existing and proposed
freeways, arterial streets, collector street, and local streets within
Salt Lake City. The ordinance appears to acknowledge routine changes
in the use or ownership of various streets in the City, including
North Temple and 1300 East. View Attachments

ordinance changing the City Code including the City' s zoning

regulations to eliminate the Board of Adjustment and the Land Use
Appeals Board as land use appeal authorities and replacing the boards
with an appointed professional hearing officer. The hearing officer
would review and make decisions relating to variance applications,
appeals of Administrative, Planning Commission and Historic Landmark
Commission decisions . The intent is to provide a more streamlined and
consistent appeal process for land use decisions and reduce the
expenditure of City funds and staffing resources . Related provisions
of Title 21A - Zoning - may also be amended as part of this petition.
Petitioner - Mayor Ralph Becker, Petition No. PLNPCM2010-00312 .
Councilmember Garrott moved and Councilmember Penfold seconded to
close the public hearing and adopt Ordinance 8 of 2012, eliminating
the Board of Adjustment and the Land Use Appeals Board as land use
appeal authorities and replacing the boards with an appointed
professional hearing officer, including changes recommended by Council
staff; and further move that is the intent of the Council that:
• Council staff collaborate with the Administration to draft an
ordinance requiring that administrative rules be established to
govern the land use appeal process and that the basis for such
rules be in writing, available to the public, and be established
through an administrative process that includes a public notice
and comment period.
• Council staff collaborates with the Administration to draft
ordinance amendments to the City Code that will require an
administrative rule-making process when establishing any
administrative regulation, which motion carried, all members

NEW BUSINESS
#1. 8 :50: 14 PM RE: Adopting a resolution authorizing the partial
refunding and refinancing of a portion of the Library General
Obligation Bond - Series 2002 . The refinancing of this bond will
result in approximately $3 million in savings over the next seven
years, which will be realized in the form of a lower property tax bill
for this project. (The Council will receive a briefing regarding a
resolution authorizing the issuance and sale of not more than $14
million aggregate principal amount of the General Obligation Refunding
Bonds, Series 2012A; and related matters . ) View Attachments

seconded to suspend the rules and adopt Resolution 3 of 2012 , which

#3 . RE: Setting the date of Tuesday, February 21 , 2012 at 7 : 00

No. 5 for Fiscal Year 2011 - 2012 . The Administration is proposing
adjusting the FY 2012 budget in a number of areas . Notable items
include an HVAC system replacement for Fire Station No . 2, an upgrade
to the City' s website, funding to treat the City' s urban forest for
insects and disease, funding to allow for solar panels on the roof of
the new Public Safety Building and funding for the remodel of Plaza
