TUESDAY, JANUARY 20 , 2015
The City Council of Salt Lake City, Utah, met in Regular Session on
Tuesday, January 20, 2015 at 7 : 00 p.m. in Room 315, Council Chambers,
City County Building, 451 South State .
The following Council Members were present:

The following Councilmember was absent:
Stan Penfold
Cindy Gust-Jenson, Executive Council Director; Jill Love, Mayor' s
Deputy Chief of Staff; Margaret Plane, City Attorney; Cindi Mansell,
City Recorder; and Nicole Smedley, Assistant City Recorder; were
present.
Councilmember Garrott presided at and conducted the meeting.
OPENING CEREMONY
#1. 7:24:54 PM The Pledge of Allegiance was led by Scout Troop
6055 .
#2 . 7:26:19 PM Councilmember Mendenhall moved and Councilmember
Luke seconded to approve the minutes of the following Salt Lake City
Council meetings , which motion carried, all members present voted aye.

PUBLIC HEARINGS
#1. 7:26:41 PM Accept public comment on applications submitted for
the following grants : View Attachments
• Salt Lake City Police Department and Alcohol & Drug Fee Committee
($10, 000) Requesting the purchase and funding of body cameras to
assist with the detection, enforcement and arrest of impaired
drivers.
• STOP Act: $48,258 requested by the Mayor's Coalition on Alcohol,
Tobacco, & Other Drugs. Requesting continuation of the grant
funding which will assist the Salt Lake City Police Dept. , the

Salt Lake City School District, and other community groups to
educate families on the dangers of underage drinking. This is the
last year of a four-year grant.
Councilmember Mendenhall moved and Councilmember LaMalfa seconded
to close the public hearing and defer action to a later date, which
motion carried, all members present voted aye .

#2 : 7:28:49 PM Accept public comment and consider adopting an
ordinance amending the City' s zoning map to create the Yalecrest -
Normandie Circle Local Historic District whose boundaries include 10
homes on Normandie Circle and two homes adjacent to Normandie Circle
on Harvard Avenue pursuant to Petition No. PLNHLC2014-00247 .

Patricia Callahan, petitioner, spoke about a recent teardown in
the Yalecrest area and a large structure that did not fit in with the
neighborhood being built in its place . She said she wanted the Local
Historic District Designation for the preservation of homes, and to
protect the neighborhood from future teardowns .
Jeff Miller, Urban Planning Program senior at the University of
Utah, spoke about the Harvard/Yalecrest area being a desirable
community. He said it was walkable with a historic nature regarding
architecture . He said he was in full support in designating all five
areas as Local Historic Districts .
Katharine Biele spoke in favor of the proposal .
Jeff Justice, homeowner, spoke about the home that was torn down
on Harvard. He said the home was rundown, and kids would break into
it. He said the home was a detriment to the neighborhood because of
its status and situation.
Councilmember LaMalfa moved and Councilmember Adams seconded to
close the public hearing and defer action to February 3, 2015 which
motion carried, all members present voted aye.

ordinance amending the City' s zoning map to create the Yalecrest -
Princeton Park Local Historic District, which includes 27 homes
generally located on Princeton Avenue between 1700 East and 1800 East

John Dewey, petitioner, spoke about the East Bench Master Plan
from 1987 noting the architectural and historical significance of
buildings in Harvard/Yale . He spoke about the 2006 City Council Budget
allocation for the preservation plan/study, and the 2012 adopted Salt
Lake City Community Preservation Plan. He asked for the Council' s
support to approve the Local Historic District designation.
Denise Smith, homeowner and business owner in the Princeton area,
spoke about the concern of teardowns and the major renovations
resulting in large houses built on small lots . She asked that the
Council approve all five Local Historic District areas .
Jim Keener, homeowner, said that the Historic District
designation for Princeton park goes beyond what was necessary or
appropriate . He said that houses on his block are ordinary, he said
they are nice homes but they are not particularly historic or worthy
of preservation in this sense. He said he agreed that full teardowns
and the rebuilding of large homes was not what he wanted and opposed
the proposal .
Councilmember Luke moved and Councilmember Mendenhall seconded to
close the public hearing and defer action to February 3, 2015 which
motion carried, all members present voted aye .

#4 . 7:50:58 PM Accept public comment and consider adopting an
ordinance amending the City' s zoning map to create the Yalecrest -
Upper Harvard and Yale Park Plat A Local Historic District, which
includes 60 homes on the north and south sides of Harvard Avenue
(approx. 1120 South) between 1500 East and 1700 East pursuant to
Petition No. PLNHLC2014-00111 . (Petitioner, Vena Childs) View
Attachments
Vena Childs, Connie Baring-Gould, Emily Bleyl, and Anne Mallon
spoke in favor of the proposal . They expressed concerns if the Local
Historic District designation was not approved there would be
teardowns, oversized homes, and neighborhood degradation.
Dixon Hindley spoke against the proposal and expressed concern
about inadequacies of the petition process relating to signatures .
Pam Allison, Kate Lahey, Loraine Goerke, Robert Snow, and Vinson
Johnson submitted written comments in favor of the Proposal .
Kenn Dayton, homeowner, submitted a written comment in opposition
of the proposal . His comments included the right of property owners to
change their homes according to their future needs .

George and Cathy Kelner, homeowners, submitted written comments
stating they would like to stay neutral regarding the proposal .
Councilmember Luke moved and Councilmember Rogers seconded to
close the public hearing and defer action to February 3, 2015 , which
motion carried, all members present voted aye.

#5. 8:33:57 PM Accept public comment and consider adopting an
ordinance amending the City' s zoning map to create the Upper Yale 2nd
Addition, which includes 30 homes generally located on Herbert Avenue
(1055 South) between 1700 East and 1800 East pursuant to Petition No.
PLNHLC2013-00862 . (Petitioner, Tracey Harty) View Attachments
Tracey Harty, petitioner, spoke about more applications coming in
2015 as residents wanted to see a large portion of Yalecrest
designated. She said her neighborhood was listed on the National
Register of Historic Places and submitted a map showing designations
in all Council Districts . She spoke about a representational form of
government and representatives making critical zoning decisions . She
encouraged the designation of all the Yalecrest Applications as Local
Historic Districts .
Kelly White, Bill Harty, and Lynn Pershing spoke in favor of the
proposal . The reasons included growth, responsible change, and ability
to add on by following the Local Historic District process .
Adam McCormick, Lynda Coleman, Sam Mokhiber, Robin Robinson, Liz
Bell, and Chase Leavitt, spoke in opposition of the proposal . The
reasons included homes requiring remodeling and updating; the concern
of homes becoming dilapidated; distorting local market prices; not
having time to go through the Local Historic District Process;
infringement of property rights; and honoring the majority vote.
Greg Poulsen and Jon Lee submitted written comments in opposition
of the proposal .
Councilmember Luke moved and Councilmember Adams seconded to
close the public hearing and defer action to February 3, 2015, which
motion carried, all members present voted aye.

ordinance amending the City' s zoning map to create the Yalecrest -
Upper Yale Local Historic District, which includes 28 homes generally
located on the north and south sides of Yale Avenue (1100 South)
between 1700 East and 1800 East pursuant to No . PLNHLC2014-00013 .

Lori Miller, homeowner, spoke on behalf of petitioner. She said
that the homes would outlive the homeowners and asked the Council to
support the Local Historic designation.
Lisette Gibson, Nathan Morgan, and Jan Burton, spoke in favor of
the proposal . The reasons included no current protection against
teardowns; the building of oversized homes; property rights and the
preservation of streetscape.
Scott Kaufmann, Susan Hansen-Porter, Steven Hansen, and Alex
Schiel spoke in opposition of the proposal . The reasons included the
infringement on property rights; desire to make homes seismically
sound with modern energy standards; potential need for ADA
accommodations or growing family needs .
Councilmember Luke and moved Councilmember LaMalfa seconded to
close the public hearing and defer action to February 3, 2015, which
motion carried, all members present voted aye.

#7 . 9:00:14 PM Accept public comment and consider adopting an
ordinance amending the City' s zoning map to create the City Creek
Canyon/Memory Grove Local Historic District, which includes the area
of City Creek Canyon between the entrance gate of Memory Grove on the
south and bordered on all other sides by Bonneville Boulevard pursuant
to Petition No. PLNHLC2010-00224 . (Petitioner, Mayor Ralph Becker)

POTENTIAL ACTION ITEMS
#1 : 9:03:06 PM Adopting an ordinance amending various fees set
forth in the Salt Lake City Consolidated Fee Schedule. Proposed
changes to the Consolidated Fee Schedule include fee changes for

COMMENTS TO THE CITY COUNCIL 9:04:30 PM
George Chapman encouraged the Council to make the Transportation
Resolution as general as possible . He said the Master Transit Plan
should come first, before street cars . He said the only way to stop
drug dealing in the homeless area was with more police. He said the
Council needs to create a good anti-monster home ordinance .
Patrick Shea said that Golf needs management independent of the
central administration. He said if WingPointe closed, the other should
remain open.
Craig DeMordaunt spoke about the Local Historic District
proposal . He said it was not the structure that was important, it was
the people. He said he was losing neighbors because their homes are
too small . He asked the Council to follow the majority vote.
Kirk Huffaker, Utah Heritage Foundation Board of Trustees, spoke
in favor of all six Local Historic Districts . He quoted the Economic
Impact Study on Historic Preservation in Utah. He said designation
does not stop a place in time, it allows flexibility to adapt to
modern codes; it promotes functional preferences of families and to
grow families; the City' s Sustainability initiative; stabilizes and
raises property values; and bolstered the City' s image as a unique
place .
Daniel Shipp said that he was homeless for the past six months
and on and off the street for the past sixteen months . He expressed
concern that people who were placed on the Homeless Coalition
Commission and coming up with a strategy were missing an important
voice . He said there was a lot of mention about service providers;
government and community representatives; and businesses in Pioneer
Park. He said the voice of those being served was going to be
important and insightful for helping people out of homelessness and
building self sufficiency.
Kim Dayton spoke in opposition of the Local Historic District
proposal .
Kim Childs and Luli Josephson submitted written comments in favor
of the Local Historic District proposal .
Jeff Justice submitted written comments in opposition of Local
Historic District the proposal .

UNFINISHED BUSINESS
#1 . 9:17:42 PM Adopting a Resolution consenting to an exchange of
land between the Board of Trustees of the Sugar House Park Authority
and the Board of Education of the Salt Lake City School District with
respect to parcels of land adjacent to Sugar House Park and Highland
High School . Under the proposal the School District and Park Authority
would exchange parcels of equal size, enabling the School District to
construct a baseball field on school property rather than using the
field located in Sugar House Park. View Attachments

CONSENT 9:20:02 PM
Councilmember LaMalfa moved and Councilmember Rogers seconded to
adopt the Consent Agenda, with the exception of Item #3 (Jeff Dixon
Board Appointment) , which motion carried, all members present voted
aye .
#1. Confirming the date of Tuesday, February 3, 2015 at 7 :00
p.m. to accept public comment and consider adopting an ordinance
amending Salt Lake City Code relating to newsracks in the public
right-of-way (amending chapter 14 .36, Newsracks pursuant to Petition
No. PLNPCM2012-00793 and the Consolidated Fee Schedule) . The proposed
ordinance would increase licensing fees for newsracks and would make
the City's Property Manager responsible for reviewing permits and
enforcing the newsrack ordinance. Currently, the City's Zoning
