TUESDAY, JULY 11 , 2017
The City Council met in Work Session on Tuesday, July 11, 2017, at
2 : 11 p.m. in Room 326, Committee Room, City County Building, 451
South State Street.

AGENDA ITEMS
#1 . 2:11:55PM BRIEFING REGARDING AN ORDINANCE CLOSING A PORTION
OF 800 WEST STREET BETWEEN APPROXIMATELY 740 NORTH AND THE
TERMINATING CUL-DE-SAC. The section of street is not needed or
used for property access, circulation or parking. The proposal
would allow for the development of a community center that would
serve immigrants and refugees. If adopted, the status of the
property would be changed from a public street to a City-owned
parcel and the City would transfer ownership lease it to the Good

Samaritan Foundation a non-profit that provides employment
counseling, English language courses, citizenship classes, after-
school tutoring, and walk-in support on issues ranging from health
care to navigating the public transit system. Petitioner: Salt
Lake City Real Estate Division, Petition No. PLNPCM2016-01008.

Councilmember Penfold said a public hearing would be held on
August 8, 2017 .
#2 . 2:16:06PM BRIEFING REGARDING A PUBLIC BENEFITS ANALYSIS
RELATED TO LEASING AN UNDEVELOPED CITY-OWNED PARCEL AT
APPROXIMATELY 800 NORTH 800 WEST AND ADJACENT CITY-OWNED CUL-DE-
SAC TO THE GOOD SAMARITAN FOUNDATION. The proposed use of the
property is to allow for the development of a community center
that would serve the needs of Salt Lake City's refugee and
immigrant community. View Attachments
Brian Fullmer briefed the Council with Attachments .
Discussion was held regarding negotiations/approval process of the
lease agreement modification requested by the Good Samaritan
Foundation, how capital replacement costs/needs of the building
would be addressed, and terms of the lease agreement in relation
to the ownership of the building.
Council Members requested the following items from Staff:
• Forward recommendation of the lease modification to the
Council as soon as the Administration had a response .
• Follow up regarding contractual obligations the Good
Samaritan Foundation were bound to (particularly capital
improvement investments) .
• Provide information on terms of the lease regarding
ownership of the building and parameters of the possible
future sale of the property.
Councilmember Penfold said a public hearing would be held
August 8, 2017 .
#3. 2:22:13 PM BRIEFING REGARDING A RESOLUTION THAT WOULD
AUTHORIZE A LOAN OF $635,000 FROM SALT LAKE CITY' S HOUSING TRUST

regarding concern of the contractual agreement between Peter
Corroon and Centro Civico Housing, Housing Trust Fund balance,
concern/encouragement with continued construction of three-bedroom
units in new housing developments, senior housing age
restrictions, current City housing needs for senior housing,
availability of multilingual speaking housing staff, senior
housing needs in other benchmark cities, and Spanish speaking
senior housing needs .
Councilmember Penfold said this item was scheduled for action
on July 25, 2017 .
#4 . 2:34:56PM BRIEFING REGARDING AN ORDINANCE THAT WOULD AMEND
THE CITY' S ACCESSORY DWELLING UNIT (ADU) REGULATIONS. The
amendments would generally allow ADUs west of Canyon Road, south
of South Temple, west of 1300 East and south of 1-80. Currently,
new ADU permits are only available for properties located a % mile
or less from a fixed transit stop. Additionally, the amendments
will limit the number of ADU permits issued per year to 25. The
Administration recently sent the Council additional information in
response to questions Council Members asked during the last
briefing in January. View Attachments
Nick Tarbet, Nick Norris, Michael Maloy, and Orion Goff
briefed the Council with attachments . Discussion was held
regarding short-term rental regulations, proposed additional
zoning districts, limited annul permits, recent State legislation
regarding Airbnb/short-term rentals, enforcement options and
impact of short-term rentals on land use and housing in the City,
partnerships with short-term rental companies, Grow Salt Lake City
Housing Plan, ADU parking and design standards, illegal ADU' s and
repeat offenders, how to deal with non-compliant structures,
potential of ADU' s as an opportunity for senior housing, lot size
criteria, tiny houses as ADU' s, off-street parking issues, ADU
height restrictions/privacy issues, and multi-owner property
situations .
Council Members requested the following items from Staff:
• Review/provide information regarding nuisance ordinances

(what they are, how responsive the City is, and how they apply
to different parts of the city) .
• Review potential of separating an ADU from a primary dwelling.
• Track/provide ADU data.
• Provide options to handle repeat offenders .
• Provide options to achieve the privacy goal with over-looking
structures .
• Research how the new civil penalties ordinance would be useful
in terms of enforcement for ADU' s .
• Examine possible majority-owner occupied provisions .
Councilmember Penfold suggested the item be pulled from the
Consent Agenda. He asked Staff to follow-up on Council requests
and report back on July 25, 2017 with a timeline to move forward
with the process .
#5 . 3:35:19 PM BRIEFING REGARDING AN ORDINANCE AMENDING THE
ZONING MAP FOR THREE PARCELS LOCATED AT APPROXIMATELY 5420 WEST
JOHN CANNON DRIVE TO REZONE THEM FROM AGRICULTURAL (AG) TO LIGHT
MANUFACTURING (M-1) AND TO REMOVE THE PARCELS FROM THE LOWLAND
CONSERVANCY OVERLAY DISTRICT (LC) . The proposal would allow the
property owner to create a light manufacturing development on the
site. The zoning change is supported by the Northwest Quadrant
Master Plan, which the Council adopted in 2016. Although the
applicant has requested that the properties be zoned to Light
Manufacturing (M-1) , the Council may consider rezoning the
properties to a different zoning district with similar

#6 . 3:38:26PM BRIEFING ON PROPOSED CHANGES TO THE CITY' S ZONING
ORDINANCE THAT ARE DESIGNED TO MAKE THE CODE EASIER TO USE; REDUCE
THE NEED FOR INTERPRETATIONS; ADDRESS CONFLICTS IN THE ORDINANCE;
AND REMOVE BARRIERS TO DEVELOPMENT. The proposed changes do not
create new regulations. Petitioner-Former Mayor Ralph Becker,

August 8, 2017 .
#7 . 4:05:54 PM BRIEFING REGARDING AN UPDATED ORDINANCE
REGARDING COMMERCIAL BUILDING ENERGY BENCHMARKING AND MARKET
TRANSPARENCY. The proposal would enact a new chapter of Salt Lake
City Code: Chapter 18-Building Benchmarking and Transparency,
which would require owners of large buildings (City buildings
larger than 22, 000 square feet and commercial buildings larger
than 25, 000 square feet, with some exemptions) to annually
benchmark energy data, share Energy Star Scores and data with the
City, and encourages implementation of improvements to the
building's energy systems. The updated proposal requires an
evaluation of buildings with Energy Star Scores that are below
average but no longer requires the building owners to implement
the energy tune-up recommendations. It also provides for
exceptions for tax-exempt properties like places of worship, and
other buildings and adds an appeals process, among other changes.

gas reduction goals, changing the energy tune-up requirement,
transparency/positive reinforcement, non-compliance fines/action,
inclusion of clarifying language/definitions, triple net leases,
enforcement issues, and implementation/monitoring.
Councilmembers requested the following items from Staff:
• Review how numbers were determined for local numbers on
emission factors .
• Include Councilmember Rogers in any further meetings with the
Building Owners and Managers Association (BOMA) Foundation .
Councilmember Penfold said a public hearing would be held
August 8, 2017 .
#8 . 4:34:41 PM BRIEFING REGARDING A RESOLUTION AUTHORIZING THE
APPROVAL OF AN INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY
AND SALT LAKE COUNTY FOR THE CONSTRUCTION OF A PORTION OF PARLEY' S
TRAIL. The section of trail to be completed runs through City-

owned Hillcrest Park, which is located at 2000 East and Interstate
80 (I-80) . This is a long-planned trail extension from the Draw at
Sugar House Park to Tanner Park and Parley's Canyon. Under the
proposal, the County would construct the trail and assume
responsibility for ongoing maintenance. View Attachments

was held regarding an addition to the City' s Urban Trails Network,
perpetual easement, and Interlocal Agreement with Salt Lake
County.
A unanimous Straw poll was conducted in support of holding a
public hearing on an Interlocal Cooperation Agreement with Salt
Lake County for construction of a portion of Parley' s Trail .
#9 . 4:43:21PM BRIEFING REGARDING IMPACT FEES 101 FROM MIKE
AKERLOW, DEPUTY DIRECTOR OF COMMUNITY AND NEIGHBORHOOD DEVELOPMENT
DEPARTMENT, WHICH WILL PROVIDE AN OVERVIEW OF THE IMPACT FEE
CONCEPT, ALLOWABLE USES FOR IMPACT FEE REVENUES, AND EXAMPLES IN
SALT LAKE CITY. The presentation was previously given to some
community organizations. View Attachments

Discussion was held regarding potential impact fees regarding
large fire equipment and impact fees increases .
