06/12/2007 - Minutes PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, JUNE 12 , 2007 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, June 12, 2007, at 7 : 00 p.m. in Room 315, City Council Chambers, City County Building, 451 South State . The following Council Members were present: Carlton Christensen Van Turner Nancy Saxton Jill Remington Love Dave Buhler Soren Simonsen Eric Jergensen Cindy Gust-Jenson, Executive Council Director; Sam Guevara, Mayor' s Chief of Staff; Edwin Rutan, City Attorney; and Scott Crandall, Deputy City Recorder; were present. Councilmember Turner presided at and Councilmember Saxton conducted the meeting. OPENING CEREMONY #1 . 7:17:33 PM The Council led the Pledge of Allegiance . #2 . 7:17:56 PM Councilmember Jergensen moved and Councilmember Simonsen seconded to approve the minutes of the Salt Lake City Council Meeting held June 5, 2007, which motion carried, all members voted aye, except Councilmember Buhler who was absent for the vote . (M 07-3) COMMENTS TO THE CITY COUNCIL 7:18:45 PM Ken Larsen submitted a petition to allow Drum Circle participants to smoke in Liberty Park as part of their religion. Douglas Cotant spoke concerning smoke in the elevator at the New Grand Apartments and residents being evacuated. Jim Garside spoke concerning a monopoly by the City' s Water Department causing high rates and litigation. UNFINISHED BUSINESS #1 . RE: 7:25:00PM Adopting a resolution authorizing the issuance and sale of approximately $19,000,000 aggregate principal amount of Tax and Revenue Anticipation Notes, Series 2007, and related matters . View Attachments Councilmember Jergensen moved and Councilmember Turner seconded to adopt Resolution 40 of 2007 . 07 - 76 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, JUNE 12 , 2007 Councilmember Christensen said he wanted to publicly disclose his employment with Zion' s Bank. He said he spoke with the City Attorney' s Office regarding a potential conflict of interest . He said the Attorney' s Office determined no conflict existed and Councilmember Christensen could participate in the formal discussion/vote. Councilmember Saxton called for the question, which motion carried, all members voted aye, except Councilmember Buhler who was absent for the vote . (Q 07-6) #2 . RE: 7:26:26 PM Adopting a resolution authorizing the issuance and confirming the sale of up to $8 , 800 ,000 aggregate principal amount of Sales Tax Revenue Bonds, Series 2007 of the City; authorizing the execution and delivery of certain documents relating to such bonds; and providing for related matters . View Attachments View Attachments 07 - 77 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, JUNE 12, 2007 Councilmember Jergensen moved and Councilmember Buhler seconded to adopt Ordinance 24 of 2007, approving Salt Lake City' s fiscal year 2007-2008 budget according to the attached schedule, approving the attached employment staffing document, and making the $500,000 appropriation for the energy efficiency fund contingent upon City Council pre-approval of expenditures and further moved to adopt the attached list of legislative intent statements in conjunction with the budget for fiscal year 2007-2008 . View Attachments Councilmember Saxton proposed an amendment to the motion to remove funding for the Civilian Review Board, which motion failed for lack of a second. She said because the situation was not addressed early on, the board had become dysfunctional . She said she was concerned about potential litigation, treatment of citizens and the impact on the City' s image . She said it was important for the City to have a viable board and the Council should pull funding until problems were corrected. Councilmember Turner called for the question, which motion carried, all members voted aye, except Councilmember Saxton who voted nay. (B 07-1) #6 . RE: 9:06:51 PM Adopting an ordinance adopting the rate of tax levy upon all real and personal property within Salt Lake City made taxable by law for Fiscal Year 2007-2008 . RE: 9:09:47 PM Adopting an ordinance amending Sections 9. 08 . 030 and 9 . 08 . 115 of the Salt Lake City Code relating to Garbage and Recycling Pick-Up Service (increase monthly fee for refuse pick-up, addition of a voluntary green waste container, and option for smaller general garbage container size) . View Attachments Councilmember Simonsen moved and Councilmember Christensen seconded to adopt Ordinance 28 of 2007, amending Section 9 . 08 . 030 and 9. 08 . 115 of the Salt Lake City Code relating to Garbage and Recycling Pick-Up Service as proposed with the following exceptions : 1) The increase in the fee for 90-gallon size container is effective March 1 , 2008 when the optional smaller containers and green waste container is available, and 2) The proposed 30-gallon container is replaced with a 48-gallon container with an associated fee of $8 .25 rather than the $7 .25 proposed for the 30-gallon size, which motion carried, all members voted aye .
