THURSDAY, DUNE 10 , 2004
The City Council of Salt Lake City, Utah, met in Regular Session on Thursday, June 10,
2004, at 7:00 p.m. in Room 315, City Council Chambers, City County Building, 451 South
State.
The following Council Members were present:
Carlton Christensen Van Turner Nancy Saxton
Jill Remington Love Dale Lambert Eric Jergensen
The following Councilmember was absent:
Dave Buhler
Mayor Ross C. "Rocky" Anderson; Cindy Gust-Jenson, Executive Council Director; Edwin
Rutan, City Attorney; and Scott Crandall, Deputy City Recorder were present.
Councilmember Love presided at and Councilmember Christensen conducted the
meeting.
#1. The Council led the Pledge of Allegiance.
#2. Councilmember Turner moved and Councilmember Jergensen seconded to approve
the minutes of Salt Lake City Council meeting held June 1, 2004, which motion carried,
all members present voted aye.

#3. RE: Adopting a joint resolution with the Mayor recognizing June 12-19, 2004
as Utah Military Appreciation Week.
Councilmember Turner moved and Councilmember Jergensen seconded to adopt
Resolution 31 of 2004, which motion carried, all members present voted aye.

PUBLIC HEARINGS
#1. RE: Accept public comment and consider adopting an ordinance to amend Salt
Lake City Ordinance 58 of 2003 which approved, ratified and finalized the budget of
Salt Lake City, Utah, including the employment staffing document, for the Fiscal Year
beginning July 1, 2003 and ending June 30, 2004. (Budget Amendment No. 4) View
Attachment
Councilmember Love moved and Councilmember Lambert seconded to close the public
hearing, which motion carried, all members present voted aye.
Councilmember Love moved and Councilmember Jergensen seconded to adopt Ordinance 24 of
2004, which motion carried, all members present voted aye.

Councilmember Love said copies of the latest draft for sidewalk entertainers and
artists had been passed out. She outlined what the sub-committee recommended. She said
on Page 6 of the proposed ordinance a change in the definition of art had been made.
She said districts where art could be sold were outlined, including the Sugarhouse
Business District, the D-1, D-2, D-3, D-4 and G-MU districts. She said a larger City
parks district was designated nine acres of land or more. She said Washington Square
and the Library Plaza districts were added to the ordinance.

Councilmember Lambert outlined changes for distances for sidewalks. He said the
issue was with a permitted event. He said the proposal was for 150 feet. He referred
to Page 9, paragraph 3 of the proposed ordinance which was changed from four feet to
six feet.
COMMENTS TO THE CITY COUNCIL
The following citizens spoke in support of keeping the City's traffic calming
program: Michael Clara, Dixe Carter, Craig Timothy, Mike Harman, Brett Hull, Stacy
Cole, Peter Luzanckh, David Galvan, Jena Burt and Alvin Goldman.
UNFINISHED BUSINESS
#1. RE: Adopting an ordinance approving the assessment list, and levying an
annual assessment upon property in Salt Lake City, Utah Lighting District No. 1, known
as L01; establishing the effective date of the 2004 assessment ordinance; providing
for a procedure to contest an assessment; and related matters. View Attachment
Councilmember Turner moved and Councilmember Jergensen seconded to adopt Ordinance 23
of 2004, which motion carried, all members present voted aye.

#2. RE: Adopting a resolution authorizing Salt Lake City to accept the United
States Conference of Mayor' s DuPont Spotlight on Excellence awards. (Budget Amendment
No. 4 related resolution)
Councilmember Lambert moved and Councilmember Turner seconded to adopt Resolution 29
of 2004, which motion carried, all members present voted aye.

#3. RE: Adopting a resolution authorizing Salt Lake City to accept the PacifiCorp
Environmental Giving Committee donation. (Budget Amendment No. 4 related resolution)
Councilmember Saxton moved and Councilmember Love seconded to adopt Resolution 30 of
2004, which motion carried, all members present voted aye.

#4. Adopting an ordinance repealing and reenacting Chapter 14.38, Salt Lake City Code,
relating to sidewalk entertainers and artists.
Councilmember Lambert moved and Councilmember Love seconded to adopt Ordinance 25 of
2004 (ordinance vetoed - see July 6, 2004 for final ordinance) , with the following
amendments to the draft. Councilmember Lambert said the proposal was for 150 feet. He
referred to Page 9, Paragraph 3 of the proposed ordinance which was changed from four
feet to six feet, which motion carried, all members present voted aye.
Councilmember Lambert said the Council had made an effort to balance the interests of
a variety of people. He said the goal was to expand access to street artists of all
varieties. He said this was an opportunity to bring more life to the City. He said
this was an advantage for artists and the City.
Councilmember Lambert said the fee reflected the City' s expenses for services provided
and was an issue of fairness and equity. He said the City had never restricted people
from displaying art as a first amendment activity. He said the fee was for selling
art. He said the other issue had been with artists and the Farmer's Market. He said
artists could be included with a registration fee and be 150 feet away from the Market.

Councilmember Saxton said she was concerned with artists using the grassy parking strip
between the sidewalk and the curb. She said it was the responsibility of the property
owner to keep up the parking strip and high use could cost property owners. She said
she was concerned with enforcement of the ordinance. She said it was not clear who
would be enforcing on weekends.
Councilmember Love said the City Council's goal was to encourage art in a way
that it enhanced commercial business districts and was fair and equitable. She said
the 150 feet should be designated at the Farmers Market, art fairs etc.
Councilmember Christensen said there had been discussion regarding the Farmer's
Market moving to a private location. He said this should not be done. He said the
Farmer's Market had done a lot for Pioneer Park. He said his hope was interested
parties would show mutual respect for each other.

CONSENT AGENDA
Councilmember Jergensen moved and Councilmember Turner seconded to adopt the
Consent Agenda, which motion carried, all members present voted aye.
#1. RE: Setting the date of July 6, 2004 at 7:00 p.m. to accept public comment
and consider adopting a resolution accepting the study performed in compliance with
the Utah Code Section 10-8-2 and authorizing a donation to the Center for Documentary
Arts to develop a documentary profile of six Westside neighborhoods.

#2. RE: Setting the date of July 6, 2004 at 7:00 p.m. to accept public comment and
consider adopting a resolution accepting the study performed in compliance with the
Utah Code Section 10-8-2 and authorizing contributions to several non-profit
organizations for transitional housing, emergency winter overflow shelter and to the
Downtown Alliance - First Night program.
