01/23/2003 - Minutes (2) PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH THURSDAY, JANUARY 23, 2003 The City Council of Salt Lake City, Utah, met in a Work Session on Thursday, January 23, 2003 at 5:30 p.m. in Room 326, City Council Office, City County Building, 451 South State Street. In Attendance: Council Members Carlton Christensen, Van Turner, Eric Jergensen, Nancy Saxton, Jill Remington Love, Dave Buhler and Dale Lambert. Council Chair Christensen presided at and conducted the meeting. The meeting was called to order at 5:30 p.m. #1. REPORT OF THE EXECUTIVE DIRECTOR, INCLUDING REVIEW OF COUNCIL INFORMATION ITEMS AND ANNOUNCEMENTS. See file M 03-5 for announcements. #2. INTERVIEW RUBY CHACON PRIOR TO CONSIDERATION OF HER APPOINTMENT TO THE LIBRARY BOARD. Ms. Chacon said she was a freelance painter and her interest was in sharing her work with community and serving the community. She said she wanted to be part of the Library Board and explore beyond her paradigm. #3. INTERVIEW MARK MILLER PRIOR TO CONSIDERATION OF HIS APPOINTMENT TO THE UTAH AIR TRAVEL COMMISSION. Mr. Miller said flying was a big part of his life as a commercial pilot and a passenger. He said he was a pilot for Angel Flight, flying cancer patients through the western United States. He said he had an interest in improving air travel services. #4. INTERVIEW AFTON BRADSHAW PRIOR TO CONSIDERATION OF HER APPOINTMENT TO THE UTAH AIR TRAVEL COMMISSION. Ms. Bradshaw said she had been in the Utah Legislature for 18 years. She said she was involved in tourism and had been on many committees to promote tourism. She said she was currently on the executive committee for the Conventioneers and Visitors Board. #5. INTERVIEW PHIL SANDOVAL PRIOR TO CONSIDERATION OF HIS REAPPOINTMENT TO THE BOARD OF ADJUSTMENT. Mr. Sandoval said he had enjoyed serving on the Board of Adjustment. He said it was nice to do good things for the community. #6. INTERVIEW LESLIE HOODES PRIOR TO CONSIDERATION OF HER REAPPOINTMENT TO THE HOUSING ADVISORY AND APPEALS BOARD. Ms. Hoodes said the experience had been challenging and pleasant. She said meetings were held the second Wednesday of each month. She said slum landlords on the west side of town did not want to keep up properties and were the hard cases. She said seeing what situations tenants were expected to live in was eye opening. #7. RECEIVE A BRIEFING REGARDING CLOSING A PORTION OF AN ALLEY BETWEEN KELSEY AVENUE AND 1300 SOUTH AND BETWEEN MAIN AND MAJOR STREETS. View Attachment Doug Wheelwright, Marge Harvey, Rob Berman and Janice Lew briefed the Council. Mr. Wheelwright said the petitioner had paid the City fair market value for the portion of the alley. He said there had been no opposition to the closing and no one appeared at the public hearing before the Planning Commission. Councilmember Lambert said the Planning Commission had recommended approval with three conditions. He asked if the conditions had been met. Mr. Wheelwright said one had been met and the other two were a part of a building permit application for redevelopment of the property. Councilmember Saxton asked what the need to close the alley was. Mr. Wheelwright said the petitioner was in negotiation to purchase all property abutting the alley. Mr. Berman said Nate Wade Subaru planned to expand the service department adjoining the showroom and clean up landscaping along 1300 South. He said on Major Street there was an old building which would be removed. All Council Members were in favor of moving the issue forward except Councilmember Saxton. #8. The proposed alley closure would facilitate redevelopment of the existing car dealership. 2. The Planning Commission recommends that the City Council consider closing the alley subject to the following conditions: a) Sale and payment to the City of fair market value for the alley property. Title to the property shall remain with the City until payment is received. b) Future development of the property is subject to compliance with all relevant City standards and ordinances. c) Private right-of-way agreements for the full width of the alley are required for properties that abut the alley(not owned by the petitioner)if the proposed property acquisitions presently contemplated are not realized. • 3. The ordinance includes a provision instructing the City Recorder not to publish or record the ordinance until the conditions have been met and certified by the City Property Manager. 4. The petitioner states that the alley has been a gathering place for illegal activity and no longer 1 functions as a positive urban design element. (Please refer to the Planning staff report, Exhibit 4 for specific crime statistics.) 5. The public benefit of the alley has already been compromised by the partial closure of the southern • portion of the alley in 1997, Petition No. 400-96-94,that limits public access through the block. 6. Mr. Schneider is in the process of acquiring all abutting property to the alley. 7. On November 7,2002,the Property Manager received a payment from Mr. Schneider for$36, 806 for the prior alley closure and the portion of the alley in the current petition. Fair market value for the property was determined by the City Property Manager. 8. The alley is surrounded by commercial uses and primarily used for interior circulation by the petitioner's abutting automobile business. The property is located in a Commercial Corridor "CC"zoning district. 9. The appropriate City divisions have reviewed this request and have no objections to the proposed alley closure and disposition of the property. 10. The applicant will be required to maintain all existing right-of-ways and easements of all public utilities now located on,under or over the alley property. 11. No objections to the petition were expressed by abutting property owners. All abutting property owners have signed the petition. MASTER PLAN AND POLICY CONSIDERATIONS: • A. The Council's recently adopted alley vacation/closure policy requires petitioners to demonstrate at least one of the following policy considerations: 1. Lack of Use. The City's legal interest in the property appears of record or is reflected on an applicable plat;however,it is evident from an on-site inspection that the alley does not physically exist or has been materially blocked in a way that renders it unusable as a public right-of-way; 2. Public Safety. The existence of the alley is substantially contributing to crime,unlawful activity,unsafe conditions,public health problems,or blight in the surrounding area; 3. Urban Design. The continuation of the alley does not serve as a positive urban design element;or 4. Community Purpose. The Petitioners are proposing to restrict the general public from use of the alley in favor of a community use, such as a neighborhood play area or garden. B. The Planning staff report notes the following: 1. The disposition of the alley property will not result in a use which is otherwise contrary to the policies of the City, including applicable master plans and other adopted statements of policy which address but are not limited to,mid-block walkways,pedestrian paths,trails,and alternate transportation uses. 41111 2 2. The 1974 Central City Master Plan identified this area within the limited commercial category intended to discourage intensive uses such as car sales through zoning, but the Central City • Master Plan has just been received by the Administration and will be processed in the coming weeks. In the past,the Administration has noted that with the adoption of the 1995 Zoning rewrite,the existing Master Plans were amended in order to provide consistency between the master plans and the zoning. 3. The Planning staff report refers to the draft Central City Master Plan and the proposed Salt Lake City Bicycle and Pedestrian Master Plan. Typically the City Council does not consider master plans before they have been through the public process and formally adopted. 4. The property is located outside of the Transvalley and Glendale/Liberty connection corridors as depicted in the City's Open Space Plan. The petitioner is in the process of acquiring all of the property adjacent to the alley for use in the redevelopment of the surrounding automobile business. Analysis: The purpose of this proposal is to close off the alley to the public with access granted to the necessary public utilities. Chapter 14.52 of the Salt Lake City Code regulates the disposition of city-owned alleys. Noticed public hearings are held before both the Planning Commission and City Council to consider the potential adverse impacts created by a proposal. Owners of abutting property zoned for multi-family(3 or more units)residential use or other non-residential uses, are required to pay fair market value for their share of the alley or provide other acceptable compensation. When evaluating requests to close public alleys, the City considers whether or not the continued use of the property as a public alley is in the City's best interest. The Planning Commission also makes a recommendation to the Mayor regarding the disposition of the property. Where the City Council has determined that it should relinquish its interest in a public alley, the Council will then adopt an ordinance to close and abandon the alley property. The petitioner states that the alley has been a gathering place for illegal activity and no longer functions as a positive urban design element. Additionally,public benefit of the alley has • already been compromised by the partial closure of the southern portion of alley that limits public access through the block. Mr. Schneider IIIhas agreed to purchase both sections of the alley at a value that has been determined by the City's Property Manager. The Property Manager received payment in the amount of$36,806 on November 7, 2002, which represents fair market value for the subject alley and the property included in the prior alley closure. All necessary City departments and divisions have reviewed the proposal and recommended approval of the petition to the public alley. The applicant has agreed to all conditions of the various depattnients/divisions. The Planning Commission determined that the proposed alley closure meets the City Council Alley Closure Policy considerations B and C and substantial evidence exists that the proposed alley closure satisfies the alley closure guidelines 1-8, and further found that the continued use of the property as a public alley is not necessary nor in the City's best interest. Public Process: The applicant met with the West Salt Lake Community Council on September 10, 2002 and the community council voted unanimously to support the alley closure. On October 17, 2002, the Planning Commission voted to forward a favorable recommendation to the City Council to close and abandon the public alley and also recommended that the property be declared surplus and disposed of according to Salt Lake City Code, Section 2.58. Noticed public hearings are held before both the Planning Commission and City Council to consider the potential adverse impacts created by a proposal. Once the Planning Commission has reviewed the request, their recommendation is forwarded to the City Council for consideration. The Planning Commission must also make a recommendation to the Mayor regarding the disposition of the property. If the commission recommends that the alley property be declared surplus, the property would be disposed of according to Section 2.58 City- Owned Real Property of the Salt Lake City Code. If an alley is next to or abuts properties which are zoned for multi-family(3 or more units)residential use or other non-residential uses, the City would retain title to the surplus property until the land is sold at fair market value or other acceptable compensation is provided. Where the City Council has determined that it should relinquish its interest in a public alley, the Council will then adopt an ordinance to close and abandon the alley. Their comments are reflected in the conditions of approval. The petitioner is also required to pay for the southern portion of the alley, which was previously closed by Petition No. 400-96-94 and Ordinance No. 6 of 1997. (Exhibit 3) The applicant has agreed to purchase both sections of the alley at fair market value, as determined by the City's Property Manager. CODE CRITERIA / DISCUSSION / FINDINGS OF FACT Salt Lake City Council policy considerations for closure, vacation or abandonment of City owned alleys: A. Lack of Use. The City's legal interest in the property appears of record or is reflected on an applicable plat,but in fact it is evident from inspection that the • alley does not exist. B. Public Safety. The existence of the alley is contributing to crime,unlawful activity or unsafe conditions. C. Urban Design. The continuation of the alley does not serve as a positive urban design element. D. Community Purpose. The Petitioners are proposing to restrict the general public from use of the alley in favor of a community use, such as a neighborhood play area or garden. Discussion: The petitioner is requesting that Salt Lake City vacate the remainder of the public alley located within the Nate Wade Subaru property at 1207 S. Main Street. The petitioner states that the alley has been a gathering place for illegal activity and attracts undesirable traffic. Please see attached police report for details. (Exhibit 4) As stated above, the purpose of the proposal is to vacate the alley as a public right-of- way. A field inspection revealed that the alley is surrounded by commercial uses and primarily utilized for interior circulation by the abutting automobile business. The petitioner believes the alley, as such,no longer functions as a positive urban design element. The petitioner would like to raze several of the older buildings and construct a new service facility. Redevelopment of the property includes the removal of the existing structure adjacent to the alley on 1300 South and replacing it with landscaping. • Staff Report,Case 400-02-26 3 October 17,2002 By Salt Lake City Planning Division Findings: The petition meets Considerations B and C. The proposed closure creates a private alley that the property owner could then properly secure to keep out any • undesirable traffic. Additionally, the value of the alley as a positive urban design element has been compromised by the partial closure of the southern portion of the alley that already limits public access through the block. Guidelines for Alley Closures: 1. The City police department, fire department, transportation division, and all other relevant City departments and divisions have no objection to the proposed disposition of the property; Discussion: Staff requested input from the pertinent City departments and/or divisions. Comments were received from the Public Utilities, Fire Department, Engineering Division, Division of Transportation,Police Department and Property Management. These comments are attached to this staff report as Exhibit 5. No objections were expressed to the proposed disposition of the property. Findings: The appropriate City divisions have reviewed this request and have no objections to the proposed disposition of the property. The applicant will be required to maintain all existing rights-of-way and easements of all public utilities now located on and under or over the alley property. 2. The petition meets at least one of the policy considerations stated above; • Findings: The petition meets Considerations B and C as outlined above. 3. The petition must not deny sole access or required off-street parking to any adjacent property; Discussion: It has been the City's policy not to close an alley if it would deny a property owner required access to the rear of their lot. However, if the abutting property owners agree to enter into right-of-way agreements with each other,this assures that they will be able to continue the original use of the alley. Most of the properties abutting the alley have access from Major Street or Main Street. There are a few buildings that have vehicular doors facing the alley and the off-street parking garage for 22 E.Kelsey Avenue is located in the rear. The petitioner, however,owns or is in the process of acquiring all abutting property to the alley and intends to purchase the entire alley as well. (Exhibit 6) Therefore,maintaining access of the alley for abutting property should not be an issue. Findings: The closing of the alley will not deny sole access or required off-street parking to any adjacent property if closure is conditioned upon execution and recordation of a private right-of-way agreement for the full width of the alley between all property owners whose property requires continued access to the alley. • Staff Report,Case 400-02-26 4 October 17,2002 By Salt Lake City Planning Division 4. The petition will not result in any property being landlocked; • Discussion: The vacant residence owned by Nate Wade Investment Co. on the north end of the alley at 22 E. Kelsey has access from the alley to an on-site rear yard parking garage. The petitioner's plan for redevelopment includes this parcel and access would be coordinated with the overall circulation pattern on the site. The remainder of the property abutting the alley has frontage from Major or Main Streets. Findings: The proposed alley closure would not create any landlocked parcels. 5. The disposition of the alley property will not result in a use which is otherwise contrary to the policies of the City, including applicable master plans and other adopted statements of policy which address,but which are not limited to,mid- block walkways, pedestrian paths, trails, and alternative transportation uses; Discussion: The 1974 Central Community Development Plan identified this area within the limited commercial category. This category was intended to discourage very intensive uses such as car sales through zoning. The 1995 Zoning Map, however, revised the zoning and updated the master plan to allow automobile sales/rental and services. The draft Central Community Master Plan designates the future land use for this area along Main Street as Medium Residential/Mixed Use (10-50 dwelling units/acre). This policy also allows for more commercially intensive land uses. The property is located outside of the Transvalley and Glendale/Liberty connection corridors as depicted in the City's Open Space Plan. The proposed Salt Lake City Bicycle and Pedestrian Master Plan shows a potential route between 800 and 2100 South along Main Street. Findings: The alley closure is consistent with applicable policies of the City. 6. No opposing abutting property owner intends to build a garage requiring access from the property, or has made application for a building permit,or if such a permit has been issued, construction has been completed within 12 months of issuance of the building permit; Discussion: The petitioner's intent is to acquire all of the property abutting the alley in an effort to redevelop the existing automobile business. All current abutting property owners have consented to the alley closure in the attached petition. (Exhibit 7) Findings: No objections were expressed by abutting property owners to the petition. I • 7. The title,however,has remained with the City because the land was never sold. Property Management has determined the fair market value for both sections of the alley at $36,806 or approximately$4.13 per square foot. Finding: The proposed petition will further the City's preference for closing entire alleys by disposing of the remainder of the subject alley that was partially closed in 1997. The portion of the subject alley to be closed should be declared surplus to the City's needs as a public alley, and sold at fair market value consistent with City policy(City-Owned Real Property Chapter 2.58). 8. The alley is not necessary for actual or potential rear access to residences or for accessory uses. Future development of the property is subject to compliance with all relevant city standards and ordinances. 3. The closure is subject to the execution and recordation of private right-of-way agreements for the full width of the alley between all property owners whose property requires continued access to the alley, as may be appropriate, if the contemplated property acquisitions are not realized. PUBLIC HEARING - Petition 400-02-26, by Mr. Kirk Schneider, President, Nate Wade Planning Commission Meeting 13 October 17,2002 Subaru, requesting that a portion of the alley located between Kelsey Avenue and 1300 • South and Main and Major Streets be closed and declared surplus property. The requested action will facilitate the commercial redevelopment of the property adjacent to the alley. The property is located in a Commercial Corridor (CC) zoning district. Planner Janice Lew reviewed the petition as written in the staff report. She explained that the petitioner is in the process of acquiring the property abutting the alley which he does not currently own in order to redevelop the existing automobile business. Plans include removal of the existing structure adjacent to the alley at 1300 South and replacing it with landscaping as well as razing several of the old buildings for a new service facility. The Staff recommended that the Planning Commission forward a favorable recommendation to the City Council to close and abandon the alley and declare the alley property surplus. This recommendation is based on the analysis and findings included in the staff report. Ms. Lew stated that the Planning Department has heard no objections to this petition from abutting property owners. The Staff also recommends that this petition be subject to the three conditions outlined in the staff report. Ms. Lew referred to the parcel map contained in the staff report and clarified that the property at 1222 Major Street is owned by the petitioner. • Ms. Seelig stated that she understood Petition 400-96-94 of 1997 was filed by this same petitioner. Ms. Lew replied that it was filed by Nate Wade, and it is the same company. Ms. Seelig asked if the petitioner has been receiving value from the already closed portion of the alley since 1997, and that portion of the alley has not yet been paid for. Ms. Lew replied that was correct. Ms. Arnold asked why they want to close the alley now. Kirk Schneider, the petitioner, explained that he has recently purchased the business, and in 1997 the property was controlled by Mr. Wade. Now that he is the property owner, he wants to do the redevelopment, building a new service facility. He noted that the alley is a perpetual crime problem, which is another reason he would like to have it closed. Ms. Seelig asked if the 1997 petition was filed by the same company. Mr. Schneider replied that the 1997 petition was filed by Nate Wade as the property owner. Mr. Schneider clarified that he is with Nate Wade Subaru and is filing as Nate Wade Subaru, the business. Vice-Chair Funk opened the public hearing. • Planning Commission Meeting 14 October 17,2002 • Jeff Davis, representing the Peoples Freeway CommunityCouncil, stated that Nate Wade Subaru presented plans during the Community Council meeting, and the Council voted unanimously to approve the petition to close the alley and allow the company to purchase it. The applicant will be required to maintain all existing rights-of-way and easements of all public utilities now located on and under or over the alley property. 2. The petition meets Considerations B and C. 3. The closing of the alley will not deny sole access or required off-street parking to any adjacent property if closure is conditioned upon execution and recordation of a private right-of-way agreement for the full width of the alley between all property owners whose property requires continued access to the alley. 4. The proposed alley closure would not create any landlocked parcels. 5. The alley closure is consistent with applicable policies of the City. 6. No objections were expressed by abutting property owners to the petition. Planning Commission Meeting 15 October 17, 2002 7. The proposed petition will further the City's preference for closing entire alleys by • disposing of the remainder of the subject alley that was partially closed in 1997. I am the Manager of Schneider Automotive Group LLC. dba Nate Wade Subaru and in addition to owning the property at 1222 So Major St I have an option to purchase the property owned by Nate Wade Investment that is adjacent to the alley. I would like to remove some of the old buildings and rebuild a new service facility. This would include removing the building adjacent to the alley on 1300 So and replacing it with landscaping. Currently the only legitimate (see below) users of the alley are our company and Utah Power due to the fact that the alley is lined with power poles. The ultimate result would be that the alley would be closed off with access granted to the necessary utility companies. Please explain how the proposed petition satisfies at least one of the following City policy • considerations: A. Lack of Use. The City's legal interest in the property appears of record or is reflected on an applicable plat, but in fact it is evident from inspection that the alley does not exist or is unusable as a public right-of-way; B. Public Safety. The existence of the alley is substantially contributing to crime, unlawful activity, unsafe conditions, public health problems,or blight in the surrounding area; C. Urban Design_ The continuation of the alley does not serve as a positive urban design element;or D. Community Purpose. The Petitioners are proposing to restrict the general public from use of the alley in favor of a community use, such as a neighborhood play area or garden. B. Public Safety. This alley has been source of crime and a gathering place for unlawful activities. We have had vehicles stolen and vandalized because of access to our business through the alley. There been occasions where transients have built fires in the alley and many times we have broken up gatherings of people that appeared to be involved in unlawful activities. C. Urban Design. I don't believe the continuation of the alley serves as a positive urban design element. The alley is surrounded by commercial use.
