06/02/2020 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JUNE 2 , 2020 The City Council of Salt Lake City, Utah, met in Formal Session on Tuesday, June 2, 2020 in an electronic meeting pursuant to Salt Lake City Emergency Proclamation No. 2 of 2020 (2) (b) . The following Council Members participated in the meeting: Chris Wharton Analia Valdemoros James Rogers Amy Fowler Andrew Johnston Daniel Dugan Darin Mano Cindy Gust-Jenson, Council Executive Director; Jennifer Bruno, Council Executive Deputy Director; Erin Mendenhall, Mayor; Rachel Otto, Mayor' s Chief of Staff; Katherine Lewis, City Attorney; Cindy Lou Trishman, Council Administrative Assistant; Scott Crandall, Deputy City Recorder; and DeeDee Robinson, Deputy City Recorder participated electronically. Councilmember Wharton presided at and conducted the meeting. The meeting was called to order at 7 : 25 p.m. 7 :25:12 PM OPENING CEREMONY #1 . 7 :11:45 PM Pledge of Allegiance (A moment of silence was held while the American Flag/Anthem was displayed on the video screen) #2 . Welcome and Review of Standards of Conduct. Note : Opening Ceremonies were held as part of the June 2, 2020 combined Local Building Authority, Redevelopment Agency, and City Council Formal agenda. 7:13:10 PM Councilmember Wharton made a statement regarding events occurring within the past week, including the killing of George Floyd by Police officers in Minneapolis, Minnesota, being thankful for peaceful demonstrators, and the Council condemning any form of violence in the City. 7:14:57 PM Councilmember Valdemoros made a statement regarding peaceful protesters, violent demonstrators, being united against Police brutality, and commitment to ending discrimination & racism within City processes . #3. 7 :25:18 PM Councilmember Rogers moved and Councilmember Johnston seconded to approve the Work Session minutes of Tuesday, April 21, 2020 20 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JUNE 2 , 2020 as well the Formal Meeting minutes of Tuesday, April 21, 2020, which motion carried, all members voted aye (roll call) . View Minutes (M 20-3) (M 20-4) #4 . 7 :26:09 PM Consider adopting a joint ceremonial resolution with Mayor Mendenhall celebrating Pride Month. View Attachments Councilmember Wharton read the resolution and said he wanted to recognize the Utah Pride Center for their assistance with drafting the Resolution. Councilmember Fowler moved and Councilmember Mano seconded to adopt Resolution 17 of 2020, which motion carried, all members voted aye (roll call) . Accept public comment and consider adopting an ordinance that would approve a new permit program for qualifying residents to reduce vegetation on a strip of City-owned open lands adjacent to their properties, such as the Foothills Natural Area or the Jordan River Parkway, to reduce potential wildfire fuel sources . The proposal seeks to strike a balance between the City's limited budget for public lands management and the concerns of some residents about the risk of wildfires spreading to their properties. View Attachment (0 20-5) Councilmember Wharton said this item would be postponed to a later date . #2 . 11:59:03 PM Accept public comment and consider adopting an ordinance that would amend the final budget of Salt Lake City, including the employment staffing document, for Fiscal Year 2019-2020 . Budget amendments happen several times each year to reflect adjustments to the City's budgets, including proposed project additions and modifications. The proposed amendment includes $2 million to repair damage to City- owned buildings caused by the 5. 7 earthquake series and $1 . 5 million from the Volkswagen diesel emissions settlement to replace 11 of the City's diesel trucks, among other changes. The Council may also consider other appropriations related to City emergency declarations including, but not limited to, year-end coverage of public safety expenses and 20 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JUNE 2, 2020 continuation of specialized public safety training. Councilmember Johnston moved and Councilmember Dugan seconded to close the public hearing and adopt Ordinance 16 of 2020 , approving item D-7 in the proposed budget amendment, with changes to the funding source shown on the motion sheet; and further moved the Council makes a finding that appropriating these funds are necessary to address resident' s unforeseen costs during the pandemic emergency. • $1 . 1 million from the General Fund' s Fund Balance for Item D-7 appropriated into Non-departmental . The Council intends to fully replenish the $1 . 1 million to Fund Balance using a funding source selected at a future date potentially including CARES Act dollars, which motion carried, all members voted aye (roll call) . Comments included: defunding/decreasing the Police budget by $30 Million, implementing a Police department hiring freeze, creation of a national law enforcement database, Police officers lacking training in psychology, additional screening protocols needed for hiring officers, chokeholds needing to become illegal, consequences needed for behavior that did not represent the Police force, requesting Police receive training on cultural competency/humility (how to respond to people of color) , curfew disproportionally affecting people of color, wanting to see elected officials join protests, reallocating funds to : housing, transportation (free/reduced public transit) , libraries, trained mental health professionals, more outdoor spaces/public parks in low-income neighborhoods, after-school programs, public defenders, education, arts council programs, natural lands/trails, mandatory de- escalation training for Police department, social workers, and low- income housing. 9:43:43 PM Councilmember Wharton made a statement regarding the amount of similar comments made to the Council regarding the Police Budget and provided information regarding various items . He said this was not intended to discourage citizens from speaking freely to the Council . 20 - 5 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JUNE 2, 2020 7 :56:42 PM Bailey Roberts spoke about Funding Our Future sales tax and the housing allocation. She said the amount allocated for rent/mortgage assistance (1 Million) was not adequate due to a possible second wave of the Coronavirus . 9:23:43 PM George Chapman said new Council Members and Mayors had always pushed hard to decrease Police violence/increase de-escalation. He said the Council made efforts over the last few years to make the City respectful, fair, and safe for everyone . He urged the Council to continue to focus the Police budget on additional training, de- escalation, and specialized body cameras . #13 . Accept public comment and consider a grant application requesting $6,500 to provide a daily snack to YouthCity summer program participants at Central City Recreation Center, Fairmont Park, Liberty Park, Ottinger Hall, and Sorenson Unity Center as part of the Summer Food Service Program 2020 . View Attachments #15 . Accept public comment on a grant application request from the Fire Department for $45,000 to support Camp Athena and Camp Prometheus this year. The funds would help purchase turnout gear for young women and young men, fund overtime for firefighters participating in the camps, and purchase additional items such as food, t-shirts, bags, and water bottles for the participants. (B 20-3) COMMENTS TO THE CITY COUNCIL 20 - 6 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JUNE 2 , 2020 Kayla McKinney, Katy Rox, Kianee DeJesus, Megan Young, Edward Hannan, Key Nemelka, Ashlyn Anderson, Jennifer Nielsen, Alana Burman, Mackenzie Bledsoe, Katheryn Van Sleen, Chris Sanger, and Emily Williams expressed concerns and were opposed to the recently enacted curfew. Comments included: used as a weapon against peaceful protesters, rooted in racism/classism, notification of the curfew was not accessible to many people of color/only provided in English, used to amplify white fear, used to silence the voices that were protesting, an act of violence for people of color, used to avoid addressing police brutality, implemented with nearly no notice, direct attack on rights/moral obligation to free speech, unconstitutional, and undermining first amendment rights . 7:58:55 PM Bailey Roberts spoke about the recent protests and said she was disappointed with Salt Lake City and University of Utah Police Department' s behavior, including the handling of the death of Lauren (McClusky) , and believed the City had a duty to be involved with global events as well as the City. 8:02:17 PM Ashleigh Hamilton spoke about the current protests and said she did not understand why City leaders were not demanding that Police/National Guard be allies to the protesters . She said they should be protecting the protesters instead of preparing for the public to dismantle things . 8:18:41 PM Simone Longo called for the firing of Police Chief, Mike Brown. He said during a recent interview, Mr. Brown did not express understanding about the protests . He said someone who could make meaningful change in the Police department should take his place . 8:21:26 PM Stephanie Schubert inquired what the Council was doing to stand for black lives . She said she was disappointed with the neutrality of some Council members and noted the disparity of Police action between the black lives matter protests and the Coronavirus protests . 9:26:44 PM George Chapman urged the Council to re-evaluate the Accessory Dwelling Unit (ADU) ordinance as it appeared to be increasing housing costs . He said the City Attorney should evaluate if the Council (as RDA Board) could have inadvertently made an illegally contracted rezone . 9:26:33 PM Ann Charles spoke about the accessibility of the currently held Webex Council meetings and said she had difficulty accessing the meeting and asked the Council to find better/easier ways for citizen participation. 20 - 7 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JUNE 2 , 2020 10:12:48 PM Richard Holman spoke about the Mayor recognizing inequities between the Westside and other parts of the City and inquired where the inequities were defined, and where in the budget were the resources to address the inequities quantified. He said the Westside Coalition requested the Mayor/Council consider funding for Planning, Zoning, and other relative City departments to provide training and resources to Community Councils to review/discuss/analyze/comment on their respective proposals . 10:39:02 PM Kelsey Harrison said the Webex platform was a generally inaccessible platform and a roadblock to participate in meetings . 10:47:00 PM Lou McKee said she was appalled by the behavior of the current Administration (support for the corporate elite/developers at the expense of persons of color/unsheltered individuals) . She spoke of experiencing police brutality daily while living in the Ballpark District and said community-led economic development on the Westside was needed to prevent gentrification. 11:28:51 PM Fota Rassmusen spoke about feeling discouraged regarding the conversations with Police representatives during the Work Session meeting and said it seemed unprepared. She said she was concerned groupthink could be occurring within the Police Department. QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL There were no questions . (I 20-15) UNFINISHED BUSINESS #1 . 12:12:50 AM Approving a resolution amending the Central Wasatch Interlocal Agreement, including the admission of the Town of Brighton. The proposed amendment includes changes to criteria for membership, various structural changes to the commission, and to include the newly 20 - 8 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, JUNE 2 , 2020 incorporated Town of Brighton, among other changes. The Central Wasatch Commission (CWC) is charged with implementing the Mountain Accord, and, in particular the major values of environment, recreation, transportation, and economy that are inherent in the Central Wasatch Mountains. The Mountain Accord was a several-year negotiation about the future of the Central Wasatch Mountains that was approved in 2017.
