07/11/2017 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, July 11 , 2017 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, July 11, 2017 at 7 : 00 p .m. in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present : Charlie Luke James Rogers Derek Kitchen Lisa Adams Erin Mendenhall Andrew Johnston Stan Penfold Cindy Gust-Jenson, Council Executive Director; Margaret Plane, City Attorney; Jacqueline Biskupski, Mayor; Patrick Leary, Mayor' s Chief of Staff; Makayla Hardy, Deputy City Recorder; and Kory Solorio, Assistant City Recorder; were present . Councilmember Penfold presided at and Councilmember Luke conducted the meeting. View Minutes • May 2, 2017, Work Session • May 23, 2017, Work Session • June 6, 2017, Work Session (M 17-4) PUBLIC HEARINGS #1 . 7 :02 :56 PM Accept public comment and consider an ordinance to provide for the imposition of civil penalties for violations of the ordinances set forth in Title 5 of the Salt Lake City Code, (enacting Chapter 5 . 88; amending Sections 5 . 02 .290, 5 . 14 . 030, 5 . 14 . 060, 5 . 14 . 070 , 5 . 14 . 080, 5 . 14 . 085, 5 . 14 . 090, 5 . 14 . 120, 5 . 14 . 130, 5 . 15 . 010, 5 . 15 . 050, 5 . 15 . 070, 5 . 71 . 310 , and 5 . 72 . 890 ; and repealing Sections 5 .28 . 150, 5. 65 .200, 5 . 68 . 110 , 5 . 84 .220 and 5 . 85 . 070) . The proposal would impose fines on business owners who violate business licensing ordinances. View Attachments George Chapman and Amy Hawkins spoke in support of the proposed ordinance and encouraged the Council to approve it . 17 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, July 11 , 2017 Councilmember Mendenhall moved and Councilmember Kitchen seconded to close the public hearing, suspend the rules, and adopt Ordinance 31 of 2017 . Councilmember Mendenhall thanked the Police and City Attorneys for collaborating on the proposal . She said the Police Bike Squad was reinstated some time ago and the reality was that the City could not police its way out of crime which happened in specific areas of business . She explained the proposal would close some loop holes making it less financially feasible for businesses to conduct illegal activity and get away with it. Councilmember Luke called for the motion, which motion carried, all members voted aye . (0 17-9) COMMENTS TO THE CITY COUNCIL 7 :07 :24 PM Polly Hart spoke regarding traffic issues in the downtown area. Douglas Cotant expressed concerns regarding Utah Transit Authority (UTA) TRAX construction and asked the Council to consider contracting with a different transportation provider. Amir Cornell spoke regarding the future public hearing on Accessory Dwelling Units (ADU) and City building permit costs . George Chapman expressed concern regarding sidewalk closures and communication within the City involving funding to water trees . He asked the Council not to complete the 2100 South reseal and to use the money for 2700 South and the West Side (for lack of services) . He encouraged the Mayor to allow Salt Lake County to step up and take care of the homeless issue . Candice Perucci, with Congressman Chris Stewart' s office, said she wished to draw attention to the refugee drive Congressman Stewart' s office was supporting. She encouraged the Council to refer constituents needing case work for immigration, social security, and veterans/military affairs to Congressman Stewart' s office for assistance . View Comments . Elmer Hite requested the Council make time on a future agenda to discuss a potential ordinance change to allow miniature goats within residential areas . View Comments . Calvin Fors spoke regarding the welcoming/accommodation of refugees to the City. He asked the City to consider providing accommodations for 17 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, July 11 , 2017 refugees as well as people already in the City. He also suggested the City pick responsible contractors (for City projects) who offer fair wages with good benefits, to insure established residents could better their own lives without becoming alienated. Patrick Bieker spoke regarding the Public Benefit Analysis . He said the biggest public benefit would be to insure local residents were hired to construct a potential community center. He expressed concern for hiring trained/skilled workforce and the underground economy on the City' s Public Works buildings . Bernie Hart spoke to House Speaker Greg Hughes' s recent comments and proposed solution regarding the Rio Grande area. He said he appreciated and welcomed the passion regarding the subject. CONSENT 7 :26:28 PM Councilmember Penfold moved and Councilmember Mendenhall seconded to adopt the Consent Agenda excluding Item No. 5, which motion carried, all members voted aye . #1. Setting the dates of Tuesday, July 25, 2017 at 7 : 00 p.m. to accept public comment and consider an ordinance amending the zoning map pertaining to three parcels located at approximately 5420 West John Cannon Drive to rezone the parcels from Agricultural (AG) to Light Manufacturing (M-1) and to remove the parcels from the Lowland Conservancy Overlay District (LC) pursuant to Petition No. PLNPCM2017- 00083. The proposal would allow the property owner to create a light manufacturing development on the site. The zoning change is supported by the Northwest Quadrant Master Plan, which the Council adopted in 2016. View Attachments (P 17-18) #2 . Setting the date of Tuesday, August 8, 2017 at 7 : 00 p.m. to accept public comment and consider an ordinance closing a portion of 800 West Street between approximately 740 North and the terminating cul-de- sac. The section of street is not needed or used for property access, circulation or parking pursuant to Petition No. PLNPCM2016-01008 . The proposal would allow for the development of a community center that would serve immigrants and refugees. If adopted, the status of the property would be changed from a public street to a City-owned parcel and the City would transfer ownership lease it to the Good Samaritan Foundation a non-profit that provides employment counseling, English language courses, citizenship classes, after-school tutoring, and walk-in support on issues ranging from health care to navigating the public transit system (Petitioner: Salt Lake City Real Estate Division) . Setting the date of Tuesday, August 8 , 2017 at 7 : 00 p.m. to accept public comment regarding a Public Benefits Analysis related to leasing an undeveloped City-owned parcel at approximately 800 North 800 West and adjacent City-owned cul-de-sac to the Good Samaritan Foundation. The proposed use of the property is to allow for the development of a community center that would serve the needs of Salt Lake City's refugee and immigrant community. View Attachments (R 17-6) #4 . Setting the date of Tuesday, August 8 , 2017 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance amending various sections of Title 21A (Zoning) of the Salt Lake City Code to provide additional clarity and efficiency in land use regulation pursuant to Petition No. PLNPCM2015-00354 . The amendments are designed to make the code easier to use; reduce the need for interpretations; address conflicts in the ordinance; and remove barriers to development. (Item removed) Setting the date of Tuesday, August 8 , 2017 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance that would amend the City' s accessory dwelling unit (ADU) regulations pursuant to Petition No. PLNPCM2014-00447 . The amendments would generally allow ADUs west of Canyon Road, south of South Temple, west of 1300 East and south of I-80 . Currently, new ADU permits are only available for properties located a mile or less from a fixed transit stop. Additionally, the amendments will limit the number of ADU permits issued per year to 25 .
