Mr. Hooton said the presentation was the same as given to the Public Utilities Advisory Committee . See Attachments Alex Ikefuna, Jennifer Bruno, Wayne Mills and Doug Wheelwright briefed the Council with the attached handouts . Mr. Mills said the Council had the recommended policy and process before them for review. He said it was based on utilizing Community Development Block Grant (CDBG) funding for design costs for streets located within CDBG eligible areas . He said construction costs would come from a 50/50 cost sharing program. He said this was a housekeeping issue changing the format of the current ordinance to read more like State law. #5 . 6 : 52 :20 PM RECEIVE AN UPDATE FROM COUNCIL MEMBER JILL LOVE REGARDING LEGISLATIVE ISSUES DISCUSSED AT A RECENT UTAH LEAGUE OF CITIES AND TOWNS BOARD MEETING. Councilmember Love and Lynn Pace briefed the Council . Councilmember Love said Representative Greg Hughes was sponsoring an energy franchise fees bill to prevent cities from benefiting from gas rate increases . She said Speaker Curtis' s bill to remove sales tax from food was an issue. She said Salt Lake would be impacted due to sales tax from restaurants etc. She said zoning legislation was also being reviewed regarding restricting cities ability to zone . #6 . 6 : 47 : 31 PM TAKE A STRAW POLL TO NOMINATE COUNCIL CHAIR AND VICE CHAIR. Cindy Gust-Jenson and Chris Meeker counted the straw poll ballots . Quintana Civil Service Commission INTRODUCTION: Mayor Anderson is recommending Jack D. Quintana, resident of the County for appointment to the Civil Service Commission. If elected, Mr. Quintana would serve a term through June 30, 2011. Mr. Quintana would be replacing John Robertson, whose term has expired. APPLICANT INFORMATION: Mr. Jack D. Quintana resides at 3807 South 5200 West. Mr. Quintana is retired but works part time at Sears Grand. Mr. Quintana has a fundamental belief that if you live and work in a community one should take every opportunity to give back. Mr. Quintana feels his background and experience would make a contribution to this commission. CURRENT COMPOSITION OF BOARD: The three-member Civil Service Commission has full charge of all examinations and establishes the classified civil service list, from which appointments and promotions are made for positions in the Police and Fire Departments. The Commission also has the power to make, adopt and oversee compliance with rules and regulations to carry out the intent of civil service statues which regulate the police/fire departments. BOARD STRUCTURE: The Salt Lake City Code does not require members of the Civil Service Commission to be City residents. The current members of this board include Lisa Flores, District 5; Linda M. Kruse, District 6 and John Robertson, a County resident. A requirement in the Salt Lake City Code relating to the Civil Service Commission is that "not more than two members of the civil service commission shall at any one time be of the same political party." E-' W C..) 14 0 U MEMORANDUM DATE: January 3,2005 TO: City Council Members FROM: Jennifer Bruno,Policy Analyst RE: Dedication of Private Streets to Public Ownership,Analysis Process On April 4,2002,the Administration presented a report to the City Council that identified 60 private streets that could be candidates for public ownership. At that time, the estimate is that it would cost approximately$8.2 million to improve all 60 streets to basic City standards. The Council requested that the Administration review and come back with a recommendation for the potential funding options for these street improvements,given that some homeowners (particularly in low income neighborhoods) may be unable or unwilling to pay all or part of the improvement costs. A. The Administration's analysis (presented to the Council in 2002),identified 25,892 linear feet of private accesses and rights-of-way that could be converted to City ownership. 1. Based on this assessment and the estimated cost of$120 per linear foot for pavement improvements-total cost for improving the pavement of these streets would be$3.1 million. Estimated total costs for utility improvements would be approximately$5 million,for a total cost of$8.2 million. 2. The Administration's transmittal includes a map of the streets identified for improvement(Attachment 1 in the transmittal). The majority of these streets are located in District 4,with others scattered throughout the City. 3. The Council's previous policy was to not invest any public money in private streets. However,this was changed as the Council instituted a"pilot program" and funded the conversion of private streets on a 50/50 basis if a majority of signatures was obtained (two streets were constructed under this pilot program). B. The Administration's recommended funding policy for improving these private streets to City standards includes the following: 1. Private streets located in CDBG-eligible areas (most of the streets are located within CDBG-eligible areas): a. The private streets owners/users would apply for money for design and engineering of the street improvements through the CDBG process. No portion of the design or engineering costs would be assessed to the property owner.To submit a CDBG application,at least 51% of the private street owners would sign a petition agreeing to the following: 1. Accept the dedication of their street to the City as a public street. 2. Agree to the reconstruction of the street to City standards. 1 3. Agree to participate in an SID which requires the owners pay 50% of the costs of the improvements construction. 4. Acknowledge that the property owner will be responsible for the full cost of any private utility improvements that feed into the main utility lines from their homes. b. If the City Council approves CDBG funding for the design,a CIP application for the City's 50% share of the construction cost(SID) will be submitted for Council review. The balance of the construction costs will be assessed to the homeowners,through the previously-agreed to SID. 1. By approving CDBG design funding,the Council is not committing to approving the CIP construction money,though in order to avoid wasted CDBG resources, the project should be given a high CIP ranking. 2. Private streets located in non CDBG-eligible areas: a. The private streets owners/users would apply for CIP money for the City's 50% share of the design, engineering,and construction cost. The remaining 50% of the total costs would be assessed to the property owners through the SID process. To submit a CIP application,at least 51% of the private street owners would sign a petition agreeing to the following: 1. Accept the dedication of their street to the City as a public street. 2. Agree to the reconstruction of the street to City standards. 3. Agree to participate in an SID which requires the owners pay 50% of the costs of the improvements. 4. Acknowledge that the property owner will be responsible for the full cost of any private utility improvements that feed into the main utility lines from their homes. 3. Streets within a platted subdivision: a. It is the Administration's recommendation that public funds are not used for the improvement and dedication of these streets, as the process to create a subdivision includes documents stating that street maintenance and responsibility lies with the property owners. This means that when the property owner agrees to buy property in the subdivision,they are aware that they are responsible for maintaining any streets that exist within the subdivision. b. The Council may wish to ask of the Administration what kind of notice these property owners were given from the City, that they are responsible for the streets in their subdivision. C. The Administration's transmittal also includes the following outline of a hypothetical funding application process: 1. Interested citizens would schedule a meeting with the Division of Housing and Neighborhood Development(HAND). A representative from HAND can determine if the street is located within a CDBG eligible area. If so,the citizen may obtain a CDBG application to complete in conjunction with the petition, and if not,the citizen may obtain a CIP application. 2 2. The applicant will the be required to provide the following in an application submitted to and reviewed by HAND: a. Letter identifying the proposal including all street,ownership,and benefit information. b. Sidwell map showing the subject street. c. Information from the Engineering Division and Public Utilities including: 1. Engineering-Degree of improvements needed,cost analysis of design,cost analysis of improvements,cost analysis of on- going maintenance. 2. Public Utilities-Status of utility infrastructure,cost analysis of improvements,status of private property systems and cost to upgrade those systems if necessary. d. A petition form signed by at least 51% of the property owners agreeing to items 1-4 listed in section A for CDBG and non-CDBG eligible streets. e. Any additional information,such as a Community Council letter of support. 3. HAND staff will determine which process the application will go through (CDBG&CIP or CIP only). 4. If funding is approved,property owners will be contacted,the Engineering Division will begin design and engineering work,updating cost estimates, and begin the special improvement district process. D. The Administration's transmittal notes that there are approximately 60 streets (25,892 linear feet) that could be improved and dedicated as public right of way,for a total cost of$8.2 million(estimate from April 2002). The City Council reviewed the report and requested that the Administration recommend potential funding options to pay the design and construction costs to improve the streets to City standards and to formulate a process that property owners might pursue to obtain such funding. Background: Prior to any formal subdivision process,many parcels in Salt Lake City were created with frontage only along privately-owned streets. In some cases, the property owners own the portion of the street directly in front of their parcels. In other cases,property owners have right-of-way easements, or easement claims, over the street. In these instances,ownership of the fee title to the street it is often unknown Maintenance of these streets has become a major issue because private agreements are not recorded addressing how the streets would be maintained. Proposed Analysis and Funding Process Dedication of Existing Private Streets to Public Ownership Recommended Funding Policy for Improving Private Streets As a policy, Salt Lake City has determined that sufficient City funding is not available to pay for the entire cost of improving a private street for the purpose of dedicating that street to public ownership. If owners of a private street, or owners of property abutting a private street, are unable to pay the cost of improving a street to City standards, they may apply for supplemental funding. The supplemental funding options are limited and still require the property owners to share in the improvement cost. The following options may be considered by the City Council to provide financial aid for the improvement of private streets to public ownership. These options in no way guarantee that applicants will receive City funding. All requests require review on a case by case basis and funds should not be allocated for private streets if the allocation diverts resources from improving existing public infrastructure and investment. Funding for private streets will be part of the annual allocation of Community Development Block Grant funds (CDBG) and Capital Improvement Projects (CIP). Applications for the funding will only be accepted once a year. In addition, these funding resources should be considered for those private streets not located within a platted subdivision. If the street is located within a platted subdivision, documents would be recorded stipulating the property owners' responsibility to maintain the street. If the street is within a platted subdivision, and the property owners petition the City to dedicate the street to public ownership, a subdivision plat amendment is required. It is recommended that public funds should not be used for the improvement and dedication of private streets located within a platted subdivision unless there is an overall public benefit. Recommended Funding Options Private Street Located within a Community Development Block Grant (CDBG) Eligible Area: Owners of private streets located within a CDBG eligible area may apply for CDBG funds for the design of improving a private street to meet City standards. If approved, the CDBG funds would pay 100% of the design costs and no portion of the costs will be assessed to the owners of the private street. Private street owners would be required to submit a CDBG application with a separate signed petition form from 51% or more of the property owners agreeing to the following: 1) accept the dedication of their street to the City as a public street pursuant to Utah Code 72-5-104; 2) agree to the reconstruction of the street to city standards including removal and replacement of street pavement, sidewalk, curbing and related drainage and streetscape features and replacement or upgrade of water and sewer lines; 3) agree to participate in the Special Improvement District which requires the owners to pay 50% of the costs of the improvements and 4) acknowledge, if necessary, the property owner will be responsible for the full cost of any private utility improvements that feed into the main utility lines from their homes. A copy of the required petition form will be available when applicants pick up their CDBG application from the HAND Division. Applications will only be accepted once a year as part of the yearly allocation of CDBG funds. If the City Council approves CDBG funding for the design of the private street improvements, a CIP application for the City's 50% share of the construction cost will follow the next year for City Council review. The property owners will be responsible for 50% of the cost of all improvements, as well as the full cost of any private utility improvements that feed into the main utility lines from their homes. By approving the CDBG design funding, the City Council is not committing to approving the CIP construction money; however, the CIP construction request must be given a high priority, otherwise the CDBG design funding would be a wasted resource and effort. Private Street Not Located within a CDBG Eligible Area: Owners of private streets not located in a CDBG eligible area may apply for CIP funds for the design of improving a private street to meet City standards. If approved, 50%of the cost of the design will be included in the private street owner's share of the construction cost of the project. Private street owners would be required to submit an application for Capital Improvement Program (CIP) with a separate signed petition form from 51% or more of the property owners agreeing to the following: 1) accept the dedication of their street to the City as a public street pursuant to Utah Code 72-5-104; 2) agree to the reconstruction of the street to city standards including removal and replacement of street pavement, sidewalk, curbing and related drainage and streetscape features and replacement or upgrade of water and sewer lines; 3) agree to participate in the Special Improvement District which requires the owners to pay 50% of the costs of the improvements and 4) acknowledge, if necessary, the property owner will be responsible for the full cost of any private utility improvements that feed into the main utility lines from their homes. The 50% share of the City will be CIP funds allocated by the City Council as part of the yearly CIP allocation process. 2 Dedication of Existing Private Streets to Public Ownership Recommended Petition and Funding Application Process Step 1: Property owner(s) inquiry to the City regarding the dedication of an existing private street to public ownership (petition process) A. Administrating Division: Because these requests involve capital budget issues, the Planning Division recommends that any inquiries made to dedicate a private street to public ownership should be directed to the Division of Housing and Neighborhood Development(HAND) within the Department of Community Development. B. Initial Meeting: Interested citizens will schedule a meeting with HAND. During the meeting a representative from HAND will provide a petition form and information regarding the City's funding policy for improving and dedicating private streets. At this time, the representative from HAND can determine if the street is located within a CDBG eligible area. If so, the citizen may obtain a CDBG application to complete in conjunction with the petition. If the street is not located in a CDBG eligible area the citizen will be provided a CIP application. Also, the citizen will be informed that if the street is located within a platted subdivision, the City will not provide financial aid to improve the street unless there is an exception granted due to a public need. The citizen can be directed to the Planning Division to determine if the street is located within a platted subdivision. All interested citizens will be informed that CDBG and CIP applications are only available one time a year as part of the process currently used by Salt Lake City to fund these types of improvements. Petition Form and CIP or CDBG Application: The purpose of the petition and the application is to obtain basic information about the private street and the level of support from abutting property owners to help pay the improvement cost of the street. The applicant will be required to provide the following information: • Letter identifying the proposal. The letter should include all pertinent information, such as the location of the street, ownership information obtained through Salt Lake County records, proposed benefit to the community, etc. • Current property ownership map (known as a Sidwell Map) showing the subject street. The property ownership map will show if the street was developed within a platted subdivision. If the street is located within a platted subdivision, it would have been created through a specific process and documents would have been recorded stipulating the property owners' responsibility to maintain the street. If the street is within a platted subdivision, and the property owners petition the City to dedicate the street to public ownership, a subdivision plat amendment is required. It is recommended that public funds are not used for the improvement and dedication of these streets. • Preliminary cost estimate of street improvements. The preliminary cost estimate would be obtained from the Engineering Division for surface improvements and the Department of Public Utilities for subsurface utility work. The applicant would be directed to the Engineering Division and Public Utilities for the following information: Engineering Division - Degree of needed improvements (street pavement, curb, gutter, sidewalk, lighting, etc.). - Cost analysis of design. - Cost analysis of surface improvements (total cost, cost per foot, cost per housing unit). - Cost analysis of ongoing maintenance. Public Utilities(water, sewer, storm drainage) - Status of utility infrastructure (ex. Existing public utility lines or private utility lines). - Cost analysis of improvements to private main lines along the street (total cost, cost per foot, and cost per housing unit). - Status of systems on private property and cost to property owners to upgrade private systems to match public systems. • A petition form from each of the property owners agreeing to the following: 1) accept the dedication of their street to the City as a public street pursuant to Utah Code 72-5-104; 2) agree to the reconstruction of the street to city standards including removal and replacement of street pavement, sidewalk, curbing and related drainage and streetscape features and replacement or upgrade of water and sewer lines; 3) agree to participate in the Special Improvement District which requires the owners to pay 50% of the costs of the improvements and 4) acknowledge, if necessary, the property owner will be responsible for the full cost of any private utility improvements that feed into the main utility lines from their homes. The applicant will be required to have 51% or more of the property owners sign the petition form before the application can be accepted. • Any other pertinent information, such as, Community Council letter of support. C. Completed Petition is Returned to HAND: A representative from HAND will review the petition and application for completeness and may request review and input from other City Departments regarding the request. The review of the petition will determine the following: ❑ Is the street within a CDBG area? If so, the petitioner is eligible to apply for CDBG funding for the design of the 2 required street improvements. ❑ Is the street within a platted subdivision, apartment/condo complex, or mobile home park? If so, the street is not eligible to receive City funding aid unless an exception is granted due to public need. The applicant can be directed to the Planning Division to discuss a subdivision amendment process to dedicate the street to the City. The property owners within the subdivision would be responsible for improvements to the street. ❑ Is there support from abutting property owners to pay their share of the costs to improve the street? Step 2: Funding Process Applications will be reviewed by appropriate HAND staff to determine if the application contains all of the necessary information. If deemed eligible, the application will be processed as part of the established process used by Salt Lake City to review funding applications. Applications will be reviewed and funding recommendations will be made by the appropriate citizen's board and the Mayor. The citizen's board and the Mayor's recommendations are both forwarded to the City Council who makes final funding decisions. Applications may or may not be approved by the City Council depending on the project and the availability of funds. If funding is approved the property owners will be contacted and an application for the City's share of the construction costs will be submitted in the next round of funding for CIP projects. CDBG funds cannot be used for the City's share of the construction cost; therefore, all applications will need to be submitted as part of the CIP funding process. If funding is approved for the City's share of the construction cost the following will occur: 1. The Salt Lake City Engineering Division will start the design and engineering work and update the cost estimates for the construction work, including the property owners' portion. 2. The Engineering Division will begin the special improvement district process. 3. The City will prepare legal documents (the final recorded document is called the "Notice of Public Dedication of Roadway) to dedicate the street to Salt Lake City for public use. 4. The SID will be approved pending recording the "Notice of Public Dedication of Roadway." 3 5. The "Notice of Public Dedication of Roadway" will be recorded with the Salt Lake County Recorder. 6. The construction bid will be advertised and awarded. The street will then be improved to City standards and become part of the public street system. 4 II. Private Street Report CITY COUNCIL POLICY DISCUSSION PRIVATE STREETS Reviewed by the Salt Lake City Council on April 4, 2002 BACKGROUND Within the past few years,the Salt Lake City Administration has received a number of requests from owners of residential properties that front on privately owned streets, to improve and dedicate those streets to public ownership. These requests are mainly from residents who live on private mid-block streets in older, moderate to low-income neighborhoods within the Central Community. Changes in property ownership have resulted in many property owners being unaware that their street is private and asking why their street is not being maintained when they pay the same amount of taxes for municipal services as owners of similar properties fronting public streets. Many of these private streets do receive some City services such as garbage collection and snow removal. Others,such as Fenway Avenue, have City posted "No Parking" signs and the City generates revenue from parking tickets distributed on those streets. Since the dedication and improvement of additional streets will have a significant ongoing financial impact, the City needs to decide how to address this issue. ANALYSIS Private Streets Identified Attachment 1 shows the distribution of all known private streets throughout the City. Each street is identified as either a: • Private Access; • Private Right-of-Way; • PUD(Planned Development) and Condos; or • Apartments and Trailer Parks These classifications are defined as follows: Private Access: Adjacent property owners own the street, usually to the centerline. Private Right-of-Way: Adjacent property owners do not own the street; however,they have a right-of-way easement over the street. Planned Developments and Condos: Private streets created within planned developments and condominium projects. By ordinance, new private streets within planned developments and condos require a maintenance fund to be established so that the streets can be maintained. Apartments and Trailer Parks: Private streets that serve either as driveways or internal circulation systems for apartments and trailer parks. 1 The majority of inquiries received from property owners are regarding private access and rights-of-way that are characteristically narrow streets located in the middle of the ten acre blocks in the Central Community. The adjacent land use is typically single-family residential. For the purpose of this analysis, calculations were made only on private rights-of-way and accesses that have residential properties fronting the street. Most of these streets are zoned residential; however, some may be identified that are zoned non-residential. Those that are zoned non-residential are mainly in or near the Central Business District and further analysis of the viability and future of these residential pockets may result in some of these streets being considered a lower priority for street and utility improvements Private streets that have residential frontage but have been targeted for redevelopment have been excluded from the calculations. Streets that provide frontage for planned developments and condominiums have not been included in staff's calculations because these properties were specifically designed to a private street standard. As indicated above, newer planned development and condominium developments are required to provide funds for street maintenance. Older developments may, or may not, have street maintenance funds set aside, but staff has viewed these streets as a lesser priority and costs of accepting and improving these streets have not been calculated. Costs for improving apartments and trailer court private streets and driveways have also not been calculated because they serve as access and circulation to those developments only. These generally have street names but were not created for the purpose of public access. Attachment 2 contains a spreadsheet of all known private streets. Those that are residential are highlighted. A map has been included to show the distribution of these streets. The following summarizes the number of identified residential private accesses and rights-of-way and their total number of lineal feet: Number of Private Accesses = 10 Number of Private Rights-of-way= 50 Total=60 Total linear feet of Private Accesses=4,457 feet Total liner feet of Private Rights-of-way=21,435 feet Total=25,892 feet Estimated Improvement Costs As is stated above, many of the residential private accesses and rights-of-way have become deteriorated. The Salt Lake City Engineering Division and Public Utilities Department have calculated the following cost estimates for the City to improve all of the identified residential private accesses and right-of-ways. The calculations are based on a rough estimate only, as each street differs in width and magnitude of deterioration. Pavement Calculations are based on an average street width of 15 feet. Overall Total Length of Residential Private Rights-of-Way and Accesses =25,892 feet Estimated cost of Pavement Improvements=$120.00 per linear foot Estimated Total Cost: 25,892 linear feet @$120.00 per linear foot= $3,107,040.00 2 Utility Improvements(Attachment 3 Provides a Cost Estimate by Street for Each Type of Improvement) Water=$1,581,310 Sanitary Sewer=$2,666,000 Drainage=$799,800 Total Estimated Cost=$5,047,110 Total Estimated cost of surface and utility improvements combined: $8,154,150 Funding Options Most of the requests by property owners to have their private street dedicated to the City are the result of the street becoming deteriorated, and the property owners' expectation that the City will provide maintenance. The cost of upgrading the street to the required standards is significant. There are several potential funding options to assist in the reconstruction of private streets. The following is a list of those options with some accompanying facts: Community Development Block Grant Program (CDBG) • Funding is limited. • Applicants may apply for, and receive, design funding prior to the street becoming publicly owned. The City must own the street before construction funding is received. • All property owners that own a portion of the street must be in support of dedicating the street to the City. • The City follows a street dedication policy that involves input from abutting property owners and affected City Departments. • The street must be located within a CDBG eligible district. The map in Attachment 2 shows which private residential streets fall within CDBG eligible areas. • Since 1981,thirty-nine private streets have been improved and dedicated to the City through the CDBG program. Attachment 4 contains a spreadsheet listing those streets and a map showing the distribution. Capital Improvement Program (CIP) • Funding is limited. • Funding private streets reduces available funds for a backlog of needs on existing public streets. • CIP funds can be used for public infrastructure only. A private street must be dedicated to the City prior to when the CIP board and staff present recommendations for funding to the Mayor.This causes a problem because the City is reluctant to take on a private street before funding is available. Special Improvement District(SID) • Costs to upgrade a private street may be shared by the City. • The program is similar to the CIP in that Special Improvement District funds must be used for public infrastructure. 3 General Fund • All applicable City departments could budget for additional street design,construction and maintenance money. Implementation Strategies to Aid the Funding Options Reversionary Clause • The City may elect to assume responsibility for a street without improvement funding secured. A reversionary clause would dedicate the street to the City; however, if funding were not received to upgrade the streets within an established time frame, the street would revert back to private ownership. This may allow for a more effective facilitation of the funding mechanisms mentioned above by assuring that public money would be spent on public infrastructure. City Initiated Block Redesign • The City assumes responsibility for design and funding of street and related block improvements in the form of a small area plan. • Funding would need to come from one of the above-mentioned funding options. Estimated Maintenance Costs When the City improves and assumes responsibility of a street, the City also assumes the responsibility of maintaining that street. The following numbers are rough estimates of the yearly maintenance cost of an average 15' wide street. Pavement Asphalt surface= $ .40 per linear foot Concrete surface=$ .25 per linear foot based on the replacement of 10% of concrete slabs over 20 years. Surface improvements do not necessarily occur on a yearly basis. Utilities Water=$1.08 per linear foot Sewer=$ .75 per linear foot Drainage=$ .73 per linear foot Utility maintenance includes cleaning out sewers and drains, exercising water valves, and flushing hydrants. Public Services Snow Removal=$0.10 per linear foot Signage=$0.01 per linear foot 4 Signage may include new street identification signs, no parking signs, dead end signs, etc. CONCLUSION In summary, Salt Lake City's transportation infrastructure consists of many privately owned streets. Through time several of these streets have become deteriorated resulting in property owners requesting the City to make improvements and take ownership of these accesses and rights of-way. An initial estimate of$8,154,150 will be needed to improve the sixty private residential accesses and rights-of-way identified in this report. Options exist within Salt Lake City's current funding programs; however, the use of programs such as the CIP and SID result in the reduction of money available to improve the City's existing public infrastructure. The report does show that the past program of using CDBG funds to dedicate and upgrade private streets has provided a beneficial improvement to many residential interior block streets. The Administration is scheduled to brief the City Council on January 3. The Administration transmittal letter recommended that the City Council hold a public hearing on the proposed amendments. However,it has since been determined that no public hearing is necessary. Given that,the City Council could forward the proposed amendments for formal consideration on any future agenda. OPTIONS • Adopt the proposed amendments. • Do not adopt the proposed amendments. MOTIONS • I move that the City Council adopt the ordinance amending, repealing and enacting sections of City Code Chapter 12 pertaining to the operation of bicycles. • I move that the City Council consider the next item on the agenda. KEY POINTS • Most of the proposed amendments either are designed to mirror Utah laws regulating bicycles or are format changes to make the current ordinances read better. • According to the Administration's transmittal, the proposed amendments would change two ordinances that are stricter than state law so the two codes would match. 1. One amendment to Section 12.44.080 would allow cyclists to ride on the shoulders of limited access roadways such as freeways "except where prohibited by federal or state law or regulation or by an official sign giving notice of such restrictions. As a practical matter,the proposed amendment would allow cyclists to ride on the right-hand shoulders of Interstate 80 west of 5600 West Street 1 within the Salt Lake City limit. Utah Department of Transportation policies allow cyclists to ride there, and a UDOT map identifies the location as a place to ride. 2. The other amendment would allow people to ride bicycles on sidewalks even if there is a bicycle lane available on a roadway. It might be noted that the current and proposed ordinances allow bicycle riders to ride on sidewalks throughout the City except in the "Central Traffic District." The district is defined as the area roughly bordered by North Temple, 200 East, 500 South and 400 West streets. • The proposed amendments are designed to meet the goal of streamlining the application of City ordinances pertaining to bicycles and pedestrians recommended by the Salt Lake City Bicycle and Pedestrian Master Plan. BACKGROUND/DISCUSSION The proposed amendments largely are designed to bring City Code into conformance with Utah laws regulating the operation of bicycles and to make the City Code sections easier to read. It should be noted that the Administration transmittal letter indicated that Section 12.44.080 described in the Key Points section would allow cyclists to ride on the right-hand shoulders of Interstate 80 in Parley's Canyon.The Administration has since indicated that the proposed amendment would affect only bicycle riders in Salt Lake City on I-80 west of 5600 West Street. UDOT policies appear to allow bicycle riders to ride on the right-hand shoulders of I-80 in Parley's Canyon as well as west of 5600 West Street, but the part of Parley's Canyon open to cyclists is outside the Salt Lake City limits. Updating these Sections is in keeping with the recently adopted Salt Lake City Bicycle& Pedestrian Master Plan Section 7.10,page 39,which states "Salt Lake City may have ordinances and code language affecting bicycle and pedestrian facilities and circulation that are no longer applicable and may be considered anachronistic. Determining these and either amending or deleting such references will serve to streamline application of codes. " Analysis: Besides modifying current language in the City Code to create consistency with the State Code, Staff proposes two new rule changes to the City Code that will bring it into harmony with best practices. The two rules are exclusive to the City and are stricter than the rules currently found in State Code. The proposed changes are as follows: City Code Section 12.44.080 Limited Access Roadways- Use Restrictions: Currently, City Code does not allow bicyclists to ride on any limited-access roadways within the City. The proposed change reflects State/UDOT policy to allow bicycles to use the shoulders of limited- access roadways except where prohibited by Federal or State law or regulation or by official signs giving notice of such restrictions. The restrictions generally occur in high population areas where there are reasonable alternative routes. According to the map, within Salt Lake City bicyclists may ride on the shoulders of I-80 west of 5600 West and within Parley's Canyon. City Code Section 12.80.070(A)(8)Riding Rules and Regulations— Unlawful Acts: This Section restricts bicycles from using sidewalks or automobile travel lanes at locations with bicycle lanes. Transportation Staff recommends this wording be removed since City Code 12.80.070(A) and State Code 41-6a-1105(1) already require bicyclists to ride as near as practicable to the right- hand edge of all roadways except when: (a) overtaking and passing another bicycle or vehicle proceeding in the same direction; (b) preparing to make a left turn at an intersection or into a private road or driveway; (c) traveling straight through an intersection that has a right-turn only lane that is in conflict with the straight through movement; or (d) reasonably necessary to avoid conditions that make it unsafe to continue along the right-hand edge of the roadway including: (i) fixed or moving objects; (ii) parked or moving vehicles; (iii) bicycles; (iv) pedestrians; (v) animals; (vi) surface hazards; or (vii) a lane that is too narrow for a bicycle and a vehicle to travel safely side by side within the lane. The wording removal will also allow bicyclists (including young children)to ride their bicycles on sidewalks along roadways with bike lanes. Public Process: The Transportation Advisory Board discussed the proposed code revisions at their meetings on May 5 and August 4, 2003, at which time they endorsed the proposed changes. The Mayor's Bicycle Advisory Committee (MBAC)discussed the proposed code revisions in their monthly meetings over the past two years. At the October 12, 2005, meeting the MBAC finalized their discussion and endorsed the proposed code revisions. B. Whenever a requirement is made as to distance from which certain lamps and devices shall render objects visible or within which the lamps or devices shall be visible, the provisions apply during the times specified under Subsection(A) for a vehicle without load on a straight, level, unlighted roadway under normal atmospheric conditions, unless a different time or condition is expressly stated. C. Whenever a requirement is made as to the mounted height of lamps or devices it shall mean from the center of the lamp or device to the level ground upon which the vehicle stands when the vehicle is without a load. 2 SECTION 4. That Section 12.36.010,Salt Lake City Code, pertaining to speed and operation to conform to existing conditions be, and the same hereby is, amended to read as follows: 12.36.010 Speed And Operation To Conform To Existing Conditions: Every person driving a vehicle or riding a bicycle on a street or alley shall operate the same at a speed and in a manner which is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing,and every driver of a vehicle, in compliance with legal requirements and the duty to use due care, shall use every reasonable means to avoid endangering or colliding with any person, vehicle or other object. SECTION 5. That Section 12.44.080,Salt Lake City Code,pertaining to limited access roadways be, and the same hereby is, amended to read as follows: 12.44.080 Limited Access Roadways -Use Restrictions: No pedestrian, bicycle or other nonmotorized traffic, excluding bicyclists, shall use any limited access roadway except for the sole purpose of crossing the same in the shortest and most direct route,and then only at designated crossings, and such traffic shall yield the right of way to any motorized traffic proceeding upon the limited access roadway. Bicyclists may use the right shoulder of limited access highways except where prohibited by federal or state law or regulation or by an official sign giving notice of such restrictions.No driver shall stop a vehicle on any limited access roadway for the purpose of taking on or discharging any passenger. SECTION 6. That Section 12.48.040,Salt Lake City Code,pertaining to emerging from or entering alleys or driveways be, and the same hereby is, amended to read as follows: 112.48.040 Sidewalks -Driving Prohibited—Exceptions - Emerging From Or Entering Alleys Or Driveways: A. Except for a bicycle or device propelled by human power, a person may not operate a vehicle on a sidewalk or sidewalk area. The provisions of this subsection do not apply on a driveway. B. The driver of a vehicle or rider of a bicycle emerging from an alley,private driveway, building or other place shall stop such vehicle or bicycle immediately prior to driving onto a sidewalk or onto the sidewalk area extending across any alley or private 3 driveway, yielding the right of way to any pedestrian or bicycle within or about to enter such sidewalk or sidewalk area as may be necessary to avoid collision and, upon entering the roadway, shall yield the right of way to all vehicles approaching on said roadway. C. The driver of a vehicle or rider of a bicycle entering an alley or private driveway shall yield the right of way to any pedestrian or bicycle within the sidewalk area extending across such alley, or private driveway. D. The driver of a vehicle or rider of a bicycle emerging from an alley or private driveway onto a roadway shall turn such vehicle only to the right, unless a different movement can be made in safety and without interfering with other traffic. SECTION 7. That Section 12.52.100, Salt Lake City Code, pertaining to opening vehicle doors in traffic be, and the same hereby is, amended to read as follows: 12.52.100 Opening Vehicle Doors In Traffic: A. N shall e „ the door e f enter:, em e f:... a .vehicle i., the path of any approaching vehicle or bicycle. A person may not open the door of any vehicle on a side available to moving traffic or emerge from any vehicle unless it can be done safely and without interfering with the movement of other traffic. B. A person may not leave a door open on a side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers. CB. No person shall open any vehicle door at any time when such vehicle is in motion. SECTION 8. That Section 12.52.140, Salt Lake City Code,pertaining to bicycle lanes and vehicle restrictions be, and the same hereby is, amended to read as follows: 12.52.140 Bicycle Lanes - Vehicle Restrictions: No motor vehicle shall at any time be driven within or through, or parked or stopped within a marked bicycle lane, except to briefly cross such lane to turn into an intersection, street, alley, driveway or other parking area. Any vehicle so turning must yield the right of way to all bicycles within the lane that are close enough to constitute an immediate hazard. No motor vehicle may use a bicycle lane as a turning lane. On all roads with no bicycle lane,operators of bicycles have the same rights, duties and responsibilities as operators of motor vehicles. SECTION 9. That Section 12.52.145,Salt Lake City Code, pertaining to operation of motor vehicle near bicycle be, and the same hereby is, enacted to read as follows: 12.52.145 Operation of motor vehicle near bicycle prohibited 4 An operator of a motor vehicle may not knowingly, intentionally, or recklessly operate a motor vehicle within three feet of a moving bicycle, unless the operator of the motor vehicle operates the motor vehicle within a reasonable and safe distance of the bicycle. SECTION 10. That Section 12.80.035, Salt Lake City Code, pertaining to bicycle inspections be, and the same hereby is, enacted to read as follows: 12.80.035 Bicycle inspections -- At request of officer. A peace officer may at any time require a person riding a bicycle to stop and submit the bicycle to an inspection and a test as appropriate if the officer has reasonable cause to believe that: (1) the bicycle is unsafe or not equipped as required by law; or (2) the bicycle's equipment is not in proper adjustment or repair. SECTION 11 That Section 12.80.040, Salt Lake City Code, pertaining to bicycle riders subject to traffic regulations be, and the same hereby is, amended to read as follows: 12.80.040 Bicycle and device propelled by human power subject to title-- Exception.: A. E e > ways of this cityl r, ,�, this t� inclu • this title, or its successor, applicable to the driver of a motor vehicle, Except as provided under Subsection (B) or as otherwise specified under this part, a person operating a bicycle or a vehicle or device propelled by human power has all the rights and is subject to the provisions of this title applicable to the operator of any other vehicle except as to special regulations of this code or those provisions which by their nature can have no application. SECTION 12. D.A bicycle or its rider may be equipped with lights or reflectors in addition to those required by subsections B and C of this section. SECTION 13. That Section 12.80.061, Salt Lake City Code, pertaining to prohibited equipment and requirement of brakes on bicycles be, and the same hereby is, enacted to read as follows: 12.80.061 Bicycle-- Prohibited equipment-- Brakes required. A. A bicycle may not be equipped with, and a person may not use on a bicycle, a siren or whistle. B. Every bicycle shall be equipped with a brake or brakes which enable its driver to stop the bicycle within 25 feet from a speed of ten miles per hour on dry, level, clean pavement. SECTION 14. That Section 12.80.065, Salt Lake City Code, pertaining to bicycle lamps and reflective material required be, and the same hereby is, enacted to read as follows: 12.80.065 Bicycles --Lamps and reflective material required. A. Every bicycle in use at the times described in Section 12.28.095 shall be equipped with a: 1. Lamp of a type approved by the Utah Department of Public Safety which is on the front emitting a white light visible from a distance of at least 500 feet to the front; and 6 2. a. Red reflector of a type approved by the Utah Department of Public Safety which is visible for 500 feet to the rear when directly in front of lawful lower beams of head lamps on a motor vehicle; or b. Red taillight designed for use on a bicycle and emitting flashing or nonflashing light visible from a distance of 500 feet to the rear. B. Every bicycle when in use at the times described in Section 12.28.095 shall be equipped with: 1. Reflective material of sufficient size and reflectivity to be visible from both sides for 500 feet when directly in front of lawful lower beams of head lamps on a motor vehicle; or 2. In lieu of reflective material, a lighted lamp visible from both sides from a distance of at least 500 feet. C. A bicycle or its rider may be equipped with lights or reflectors in addition to those required by Subsections (1) and (2). SECTION 15. That Section 12.80.070,Salt Lake City Code, pertaining to riding rules and regulations be, and the same hereby is,repealed. 12.80.070 Riding Rules And Regulati.,.,��Unl A.It is unlawful for operators of bicycles: 1. When riding upon a sidewalk to fail to yield the right of way to pedestrians and sound a warning device before overtaking or passing any pedestrian; 2. To ride more than two (2) abr ast upon any street; 3. To proceed other than single file upon any sidewalk; 1. To carry extra passengers or carry any packages, bundles or articles which would require the removal of the hand or hands from the handlebars of the bicycle; 5. To permit the bicycle such operator is riding to be towed by another vehicle or bicycle; 6. To ride any bicycle upon any sidewalk within the "central traffic district", as defined in section 12.04.1)90 of this title, or its successor, and as described in schedule 1 of this title, set out in chapter 12.101 of this title, or its successor, and made a part hereof by reference, or on any other area where prohibited by signs, provided, however, the 7. That Section 12.80.075,Salt Lake City Code, pertaining to carrying more persons than design permits be, and the same hereby is, enacted to read as follows: 12.80.075 Carrying more persons than design permits prohibited --Exception. A. Except as provided in Subsection B, a bicycle may not be used to carry more persons at one time than the number for which it is designed or equipped. B. An adult rider may carry a child securely attached to the adult rider's person in a back pack or sling. SECTION 17. That Section 12.80.085,Salt Lake City Code, pertaining to persons on bicycles, skates and sleds not to attach to moving vehicles be, and the same hereby is, enacted to read as follows: 12.80.085 Persons on bicycles, skates and sleds not to attach to moving vehicles -- Exception. (l) A person riding a bicycle, coaster, skateboard, roller skates, sled, or toy vehicle may not attach it or a person to any moving vehicle on a roadway. (2) This section does not prohibit attaching a trailer or semitrailer to a bicycle if that trailer or semitrailer has been designed for attachment. SECTION 18. That Section 12.80.095, Salt Lake City Code,pertaining to operation of bicycles on and use of roadway be, and the same hereby is, enacted to read as follows: 12.80.095 Operation of bicycle on and use of roadway--Duties, prohibitions. A. A person operating a bicycle on a roadway at less than the normal speed of traffic at the time and place and under the conditions then existing shall ride as near as practicable to the right-hand edge of the roadway except when: 8 1. overtaking and passing another bicycle or vehicle proceeding in the same direction; 2. preparing to make a left turn at an intersection or into a private road or driveway., 3. traveling straight through an intersection that has a right-turn only lane that is in conflict with the straight through movement; or 4. reasonably necessary to avoid conditions that make it unsafe to continue along the right-hand edge of the roadway including: a. fixed or moving objects; b. parked or moving vehicles; c. bicycles; d. pedestrians; e. animals; f. surface hazards; or g. a lane that is too narrow for a bicycle and a vehicle to travel safely side by side within the lane. B. A person operating a bicycle on a roadway shall operate in the designated direction of traffic. C. 1. A person riding a bicycle on a roadway may not ride more than two abreast with another person except on paths or parts of roadways set aside for the exclusive use of bicycles. 2. If allowed under Subsection C(1), a person riding two abreast with another person may not impede the normal and reasonable movement of traffic and shall ride within a single lane. D. If a usable path for bicycles has been provided adjacent to a roadway, a bicycle rider may be directed by a traffic-control device to use the path and not the roadway SECTION 19. That Section 12.80.105, Salt Lake City Code,pertaining to bicycles and human powered vehicles to yield right-of-way be, and the same hereby is, enacted to read as follows: 12.80.105 Bicycles and human powered vehicle or device to yield right-of-way to pedestrians on sidewalks, paths, or trails --Uses prohibited-- Negligent collision prohibited -- Speed restrictions -- Rights and duties same as pedestrians. A. A person operating a bicycle or a vehicle or device propelled by human power shall: I. Yield the right-of-way to any pedestrian; and 2. Give an audible signal before overtaking and passing a pedestrian. B. A person may:not operate a bicycle or a vehicle or device propelled by human power on a sidewalk, path, or trail, or across a roadway in a crosswalk, where prohibited by a traffic-control device or ordinance. C. A person may not operate a bicycle or a vehicle or device propelled by human power in a negligent manner so as to collide with a: 9 1. Pedestrian; or 2. Person operating a: a. Bicycle; or b. Vehicle or device propelled by human power. D. A person operating a bicycle or a vehicle or device propelled by human power on a sidewalk,path, or trail, or across a driveway, or across a roadway on a crosswalk may not operate at a speed greater than is reasonable and prudent under the existing conditions, giving regard to the actual and potential hazards then existing. E. Except as provided under Subsections A and D, a person operating a bicycle or a vehicle or device propelled by human power on a sidewalk, path, or trail, or across a roadway on a crosswalk, has all the rights and duties applicable to a pedestrian under the same circumstances. F. A person operating a bicycle or a vehicle or device propelled by human power on a sidewalk shall proceed only in single file. SECTION 20. That Section 12.80.110, Salt Lake City Code, pertaining to bicycles —carrying bundles be, and the same hereby is, enacted to read as follows: 12.80.110 Bicycles - Carrying bundle-- One hand on handlebars. A. A person operating a bicycle may not carry any package, bundle, or article which prevents the use of both hands in the control and operation of the bicycle. B. A person operating a bicycle shall keep at least one hand on the handlebars at all times. SECTION 21 That Section 12.80.120, Salt Lake City Code, pertaining to bicycles parking on sidewalk or roadway be, and the same hereby is, enacted to read as follows: 12.80.120 Bicycles -- Parking on sidewalk, roadway--Prohibitions. A. A person may park a bicycle on a sidewalk unless prohibited or restricted by a traffic-control device. B. A bicycle parked on a sidewalk may not impede the normal and reasonable movement of pedestrian or other traffic. C. A bicycle may be parked on the roadway at any location where parking is allowed: 1. At any angle to the curb or edge of the roadway; and 2. Abreast of another bicycle or bicycles near the side of the roadway. D. A bicycle may not be parked on a roadway in a manner as to obstruct the movement of a legally parked motor vehicle. E. In all other respects, bicycles parked anywhere on a roadway shall conform with the provisions of Chapter 12.56, regarding the parking of vehicles. 10 SECTION 22. That Section 12.80.130, Salt Lake City Code, pertaining to bicycles, turns and designated lanes be, and the same hereby is, enacted to read as follows: 12.80.130 Bicycles -- Turns -- Designated lanes. A. A person riding a bicycle and intending to turn left shall comply with Section 12.44.120 or Subsection B. B. 1. A person riding a bicycle intending to turn left shall approach the turn as close as practicable to the right curb or edge of the roadway. 2. After proceeding across the intersecting roadway, to the far corner of the curb or intersection of the roadway edges, the bicyclist shall stop, as far out of the way of traffic as practical. 3. After stopping, the bicyclist shall yield to any traffic proceeding in either direction along the roadway he had been using. 4. After yielding and complying with any traffic-control device or peace officer regulating traffic, the bicyclist may proceed in the new direction. C. 1. Notwithstanding Subsections A and B, the city transportation engineer may place traffic-control devices that require and direct turning bicyclists to travel a specific course. 2. When the devices are placed under Subsection C(1), a person may not turn a bicycle other than as directed by the devices. SECTION 23. That Section 12.80.140,Salt Lake City Code, pertaining to bicycle turn signals be, and the same hereby is, enacted to read as follows: 12.80.140 Bicycles -- Turn signals -- Exceptions. A. Except as provided in this section, a person riding a bicycle shall comply with Section 12.44.140 regarding turn signals and turning. B. A person is not required to signal by hand and arm continuously if the hand is needed in the control or operation of the bicycle. C. A person operating a bicycle who is stopped in a lane designated for turning traffic only is not required to signal prior to making the turning movement. D. A person operating a bicycle may give the required hand and arm signal for a right turn by extending the right hand and arm horizontally to the right. SECTION 24. That Section 12.80.150, Salt Lake City Code, pertaining to operation of bicycle on one-way roadway be, and the same hereby is, enacted to read as follows: 11 12.80.150 Operation of bicycle on one-way roadway On a roadway, other than a limited access highway, designed and signposted for one-way traffic and which has two (2) or more marked traffic lanes, a person operating a bicycle may ride as near to the left side of the left through lane as is safe. SECTION 25. That Section 12.80.160, Salt Lake City Code, pertaining to central traffic district bicycle riding restriction be, and the same hereby is, enacted to read as follows: 12.80.160 Central Traffic District bicycle riding restriction It is unlawful for operators of bicycles to ride any bicycle upon any sidewalk within the "central traffic district", as defined in section 12.04.090 of this title, or its successor, and as described in schedule 1 of this title, set out in chapter 12.104 of this title, or its successor, and made a part hereof by reference, or on any other area where prohibited by signs, provided, however, the foregoing shall not apply to police officers in the scope and course of their employment; SECTION 26. That Section 12.80.170,Salt Lake City Code, pertaining to bicycle racing be, and the same hereby is, enacted to read as follows: 12.80.170 Bicycle racing-- When approved-- Prohibitions -- Exceptions -- Authorized exemptions from traffic laws. A. Bicycle racing on roadways is prohibited under Section 12.36.040, except as authorized in this section. B. 1. Bicycle racing on a roadway is permitted when a racing event is approved by the city transportation engineer on a roadway under its jurisdiction. 2. Approval of bicycle roadway racing events may be granted only under conditions: a. Which assure reasonable safety for all race participants, spectators, and other roadway users; and b. Which prevent unreasonable interference with traffic flow which would seriously inconvenience other roadway users. C. Participants in an approved bicycle roadway racing event may be exempted from compliance with any traffic laws otherwise applicable: 1. By agreement with the city; and 2. If traffic control is adequate to assure the safety of all roadway users. 12 SECTION 27. That Section 12.80.080, Salt Lake City Code, pertaining to alteration of license or frame number be, and the same hereby is, amended to read as follows: 112.80.1080 Alteration Of License Or Frame Number Prohibited: No person shall wilfully or maliciously destroy, mutilate or alter the number of any bicycle frame number, any bicycle license issued pursuant to this code or remove, destroy or mutilate any license decal while the same is valid, or operate any vehicle without having attached thereto a valid license decal issued as provided in this code. SECTION 28. That Section 12.80.090, Salt Lake City Code, pertaining to bicycle license suspension or revocation be, and the same hereby is, amended to read as follows: I 12.80.1090 License- Suspension Or Revocation When - Impoundment: A._The city judges or judges of juvenile courts who hear traffic cases are hereby empowered to revoke or suspend the license of any bicycle when it appears that the owner of any bicycle is not the licensee of record, or that the owner of the bicycle or the licensee thereof has used or knowingly permitted the bicycle to be used in violation of this code. B._The police department is hereby directed and authorized to impound any bicycle so used in violation of this code for a reasonable period of time pending investigation of any alleged violation of this code, or until such bicycle is registered and licensed by the owner thereof and equipped as herein provided. SECTION 29. That Section 12.80.100, Salt Lake City Code, pertaining to bicycle violations and penalties be, and the same hereby is, amended to read as follows: 112.80.24-00 Violation - Penalty: An operator of a bicycle who violates any of the provisions of this chapter shall be punished as an infraction in accordance with subsection 12.12.010B of this title, or its successor. B. Whenever a requirement is made as to distance from which certain lamps and devices shall render objects visible or within which the lamps or devices shall be visible, the provisions apply during the times specified under Subsection(A) for a vehicle without load on a straight, level, unlighted roadway under normal atmospheric conditions, unless a different time or condition is expressly stated. C. Whenever a requirement is made as to the mounted height of lamps or devices it shall mean from the center of the lamp or device to the level ground upon which the vehicle stands when the vehicle is without a load. SECTION 4. That Section 12.44.080,Salt Lake City Code,pertaining to limited access roadways be, and the same hereby is, amended to read as follows: 12.44.080 Limited Access Roadways- Use Restrictions: No pedestrian or other nonmotorized traffic, excluding bicyclists, shall use any limited access roadway except for the sole purpose of crossing the same in the shortest and most direct route, and then only at designated crossings, and such traffic shall yield the right of way to any motorized traffic proceeding upon the limited access roadway. Bicyclists may use the right shoulder of limited access highways except where prohibited by federal or state law or regulation or by an official sign giving notice of such restrictions.No driver shall stop a vehicle on any limited access roadway for the purpose of taking on or discharging any passenger. That Section 12.52.140, Salt Lake City Code, pertaining to bicycle lanes and vehicle restrictions be, and the same hereby is, amended to read as follows: 12.52.140 Bicycle Lanes -Vehicle Restrictions: No motor vehicle shall at any time be driven within or through, or parked or stopped within a marked bicycle lane, except to briefly cross such lane to turn into an intersection, street, alley, driveway or other parking area. Any vehicle so turning must yield the right of way to all bicycles within the lane that are close enough to constitute an immediate hazard. No motor vehicle may use a bicycle lane as a turning lane. SECTION 9. That Section 12.52.145, Salt Lake City Code, pertaining to operation of motor vehicle near bicycle be, and the same hereby is, enacted to read as follows: 12.52.145 Operation of motor vehicle near bicycle prohibited An operator of a motor vehicle may not knowingly, intentionally, or recklessly operate a motor vehicle within three feet of a moving bicycle,unless the operator of the motor vehicle operates the motor vehicle within a reasonable and safe distance of the bicycle. SECTION 10. That Section 12.80.035, Salt Lake City Code, pertaining to bicycle inspections be, and the same hereby is, enacted to read as follows: 12.80.035 Bicycle inspections -- At request of officer. A peace officer may at any time require a person riding a bicycle to stop and submit the bicycle to an inspection and a test as appropriate if the officer has reasonable cause to believe that: 4 (1) the bicycle is unsafe or not equipped as required by law; or (2) the bicycle's equipment is not in proper adjustment or repair. SECTION 11 That Section 12.80.040, Salt Lake City Code, pertaining to bicycle riders subject to traffic regulations be, and the same hereby is, amended to read as follows: 12.80.040 Bicycle and device propelled by human power subject to title-- Exception.: A. Except as provided under Subsection(B) or as otherwise specified under this part, a person operating a bicycle or a vehicle or device propelled by human power has all the rights and is subject to the provisions of this title applicable to the operator of any other vehicle except as to special regulations of this code or those provisions which by their nature can have no application. B. A person operating a bicycle or a vehicle or device propelled by human power is not subject to the penalties related to operator licenses under alcohol and drug-related traffic offenses. SECTION 12. That Section 12.80.060,Salt Lake City Code,pertaining to brakes, lights and other equipment be, and the same hereby is, repealed. SECTION 13. That Section 12.80.061, Salt Lake City Code,pertaining to prohibited equipment and requirement of brakes on bicycles be, and the same hereby is, enacted to read as follows: 12.80.061 Bicycle-- Prohibited equipment-- Brakes required. A. A bicycle may not be equipped with, and a person may not use on a bicycle, a siren or whistle. B. Every bicycle shall be equipped with a brake or brakes which enable its driver to stop the bicycle within 25 feet from a speed of ten miles per hour on dry, level, clean pavement. SECTION 14. That Section 12.80.065, Salt Lake City Code,pertaining to bicycle lamps and reflective material required be, and the same hereby is, enacted to read as follows: 5 12.80.065 Bicycles -- Lamps and reflective material required. A. Every bicycle in use at the times described in Section 12.28.095 shall be equipped with a: 1. Lamp of a type approved by the Utah Department of Public Safety which is on the front emitting a white light visible from a distance of at least 500 feet to the front; and 2. a. Red reflector of a type approved by the Utah Department of Public Safety which is visible for 500 feet to the rear when directly in front of lawful lower beams of head lamps on a motor vehicle; or b. Red taillight designed for use on a bicycle and emitting flashing or nonflashing light visible from a distance of 500 feet to the rear. B. Every bicycle when in use at the times described in Section 12.28.095 shall be equipped with: 1. Reflective material of sufficient size and reflectivity to be visible from both sides for 500 feet when directly in front of lawful lower beams of head lamps on a motor vehicle; or 2. In lieu of reflective material, a lighted lamp visible from both sides from a distance of at least 500 feet. C. A bicycle or its rider may be equipped with lights or reflectors in addition to those required by Subsections (1) and (2). SECTION 15. That Section 12.80.070, Salt Lake City Code, pertaining to riding rules and regulations be, and the same hereby is, repealed. SECTION 16. That Section 12.80.075, Salt Lake City Code, pertaining to carrying more persons than design permits be, and the same hereby is, enacted to read as follows: 12.80.075 Carrying more persons than design permits prohibited-- Exception. A. Except as provided in Subsection B, a bicycle may not be used to carry more persons at one time than the number for which it is designed or equipped. B. An adult rider may carry a child securely attached to the adult rider's person in a back pack or sling. SECTION 17. That Section 12.80.085, Salt Lake City Code, pertaining to persons on bicycles, skates and sleds not to attach to moving vehicles be, and the same hereby is, enacted to read as follows: 6 12.80.085 Persons on bicycles, skates and sleds not to attach to moving vehicles -- Exception. (1) A person riding a bicycle, coaster, skateboard, roller skates, sled, or toy vehicle may not attach it or a person to any moving vehicle on a roadway. (2) This section does not prohibit attaching a trailer or semitrailer to a bicycle if that trailer or semitrailer has been designed for attachment. SECTION 18. That Section 12.80.095, Salt Lake City Code, pertaining to operation of bicycles on and use of roadway be, and the same hereby is, enacted to read as follows: 12.80.095 Operation of bicycle on and use of roadway--Duties,prohibitions. A. A person operating a bicycle on a roadway at less than the normal speed of traffic at the time and place and under the conditions then existing shall ride as near as practicable to the right-hand edge of the roadway except when: 1. overtaking and passing another bicycle or vehicle proceeding in the same direction; 2. preparing to make a left turn at an intersection or into a private road or driveway; 3. traveling straight through an intersection that has a right-turn only lane that is in conflict with the straight through movement; or 4. reasonably necessary to avoid conditions that make it unsafe to continue along the right-hand edge of the roadway including: a. fixed or moving objects; b. parked or moving vehicles; c. bicycles; d. pedestrians; e. animals; f. surface hazards; or g. a lane that is too narrow for a bicycle and a vehicle to travel safely side by side within the lane. B. A person operating a bicycle on a roadway shall operate in the designated direction of traffic. C. 1. A person riding a bicycle on a roadway may not ride more than two abreast with another person except on paths or parts of roadways set aside for the exclusive use of bicycles. 2. If allowed under Subsection C (1), a person riding two abreast with another person may not impede the normal and reasonable movement of traffic and shall ride within a single lane. D. If a usable path for bicycles has been provided adjacent to a roadway, a bicycle rider may be directed by a traffic-control device to use the path and not the roadway 7 SECTION 19. That Section 12.80.105, Salt Lake City Code, pertaining to bicycles and human powered vehicles to yield right-of-way be, and the same hereby is, enacted to read as follows: 12.80.105 Bicycles and human powered vehicle or device to yield right-of-way to pedestrians on sidewalks, paths, or trails -- Uses prohibited -- Negligent collision prohibited -- Speed restrictions -- Rights and duties same as pedestrians. A. A person operating a bicycle or a vehicle or device propelled by human power shall: 1. Yield the right-of-way to any pedestrian; and 2. Give an audible signal before overtaking and passing a pedestrian. B. A person may not operate a bicycle or a vehicle or device propelled by human power on a sidewalk, path, or trail, or across a roadway in a crosswalk, where prohibited by a traffic-control device or ordinance. C. A person may not operate a bicycle or a vehicle or device propelled by human power in a negligent manner so as to collide with a: 1. Pedestrian; or 2. Person operating a: a. Bicycle; or b. Vehicle or device propelled by human power. D. A person operating a bicycle or a vehicle or device propelled by human power on a sidewalk, path, or trail, or across a driveway, or across a roadway on a crosswalk may not operate at a speed greater than is reasonable and prudent under the existing conditions, giving regard to the actual and potential hazards then existing. E. Except as provided under Subsections A and D, a person operating a bicycle or a vehicle or device propelled by human power on a sidewalk,path, or trail, or across a roadway on a crosswalk, has all the rights and duties applicable to a pedestrian under the same circumstances. F. A person operating a bicycle or a vehicle or device propelled by human power on a sidewalk shall proceed only in single file. SECTION 20. That Section 12.80.110,Salt Lake City Code, pertaining to bicycles —carrying bundles be, and the same hereby is, enacted to read as follows: 12.80.110 Bicycles - Carrying bundle -- One hand on handlebars. A. A person operating a bicycle may not carry any package, bundle, or article which prevents the use of both hands in the control and operation of the bicycle. B. A person operating a bicycle shall keep at least one hand on the handlebars at all times. 8 SECTION 21 That Section 12.80.120, Salt Lake City Code, pertaining to bicycles parking on sidewalk or roadway be, and the same hereby is, enacted to read as follows: 12.80.120 Bicycles -- Parking on sidewalk, roadway -- Prohibitions. A. A person may park a bicycle on a sidewalk unless prohibited or restricted by a traffic-control device. B. A bicycle parked on a sidewalk may not impede the normal and reasonable movement of pedestrian or other traffic. C. A bicycle may be parked on the roadway at any location where parking is allowed: 1. At any angle to the curb or edge of the roadway; and 2. Abreast of another bicycle or bicycles near the side of the roadway. D. A bicycle may not be parked on a roadway in a manner as to obstruct the movement of a legally parked motor vehicle. E. In all other respects, bicycles parked anywhere on a roadway shall conform with the provisions of Chapter 12.56, regarding the parking of vehicles. SECTION 22. That Section 12.80.130, Salt Lake City Code, pertaining to bicycles, turns and designated lanes be, and the same hereby is, enacted to read as follows: 12.80.130 Bicycles-- Turns --Designated lanes. A. A person riding a bicycle and intending to turn left shall comply with Section 12.44.120 or Subsection B. B. 1. A person riding a bicycle intending to turn left shall approach the turn as close as practicable to the right curb or edge of the roadway. 2. After proceeding across the intersecting roadway, to the far corner of the curb or intersection of the roadway edges, the bicyclist shall stop, as far out of the way of traffic as practical. 3. After stopping, the bicyclist shall yield to any traffic proceeding in either direction along the roadway he had been using. 4. After yielding and complying with any traffic-control device or peace officer regulating traffic, the bicyclist may proceed in the new direction. C. 1. Notwithstanding Subsections A and B, the city transportation engineer may place traffic-control devices that require and direct turning bicyclists to travel a specific course. 2. When the devices are placed under Subsection C (1), a person may not turn a bicycle other than as directed by the devices. 9 SECTION 23. That Section 12.80.140, Salt Lake City Code, pertaining to bicycle turn signals be, and the same hereby is, enacted to read as follows: 12.80.140 Bicycles -- Turn signals -- Exceptions. A. Except as provided in this section, a person riding a bicycle shall comply with Section 12.44.140 regarding turn signals and turning. B. A person is not required to signal by hand and arm continuously if the hand is needed in the control or operation of the bicycle. C. A person operating a bicycle who is stopped in a lane designated for turning traffic only is not required to signal prior to making the turning movement. D. A person operating a bicycle may give the required hand and arm signal for a right turn by extending the right hand and arm horizontally to the right. SECTION 24. That Section 12.80.150, Salt Lake City Code, pertaining to operation of bicycle on one-way roadway be, and the same hereby is, enacted to read as follows: 12.80.150 Operation of bicycle on one-way roadway On a roadway, other than a limited access highway, designed and signposted for one-way traffic and which has two (2) or more marked traffic lanes, a person operating a bicycle may ride as near to the left side of the left through lane as is safe. SECTION 25. That Section 12.80.160, Salt Lake City Code, pertaining to central traffic district bicycle riding restriction be, and the same hereby is, enacted to read as follows: 12.80.160 Central Traffic District bicycle riding restriction It is unlawful for operators of bicycles to ride any bicycle upon any sidewalk within the "central traffic district", as defined in section 12.04.090 of this title, or its successor, and as described in schedule 1 of this title, set out in chapter 12.104 of this title, or its successor, and made a part hereof by reference, or on any other area where prohibited by signs, provided, however, the foregoing shall not apply to police officers in the scope and course of their employment; SECTION 26. That Section 12.80.170, Salt Lake City Code, pertaining to bicycle racing be, and the same hereby is, enacted to read as follows: 10 12.80.170 Bicycle racing-- When approved-- Prohibitions--Exceptions -- Authorized exemptions from traffic laws. A. Bicycle racing on roadways is prohibited under Section 12.36.040, except as authorized in this section. B. 1. Bicycle racing on a roadway is permitted when a racing event is approved by the city transportation engineer on a roadway under its jurisdiction. 2. Approval of bicycle roadway racing events may be granted only under conditions: a. Which assure reasonable safety for all race participants, spectators, and other roadway users; and b. Which prevent unreasonable interference with traffic flow which would seriously inconvenience other roadway users. C. Participants in an approved bicycle roadway racing event may be exempted from compliance with any traffic laws otherwise applicable: 1. By agreement with the city; and 2. If traffic control is adequate to assure the safety of all roadway users. SECTION 27. That Section 12.80.080, Salt Lake City Code, pertaining to alteration of license or frame number be, and the same hereby is, amended to read as follows: 12.80.180 Alteration Of License Or Frame Number Prohibited: No person shall wilfully or maliciously destroy, mutilate or alter the number of any bicycle frame number, any bicycle license issued pursuant to this code or remove, destroy or mutilate any license decal while the same is valid, or operate any vehicle without having attached thereto a valid license decal issued as provided in this code. SECTION 28. That Section 12.80.090, Salt Lake City Code,pertaining to bicycle license suspension or revocation be, and the same hereby is, amended to read as follows: 12.80.190 License- Suspension Or Revocation When- Impoundment: A. The city judges or judges of juvenile courts who hear traffic cases are hereby empowered to revoke or suspend the license of any bicycle when it appears that the owner of any bicycle is not the licensee of record, or that the owner of the bicycle or the licensee thereof has used or knowingly permitted the bicycle to be used in violation of this code. B. The police department is hereby directed and authorized to impound any bicycle so used in violation of this code for a reasonable period of time pending 11 investigation of any alleged violation of this code, or until such bicycle is registered and licensed by the owner thereof and equipped as herein provided. SECTION 29. That Section 12.80.100, Salt Lake City Code, pertaining to bicycle violations and penalties be, and the same hereby is, amended to read as follows: 12.80.200 Violation - Penalty: An operator of a bicycle who violates any of the provisions of this chapter shall be punished as an infraction in accordance with subsection 12.12.010B of this title, or its successor.
