TUESDAY, JULY 17 , 2012
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, July 17, 2012 at 7 : 00 p.m. in Room 326, City Council
Office, City County Building, 451 South State.
The following Council Members were present:
Carlton Christensen Charlie Luke Kyle LaMalfa
Jill Remington Love Luke Garrott Stan Penfold
Soren Simonsen
Cindy Gust-Jenson, Executive Council Director; Edwin Rutan, City
Attorney; Bianca Shreeve, Mayor' s Assistant Chief of Staff; Karen
Hale, Mayor' s Communication Director; and Beverly Jones, Deputy City
Recorder; were present.
Councilmember Simonsen presided at and Councilmember Love
conducted the meeting.
OPENING CEREMONY
#1 . 7 : 15 : 35 PM Troop 243 from District Six presented the colors
and led the audience in the Pledge of Allegiance.
#2 . 7 : 17 : 38 PM Councilmember Christensen moved and Councilmember
Garrott seconded to approve the Salt Lake City Council minutes for
Tuesday, June 19, 2012, which motion carried, all members voted aye.

PUBLIC HEARING
#1 . RE: 7 : 18 : 00 PM Accept public comment and consider adopting an
ordinance amending Salt Lake City Code 21A, the City's Zoning Code,
which would do the following: View Attachments
• Bring City definitions of businesses that serve alcoholic
beverages into conformance with Utah laws .
• Replace the alcohol licensing districts map with using the
zoning code to guide where businesses that serve alcoholic
beverages can locate .
• Revise tables of permitted and conditional uses to allow
locating businesses that serve alcoholic beverages in zones
including some commercial areas where businesses previously
could not locate .
• Require businesses that serve alcoholic beverages meet
requirements adopted by the City Council in 2009 for social
clubs located in Mixed Use and Residential Mixed Use zones .

Continue to follow Utah law regarding spacing from "community
facilities" such as schools, parks and churches and Utah law
pertaining to the location of liquor stores .
The following spoke or submitted hearing cards in opposition of
the proposed ordinance : Marjorie Johnson; Jonathan Dibble; Ross
Fulton; Robert Doxey; Thomas Harrison; Meg Randle; Jenet and Michael
Erickson; Anne Cannon; Ralph Finlayson; J. Fielding Nelson; Jaynie
Brown; Marlene Little and William D . Oswald.
David Perschon spoke in support of the proposed ordinance .
Councilmember Penfold moved and Councilmember LaMalfa seconded to
close the public hearing.
7 : 43 : 46 PM Councilmember Luke said he wanted staff to consider
removing the RB, the RMU, the CN and the CB zones . He said his main
concern had nothing to do with alcohol . He said the Council was trying
to create a blanket overlay of the entire City and to treat all City
neighborhoods the same . He said it made sense to have more access to
establishments' downtown. He said some residential neighborhoods were
not appropriate . He recommended opening the RB zone to restaurants .
7 : 46 : 01 PM Councilmember Love said two to four people could get
together and work on a proposal to bring back to the Council .
7 : 46 : 30 PM Councilmember Penfold said he would be uncomfortable
removing the RMU zone after the lengthy process the Council went
through to put the RMU into the classification.
7 : 46 : 54 PM Councilmember Garrott said he felt a subcommittee was
a good idea . He said they could come up with three options for the
Council to vote on.
Councilmember Love called for the question, which motion carried,
all members voted aye .
Councilmember Simonsen asked if there was any interest from
Council Members to serve on the subcommittee . Council Members Luke,
Love and Garrott volunteered. He asked that the subcommittee have
recommendations to the Council by August 14, 2012 .

POTENTIAL ACTION ITEMS
#1 . RE : 7 : 50 : 47 PM Adopting an ordinance repealing Section
3 . 50 . 230 and amending Section 3 . 50 . 240, Salt Lake City Code, to remove

restrictions on distributing candy and other items from parade
vehicles and to change the time when a person may reserve space on
public property to view a parade from 8 : 00 p.m. to 6 : 00 p.m.
Corresponding time changes may be made to Section 3. 50. 240 which
restrict dogs and vehicle parking. View Attachments
Councilmember Garrott moved and Councilmember LaMalfa seconded to
adopt the ordinance .
7 :52 :31 PM Councilmember Christensen said he was not opposed to
the change in time. He said the challenge was that it was hard to
communicate the message as a City.
7 : 53 : 47 PM Councilmember Simonsen said he shared the same concern
that Councilmember Christensen had with trying to communicate the
policy. He said the Days of ' 47 Parade had no intention of changing
their policy to allow candy to be thrown.
Councilmember Love called for the question. A roll call vote was
taken, which motion failed, with Council Members Christensen, LaMalfa,
Luke and Simonsen voting nay and Council Members Penfold, Garrott and
Love voting aye.
Councilmember LaMalfa moved and Councilmember Christensen
seconded to adopt Ordinance 52 of 2012 to expand camping to 6: 00 p.m. ,
which motion carried, all members voted aye .

7 : 56 : 45 PM COMMENTS TO THE CITY COUNCIL
Bruce Osojnak said he opposed changing the parade time for
camping; Norma Shoell spoke about licensing of apartments; Shawn
Halladay said he had a soccer team that practiced and played soccer
games at the 1700 South River Park. He said on Memorial Day Seven
Peaks Water Park opened and then there was no more parking. He
proposed the City place two hour parking limit signs in the park
parking lot; Amir Cornell spoke in support of accessory dwelling units
and Marlin Baer spoke on House Bill 104 and idling.
NEW BUSINESS
#1 . RE: 8 : 09 : 06 PM Adopting a resolution authorizing the approval
on an interlocal cooperation agreement with Salt Lake County about
property located over the Jordan and Salt Lake Canal at 1216 South
1100 East. The property is owned by the County and maintained by the
City. The County has agreed to deed the parcel to the City. View

Councilmember Simonsen moved and Councilmember Luke seconded to
suspend the rules and adopt Resolution 29 of 2012 , which motion
carried, all members voted aye .

#2 . RE: 8 : 09 : 42 PM Adopting a resolution authorizing the approval
of an interlocal cooperation agreement between Salt Lake County and
Salt Lake City that would transfer ownership of the Regional Detention
Basin property located at 1084 S . West Temple (Jefferson Detention
Basin) from Salt Lake County to Salt Lake City Public Utilities . Under
the agreement, the property would be used as part of the existing Salt
Lake City storm drain system. View Attachments
Councilmember Garrott moved and Councilmember Christensen
seconded to suspend the rules and adopt Resolution 30 of 2012 , which
motion carried, all members voted aye .

8 . 04 . 135-8 . 04 . 136, Salt Lake City Code, regarding the proper
care and regulation of feral cats . This proposal mirrors
Salt Lake County's code pertaining to feral cat colonies.
Councilmember Simonsen moved and Councilmember Penfold seconded
to adopt Ordinance 53 of 2012, which motion carried, all members voted
aye .
b) 8 : 10 : 30 PM Amending the Salt Lake City Consolidated Fee
Schedule to remove permit fees relating to registration of
feral cat colonies .
Councilmember Simonsen moved and Councilmember Penfold seconded
to adopt Ordinance 54 of 2012, which motion carried, all members voted
aye .
