01/07/2014 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JANUARY 7 , 2014 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, January 7, 2014 at 7 : 00 p.m. in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present: Lisa Ramsey Adams Luke Garrott James Rogers Kyle LaMalfa Charlie Luke Erin Mendenhall Stan Penfold Cindy Gust-Jenson, Executive Council Director; Ralph Becker, Mayor; David Everitt, Mayor' s Chief of Staff; Jennifer Bruno, Executive Council Deputy Director; Margaret Plane, City Attorney; and Scott Crandall, Deputy City Recorder; were present. Councilmember LaMalfa presided at and conducted the meeting. OPENING CEREMONY #1 . 7:18:50 PM Pledge of Allegiance. #2 . 7:19:26 PM Councilmember Penfold moved and Councilmember Garrott seconded to approve the minutes of Salt Lake City Council Work Session meetings held Tuesday, December 3, 2013 and Tuesday, December 10, 2013; and minutes of the Formal Meeting held Tuesday, December 10, 2013; and minutes of the Joint Retreat Meeting with Utah Transit Authority (UTA) held Monday, December 9, 2013 , which motion carried, all members voted aye . View Attachments (M 13-3) (M 13-4) PUBLIC HEARINGS #1. 7:21:09 PM Accept public comment and consider adopting an ordinance repealing Chapter 8 . 16, Salt Lake City Code, in its entirety and renumbering and amending Chapter 5 . 37, Salt Lake City Code, regarding the operation of carriage businesses . The proposal is in response to the Council's request from their September 24, 2013 briefing to have the Mayor's Administration and Salt Lake County Animal Services develop recommendations to horse-drawn carriage regulations and using Council Member Charlie Luke's recommendation as part of the framework in developing their recommendations. Comments included complete ban, move carriage business to other locations, animal cruelty, safety/traffic issues, dangerous/hazardous working conditions for horses, traffic congestion/pollution, support for routes proposed by Councilmember Luke, exposure to extreme temperatures, tighten regulations, antiquated practice, potential impact to other horse owners/businesses, legal/fairness issues, and enforcement . Councilmember Luke moved and Councilmember Penfold seconded to continue the public hearing to a future date, which motion carried, all members voted aye . 7 :46:59 PM Councilmember Luke said the Council would continue to analyze the Administration' s proposal and discuss additional issues including fee structure, temperature ranges, and designated routes . He said the public would be informed about future meetings/discussions . Councilmember Garrott said the option for a complete ban would continue as part of the discussion. (0 13-29) #2 . 7:49:33 PM Accept public comment and consider adopting an ordinance amending zoning map properties located between 700 South to 900 South and 700 East to 900 East pursuant to Petition No. PLNPCM2012-00360 . View Attachments The changes would modify the zoning for: • Existing single-family and two-family residences from RMF -30 - Residential Multi-Family to R2 - Single and Two-Family Residential; and • Existing commercially-used properties from RMF-30 (Residential Multi-Family) to either SNB (Small Neighborhood Commercial) or CN (Neighborhood Commercial) . Although the request is to change the zoning of the properties to R2 (Single and Two Family Residential) and SNB (Small Neighborhood Commercial) or CN (Neighborhood Commercial) , consideration may be given to rezoning the properties to another zoning district with similar characteristics. Petitioner - City Council. 14 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JANUARY 7, 2014 Hoang Nguyen, Tosh Hatch, Clara McKenna, Nathan Florence, and Marian Florence spoke or submitted written comments in support of the proposal . Councilmember Garrott moved and Councilmember Penfold seconded to close the public hearing and adopt Ordinance 1 of 2014 , amending the zoning map pertaining to several properties located in an area approximately situated between or adjacent to 700 South and 900 South and 700 East and 900 East according to the Planning Commission' s recommendation and pursuant to Petition No. PLNPCM2012-00360 , which motion carried, all members voted aye, except Councilmember LaMalfa, who voted nay. (P 13-17) QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 7 :55:01 PM Comments were made about the State of the City Address to be presented by Mayor Becker on January 8, 2014 at Rice-Eccles Stadium. COMMENTS TO THE CITY COUNCIL 7 :55:51 PM Saundra Duffy-Hawkins spoke about the Oath of Office ceremony and the burden of taxes/fees on residents . Stephen Ferris, Ilene Ferris, Soren Simonsen, Nancy Scharman, spoke or submitted written comments regarding wood burning in their neighborhood causing serious air quality/health issues . They requested the Council' s help in addressing the issue including potential time, place, and manner restrictions . Harald Illig submitted written comments about imposing taxes on churches . Jacob Blada submitted written comments about being honest and struggling with hopelessness . NEW BUSINESS #1 . 8:04 :05 PM Adopt a motion ratifying the election of Chairperson and Vice-Chairperson of the Salt Lake City Council for the calendar year 2014 .
